Oregon state law requires that irrigation water is used beneficially at least once every five years. After five successive years of failure to beneficially apply and use water according to state water law, the water rights are subject to confiscation. Tumalo Irrigation District records indicate that the water rights for 19435 Dayton Road, Bend, Oregon were last used in 2016 and are in good standing. TID partners with the Deschutes River Conservancy to offer an annual water leasing program. Each year of a lease counts as a year of beneficial use, thereby preserving the validity of your water right. You may lease all or part of your irrigation rights. TID processes and submits the application. The cost for mapping and processing the application is $280 per lease. Definition of Beneficial Use Beneficial use is the use of irrigation water to produce a crop, grass, or landscape areas. This means the irrigation water will be used on land that has been designated for this purpose- irrigable land, not a rock pile, not driveways or roadways, and not under structures. Landscape areas such as lawn or shrub beds or a commercial crop such as shrubs, trees, or growing of plants for resale is allowed. The land must be under production or cultivation to qualify as beneficial use. The placement of water on land that is not cleared, seeded, or under some type of cultivation is not beneficial use. The use or irrigation water for dust abatement is not beneficial use. The use of irrigation water on anything that would grow naturally without the benefit of irrigation water is not beneficial use.

Transfers
Oregon State Law requires that lands with mapped water right are to be irrigated in the specific area it is mapped. Water rights can be transferred to a new location by submitting a transfer application to the State which is processed by the District. The cost for a water transfer is $1406 and the new l ocation must be beneficially used in the year in which the transfer takes place and at least once every five years thereafter.
