After looking at their water rights and the aerials of their property and measuring out their water rights, I have come across an issue which will have to be handled before they sell the property to a new owner. This water right is not mapped because each property is under 5.00 acres in size. However, they are irrigating all the areas they possibly can and they have more water rights than they can beneficially apply. They cannot have more water rights than they have land to irrigate. As you can see from the map and I have measured it out on my mapping system all the areas they irrigate or can possibly irrigate they have more water rights than they have area to irrigate. On TL 3700, they have a 2.80 acre water right. They can only use 1.91 acres of that water right. That leaves 0.60 acres of water right they cannot use. On TL 3800, they have a 3.20 acre water right. They can only use 2.95 acres of that water right. That leaves 0.25 acres of water right they cannot use on that tax lot. In total, that is 0.85 acre water right they cannot use. They can try sell that portion of their water right to another Arnold Irrigation District patron. The going price for an acre of water is $1,250.00 per acre which would be $1,062.50 for 0.85 acres of water rights. If there is an interested party, they would have to complete a field inspection to determine if they can actually receive the water and use it. If they cannot sell the water right prior to the property selling, they will have to quitclaim the water right back to the District. The District does not purchase water rights back. There is a $300.00 per tax lot fee to prepare the quitclaim and have it recorded (total $600.00). Please feel free to call with questions. I’m sure the Mr. and Mrs. Weeks will have questions as well. William I just got back from the planning department and was told that both lots are buildable but since the current home is on the property line to get another dwelling a lot line adjustment would have to be completed. I was also told that in the current zoning once the lot line has been completed a home could be built on the irrigated pasture if it was the best site but the water right would have to be removed.
