Foreword from the 2017 Parade of Homes Chair On behalf of the Metropolitan Builders Association (MBA), we are proud to present the 2017 MBA Parade of Homes presented by Nonn’s. The Parade of Homes is a nationally recognized event that began in southeastern Wisconsin in the 1940’s. Each year, Parade of Homes showcases one or more premier subdivisions featuring new homes that have not previously been available for touring by the public. The 2017 Parade will take place in three subdivisions: Four Winds West in Hartland, Fox Meadow in Menomonee Falls and Highlander Estates in Mequon. Among the three subdivisions, twenty-two homes will display a wide array of residential building trends, including the latest concepts in floor plans, energy efficient products and materials, trending fixtures and appliances, home David Roembke automation, interior design and landscaping. Each of the Parade builders will have staff Chair, 2017 MBA Parade of Homes on-site to answer your questions and walk you through the unique features of their home(s). STEEPLE POINTE HOMES® While you tour this year’s Parade homes, be sure to make note of your favorite features and fill out a 2017 People’s Choice Award ballot which will be available at each site. Vote for your favorite interior design, best room, landscaping and overall home. Completed ballots can be placed in the designated drop boxes as you leave the subdivisions for the chance to win an exciting grand prize. The MBA Parade of Homes is the longest running Parade in the United States spanning more than 70 years! This year is no exception, with some of the finest home designs, latest styles, and cutting edge features for you to enjoy. If you are considering building a new home or remodeling your existing home, the Parade of Homes offers the perfect opportunity to tour new construction homes by a variety of industry-leading MBA Builders. Copyright Infringement The Protection of Homes and Their Designs Make your home building experience a positive one by sticking with plans you know are legitimate. The homes you tour during the 72nd Annual Parade of Homes are a true testament to the vision of Parade builders. What starts out as a design concept develops into a fabulous architectural plan. From there, a majestic home takes shape. Decisions are made regarding every component that will go into the home. What kind of flooring should be used? What type of lighting? A Parade builder must address all the issues you will need to consider when it comes time to build your new home. The biggest difference is a Parade builder must plan on building his or her home to impress the varying personalities of thousands of visitors. Because there is so much work that goes into the design and construction of a home, there are also laws in place that protect each home’s unique design. Just as there has been copyright protection in place to safeguard the original works of authors of literary, dramatic, musical and artistic works, in 1990, copyright protection was extended to include architectural works. With respect to new home construction, the federal copyright laws protect the copying of all or a portion of a home design. Protection is found in two different areas: The protection of the design plans (including blueprints and floor plan layouts). The protection of the completed structure. This extends to its overall interior and exterior appearance.

This means that while you are welcome to tour the Parade homes, you need to remember that the plans builders have available for you, detailing the layout and the exterior of the home, are for educational purposes only. You may not copy those plans. If you bring plans gathered at the Parade of Homes to another builder and ask him or her to duplicate the same home for you, you would be in direct violation of the 1990 Copyright law. Many copyright infringement cases in southeastern Wisconsin have resulted in extensive litigation, and significant judgments. The consequences for plan stealing are very serious and can result in substantial financial penalties. Recent parties convicted of architectural copyright infringement have been required to pay anywhere from $15,000 to $125,000. In future cases, penalties may be higher or lower depending on the extent of copyright infringement. Consumers who are interested in building new homes should consider the following advice to avoid copyright infringement claims: 1) Never ask one builder to copy all or part of the design or finished appearance of another builder. 2) W hen interviewing builders and shopping for different home designs, ask each builder you interview whether he or she has a home design that incorporates the style or features you are looking for. Explain the style or features by giving examples; but keep in mind that copying is prohibited.

3) M ake sure that you are purchasing the rights to a legitimate plan by asking the builder to confirm that he or she has the right to build the plan or design that you have selected. If you see a specific feature, like a sunroom, in a home that you like, you could ask the builder you would like to work with if they have something similar in one of their home designs or if they could design something similar. The key to avoiding copyright infringement is to understand that copying any part of another builder’s plan is against the law. If you ask your builder to construct the same exact feature found in another builder’s home, it is a violation. Keep in mind that individual standard features or design elements that are functionally required may not be copyrighted (such as doors, windows and stairs). One question frequently encountered by area attorneys is how handwritten sketches are viewed with regard to the copyright law. Many homeowners believe that when they contribute their own sketch to a builder, detailing ideas for a floor plan or a specific design idea, that they have rights to the final design of the home. In reality, the copyright is owned by the person who puts the ideas into final form. When an owner’s sketch is incorporated into an architectural design it becomes part of the architectural design and becomes the property of the person who drew the plan. While the homeowner still has rights to his or her sketch, that is the only part of the plan he or she may take to another builder without having to worry about infringing on the copyright owned by another party. 2017 MBA Parade of Homes

The term “craftsmanship” is a word used so often by builders today that it seems to have lost its meaning. However, when applying the term “craftsmanship” to Westridge Builders, it has a wealth of meaning that goes back four generations. Michael Jasin was a semi-professional woodworker who made a name for himself by hand-tooling propellers for World War I planes. His talent for detailed woodworking led him to hand-craft several instruments and furniture pieces. Eventually, he found home building to be his true calling. His son-in-law, Paul Tomich, acquired his talent for precision craftsmanship from his father-in-law, and later incorporated Life Homes in 1958. The 1950’s saw a trend in building with new subdivisions popping up which were designed specifically for raising families and Life Homes fit perfectly into that niche.

Village of Menomonee Falls The Village of Menomonee Falls, with nearly 33,000 residents, is located in the northeastern corner of Waukesha County. Today, Michael Jasin’s great grandson, Carl Tomich, heads Westridge Builders, Life Homes, & City Homes along with developing numerous subdivisions in southeastern Wisconsin.
