AUTUMN LEGAL THOUGHTS ADVICE FROM RICHARD WOOD

s the nights well and truly draw in, the summer has disappeared for another year. Unlike the seasons though, the law does not change quickly. Since 2000, a lot has happened, but more in society than in the legal system.

This can affect Family Law disputes as well, when unfortunate observations can lead to evidence in proceedings.

Digitally, much has happened over the last twenty years, but Employment Law mainly developed up until the Equality Act in 2010. There was frantic activity (or what passes for that!) in the period from the 1970s until then with the law reflecting changing times in society, alongside European Directives. The Employment Tribunal (supposedly informal to begin with) has grown into an important venue for employees.

Inheritance Tax allowances have been brought in during the last eleven years which makes the drawing up of wills much easier, at least for now. No one knows what awaits in the future, but making a will now has never been more straightforward.

Everyone should, of course, take care with digital security in these changing times and in what they say online in social media. In the last ten years, the new area for evidence in disputes can come from what is said online or in messages which, if considered inappropriate, can lead to consequences.

Fortunately, the government has decided to implement “No Fault” divorce (the details of which are awaited).

The price of property has obviously risen in the last thirty years and there are challenges to youngsters trying to get on to that ladder.

The law of Landlord and Tenant is ripe for consideration, especially considering the difficulties caused by the shortage of property.
