Avoiding

Hot Weather Damage

In what’s looking like a rerun from last year, weather experts are predicting the coming months to be hot and dry for most of the country. While weather predictions are never a sure thing, it’s smart to prepare your tow truck for Summer heat.

Some basics include making sure there’s plenty of airflow to the cooling system, and regularly cleaning filters as needed. Also, check the coolant often with a hydrometer, and make sure you have the correct percentage of glycol. Don’t top off with plain water, as

the glycol helps control heat better and doesn’t boil off.

Do whatever you can to minimize dust, which is an engine killer. Turbocharger vanes and bearings in a turbodiesel are particularly sensitive to abrasive particles, so check your air filter frequently. Pay special attention to your EGR cooler and temperature readouts, as they run much hotter than the radiator. But don’t worry about how hot your DPF (Diesel Particulate Filter) may get, since it’s designed to withstand the heat of regeneration. On the other hand, store your DEF (Diesel Exhaust Fluid) out of direct sunlight and at temperatures below 85 degrees F. Since DEF is 60 percent water it can evaporate quickly in hot weather. Lastly, after a hard pull, don’t shut off your engine without letting it idle for five to 10 minutes, to provide essential time for cooling down.

Delaware City Votes on Tow Bill

The city of Wilmington is getting set to vote on House Bill 351, which would codify requirements for towing and storage of vehicles, and provide protection for vehicle owners. Among the provisions is capping charges to owners for retrieving their vehicles at $500, and preventing towing companies from patrolling for “illegally parked cars.” An amendment to the bill would ensure that communities like Wilmington could still tow vehicles for unpaid parking tickets, starting at $200 in fines.

The bill would add a new chapter to Title 21 in the State Code regarding towing, and require companies to provide photographic evidence of the “unauthorized parking of a vehicle” before it’s towed; publicly display rates and ensure they are reasonable; and prevent towing companies from patrolling for “illegally parked cars.”

It also makes any violations enforceable by the Consumer Protection Unit of the state Department of Justice.

Towers Unite for SDMO Fundraiser

Tow truck drivers from the Phoenix area came out in full force to show their support for Arizona AAA towman Ramon Garcia, who was seriously injured after being struck on the highway while loading a vehicle onto his flatbed.

His wife said, “We are extremely humbled, thankful, and feel blessed that the towing syndicate has put this together for him.”

Garcia broke six bones in his left leg and has undergone two surgeries.

“He is in a lot of pain,” his wife said. “The incision is from above his knee straight down to his ankle.”

Travis Brown, also a AAA tow truck driver, was on hand for the fundraiser, said, “He’s a brother. In the towing industry, we are all brothers and sisters and we help each other out. We are working on the side of the road everyday. We call it the white, thin line of death. We try to stay within that area, but we see more and more distracted driving every day.”

A GoFundMe page has been set up for Garcia to help pay for medical bills and other expenses.

Colorado Legislature Passes Tow Bill

The Colorado Legislature, intent on curbing predatory tow practices, has passed more towing regulations. The state Senate approved House Bill 24-1051 after passing the state Congressional legislature, which will prohibit towing companies from patrolling private lots, and give the Public Utilities Commission (PUC) the ability to revoke the business license of carriers if they continuously break the law. Currently, the PUC can only refuse to renew a license when it is up and issue fines for violating the law.

The bill will require landlords or property owners to fill out a form

requesting each tow. A previous version of the bill would have required property owners to pay for a tow, but that provision was removed.

California Towing and Recovery Trucks Face Regulatory Road Hazard

Truck manufacturers and drivers have called on Governor Gavin Newsom and the California State Legislature to amend the California Vehicle Code to classify their trucks as emergency vehicles. Due to the California Air Resources Board’s (CARB) passage of the Advanced Clean Truck (ACT) regulation, towing and recovery trucks will no longer be assembled or sold in California once new truck inventories are depleted.

According to a press release put out by River City Communications: “While public safety agencies widely view towing and recovery trucks as emergency vehicles, California’s Vehicle Code does not. Therefore, CARB’s diesel truck engine regulations do not afford them an exemption, such as police, fire, and government-owned towing and recovery vehicles. Since truck and engine manufacturers are not producing custom truck chassis that support the range, performance, and safety standards of tow and recovery trucks, truck body manufacturers have been forced to stop deliveries to California.”

Brandon Neal, owner of Truck Body Sales in Sacramento, California, pointed

out that, “State regulators have created an insurmountable roadblock for towing and recovery truck drivers by mandating electric engine technology that can’t yet support custom, high-performance trucks. When our inventory of new trucks is sold, we will be out of business, and fewer tow trucks will be on the road to support stranded motorists.”

The coalition has launched a website where small businesses, truck drivers, and motorists can join a grassroots campaign to urge Governor Newsom and the State Legislature to find a legislative solution before existing inventories of new towing and recovery trucks are depleted. A Colorado Tow Bill will significantly curtail nonconsensual tows on private property.

Companies selling tow trucks will feel the impact of California’s stringent regulations in not classifying tow trucks as emergency vehicles.

North Carolina, through a nonpartisan sponsored bill entitled, “Nonconsensual Booting and Towing Reform,” seeks to pass legislation curtailing predatory towing. It imposes regulations that will include requiring towing businesses to

acquire a permit to operate, and create a system for consumers to lodge complaints against companies through a new Towing and Recovery Commission. It will also allow the new commission to set maximum fees for towing and booting.

“This bill provides a regulatory framework where none existed before,” stated Rep. Laura Budd, one of the bill’s sponsors. “It is supported by the towing and trucking industries and will go a significant way in protecting North Carolinians from predatory towing practices, as well as companies conducting business in our state.”

Milwaukee Tower Rescues Man from Under Bus

After a Milwaukee bus crashed, a tow truck driver who was passing by, jumped into action. Tony Evans, a tower for Always Towing, said, “All I seen was a boom and the bus spin around in the air. I jumped into rescue mode.”

Evans got out of his tow truck and ran to the scene of the crash.

“I just happened to be here when it happened, and that was just horrific,” Evans said.

Evans said he helped pull a woman out of the car, then noticed a man trapped under the bus.

“I grabbed the tow truck, put it on the back of the bus, lifted the bus up off of the guy, then pulled him out from under the bus,” Evans said.

Now recovering in the hospital, the man called Evans to thank him.

“He said he just wanted to talk to me and give me a hug and thank me for saving his life,” he said.

Auto Loan Delinquencies Rise

Between 2022 and 2023, the percentage of auto loan balances over 90 days delinquent in America increased from 3.81% to 4.2%, and every state experienced an increase.

This figure is according to a study by attorneys at Thompson Consumer Law Group, which analyzed 2022 and 2023 auto loan data from the Federal Reserve Bank of New York to see which states had the highest percentage of auto loan balances delinquent for more than 90 days. Their results showed it is not a problem everywhere, yet is steadily increasing.

The study showed these states have the highest percentage of auto loan balances that are delinquent: Mississippi: 6.77; Alabama: 6.05%; Georgia: 5.71% Louisiana: 5.69%; Indiana: 5.29%; Hawaii: 5.24%; Michigan: 5.24%; Delaware; 5.2%; South Carolina: 5.2%; North Carolina; 5.14%.

Jeff Fitrzyk, the chief lending officer at Michigan First Credit Union, said, “We’re also seeing an increase in repossessions, both voluntary and involuntary.”

Decatur, Alabama Passes Repo Law

A new ordinance was passed in Decatur, Alabama that would require police notification 30 minutes prior to repossession. The ordinance was prompted by a police shooting last year in which police intervened during a repossession, resulting in a death.

The changes include a detailed description of the vehicle to be towed, including the vehicle ID number, tag numbers, and colors. They must also provide the location of the attempted repossession, and the name of the person believed to be in current possession of the vehicle.

“I don’t feel like a hero or anything like that; it’s just something that anyone would have done at that time seeing all that tragedy,” Evans said.

“No repossessor shall proceed with more than one repossession attempt of the same motor vehicle at the same location during any 24-hour period,” the ordinance reads. Violations of this ordinance could result in a fine of up to $500 and six months imprisonment.

How to Calculate Recovery Resistance

Performing a safe and effective recovery requires tow operators to calculate the total amount of resistance that must be overcome in order to move a casualty vehicle from its resting place back to the roadway for towing. Commonly known as Total Recovery Resistance (TRR), failure to calculate this may result in equipment damage or failure, an anchor moving, or even the tow truck moving instead of the casualty.

To calculate the TRR, begin by estimating the resistance created by the slope and type of terrain that the casualty will traverse in the recovery path, along with the ability of the casualty’s wheels to roll freely.

ESTIMATING CASUALTY WEIGHT

There are several ways to estimate a casualty’s approximate Gross Vehicle Weight (GVW). By far, the simplest

way is to search Google for the weight of the specific year, make, and model of the vehicle being towed, which will quickly provide an approximate number. Typically, a Google number is within 200 pounds of the certified scale weight.

If a Google search is not an option, an approximate weight can be determined by identifying the Gross Vehicle Weight Rating (GVWR) from the vehicle’s certification tag. Once the GVWR is obtained, deduct the approximate weights for the driver, passengers, and cargo capacity to get an approximate GVW.

For example, a 1998 Dodge Durango 4-wheel drive SUV has a GVWR of 6,400 pounds. It has seating for one driver and six passengers, plus a cargo space. Deduct 200 pounds per person and 200 pounds for cargo, for a total of 1,600 pounds from the GVWR of 6,400 pounds. Therefore, the GVW is about 4,800 pounds (i.e., 6,400-1,600 = 4,800). A Google search of this specific vehicle indicates it weighs 4,568 pounds, which is within the 200 estimated pounds noted previously. When calculating the recovery resistance, do not add the total weight of the casualty to the recovery resistance calculation.

With just one load shackle in the rigging, compare the tension generated to the calculated load to ensure the equipment is not overloaded.

GVW of the casualty, allowing for the amount of slope, the surface type, and the rolling resistance.

CALCULATING SLOPE RESISTANCE

After determining an approximate GVW for the casualty, look at the slope that the vehicle will traverse in the chosen recovery path. Recovery resistance due to slope can be a positive or negative calculation, obviously depending on whether the recovery path is

uphill or downhill. The towing and recovery industry has long used the following approximate resistance percentages for slope resistance:

• 15 degree up-slope = 25 percent of the casualty GVW

• 30 degree up-slope = 50 percent of the casualty GVW

• 45 degree up-lope = 75 percent of the casualty GVW

• More than 45 degrees up to 90 degrees = 100 percent of the casualty GVW

The absolute most recovery

resistance added or subtracted from a recovery resistance calculation is 100 percent of the casualty GVW. That’s because a towman would be vertically lifting or lowering the casualty at a 90-degree slope.

WHAT’S ON THE SURFACE?

The surface that the casualty will traverse in the recovery path will create resistance and must be calculated and added to the total recovery resistance as well. During a scene survey, prior to developing a recovery plan, choose the best available recovery path. In this path, observe the type of surface the casualty will traverse, and calculate the surface resistance so it can be added to the total recovery resistance calculation.

If there is more than one type of surface in the recovery path, use the calculation for the most amount of surface resistance. As an example, if the casualty will traverse both sand and concrete within the recovery path, use the surface resistance calculation for sand because its resistance is higher than it is for concrete.

The surface resistance calculation percentages generally accepted in the towing and recovery industry consist of the following:

• Hard surfaces = 10 percent of the casualty GVW. These would include asphalt, concrete, or hard packed dirt roads.

• Medium surfaces = 33 percent of the casualty GVW. These would include gravel, grass, or softpacked dirt roads.

Soft surfaces, such as sand or mud, will create recovery resistance based on how deep and how many wheels are mired in the surface at any given point along the recovery path.

If all the wheels of the casualty are mired at the following depths, calculate the surface resistance as indicated:

• Tire Depth = 100 percent of the casualty GVW

Tire depth is when the wheels are mired to the bottom of the rims. None

of the other components of the casualty vehicle are mired in the mud or sand besides the tires.

• Wheel Depth = 200 percent of the casualty GVW

Wheel depth is when the wheels are mired between the bottom of the rim and the center of the rim. A casualty mired at this depth will have many components of the casualty mired including the suspension, and at least a portion of the engine and transmission.

• Body Depth = 300 percent of the casualty GVW

Body depth is when the casualty vehicle is mired anywhere above the center of the rims. Most of the casualty is mired at this depth.

Once you have calculated the surface resistance, this amount must be added to the slope resistance.

CAN YOU GET ROLLING?

If any of the wheels of the casualty are not able to roll freely during the recovery process, it will create rolling resistance that must be calculated and added to the total recovery resistance.

The generally accepted calculation in the tow industry for wheels that do not roll freely is 25 percent of the casualty GVW for each stuck wheel. The rolling resistance calculation must be added to the slope resistance calculation and the surface resistance calculation in order to calculate the total recovery resistance.

The percentages used in this article are generally accepted in the towing and recovery industry, and likely came from information in the US Army Vehicle Recovery Operations Manual FM 2022 published in 1962. A newer version published in 2014 is called the Recovery and Battle Damage Assessment and Repair (BDAR), but the original information is basically still used. In my experience, the actual resistance has always been less than the calculations.

LOAD CELLS

Technology allows us to verify our calculations in the field. When

making these recovery resistance calculations, most towers often don’t know just how accurate they are. But here’s a good rule of thumb to

follow: If the casualty begins to move as planned, all anchors are holding, the truck is not moving, and there are no other indications of overloading, then proceed.

In addition, load cells are available for measuring tension and compression loads. As technology improves, they have become smaller, more durable, wireless, and Bluetooth-enabled, along with being integrated with rigging equipment such as shackles.

For example, the Crosby Loadshackle (WLS3.25T) is a wireless, environmentally sealed load cell shackle. With just one load shackle, place it in the rigging, and then compare the tension generated to the calculated load at that location to verify calculations and ensure the equipment is not overloaded.

Also, the Crosby Chain Safe is a wireless Bluetooth, environmentally

sealed load cell that measures the tension load along the length of a chain. It features clevis fittings for grab hooks, chain shorteners, and other connectors. This is useful when performing overhead lifting with chain.

There are a variety of load cells available on the market, ranging from a simple analog gauge to wireless Bluetooth enabled.

Overall, calculating the TRR is an essential step in the successful recovery of a casualty. If the load being placed on the rigging is not estimated, it’s hard to avoid overloading towing equipment. By first calculating the TRR, a tower can make an educated decision on the equipment to use, and how it needs to be rigged to complete the task safely.

What Towers Took Home

While most visitors head to Las Vegas for the gambling and entertainment, there’s yet another compelling draw: the American Towman ShowPlace Exposition. Early in May this event packed out the South Point Hotel, Casino and Convention Center.

“We had a strong attendance over the course of the two days,” noted Henri “Doc” Calitri, president AT Expo Corp. “Everybody enjoyed it and was pleased with the turnout.”

In addition to numerous new products, services, and tow trucks on display, there were a number of other compelling events for towers. These included an ERSCA informational clinic, as well as a Q&A session in the arena on towing the Tesla Cyber Truck and the Nikola Hydrogen Truck.

One of the more unusual wreckers on display was from Murphy’s Towing of Arizona. This firm built an innovative off-road tow truck, which garnered lots of interest.

The AT ShowPlace event kicked off with American Towman’s legendary Cactus Feast Welcome Night. This hospitality event was followed by the Desert Smoke, along with a host of educational workshops and seminars that included hands-on rotator training and quick-clearance certification.

These gatherings all foster a spirit of friendly cooperation and company growth. This spirit was in evidence during the show, both on the floor and after hours, as towers from across the country broke bread and shared ideas freely. Such camaraderie leads to overall encouragement for maintaining high levels of professionalism and best safety practices in the towing industry. Which means the benefits of AT ShowPlace don’t just stay in Las Vegas.

A large number of suppliers were on hand to help with any questions on new tow trucks.

The South Point’s conference center was jammed with towers checking out all the latest trucks, products and services.

A variety of equipment manufacturers showed how to streamline towing operations.

All sorts of essential items for towing were on display.

Towers were able to inspect the latest wreckers firsthand and speak directly with factory reps.

Numerous seminars provided advice on managing a tow business.

Some tasty eats were enjoyed at the hospitality receptions.

The ACE awards recognized towing businesses’ service excellence.

Size Matters

Is Bigger Always Better When Upgrading to a Heavy-Duty Wrecker?

Many towers aspire to be in the heavy-duty segment for a multitude of reasons. Perhaps they have always wanted to drive a big truck, are looking for a new challenge, or are just chasing dollars. Heavy-duty towing brings these opportunities and much more to the table. The question is: is a tower really ready to make that leap, and if so, should they?

Bigger might be better, but not always. While most towers dislike turning down calls, it’s understood that they can’t be everything for everybody. Various business regions might not support the revenue required to have a diverse fleet. So, how does a towman determine whether or not a moderately sized tow truck that’s good enough for most jobs, versus a massive wrecker that can do it all, is needed?

REALITY CHECK

For as much enthusiasm as there is in the towing industry, know that this is a business and not a lifestyle, so decisions should be made based on economic reality first and foremost. Emotions or personal desires are secondary. Unfortunately, many good towers have failed because they added that new heavy-duty wrecker or rotator to their fleet without any consideration as to how they were going to pay for it—or if they really even needed it.

While it’s obvious that the equipment is similar (only much larger and more expensive), many towers might not realize just how much more skill and effort it takes to safely operate heavy-duty wreckers, compared with their mediumduty counterparts. Similar to the change from light-duty into medium-duty, with the size and weight increase of a heavy there is an exponential increase in the skills required, as well as serious consideration of the risk factors involved with operating a much larger tow truck. The average heavy-duty operator needs to be an expert truck driver, part master-mechanic, and an extremely creative problem-solver capable of “field engineering” and grasping the whole picture.

Before casting aside an older medium-duty truck, look before you leap into the heavy-duty segment.

wreckers, it is often not possible to allow each driver to have their own take-home truck, which results in more sharing or “slip seating.” This practice is often necessary for the financial success of the tow business, but can lead to problems with the drivers.

SHARED USAGE

Towers, especially heavy-duty operators, like to take ownership of their equipment, and don’t relish the idea of sharing trucks with other drivers. While it is great that a driver wants to treat a truck as if they owned it (usually resulting in

better maintenance and upkeep), the bottom line is that all trucks need to be available around-the-clock. Drivers cannot safely run 24/7 by themselves. An essential key to success is ensuring that more than one heavy-duty operator is working in any particular fleet.

While on the topic of staffing, it’s the ideal time to examine the type of heavy-duty operation that is being considered. It is important to recognize that heavy-duty towing has many subsegments, each with their own unique challenges.

Consider the volume of calls for each segment since heavy-duty trucks are not nearly as versatile as their medium-duty counterparts. A true heavy-duty is not capable of towing smaller vehicles—at least not easily. Owning a heavy-duty wrecker requires having a good customer base of larger vehicles that require recovery services, since heavies ◀

Basic heavy-duty towing for breakdowns, tractor swaps and such only requires a handful of drivers and doesn’t typically impact other areas of your company. For those towers already doing varying degrees of this

type of work with a medium-duty, it is natural to explore the expansion of your offerings.

On the other hand, venturing into police towing and bigger truck wrecks/recovery often requires the availability of multiple extra laborers on very short notice. Most

heavy-duty companies will pull from their light-duty division or the shop when getting a call for a large truck wreck. While this can provide a welcome distraction for those other employees, it may cause such a disruption in your business that you could lose money on, rather than make a profit simply by handling a smaller truck wreck call.

Major incidents often require responding with specialized equipment such as forklifts, frontend loaders, sweepers and more, with each piece requiring a skilled, trained, and competent operator. While owning or renting the equipment is fairly simple, finding and retaining skilled operators whose primary jobs involve other tasks at a company can be a challenge.

industries. This setup allows them to have near-instant access to skilled operators and equipment without paying for those assets to sit idle between major highway incidents.

WORKING RELATIONSHIPS

Getting back to a point mentioned above, does a tow company’s service area have the need for more heavyduty services? Or, is there someone to subcontract these services from? Towers aren’t expected to do it all by themselves, but they must have solid, pre-arranged, working relationships with many different disciplines in their community to successfully venture into the heavy-duty recovery segment.

If your business plan calls for doing mostly tractor swaps and onhighway truck breakdown towing, a quick swap (detachable tow unit on a tractor) or a 25-ton unit may be all that is required. If, however, operational plans, along with actual workload, call for towing loaded cement mixers, coach buses or fire trucks, a 50-ton wrecker with the

correct under-reach is necessary. Also, always keep in mind that selecting the correct combination of wheelbase, front-axle weight, overall static weight, and weight ratings will give you both the required tow performance and drivability. Longer wheelbase wreckers can tow more weight safely, but may not be practical in some urban environments, especially for operators new to towing larger vehicles. A shorter wheelbase with a counterweight may be preferable.

In summary, heavy-duty towing can be very rewarding when a tow boss is fully prepared for this new venture. As with any other change in a business segment, understanding the market and forces at play is the key to success. Avoid getting snowed by exaggerated promises of large tow and recovery invoices, as they are the exception not the rule, and often not fully collected without a fight.

True’s Towing Recover a Toppled Trash Truck

On April 4th, 2023, True’s Towing & Recovery was dispatched to an overturned side-loading garbage truck near Lake Michigan. Rob and Travis True, along with operator James Squires responded to the incident. Upon arrival, they found that the single-lane road had given way under the truck, causing it to overturn, ultimately putting the Peterbilt packer’s roof ten feet lower than the roadway.

The recovery plan for the 71,000-pound casualty vehicle began with Ernest Holmes in mind. An assortment of “Holmes trees” would prove to be indispensable for the execution of this job, and stabilizing the wreckers. The narrow gauge of the roadway prompted Travis to rely on his WreckMaster Rotator training, which strongly recommends first calculating the resistance to overcome.

Travis then set his Jerr-Dan 50/60 to work within its tipping capacity, while maintaining traction on the narrow road. The rotator was initially rigged to lift the rear of the casualty. Two parted lines were connected to the waste hopper.

Next, the rotator’s drag winch line was laid up between ground anchors and the tandems of the casualty, forming a four-part line. The casualty’s rear tandems were chained to the frame.

Placed at the front of the casualty was an NRC 40CS. Another Holmes Tree served as a ground anchor for a twoparted line to spike the steering axle.

After the rigging was completed, Travis and his team carefully checked their calculations to ensure the wreckers weren’t being overloaded.

True’s Towing was founded by Lester True in 1948 and each of the four generations since have taken on the many challenges that have come their way. Today, the company is owned and operated by father and son, Rob and Travis True. They frequently work big jobs together. The loamy soils of southern Michigan make the fields of recovery ripe for the picking. This father and son duo are always looking ahead to their next big opportunity.

Travis True is a prime example of a generational tower. He’s been riding in tow trucks and helping on jobs since he was in kindergarten. Seeing previous generations at work has formed Travis into a well-rounded recovery man. Nearly every day draws on some aspect of his expertise, but Travis still makes time to get into the woods with his Grandfather Ed.

The wreckers’ pulling force made its way through the wire ropes, round slings, shackles, and alloy chains on its way to the casualty. These forces overcame the truck’s weight, causing it to rotate back into an upright position.

Although the casualty was now back on its wheels, its heavy load was still leaning. Travis’ Jerr-Dan 50/60 held the unit upright, while a winch line from James’s NRC 40CS

was rigged to the casualty’s low side. Then, in a coordinated effort, the two wreckers lifted and slid the casualty sideways until it rested safely on the road.

Travis True’s reliance on training, careful planning and a well-executed recovery made this job a significant achievement. It’s one for the memory bank, not only for success, but also to train for the future and to look back on with pride.

Avoiding Violent Confrontations

In the repo world, it’s been said, “Do whatever you have to do to pick up more cars.”

This free-for-all thinking of some companies and finance institutions indicates a “get er’ done” mentality, likely to send an untrained agent into creating a potentially life-altering situation.

In 2023, seven repossession agents were shot and killed, the deadliest statistic ever in a single year. All told, as many as 60 agents have died during repo procedures dating back to 1932. Such tragedies warrant focusing on the dangers that agents face, and lessons which can be learned going forward.

First, let it be known that taking someone’s vehicle without permission or legal authority is considered, “an act of theft.” No matter what experience level an agent has, there’s one clear lesson—debtors perceive repo agents as someone out to steal their car. Even though debtors have fallen into arrears, they see themselves as victims and often inflict violence against repo agents who are simply doing their job.

In reality, debtors having a vehicle repossessed creates three possible reactions, no matter what the time or the circumstances: 1) desperation, 2) a sense of rage, and/or 3) immediate revenge.

Regardless of why or when a debtor’s payments fall behind, they regard the repo agent as “The Enemy,” who is about to seriously inconvenience their lives.

NIGHT MOVES

Repos and PPIs (Private Property Impounds) are touted as, “the dark side of towing.” Since most repos are conducted at night, stealth and the cover of darkness are regarded as “illegal and clandestine” in a debtor’s eyes. Unfortunately, the repo industry has earned a bad rap for the manner in which its business is conducted. Call it fair or unfair, agents oftentimes resort to creative techniques to avoid confrontation. In trying to prevent violent situations, agents snag vehicles when debtors are sleeping. Isn’t that justifiably an essential way for repo agents to stay alive?

Not always.

For example, in June 2015, a Columbus County, NC homeowner was awakened by noises and a flashlight’s “glint” at 2:30 a.m. The homeowner believed a home invasion or robbery was about to occur. In all of 20 seconds, shots were fired, one striking the agent in the head, killing him instantly. There was no illicit behavior involved—just a repo in progress.

DESPERATION AWAITS

No matter what experience level repo agents have, personal attacks can befall them. Realize that when a debtor’s vehicle is taken, it denies them freedom and mobility,

In response to violence against agents working at night, in 2009, the thendirector of the American Repossession Association, (ARA), Les McCook,

observed that, “The smart operators aren’t out there at two or three o’clock in the morning with people who can put you in a bad situation.”

While McCook’s comments were likely addressing the problem of night repossessions, note that Blaine LaPrairie, a veteran California repo agent, was shot and killed at 8:00 a.m. on December 15, 2023, while working within the city of Compton. Apparently, there’s no such “safe time” to lawfully repo someone’s car.

COURAGEOUS OR CARELESS?

Among countless accounts of agents killed during repo scenarios, another article described one agent as being, “a no fear kind of guy.” The phrase alone suggested that agents go to all lengths to gain custody of a debtor’s vehicle. Do these actions lead to undue violence?

In the eyes of the law, no state permits a “breach of peace” during repossession. A breach of peace might be defined as, “any type of adversarial encounter.” Repossession law prohibits agents from breaching the peace during a seizure tow or drive-away operations. Agents are prohibited from initiating physical force, verbal threats that suggest physical harm, intimidation, or breaking into locked buildings and garages to seize a vehicle. All of these activities constitute a “breach of peace.”

However, when repo agents have been accused of committing “a breach of peace,” as is often brought up, it’s debatable as to who actually breached the peace. As a means to prevent false accusations against agents, nowadays it’s smart for agents to wear functioning body cams as “best evidence” to prove there was no breach of peace.

OTHER DANGERS

Oddly enough, it’s not uncommon for an enraged debtor to willingly jump into their vehicle in an attempt to liberate it. Based on repo history, debtors have physically assaulted agents, ambushed them, or pumped bullet rounds through doors and windows of fleeing tow trucks.

What’s worse, for incidents where breach of peace isn’t proven, a plaintiff’s attorney may unearth some hidden technicalities in other laws. To accompany the filing of their fictitious claims against agents, an accusation may say the agent violated laws in other legal arenas such as:

• The Uniform Commercial Code

• The Fair Credit Reporting Act

• Telephone Consumer Protection Act

• Federal & State Fair Debt Collection Law

• Fair Debt Collection Practices Act

• Truth In Lending Act ◀

PEANUT PAY

Anyone working asset recovery knows that some agents work on a commission scale or a flat rate. When a single, “snatch and grab score” becomes priority one, agents tend to push the envelope, taking chances not considered legal, cautious, or prudent. An agent’s aggressive and threatening actions can initiate a gunfight.

In other cases, when repo agents are seated in their vehicles during scouting events, ambush is more likely. Or, they are ambushed at the agent’s residence, repossession site, or followed to a place of work. Parking a tow truck in a rough neighborhood where robberies are more common can be another contributing factor.

TAKING REVENGE

Violent interactions have resulted in agents being shot multiple times. When a debtor fires upon someone a dozen

times with a high-powered rifle from a third-story hotel window, “revenge” is likely the root cause of rage. This was the case in the 2019 shooting death of agent, Zachary Johnson in Gainesville, Texas.

In response, July 18, 2023, Vaughn Clemmons, President of the American Recovery Association (ARA), wrote a heartfelt editorial: “Assaults on repossession agents and repossession office employees is on the rise, and it’s unacceptable,” he stated. “Repossession agents and employees are on the front lines of this industry, working hard to make sure that people can maintain their possessions and to help keep our industry moving forward. We must do something to protect them and the industry.”

There’s no debating that some agents manifest macho personalities where taking someone’s car is just “a dramatic game.” Making the “Ultimate Grab” is the excitement that lures them

to repo work. (In fact, one repo agent admitted privately that it helps to have a “heart of larceny” to do the job.)

Agents will typically claim that they’re “in control” during the repo procedure, but likely the comment is more sarcastic than what’s really taking place. This statement is simply not accurate, especially when an angry vehicle owner lies in wait to ambush someone taking their car. This sort of attitude merits a reality check and conceivably job re-training.

BY COURT ORDER?

In the midst of increased violence against repo agents tasked with asset recovery, the question arises, “Why aren’t debtor vehicles surrendered to the county Sheriff as an order of the court?” Doesn’t doing so lessen the potential of agents sneaking at night onto someone’s property? Would this not eliminate (or reduce) brazen acts considered a breach ◀

of the peace? Does this seem like a realistic option, versus agent fatality? Perhaps not.

It would make more sense to change an owners’ perception that their vehicle isn’t being stolen, but rather “surrendered”. It would seem prudent for the sheriff’s office to serve an “asset recovery warrant” as a process of vehicle seizure.

Of course, the downside of doing so would be reducing the number of active repos, and the need for licensed agents. Yet this approach would likely minimize undue violence.

FURTHER RECOMMENDATIONS

Only about one-quarter of all states in the U.S. have implemented specific requirements for agents to be licensed. Even with lawful paperwork, snagging cars without current licensing will put a repo agent in violation of the law.

State-licensed repo agents are allowed to conduct vehicle seizures per the Uniform Commercial Code (UCC) provided (once again) there’s no breach of peace. When “active repossessions” are conducted, agents shall have

necessary documents, i.e., agent license, state-issued ID card, Lienholder Statement, Affidavit of Repossession, applicable court orders, title, Lien Satisfied Statement, Bill of Sale, or other documents required by state of operation.

PROTECTING ONESELF

Regarding handguns and self-protection, do it legally, cautiously, and responsibly. Weapons should never be displayed as a means to intimidate or threaten debtors into surrendering vehicles. There are plenty of incidents where repo situations have escalated into shooting scenarios, resulting in loss of a debtor’s or agents’ life, or incarceration. If a towman fires in self-defense, he’d best be able to justify his actions.

As an additional level of personal safety, “body armor” should be worn as a means towards self-preservation. Be sure to research the legality of wearing body armor based on individual state requirements.

The bottom line is that repo agents have an obligation to understand all laws pertaining to vehicle repossession and asset recovery. The best source of education is to join one of the repo industry’s associations. Remember, calm heads prevail where an agent exhibits no breach of peace, knowing that no vehicle is worth being killed over.

Is It Time for a National Standard?

Roadside tow operator deaths and injuries are at an all-time high, and despite the industry’s efforts to bring awareness of SDMO laws and the dangers of distracted driving, the statistics show no sign of decreasing. With the ever-expanding mobile technology market infiltrating vehicles at an alarming rate, and law enforcement consistently overwhelmed with requests for services beyond traffic enforcement, there is likely no easy solution for roadside dangers. Perhaps the best defense against the roadside dangers that operators face is fostering a good offense. This must begin with uniform training, as well as deployment of industry best practices for standard operating procedures. As a pointed comparison, have you ever wondered why most fire or lawenforcement scenes look similar, even though the area where the event is occurring is entirely different?

CONSPICUOUS ABSENCES

Emergency scenes usually have uniform deployment of equipment, parking protocols, and safety apparel, with the exception of the attending towing company. Unfortunately, a towman will stand out because their equipment is parked with little rhyme or reason to its placement, and the lack of PPE makes a tow operator stick out from first responders like a sore thumb.

There is no reason given for this except a simple lack of training. Remarkably, most towers will not

devote the time and effort to training unless it is mandated by a contract, regulation, or promises of a discount incentive, or perhaps preferential treatment for being “trained and certified.” Not all, but many tow managers simply will not invest in their future, nor the safety of their operators.

TRAINING DAYS

Roadside responder training is not new, with the earliest forms being offered to towing operators beginning with the SHRP2 program authorized by Congress back in 2005. Predating even this, some states had training available. But, since at least 2006, some form of national traffic incident management training has been available, free of charge, to towing operators. The only requirement is to simply show up. Even for those who do not have time to go to an in-person event, (although highly recommended in order to develop relationships with other responder disciplines), there are free online resources that will provide a TIMS certificate and the

basic foundation for safety practices.

Roadside safety training should be a company requirement for all personnel that may have to work roadside, regardless of their experience level or job title. In 2022, as Executive Director of the Pennsylvania Towing Association, I was involved with Sherry Morgan, then a Board Member, Dan Spies (the former Executive Director) and Todd Leiss, then the Traffic Incident Manager for the Pennsylvania Turnpike. We developed a Traffic Incident Management (TIM) for Towers program specific to Pennsylvania based towing operators. Despite having more than three decades working roadside, this program was an eye opener. Not only for me, but also everyone else it was presented to since its launch in 2023. Even an old dog can learn new tricks!

TOWMAN MINDSET

With regard to a national standard, it must be recognized that towing consists of a bunch of hardworking and well-intentioned small business owners, all with one thing

in common—they are fiercely independent. While this autonomous spirit serves them well with many of the daily tasks they face, there is a time for uniformity. And that time is now, especially when we are talking about roadside safety. Without a national towing standard operating procedure, towers will continue to be at risk working calls on our highway system due to the public’s lack of recognition that a tow truck operating roadside is an emergency vehicle.

Key visual cues include equipment placement, such as angling outward to clearly indicate the equipment is parked and not moving, the proper use of advanced warning lights, signs and cones/channeling devices, and proper PPE for pedestrian workers. Without these cues, the average motorist won’t be aware that anything dangerous is occurring on the shoulder of the roadway.

The reason a national standard is called for is simple— consistency. This is the very same reason that most ambulances and fire apparatus’ have similar lighting placement, patterns, and nearly identical retroreflective markings. It provides them with instant recognition as a special vehicle that requires caution when approaching. Imagine the chaos if police, fire, and EMS vehicles were not instantly recognizable as such. This would undoubtedly lead to more crashes and quite possibly a total disregard for the safety of these vehicle operators!

WORK TOGETHER

Even so, they are still involved in struck-by incidents at nearly the same rate as towers, possibly even more often since accident reporting procedures have no nationwide uniformity, and the true numbers may never be known. For these reasons, towing needs to work more directly with fellow responders to promote the national recognition of uniform traffic control and management procedures. This means towers need to train with other disciplines, follow along with their methods to identify hazards, and operate as safely as possible in the roadside environment.

The hardest part for towing is both the legal obligation and moral duty to provide a safe working environment at roadside. Yet, towers often do not have the legal authority to do so, at least not using the same methods used by other emergency responders.

This must change! With no disrespect meant to highway maintenance workers, a litter crew has the legal right to set up traffic attenuator trucks, channeling devices, and occupy a lane to pick up litter. So, why shouldn’t towers have the same right to protection?

SAFETY MEASURES

TIM training, the progressive tower can show their willingness to support a national standard. Once there is a majority of towers properly trained in traffic incident management, including temporary traffic-control procedures, they can request Federal Highway Administration support in creating rules requiring towers to deploy TTC (Temporary Traffic Control) measures. Once mandatory, towers will have the right to collect for these added expenses without protest from insurance companies.

For the towers already doing so, they are to be commended. Please feel free to contact American Towman magazine about roadside experiences, both good and bad, especially how the community received these additional services. In areas with all-volunteer fire services, the addition of towers providing TTC is welcomed with open arms, as it frees up the volunteers to handle other tasks, and also go home and

enjoy their personal lives.

TTC services were provided by my company during rotation coverage back in 2005 on a section of interstate highway under a cooperative agreement with the Pennsylvania Department of Transportation. Admittedly, this responsibility had a rocky start, as the State Police officers were uncomfortable with a tower providing sign boards and cone lines. Plus the PennDOT workers were upset about losing overtime pay to provide TTC at large crash scenes.

Within a year, however, the attitude changed and my tow company’s TTC service was well received. Eventually it came to the point that on a long duration event, we were called just because we could handle the TTC. The State Police even began to expect us to deploy TTC for short-duration events so their Troopers could move on and provide services needed elsewhere.

KNOW LOCAL REGS

Be aware that legal council is needed before deciding to begin any type of temporary traffic control, so check local and state regulations before deciding to add TTC services. While sending tow operators, mobile mechanics, and “soft service” providers to a TIMS class is always a good idea, it pays to be familiar with the legal limitations and liabilities before deploying any TTC or TIMS methods.

There are, however, several universal measures operators can employ to provide advance warning for incident scenes. The most basic of these is to deploy the reflective warning triangles that all commercial motor vehicles are required to carry. Federal regulations stipulate that within ten minutes of stopping roadside, a CMV must deploy these warning devices in a universal pattern that depends upon the direction of traffic flow and ◀

the location of the disabled vehicle.

Beyond deploying reflective triangles, a tow operator or mobile mechanic can always follow the wise advice, “Drop three to save me.” Simply said, carry three traffic cones, and deploy them on the shoulder of the roadway behind the disabled vehicle or tow truck, whichever is exposed. What you can’t do, though, at least not without technician training and proper legal authority, is deploy cones into the live lane of traffic.

BEACONS ON!

Lastly, proper use of warning lights is essential. Don’t become a “Beacon Bandit” who rides all day with amber strobe lights on. Only eight states require the use of amber warning lights while in tow, and while several others allow them to be used, they are generally

not required unless there’s a hazard to traffic.

It is not industry standard or a even a good idea to overuse amber, or other color, warning lights. Only activate the minimum number of warning lights necessary to alert the public of a tow truck’s presence and that there is a hazard. Also, be mindful of the glare presented by white work lights, which will often make a human form invisible at night while working roadside, potentially making a motorist blind to a towman’s presence.

While all of the above best practices can help to reduce roadside injuries and deaths, there’s still a rough road ahead to implement them. Tow operator training, however, can be a solid start on the path to safer roadways.

His Way

Like many towers, Ronnie Mayer’s life didn’t start out all that easy, but he later found a way into the tow business. At the age of 12, his father died of colon cancer, and he became a rebellious young man. He wasn’t a bad kid,

but had to stay in a children’s home for a time, and did a stint in military school as well.

“I just wasn’t a mainstream guy,” he explained in a rich Georgia drawl. Referring to his authority figures, “I just didn’t do things their way.”

Ronnie admits he’s still a rogue to this day, as seen in how he got into the towing business in the first place, and later on fighting and over-turning restrictive city permits all the way up to the Supreme Court. On the other hand, he is careful about consequences, especially when it comes to safety training for his tow operators.

“Don’t drink before a job,” he insisted. “When you’re driving a truck with your name on it, you’ve got to be careful—no hot rodding, and think about the area around where you park your truck to avoid problems.” He recalls that as a boy his father always told him to walk with a feather duster behind him, and don’t leave a trail of bad tracks behind.

Before getting into the towing business, Ronnie worked as a welder and ironworker, and sometime later in a body shop. Noting the clean, beautiful tow trucks coming into the shop, he befriended their operators. After getting to know them, Ronnie exclaimed, “I’m gonna own a tow truck one day!” They laughed at his ambitious admission, but Ronnie just wasn’t one to be discouraged, despite never even having driven a wrecker. After saving up his wages, he was able to buy a ’79 Ford F-350 with a Chevron 17-foot aluminum rollback. With no tow training, but “eaten up with common sense” (to use a Southern expression), he drew on his car-guy background and handled three tows his very first day on the job.

he knew through the body shop where he worked. Another unconventional method involved focusing mostly on high-end clientele with BMWs, Mercedes’, and Cadillacs. To facilitate getting recommendations for these well-heeled customers, he kept his wrecker spotless, so they would feel comfortable having him handling their luxury cars.

Ronnie’s company motto was, “The Best Bed in Buckhead,” referring to the area he served. Adding that, "We didn’t invent the flatbed, but perfected it.”

His roadside tows were successful enough for him to afford a second truck, and eventually his fleet expanded to a total of 70 or so carriers over the years. As his company grew, his reputation led to towing for all the local

Over the years, Ronnie didn’t let his success go to his head, and has always liked to look after fellow towers. A case in point is Christina Floyd of Hawkinsville Collision and Towing, who he helped get into the business.

As recalled by Christina, “We met at a tow show, and I was just getting my new tow company started,” she notes. “But I didn’t know what to do. He has been absolutely amazing, and been my mentor through everything. He has been a huge asset, guiding me what to do.” Be it a difficult employee, handling a truck, or dealing with insurance.

For instance, Christina once had an issue with a driver giving her lip. Ronnie gently told her to just let the driver know you love them, and hear them out, but also let’s work on that problem and get back into work mode.

“He’s a wonderful, wonderful man,” Christina adds. “I’m so glad he’s getting admitted into the Towing Museum’s Hall of Fame—he really deserves it!”

Martin Peacock of Peacock Towing, Inc. was the tower who nominated Ronnie for the Hall of Fame. He has known Ronnie for 45 years, and he, too, met him at a tow show in the late ‘70s. They both worked on the Century racing program at the tracks, and having much in common, they became lifelong friends.

“He’s a people person,” Martin says. “He’d give you the shirt off his back.”

As one example of many, during the 1994 flood in Albany, Georgia, which split the town in two, Martin had to handle a number of difficult heavy-duty recoveries. But his rigging equipment was failing on him, so Ronnie drove many miles with a couple spools of steel cable and delivered them at no charge.

Ronnie Mayer’s company became known for his “white glove” handling of race cars and luxury vehicles.

And, he also took a casualty Jaguar back to Atlanta for Martin, again for no fee.

On a broader scale, and what prompted Martin’s nomination, Ronnie fought and won a court case with the city of Atlanta over restrictive city towing permits. Just as in his strong-headed youth, he defied local authorities.

“That made his name,” Martin recalls. “It was a major precedent for all of us, and helped everybody in the towing industry.” He also notes that Ronnie is involved in the local community, such as the Ronald McDonald House, Special Olympics, and American Towman’s Spirit Ride.”

While still a rogue in some ways, Martin notes that, “He’s very humble and big hearted,” setting a fine example for all of his fellow towers.

Good Samaritan of the Highway

A Tribute to a Pioneering Roadside Service Vehicle

Back in the 1920s, roadways were nothing like today’s high-speed freeways. Dirt roads were barely suitable for horse and wagon, but even more troublesome for automobile owners. Paved roads were still rare in rural areas. Wooden planks improved the road surfaces, but traveling any distance was still a risky adventure, requiring the skills of a master mechanic and the fortitude of an explorer the likes of Daniel

Boone. Top speeds were typically less than 30 mph. Even so, between 1919 and 1929, the number of passenger cars in the U.S. ballooned from 6.5 million to 23 million, quickly overwhelming local road infrastructure. Interstate freeways were still decades away.

Originally the service trucks were painted brown, but later on were painted white to increase their visibility.

Hence the need for the Auto Club’s “Highway Patrol Service.”

Beginning in 1924, this fleet of ten, light-duty Dodge trucks operated on regularly scheduled routes in Southern California. They were driven by qualified staff ready to render mechanical and personal first aid to stranded motorists, members, and non-members alike. These specially trained, uniformed drivers could not only change tires, but also often get stalled cars moving again. In outlying areas, the patrol drivers regularly handled services such as delivering the mail and transporting people to the hospital. In the first six months of its operations, the patrol provided first aid to more than 100 injured motorists, and emergency

repairs to just over 1,400 disabled autos. Thus, the Service earned a deserved reputation as, “the Good Samaritan of the Highway” and “the Friend to all Motorists.”

As part of the Auto Club’s collection of historic vehicles, this Dodge will help to celebrate 100 years of service this coming July. Last year, the Club’s current network of Roadside Assistance providers responded to more than five million calls. And to think this all started with a sturdy Dodge truck.

The signage on the side of this 1924 Dodge Panel Truck indicates that the Auto Club already had more than 137,000 members.

The motometer mounted on the hood measures and displays the temperature of coolant water vapor in a car’s radiator, and indicated if the engine was overheating.

Among many other invaluable services, the Highway Patrol cars camped out near the Santa Clara River to render assistance during the St. Francis dam disaster in March of 1928. The makeshift headquarters for handling the incident was housed in a crude canvas tent.

Working Together With First Responders

How much do you know about your job? If you’re good at what you do, you probably know a lot about what goes into making you able to do it, along with what could enable you to perform it even better. If you work alone, that might be enough to get you through the day. You may be by yourself in your rig, traveling to and from a call. You probably do most of the rigging alone depending on the situation you respond to. But sometimes you’ll be joined by law enforcement officers and/or firefighters.

This is when the situation becomes highly dependent on working together and allowing others to do their jobs, too. During the Spirit Ride from 2017 to 2018, I was struck by stories I heard of confrontations between towers, police and fire personnel. For instance, one time we were having an event and the host tower had requested that the state police join us at the ceremony and hopefully give us support since we would be traveling on the Interstate for part of the procession. To his surprise we were turned down and were told that the state police wouldn’t be providing any services. Then, unfortunately, two nights before the ceremony a state police officer was struck and killed during a traffic stop on the Interstate. The day of the

ceremony, it looked like what must have been the entire police force, arrived and proceeded to join the ceremony.

One officer asked if he could say a few words. He began by reflecting on the sad event that had occurred. He spoke of the hazards that lurk out there, how stressful a tower’s job must be, and the danger that awaits when performing such a difficult job. “For me, from this day forward,” he solemnly stated, “I will not leave any scene that I am called to involving a tower, until that tower is ready to leave the scene. They need our protection and I will work together with them to help give them that protection.” I realized this isn’t true of all recovery situations. But the fact that it occurred at all, gave me pause to ask myself, what was the problem that made working together so difficult? It was something that needed to be fixed.

Since that day I have started to see more police and firefighters remaining until everyone has competed their jobs. At tow shows I speak with towers who tell me how this situation has improved and that even tow companies are working together. Yes, working together, for the benefit of all first responders including towers, makes it possible to get home to those we love, to those waiting for our safe return.

The Tennessee Legislature passed a bill prohibiting unlicensed companies from booting vehicles and have also capped the fee to remove a boot at $75. The bill awaits the governor’s signature.

Complaints by consumers spurred these actions, due to tow companies not providing a grace period, unclear signage, and long wait times to remove the boots. Companies would

also be required to remove the boot within 45 minutes after a driver’s call.

Sen. Jack Johnson (R), who co-sponsored the bill, said he proposed it after hearing many complaints from constituents.

“This legislation will protect vehicle owners in Tennessee from bad actors seeking to profit off of immobilizing and confiscating vehicles,” Johnson said in a statement.

The law would take effect July 1. In addition to the state law, Nashville city leaders are considering their own stricter laws.

Suspects in a killing that targeted a tow truck driver near Homestead, Florida were apprehended by authorities and brought into custody. Towman Juan Garcia, 39, owner of JL Towing, was murdered on April 10, coinciding with another homicide in-

volving a kidnapping and murder of a woman that is connected to the same suspects.

Seminole County Sheriff Dennis Lemma said there was a green Acura captured on video during the kidnapping, which was the same vehicle Garcia and his company towed from an Orange County apartment complex in March.

The suspects are facing federal charges in connection with the Homestead woman’s carjacking and murder, and are most likely connected to the murder of the towman.

Lemma said that the two suspects apprehended were Jordanish Torres-Garcia, 28, who owned the
