Huge swindle rocks PNB & SBI I

t is very shocking and alarming to note that series of scams rocked and bewildered the largest banks, SBI and PNB which shook the entire nation S. Ganapathy by surprise for the past one month. 7358768630 PNB was shaken by a major financial wilful fraud, perpetrated by the diamond czars, Nirav Modi and Mehul Choksi at its southern Mumbai branch to the tune of $1.77 billions ( Rupees 13000 crore) since 2010. It is alleged that they could dupe the bank with the active connivance of the branch officials in the issue of 1590 Letter of Undertakings (LOU) totally to Gitanjali Gems and Firestone Diamond companies in the Gems and Diamond sector. The major fraud was the culmination and consequence of staff involvement with the malafide criminal intent in collusion with the above fraudsters. There was no job rotation for the dealing staff every 6 months as per rule and same 2 officials were allowed to issue and authorise the LOUs through Swift which was not connected to the core banking system which is very dangerous and serious lacunae and made them prone to fraud easily. IT is a great wonder that how this grievous lapse was not known to the management of the bank for so many long years? Whether the internal and external auditors also failed to point out this anomaly? The LOUs were allowed periodic renewals for adjustments of funds, flouting all the banking norms without any margin requirements and backed up by any security. Easy money for the fraudster. There is abject and abrupt failure in the supervision and followup measures adopted by the bank ,lacunae in the internal and external control measures in the area of periodic bank audits, RBI audits, Forex audits, laxity of fraud protection measures etc for which the entire bank and RBI as the regulator and banker's bank are responsible who can not escape from the clutches of law. No validating turn-over, cash flows and income were conducted. The bank failed to detect the early warning signals before the borrower defaults for payment. Already PNB had a shock of 1800 crore fraud last year, perperated by Winsome Diomond. Apart from the alleged fraud of 13000 crore, it seems that the bank also have an estimated exposure of 7000 crore to the duo Another scam shook SBI by Chennai based Kanishk jewellers who defrauded the bank to the tune of 824 crore over a perod of years. It is alleged that the promoter admitted for falsification of records, financial statements, removal of stocks hypothecated to the bank, auditors falsified certificates etc. The promoter Bhupesh Kumar was also arrested for tax evasion of 20 crore earlier. It seems that Kanishk business turnover appeared to rise 10 fold from 180 to 1780 crore during the 8 financial periods. There was spurt in sales and current assets which should have evoked suspicion. Another wilful defaulter by Nathella Sampathu Jewellers to the tune of 250 crore over the years, came to light in SBI. It is alleged that the promoters misrepresented the financial statements, liquidated the primary assets and falsified statements by the auditors. There was wild mismatch of funds collected and deployed over gold chit fund schemes in 2017. In all the above fraud cases, CBI and Enforcement Directorates are probing the entire accounts of the said companies and come out with full picture and institute necessary legal proceedings for the recovery of the dues. Urgent steps to be taken: The banks should strengthen the lending practices by more scrutiny and follow-up, step up data sharing and monitoring, strengthen norms for swift transactions by linking it to core banking software, track carefully to electronic tuned transactions, reconscile all nostro accounts due to overseas business expansions, boost cypher security and insurance cover, strengthen internal and external audits including RBI audits, take immediate remedial measures wherever there is a default in recovery and payment proceedings, Identify bad and NPA accounts, take action upon the staff for any lapses found. The government's intent to scan all bad debts above 50 crore, its plan to bring in new Regulator body for auditors, NFRA to set new standards and punish erring auditors, if proved, to impose fine and removal, are valid and encouraging. Its intent to take action upon the RBI auditors and other connected officials who failed in their duty will also be taken to task, is welcome. The respective Bank Boards should assign clear accountability and responsibility to senior functionries to implement sound banking practices in the bank for follow up actions. Overall, the promoter should be more honest in all his business dealings with the bank, His antecedents should be thoroughly verified discreetly before any sanction of loans. The company auditors should be more responsible and honest and point out any serious lapses if found, without any fear or favour. The dealing staff should be honest. The other parametres of the advance should also follow suit for safe lending.

Cauvery issue further delayed... F

rom time immmemorial, the river Cauvery is the life-blood and life-line of Tamilnadu. Even 2000 years back, Karikal Chozhan built an earthern dam to protect from frequent floods, at Kallanai for the the benefit of farmers, with all irrigation facilities.and made Thanjavur, the granery of south which boasts to be the firsts in the world. River Cauvery is worshipped and venerated by all sections of people esp. Hindus as Goddess and people take holy dips and perform religious ceremonies on Amavasya days and Poojas on Adiperukku days and such is the warp and woof of life. Dating back to 1974, Tamilnadu got 645 tmc feet of water which was reduced to 419 tmc feet of water as per the Final Cauvery water Disputes Tribunal order dated 05.02.2007 and the present verdict of the Supreme Court dated 16.02.2018 further dwindled to 177.25 tmc feet of water which is reduced by 14.75 tmcft which is transferred to Karnataka to meet its water requrements and our groundwarer etc. However, despite the shortcomings in the order,Tamilnadu accepted in toto the verdict and waited patiently in the fond hope of the Central goverrnment to implement. If you verify the past history, the Election Commisision by it's order on 05.05.2013 had deferred the Cauvery order implementation then upto 05.05.2013 in view of Karnataka's assembly Elections. But now, the Election Commission has given green signal for the implementation of the order of the Supreme Court and not deferred it due to Karnataka Assembly Elections. This shows it's sincerity towards the issue. The Supreme Court before reserving the judgement on 20.09.2017, had pulled up the central goverenment for not implementing the Final Award of the Tribunal and categorically questioned its reluctance to set up the Cauvery Management Board. etc. This attitude shows the real intent of the Central government not to implement. Now the Central Government has filed a petition in the Apex Court seeking 3 months time from 16.02.2018 to implement the order in view of the impending Karnataka Assembly Elections and the issue is emotive. Tamilnadu government filed one of it's first ever contempt proceedings against the respective cabinet secretaries of the Central government which is posted to 9th April 2018. In this context, it is imperative that all the political parties, farmers associations etc should also file necessary affidavits in the Apex Court for contmpt proceedings against the respective cabinet secretaries, in league and in support of the Tamilnadu government which will definitely strengthen our case before Apex Court takes our case for a honourable and just solution. In the meantime, the state governement, all opposition parties, farmers associations, trade associations and people of all strata of society irrespective of colour and creed should come together and join in conducting all rallies, demonstrations, hartals etc in a peaceful manner throughout Tamilnadu like Jallikattu agitation to draw the attention of the central government for its passive attitude, for getting a fair, just and honourable solution in this vexed, ageold issue. Let us all wake up from slumber and fight for our rights to be retrieved. Victory is ours.

S. Ganapathy Continued from March 3rd Issue

The secrets of Hindu life This Upanishad pertains

to Sama Veda. The meaning of Susika in Sanskrit is Needle. The meaning of Vajra Susika is Diamond Needle. Usually, the diamond needle can pierce through and make holes in hard iron rods also. The name Vajra Susika dispels ignorance and to attain Viveka (Wisdom). Vedas extol and eulogise Brahmins as superior. Sruthis also support this perspective. Who is the real Brahmanan? Is it body, soul, caste. karma, wisdom or virtues? There are ample elucidations available in Vedas. Since the soul is one and the same in all beings in this world, It also takes different births due to one's past karmas, we can not say that the Jiva is not Brahmanas. Likewise, the body is not Brahmanas. It is composed of five senses and never there is a disparity as high or low in birth. Birth or death is equal to all beings. There is no distinct colour for each caste. If father is dead, his son cremates and does rites to the body of his

father. Because of this act, there is no Brahmahathi dosham. Hence the body is not Brahmanan. Because of caste identity, there is no Brahmanan. There are many Brahmanas among other castes and even born to animals. Lot of Rishis are born to animals, for instance, Rishyasringar to a deer, Kousika to a darpai(grass), Jampukar to a jackal, Valmiki to anthills, Goutama to a hare, Vashista to Oorvasi, Agasthiar to a Kumbham etc. The above rishis are illustrious Gnanis having supernatural powers. King Janakar and Ajatha Chatru are kshatriyas by caste and were great gnanis and warriors of high calibre. They lustily donated all their wealth, money and gold to people. Hence having wisdom is not Brahmanan. Brahmanan is not due to past, present and future karmas. He can not become a brahmanan due to performance of vast charities to people. Then who is real Brahmin? A brahmin is characterised as the one who sees all the beings as One soul in this world. He is bereft of any caste, creed or behaviour. He has

no birth, exixtance, change, ageing or death to him. His soul is beyond death, sorrow, ignorance, ageing, hungry or thirsty. He sees the soul with fullness without any pitfall, discripencies and possess the great qualities of truth, wisdom, happiness and deathlessness. He is always crisp with purity of heart and crystal clear in his faculty of thinking. He sees the soul as pivoter for anything which exists in all beings as the same. It is a sign of total bliss. He is beyond any mental-makeup which can be realised only through experience. His soul is ever lustrous. He is beyond any likes and dislikes bereft of any shortcomings having sound and sacred qualities of peace, harmony and humility. He is sans any desire. hate, lust, anger, hypocrasy, ego and miserliness. He is a total brahman in nature where people find in him peace, happiness, mental solace and total surrender for his grace to quell one's problems. Thus our vedas, shastras, puranas and ithihasas succinctly clarifies and extol him only as a Brahmanan and none else. (to be continued)
