t is laudable and remarkable that the President, Ram nath Kovind promulgated two vital ordinances viz, The Crimi nal Law Amendment Act and the Fugitive Economic Offenders Act, upon Union Cabinet's urgent decision on last Saturday immediately after the Prime Minister's visit to United Kingdom.

1. The new ordinance provides death penalty for those convicted of raping children below aged 12 years, paving the way for stringent punishment of minimum 20 years imprisonment or jail for rest of life. It also rules out anticipatory bail for rape or gang rape of a girl less than 16 years of age. It also provides 2 months time frame for investigation and the same for trial. The ordianance is a sequel to the public outcry over the recent cases of sexual assault and murder of minors at Kathua, Unnao and Surat.It is distressing and deplorable to note that according to NCRB's data that reveals an astounding statement that more than 48% of rape survivors were minors some even younger than 6 years old. The government is also contemplating to include minor boys in this catagory of rape with the same degree of sentences in view of persistant public demands. The earlier Nirbhaya case led to the inclusion of specific offences review of sentencing in 2012. Now, the Indian penal Code,the Evidence Act,Code of Criminal Procedure and Protection of Children from Sexual Offences stand amended. The ordinance also provides of setting up of fast track courts for appeals in rape cases and also setting up of speciaal forensic kits for such cases in certain police stations and hospitals in the long run.Eventhough it acts as an effective deterrant against the offence of rape and certainly will instil a feeling of security and confidence in the minds of girls and women. The society is largely responsible to arrest certain horrondous crimes like this. Such frustrating and scaring incidents happen, how many girls come out open and her family reports the matter and file case in the police station, feeling shame in the matter. Some people compromise by fixing forced marriage with the offender without the girl's consent and in the long run, bitterly end in discord and finally in divorce, sometimes danger to the life of the affected victims. Nowadays, we see some girls are very bold and strong minded to report the matter to police station to take necessary action upon the offender, social activists also back up for such a demand strongly.It is a welcome sign. Sometimes, the matter goes unreporting for fear of the girl's life and her future.. The government should ban such obscene scenes in the films which lure the youngsters for such wrong acts that destroys the culture to a great extant. Of late, the drinking habit among some youngsters embolden them to do such acts without their senses. Will the law arrest the tendency of rape in the society and book the culprits for stringent punishment within the time frame and the innocents should be spared. 2.The Fugitive Economic Offenders ordinance provides stringent punishment against economic defaulters and tackle cases involving Vijay Mallya,Nirav Modi etc. They had been evading prosecution by remaining outside the jurisdiction of Indian courts. A Special forum is to be created for this purpose for confiscation of proceeds of crime in India and abroad, when the value involved in is Rs 100 crore and above. The order will help banks and financial instituitions to achieve higher recovery processes and thereby improve the financial health of such institutions. It will also act as a deterrant for large scale defaults and diversion of loans without the end-uses of the borrowed loans. If these lawa are applied in a right manner, the offence will come down drastically benefitting the common man and tax payers. Such huge defaulters passports must be rescinded and reprimanded soon before absconding to a third country and to bring them back to face the trial is a long drawn process between the two countries. The banks are also summarily responsible to detect such cases in taking legal steps at once the laons become bad and recovery doubtful. The collateral security and personal guarantees of the borrower should be strengthened. Even the the government should contemplate certain stringent punishment for wilful defaults like life imprisonment in addition to confiscation of properties in India and abroad.
