Many of our clients that suffer injuries in motorcycle or other vehicular accidents ask us, How much is my case worth? The answer to that question depends on many factors. The purpose of making a bodily injury claim or filing a lawsuit is to provide compensation to an injured victim which will, as nearly as possible, place the injured person in a position equivalent to that which existed just prior to the accident. To do so, the following types of losses and damages are to be considered: Under Pennsylvania Law, damages are recoverable for medical expenses and rehabilitative care made necessary by the accident. Also, with proof that expenses for medical care and rehabilitative care will be incurred in the future, those amounts are also to be considered and valued. Under Pennsylvania Law, an injured person is entitled to recover for both loss of wages/earnings, and loss of future earning capacity caused by the accident. The element of actual wage loss is relatively easy to calculate, but just because a person continues to work in the same position after an accident, that doesn’t necessarily eliminate a claim for loss of earning capacity, because the ability of the injured person to earn over time must be considered. Under Pennsylvania Law, an injured person is entitled to be compensated money damages for past and future physical pain and mental suffering. Pain and suffering are real losses and can include damages for the loss of life’s pleasures caused by the accident. The loss of life’s pleasures encompass a wide variety of losses, such as the ability to engage in a normal life, curtailment of social activities and the loss of a sense of well-being. The monetary value of damages for past and future physical pain and mental suffering is governed in large part by whether the injured person makes a full and complete recovery from his/her injuries or whether the injuries are permanent in whole or in part. In conclusion, in order to advise a client of ours as to what his/her bodily injury case is worth, we need the passage of time to occur so that we can make a full assessment of the above mentioned elements of damages after the injured person has undergone his/her medical care. Our experience in valuing cases for settlement purposes is extensive as our firm has been operating since 1965. As I Look back over the past ten years and how this magazine, which began as a newsletter, has changed and I am amazed. One of the biggest changes has been the website and how it has developed. I’ve put a lot of work in this magazine and the website. In the early days I was getting so many requests for classified listing and posting’s for my calendar of events that I’ve had to streamline it to save time. From time to time I come across someone that does not understand or use the internet and they are upset that I’ve relied on the website to expand the magazine and keep you up to date. By making it easy for you to post your events into my calendar or list your bike or just about anything you want to sell it has saved me a lot of time. The Calendar of Events on my site gets so many listings that we have more event listings than all of the other magazines in this market and it’s one of the most active pages on my site. I no longer accept mailed in calendar or classified listings because I’ve made it easy to go to the web and do it yourself. If you’re not too familiar with the web I’m sure that you know someone that can help you with your listing. Call me and if I’m available I’ll even walk you through it. There will come a day when the cost of printing and distributing this type of magazine will get too expensive and I don’t want to be left behind, that is why I spend so much time developing my website. In fact, every month I have more people going to my website than magazines I print so I must be doing something right. Whether it’s print or online, the East Coast Biker keeps you informed on what is happening in the motorcycle community. I’ll see you on the road. 2012 Lehigh Valley Community Benefit! WOW! The Lehigh Valley Community Benefit Committtee did it again. on June 16TH as I stood in the parking lot you could hear the sounds of a siren, you saw flashing lights and then all you heard was the roar of thundering bikes pipes as the group of over 300 came into the parking lot. It was breath taking and sent chills through your body. Watching them as they were directed to park it was hard to explain the emotion and excitement to witness the support for families of the Lehigh Valley area! If you were there you know what I’m talking about. I get chills thinking about it as I write. It was just an awesome event from start to finish. They had so much food and desserts that I can’t even mention them all. The Beer truck was busy all day long. This was a Family friendly event that had the childrens area separate from the adults. There was so much to do for the kids, games, face painting, tattoo’s, balloons created by “Huffy” and so much more. The adults had a spinning wheel, 50/50 and so many prize baskets for drawings. The bands played all day long and kept people dancing and tapping their feet to the beat. If you missed the event shame on you. If you were there you know what I’m talking about and will be back next year! The Committee for the Lehigh Valley Community Benefit (Rick Nauman, Tricia Brown, Cory Chryst, Chris Hickey, Brent Hugo and Chris Wittik) would like to thank the many volunteers, all local communities and the local businesses who donated time, money and product to make this event succesful. I’d like to recap some number’s for you and who the event helped. There where over 300 bikes on the ride and more than 1,100 people attended. More than $20,000 was raised from this event. The money will be distributed between the five families chosen. The boro of Northhampton Fire Police, the Lehigh Township Fire Police and the Tri-Boro Sportsmen’s Club would like to give a special thanks to the club for supporting this event 3 years in a row! Thanks to the bands that donated time; Lou Franco Project, Smith Compound, Ricky Smith and the Crush, Hoozya Daddy and Social Call. I just want to mention that Social Calls one menber (Larry) left his Daughter Mandalyn sing a song and it was Awesome. Tri-state riders took the heat in stride as they hit the road to enjoy what was happening in June. Actually, two opportunities to travel out of the area attracted riders in June. The eighty-Ninth Progressive Laconia Motorcycle Week took place in Laconia, NH from June 9-17. The event featured vintage racing, hill climbs, flat track races, tours and many vendors to find a great deal. To help women with breast cancer, the ride across Maryland to Ocean City, MD took place from June 2-4. The annual Pennsylvania Rally on the River took place in Northumberland, PA on June2nd. The event was held to help Eli Matthews. It included a motorcycle show, live band and door prizes. A motorcycle ride to support the Chester County Hero Fund was part of West Chester’s Super Sunday on June 3rd. The ride ended at Benny’s Pizza in West Chester, PA after a 60 mile bike ride through southern Chester County. Tri-State HOG was busy in June. On June 3rd Charlie Dresden, the club’s Road Captain, led a group to the White Rose Motorcycle Club to see the AMA Pro Racing Hill Climb in Spring Grove, PA. The group left Kennett Square and arrived at Spring Grove around 12:30 to watch the bikes try to beat each other’s time up the hill. Bad Alman led members of the club to Brian’s Harley-Davidson in Langhorne to participate in Bucks County HOG’s annual covered bridge run on June 10th. On Father’s Day, June 17th, Charlie Dresden organized a breakfast ride to the Pottstown Diner followed by a tour of Berks County. The group returned to Hannum’s Harley-Davidson in Media in the afternoon to allow time for Father’s Day family celebrations. In an e-mail addressed to the club, Dresden stated that “In the spirit of Million Mile Monday” he led club members on an ice cream ride from the Granite Run Mall in Media on June 26th. The Keystone Chapter of Women on Wheels held three rides in June. Julianne Yarwood, the Chapter Director, led a group of six people to Bill’s Bike Barn in Bloomsburg, PA on June 10th from the WAWA on Route 100 north of Smaltz’s Harley-Davidson in Eagle. Marge B led a group to the Joanna Furnace in Morgantown to see a car cruise and motorcycle show on June 16th after the monthly chapter meeting at Smaltz’s Harley-Davidson. On June 30 the group also went on a ride to Michaels, MD. The Delaware County Motorcycle Riders were busy in June. Rides took place on the weekends and on Mondays and Thursdays during the week. Groups of riders took trips to places like the Glen Rock Mill in Glen Rock, PA. A group of 47 stated on the club’s website that they rode their motorcycles to work on June 18 th which was Ride to Work Day. July heated up in the tri-state area as local riders kept their cool.

It began in 1995 when Joe Snyder retired as an equipment operator but he wasn’t ready to sit around and watch the world pass him by. He took his passion for motorcycle and began Snyder Cycle. He wanted to do it his way, the way things used to be when you took pride in your work and your customer was more than just cash on the bottom line. “I’ve got a reallly good reputation for making things go fast,” says Snyder. Looking at some of the work sitting in his shop makes you think that this guy must know what he’s talking about. Bikes sitting on stands, tools out and ready to work. He prefers to work on V-twin motorcycles and he can customize your ride or build you a bike from the ground up. They have their own paint shop so they can do everything that is needed on site. Featured on this months cover is a ‘75 Shovelhead that was a basket case when Joe got it. He worked on the bike with his son David, who spends a lot of time in the shop with his Dad, and you can see the end result is a work of art. David works at Faulkner’s Auto Body in Allentown but you don’t have to coax him much to do some work with Dad. He has also worked in the pit crew with Dean Commonall (salesman at Schoch HD) working on his top fuel drag bike. David’s wife Sherry rides her own 2011 HD Sportster 48. This is a family business where Joe’s daughter Kati, age 17, has been in the shop since she could walk and she doesn’t mind getting a little grease on her hands. For this months cover we are featuring Andrea Barrasso, a former contestant for Miss East Coast Biker and I’ve been waiting for some time to get this shoot done. Andrea loves riding Harleys and horses! “I’ve learned that life can hurt a lot and you need to focus on what gives you strength”, Andrea says, and she gets her strength here. She has four beautiful children that keep her
plenty busy but we’re glad that she’s taken time to be on this months cover. Snyders Cycles is a little out of the way but you’ll enjoy the ride getting there. OBITUARY Robert “Sideshow” Barrett
Born in Jersey City, NJ on Jun. 29, 1964. Departed on Jul. 5, 2012. Resided in Westville, NJ. Robert M. “Sideshow”, of Westville, died on July 5, 2012 at the age of 48 years. “Sideshow”, as he was affectionately known, was a generous, helpful guy with a great smile and sense of humor. He was there to lend a helping hand to anyone who asked and had a way of taking over a situation and making it seem effortless. A good day for Sideshow was anyday riding his Harley with Monica on the back. They enjoyed their long road trips on the bike and made it an annual event. He also enjoyed cooking, NASCAR and had a soft spot for any animal that “found him.” Born in Jersey City, NJ, Sideshow was a resident of Westville for the past eight years and prior to that lived in Woodbury. He was a wire technician with Comcast Cable for 20 years and a Mason with the Florence Masonic Lodge of Woodbury. Farewell Service and viewing were held at the McGuinness Funeral Home, 34 Hunter Street in Woodbury, where the Farewell Service followed.

With virtually every new claim my office takes in, at some point there is a discussion about if and when we are forced to file a lawsuit, which county would be the best for a motorcycle accident case to be filed?

Most clients, after hearing my typical speech about which counties will return the highest verdict for someone injured in a motorcycle accident, understand that in Pennsylvania, the best counties to file a lawsuit are generally Philadelphia and Alleghany counties and in New Jersey, generally, most of the northern counties, given their proximity to New York, usually return the highest verdicts. However, the law generally restricts where we are allowed to file suit.
After giving this speech to current and former clients for well over twenty years, many still have difficulty understanding it, because as they ride their motorcycles, they see many other bikes on the road and it leads them to believe that if they do end up facing a jury trial, the pool of potential jurors will be filled with other motorcycle riders. However that is rarely the case. In many of the jury trials I have been involved with over the years, you would be surprised that a majority of the people sitting on the panel have never been on a motorcycle, nor do they have any desire to ride one, and therefore we generally end up with a jury panel of between 8-12 people, most of which don’t have much sympathy for an injured biker. A perfect example can be observed in local counties such as Montgomery, Chester, Delaware, Lehigh, Northampton and Bucks. If you go for a ride, you will see motorcycles on almost every street which may lead you to believe that if a jury trial becomes necessary, those are the “peers” you are going to see waiting to be selected to sit on your jury. However, the reality is that most of the individuals that get selected to serve on the jury have never operated a motorcycle and carry with them the negative feelings about those who enjoy riding, believing that there is an inherit risk that comes with operating a motorcycle. Although Pennsylvania is fifth in the number of registered motorcycles with almost 900,000 bikes licensed and registered, when you compare that number to the number of residents that are over 18 and are eligible to sit on a jury panel, you quickly come to realize that most of the potential jurors do not ride a motorcycle. If you factor that in along with the state of our overall economy, your going to find that most juries are not looking to award large amounts of money to an individual who is complaining about neck or back pain unless there are substantial residual injuries from surgery or loss the loss of the ability to work. The bottom line is, “The Best” cases settle out of Court and unfortunately cases where there is a question as to liability and/or the severity of the injuries are the ones that end up in front of a jury. Fortunately, given the types of motorcycle accident claims that we handle, we have been extremely successful in settling a large majority of our clients’ cases well before trial ever becomes necessary. Dean’s Harley-Davidson celebrates mile mark Story & photos by Norm Keller
You could say that longevity and good customer service go hand in hand. Perhaps that is why Dean’s Harley-Davidson has been going strong since 1947 when Frank & Peg Dean founded the dealership. Although Frank and Peg are no longer with us the business continues with Frank “Bud” Jr. keeping the family business alive. This dealership that started in a chicken coop in Kulpsville recently moved to their new location on State Road off of Route 309 in Souderton. In June they held an open house/birthday party to celebrate 65 years of servicing Harley-Davidson’s. The event was well attended with customers and friends coming to wish them well as Randy Ziegler (seen top right) was on hand to keep things moving along. The Indian Valley HOG Chapter sponsored by Dean’s was on hand to lend support with a bake sale of some of the most delicious looking pastries you could imagine. They also raffled off a quilt made from T-shirts from dealerships throughout Pennsylvania. As I talked with people thier love for this family run business was obvious and they offered well wishes for many more years. I’d like to wish them another 65 years but I’m afraid that I won’t be here to celebrate that one but I would like to be here for their 90th. I hope to see you there.

Indian Valley beats Lehigh Valley in softball challenge Story & photos submitted by Rich Lanning
On June 16th two HOG chapters met on the battle field at Southern Lehigh Memorial Park. The challenge was the first annual HOG Softball Tournament. The winners would have bragging rights for the year, and the losers would have to pay for the rental of the field. Lehigh Valley won the coin toss and came on strong with some impressive hitting and taking the lead in the first 3 innings. However, Indian Valley found their groove and started a rally of hitting and making some great plays. When the dust settled, the final score was Indian Valley 13 and Lehigh Valley 5. After the game everyone filled up on hamburgers, hotdogs, salad and desserts supplied by both clubs and their members. This was a fun day for everyone involved, and maybe with a lot of practice, next year a Lehigh Valley member can submit this article. LOL, Rich Lanning EDITORS NOTE: Now here is a challenge.
