Hi Future Friesian Owner!!! :) We are so excited to meet you, and welcome you to the Ebony Park Family! At Ebony Park, our mission is to help all Friesian lovers with a dream - to own a Friesian - and to make that dream a reality. In the coming pages, you will meet out much loved mares, and our impressive list of stallions. Every single horse here has been hand picked for excellence in the dressage arena, as well as temperament. To us temperament is everything, and all our Friesians are kind, loving and gentle horses, as we think trainability and temperament are the most important things to look for in a horse. This being said, every single mare and stallion is different, with their personality shining through. It’s our job to match your personality with the right horse, so you can have a great connection with your dream Friesian. You can read about some of our many Ebony Park Family members, who have successfully gone through the in utero dream experience, and are very happy with the outcome. Welcome to the Ebony Park In Utero Guidebook Hi and welcome to the Ebony Park Friesian Dream Guidebook for 2014! I am so excited you are reading this and really look forward to meeting you in person, and helping you move forward in creating your Dream Friesian. I understand it can be overwhelming at times, and there is a lot of information coming to you. That’s why we have created this resource for you, to hopefully answer every question you have, and to help you make an informed decision moving forward so you can ultimately achieve your dream friesian. There are only 3 decisions you need to make! 1. The first thing you need to do is to decide what you want out of your Friesian - is it for dressage, showing, pleasure? What height and type would you like? Preferred temperament? And were you looking for a purebred Friesian or a partbred?
Once you have made those decisions, and perhaps come out and visited the stud to check out all the mares and stallions, as well as their progeny, we can get the ball rolling! Once we have processed your contracts and received your deposit or organised a payment plan on the deposit (we are fairly flexible!) it’s just a waiting game! To make the waiting for your foal more bearable, we have a special gift coming your way, as our way of saying thank-you for trusting us with your Friesian Dream! Please do not hesitate to call or email with any questions you might have. Ebony Park Abe
Abe is currently competing and winning at the Grand Prix level in 2012 and 2013 with consistent scores over 61%, improving with each competition! Early in his career Abe was the horse to beat in Novice bringing home 3 Novice Championships with scores up to 71%. He also took home an Advanced Championship in 2008 and competed and qualified for the prestigious Dressage with the stars in the Grand Prix in 2012, and the Grand Prix and Grand Prix Kur in 2013. Abe is now establishing himself in Grand Prix and he hasn’t disappointed. Abe is now established in the Grand Prix movements and hasn’t disappointed. This horse is destined for a legendary Grand Prix career. Ebony Park Abe is an exceptional stallion to ride. He is powerful and responsive and carries you through any situation with pride and attitude.
To ride him is pure joy! He is solid, strong and powerful! Abe takes you into a test almost like a war horse taking you into battle. He is proud, noble and loves to show off and be the centre of attention.

Ebony Park Abe
Progeny Profile:
Ebony Park Jorrit Jorrit is an exceptional dressage stallion that made it through to the very prestigious 70 day performance test for approved stallions. In the performance test in Holland, Jorrit was within days of being approved as a stallion but a muscle strain hindered his movement and was unfortunately eliminated late in the test. He was also awarded a breeding permit from the KFPS when they came out for the 2013 Keuring. This is only awarded to very select Friesian stallions who possess the desired characteristics of the breed. There are only a few Friesian stallions in Australia Born 12/05/2003, 16.2hh, Jet Black that hold a current KFPS permit, and Ebony Park is imported Friesian ster stallion very proud to offer Ebony Park Jorrit to the discerning Friesian breeder. Ebony Park Elko
Unfortunately, due to a paddock injury to his knee, Elko is no longer able to be ridden, and has been retired from the competition arena. Ebony Park is extremely disappointed and upset by this incident, however we are very happy that he is still able to be bred, and has still retained his breeding permit (not something to be taken lightly, as the KFPS are very strict about awarding breeding permits!). When Elko was able to be ridden he was destined to be Natasha’s Olympic Grand Prix horse. He had everything! Three amazing paces, the desire and trainable temperament, and was quick to learn and improve. In his short career he scored up to 72% in preliminary and gained 44 grading points qualifying him for the 2006 Australian Dressage Championships in Novice in only 2 months of competition.

Ebony Park Dante Dante is by Champion dutch stallion Norbert 444, who has won the prestigious Friesian Stallion Show in Holland for the last 2 years in a row – 2012 and 2013. We imported his gorgeous mother, Ebony Park Jantje from Holland, and within 2 months of his birth, Jantje was competed by Natasha, with three floating paces and one of the easiest horses to ride! Dante looks to be a superb mixture of sire and dam – he is solid, strong and powerful, at the same time being easy and willing to train. Natasha says this stallion is the definition of ‘easy’ – you get on and do nothing, and the horse performs exactly how you want underneath you. To handle he is quiet and obliging. He has great bloodlines and breed potential, and we can’t wait to breed him for the first time this year for some gorgeous foals in 2014! Dante was competed for the first time in February 2013 in Preliminary dressage – and what a superstar! It was his first time out ever, and he took it all in his stride, coming home with over 62%! We can’t wait to see what he does in the future on the dressage arena!

Success Stories
Success Story: Snow White of Ebony Park with Gabbi & Dion one special little girl. Snow White, the newest addition to our collection! Having met her back in December when she was only a few weeks old, the chance to hang out with her and her Mum, Kirsten, was something I will never forget.
For two months I had the honour of feeding 34 of Ebony Park's finest at their Garfield farm. Getting up at 6:30am everyday to brave 1 degree frosty mornings may not be everyone's cup of tea - but it sure was mine! That time of the morning is so peaceful, with the sunset rising, fog clearing and frost melting. Ginger and I would cruise around in the Polaris, Bluey out in front, Ebony miles behind and deliver the food to all the horses! There was a strict hierarchical order to keep to, otherwise all hell broke loose! One of my favourite moments was when we put Anika and Victoria together, in the same paddock! Forget Rudd and Abbott this was the biggest power struggle of the year! All of the horses had their own personalities from Fia constantly kicking her back legs out whilst eating (not nasty - just something that she does), to Amigo hating to get wet. Of all of them I had
The chance to feed her her first carrot, see her weaned, then watch her as she asserted her dominance over the other young foals, something Kirsten could never do with the other mothers, reassured Gabbi and I we were on to a winner. Apart from the horses, I also got to hang out and play golf with Ginger and Hans, which was also a privilege I will always cherish. But I think the greatest moment was seeing Snow White recognize me two months later when we went to pick her up that made it all worth it! -- Dion
Chapter Two: Choose Your Mare
Now we may have done this the wrong way around... choosing the stallion first... but perhaps now that you have chosen the stallion, or you have a couple in mind, you can pick a mare that will make the perfect match and create your Dream Foal! We have a number of mares to choose from - both purebred and crossbred, and they range in height and body type... so we will find you a combination that will suit your needs! The best part is! You get to pay the foal off over 4 years instead of three, which really brings the monthly repayments down and it really is the foal of your dreams! You can choose the sire (if the mare is not already bred), you can choose the name. Case Study: Onyx of Ebony Park and Michelle Gill I’m blessed to be the owner of the gorgeous Onyx of Ebony Park.
We also practice running in hand and standing square in prep for some shows one day.
He is currently 16 months old, 15hh and is by the wonderful Jorrit out of Victoria whom is by Abe.
He is learning some tricks and has aced "fetching" things. Next he will learn to bow and lay down, so stay tuned for that one! (there’s a video on his Facebook page!)
So I’m very lucky to have Abe and Jorrit in one divine package, how cool is that!! :) :) When Ebony Park asked me "what would you like in your dream horse?" i remember saying some key things, "intelligent, built uphill and a bit of spark" well, that’s exactly what I got! Goes to show they know their stuff when helping breed and design dream horses - I couldn't be happier. I remember the day he was born (Jan 2012) and the text from Kate in the wee hours of the morning, “it’s a boy, congratulations!!!” I brought Onyx home around Sept 2012... best feeling ever when the truck pulled up in front of my house and this brave little yearling stepped down, I was so overwhelmed and tears of joy ran freely (well it’s not everyday a friesian turns up on your doorstep!). Onyx is currently just chilling and growing at home, and should be heading out for a spell at the start of spring. He is also having an angle float made to suit him, and it will be in black and gold... his planned show colours, finally we will have wheels, exciting stuff! We are hoping his float to be finished in a week or two and we are so excited to get out and about to clinics! As for now, we go for walks to the park and as out and about as we can get on foot.

Onyx is currently sporting a lovely winter beard but is still a handsome young man (of course!) He has truly captured my heart, he wants nothing more than to be near me and will leave food and buddies just to come and hang out and see what I’m doing... he is kind, trusting and is constantly nickering and talking to me, love him!! I’m finding the journey thus far incredible, I'm learning so much from him and he is making me grow so i can become everything he needs me to be to ensure he grows up a well mannered young man. He is starting to realise he is a boy... so this in itself ensures I rise to the challenge - I'm constantly learning that’s for sure. I am forever grateful to Ebony Park for the opportunity to own Onyx and find that they are always there, from day one, to help and guide me on my first friesian journey. I must add, I'm finding friesians are like chocolate, you can never have just one.... ;) I’m very excited about our future together, and our plan is to ride Grand Prix one day, so stay tuned.... :) - Michelle Gill

Ebony Park Gjanna is a magnificent, strong-willed mare that has shown a lot of potential in dressage – she has competed to the Elementary level, with scores over 66%. She stopped competing late 2009, a few months before giving birth to her first foal, Deja Vu of Ebony Park. She is now doing a great job breeding the next Friesian superstars! However, as you can now see, she is a lovely 7yo mare, she is strong and healthy, and has the pride and carriage of her sire, Ebony Park Abe, coupled with the gentle nature of her dam, Ebony Park Famke. We are very proud to have her as part of our stud, as she is the only purebred progeny of Ebony Park Abe so far. Success Stories “For as long as I can remember I have dreamed of owning a Friesian and now, thanks to Ebony Park, I am the very proud owner EP Diamante (born October 2012). My journey with Diamante began in December 2011 when I selected Elko and Dazzle to breed my dream baby. Dazzle and I were pregnant at the same time, so when I visited her the week before she was due, I sympathized with how big and uncomfortable she looked. Still I think she knew I was pregnant as well because when she cuddled up to me, she was being extra gentle and careful around my tummy. The night Dazzle went into labour I was so excited that I could hardly sleep! Kate kept me updated on her progress and by morning we were rewarded with a gorgeous filly with long legs. She was such a sweetie and at just 6hrs old, she was happy to dish out the cuddles for me. Since then I have had the pleasure of watching Diamante grow and develop a cheeky personality. She has a thing for the boys, which was evident when I took my husband to meet her – I got dumped while my husband was lavished with all her attention. She has inherited her dams sweet cuddly nature along with the typical Friesian curiosity and is going to be so much fun to train. At the moment she will be staying at Ebony Park playing and growing with the other babies while I pay her off, but I can’t wait to bring her home. I’ve been inspired by the other EP horse owners to give Diamante many different experiences and adventures while she’s a baby and am looking forward to spending lots of time with her.” - Maxine

The Carrock Zip was purchased by Natasha as a weanling, and has been nothing but a joy to handle and watch grow. She has beautiful foals with lovely movement from both sire and dam’s sides, and all inherit the easygoing and friendly nature of their dam. Generally Ebony Park retains Zip’s foals to see them on the ground first (we like to have first dibs!) but we have decided to offer Zip’s 2015 foal on one of our payment plans (her 2014 foal has already been sold) – click here for more information!!

EP Anika is a 7 year old Friesian x Thoroughbred mare. She is an honest, smart filly who is very willing to learn. She has inherited a lovely trot and spectacular canter, and we expect big things from her offspring in the eventing world!! Anika is a fairly recent addition to our crossbred breeding program – she was broken in and ridden for a year when she was 4 – she is calm, unflappable and effortless to ride at home and in new situations. She is by Grand Prix Dressage Friesian Stallion Ebony Park Abe who is winning at Grand Prix level dressage, and has inherited her fathers boldness and confidence. She is out of a lovely thoroughbred mare who had the sweetest nature and passed this trait onto all of her offspring. She is very lovely and forward to ride and very trainable. Already starting leg yielding and shoulder-in, it was decided she would be a great addition to our broodmare band to produce 3/4 Friesian foals!

Fia is one of only a handful of non-Frieisan mares we have here at Ebony Park! She is an impressive warmblood mare who throws her height and beautiful personality to all of her foals. She has produced five gorgeous foals here at Ebony Park, with three of them at their new forever homes, and two of them being retained by the stud.

We insure the foal as soon as it is born - so the vet comes out and does an insurance exam, which includes taking bloods to test IgG (antibody) levels in the foals blood, and checking the foal all over to make sure it is in good health. This costs around $200. Insurance depends on the price category of the foal and ranges between $725 - $2,500 per year (around $60 - $210 per month). Agistment is added once the foal has been weaned at 6 months of age, and includes everything (farrier, feeding, worming, vaccinations etc.) except vet bills. Agistment is currently $249 per month. Monthly payments are calculated monthly over 4 years (48 months) and are displayed in Australian dollars. Generally this is from when the mare is bred and confirmed 14 days pregnant, to when the foal turns 3 years of age and is ready to break in.

Chapter Four: Contracts Hi Fabulous Friesian Lovers!! Are you feeling overwhelmed yet? Please let us know if you have any questions, or if it is all getting too much for you - we are here for you! On the following pages are the sample contracts for our in utero payment plans. They apply to all of the foals put on an in utero plan - we just need to fill in the relevant blanks!! So have a read through the pages (I know, contracts are boring, but they are important!) and come back to us with any questions or concerns you have! Please don’t fill in the form just yet - we will tailor it to the mare and stallion combination that you have decided on! After the sample contracts, there is a reservation/intention form - make sure you fill this out and get it back to us to reserve your foal so that you don’t miss out on the foal of your choice! Please note: if you have decided that a purebred Friesian is the way to go, please be aware that if you decide to become a member of the Friesian society or ANZFHS (Australia and New Zealand Friesian Horse Society), you need to register yourself as a member, and there are a number of rules that you need to follow such as in the naming of your foal eg. A horse born in 2014 has to have a registered name starting with P, Q, R or S. A Horse born in 2015 starts with T, U or V, and a horse born in 2016 with the letters W, X, Y or Z... and so on. Ebony Park is a member of the ANZFHS, but we don’t demand that you register your purebred friesians with the society if you don’t want to - it all comes down to what you want our of your foal! CONTRACT FOR 20 FOAL OUT OF MARE “

1. Ebony Park agrees to breed our
(breed) mare, known as “ ” to an Ebony Park stallion of the purchasers choice (Ebony Park Elko, Ebony Park Jorrit, Ebony Park Abe, Ebony Park Dante).
2. E b o n y P a r k a g r e e s t o s e l l t h e r e s u l t a n t f o a l f r o m t h i s b r e e d i n g t o
(the purchaser) for the amount of $ 3. The purchaser agrees to purchase the foal regardless of sex, colour or markings. Please
note that although Friesians are not ‘supposed’ to have any white marking on them except for a ‘thumb-sized’ white star, it is possible for white markings to happen (eg. white feet) - the purchaser agrees that this is a risk that can occur with an in utero payment plan, and agrees that regardless of how the foal turns out in terms of colour and markings, this is the foal the purchaser has agreed to take. 4. The purchaser agrees to pay Ebony Park a deposit of $
(10%) upon
signing this contract for the resultant foal. 5. Once the mare, “
”, is confirmed to be 16 days pregnant via ultrasound examination, the purchaser agrees to pay Ebony Park $ over the next 48 months. If the mare is confirmed pregnant after the 15th day of the month, the first payment is due on the 1st of the next month. If the mare is confirmed 16 days pregnant before the 15th day of the month, the first payment is due that day, and then the second payment due on the 1st day of the next month (i.e. 10th January confirmed 16 days pregnant - 1st Payment due now, then second payment due 1st Feb OR 18th Jan confirmed 16 days pregnant - 1st Payment due 1st Feb)
6. The purchaser understands that buying a horse on an in utero payment plan has certain
risks. The resultant foal might have more white than is desired on a Friesian; the mare may not fall pregnant that season; the mare might lose the foal between 45 days and term; the foal might die when it is born. The purchaser understands that all of these situations are unfortunate for both Ebony Park and the purchaser, but are out of Ebony Park’s control. Ebony Park does everything we can to minimize these risks as much as possible, and produce healthy strong foals, but the purchaser is aware that they can happen, and understands this is not the fault of Ebony Park should they occur. 7. In the small percentage of cases where the foal is lost after the 45 day pregnancy confirmation, another foal can be substituted if available, a refund organised (minus a $500 administration fee), the mare bred again if possible, or a substitute mare bred such as the daughter of the chosen mare if possible. In the event of this occurring, this contract will be terminated and a new one will have to be signed. 8. If the mare does not fall pregnant in the chosen breeding season, Ebony Park will breed her again the following breeding season for the purchaser. The purchaser understands that if this has happened in the previous season for another client, that their might be pushed back a season. Ebony Park makes every effort to ensure our mares are pregnant each season, but the purchaser understands that horses are not machines, and sometimes they do not fall pregnant. 9. In the event that the chosen mare or stallion dies or is sold before or during the breeding season the mare is due to be bred as outlined in the contract, the purchaser can transfer to another available mare or stallion. This will be at the discretion of the stud and will be subject to horse availability. In the event that a suitable substitute cannot be found and agreed on by both parties, a refund (minus $500 administration fee) will be given to the purchaser. 10. The balance of the purchase price ($ ) is to be paid off in full by the purchaser to Ebony Park by the time the foal leaves the property (generally 48 months after confirmed pregnancy of the mare, but there are no penalties for early full payment and pick up of the horse). 11. If the purchaser is unable to continue making repayments on the foal at any stage during the agreement, Ebony Park will not refund any payments already received. 12. Insurance: Within 48 hours of the birth of the foal, Ebony Park will arrange, at the expense of the purchaser, a veterinary examination of the foal and provide a veterinary report to the purchaser. This is for insurance purposes. In the rare case that a foal fails the veterinary examination (eg. IgG levels are too low and foal needs to be treated with plasma or another supplement, or contracted tendons need to be treated with drugs or splints), Ebony Park will pay for veterinary treatment rather than the purchaser. The treatment level will at the full discretion of Ebony Park. The basic mortality insurance that Ebony Park takes out (with IRT insurance) on the horse covers accidental death due to an accident, disease or sickness, and death during any kind of road transport in Australia. It also covers theft, and death as a result of fire.

13. The purchaser can choose to, at their expense, cover the horse for loss of use - IRT insurance covers 60% loss of use at a rate of 3.5% of the value of the horse per year. This cost is on top of the mortality insurance taken out on the horse. The purchaser can also opt to cover the horse for colic surgery which is charged at a flat rate on top of the mortality insurance. If the horse in question is a colt/stallion, loss of fertility insurance can be taken out on the horse, which covers for non-congenital events occurring to the horse which render the horse impotent or infertile - this is charged at a rate of 0.75% of the value of the horse on top of the mortality insurance. 14. Accident/illness or injury: If the horse becomes ill or injured while still under the agreed payment time the purchaser is responsible for all veterinary costs. 15. Other costs: Worming, vaccination and farrier costs are the responsibility of Ebony Park up to the time the foal reaches 6 months of age and is weaned. Ebony Park is not responsible for other veterinary costs arising from accidental illness and injury. Once the foal is removed from the property these costs become the full responsibility of the purchaser. In the event that Ebony Park considers that the foal needs veterinary attention, and if the purchaser cannot be contacted, Ebony Park may exercise its discretion as to the treatment of the foal. 16. All vaccine, worming, farrier and veterinary details will be documented by Ebony Park and provided to the purchaser. 17. Once the foal becomes the property of the purchaser, if the purchaser wishes to sell the foal/horse, the purchaser agrees that Ebony Park will be given the first option to purchase or assist in re-homing the foal/horse. 18. Appointments must be made to see the foal/horse while it remains on the stud. Any handling of the foal before it is fully paid for will be at the discretion of the stud, but no reasonable request to visit will be refused, if sufficient notice has been provided. Agistment Contract Once the foal has reached 6 months of age and is weaned, Ebony Park agrees to enter into an agistment contract with the purchaser, for the price of $249.00 per calendar month, including worming, vaccination and farrier costs, feeds, basic handling and vaccinations. Ebony Park is not responsible for other veterinary costs arising from accidental illness and injury during the period of the agistment. In the event that Ebony Park considers that the foal needs veterinary attention, and if the purchaser cannot be contacted, Ebony Park may exercise its discretion as to the treatment of the foal. Please note that if prices for feeds, farrier etc rise, the agistment costs over the payment plan time period may also rise – the purchaser will be informed of any changes in agistment costs. Agistment Terms and Conditions/Agreement 1.
Definition and Interpretation 1.1.
“Agistment Areas” means those parts of Land where Stock are being agisted and pastured from time to time;
1.2.
“Agistment Fee” means the fees set out in the Schedule, or as varied in accordance with this agreement;
1.3.
“GST” means any consumption tax imposed by government, whether at the point of sale or at some other specific occurrence, by whatever name, which operates during the Term of any renewal or overholding and includes (without limitation) a Goods and Services Tax, a broad based consumption or indirect tax or value added tax;
1.4.
“Land” means the land 15 Finlay Lane, Garfield, and includes any part of the Land;
1.5.
“Ebony Park” means either Althoff Nominees Pty Ltd or H & G.D Althoff, and includes its successors and assigns;
1.6.
“Owner” means the party named in the Schedule as Stock Owner and includes the Owner’s personal representatives, successors and permitted assigns;
1.7.
“Owner’s Agents” means the employees, agents, contractors, guests and invitees of the Owner;
1.8.
“Ebony Park” means the authority established under 1.5 and Part 2 and includes, where the context so admits, its authorized officers;
1.9.
“Stock” means the type and number of livestock described in the Schedule to be agisted and pastured on the Land, and includes any of them;

Agistment Agreement 1.1.
Subject to clause 9, Ebony Park agrees to take in the Stock to be agisted and pastured on the Land for the period starting from and ending on the dates set out in the Schedule.
1.2.
Immediately after the end of the term specified in the Schedule, this agreement will be Renewed for successive periods of three months on the terms and conditions set out in this agreement, until ended by either party giving the other one month’s written notice which may be given at any time.
Agistment Fee 2.1.
In consideration of Ebony Park taking in Stock to be agisted and pastured on the Land, the Owner must pay Ebony Park (Althoff Nominees Pty Ltd) the Agistment Fee.
2.2.
The Agistment Fee must be paid by the Owner to Ebony Park (Althoff Nominees Pty Ltd) monthly in advance, before the 15th of that month. If this agreement commences on a date other than those dates, a pro rata proportion of the Agistment Fee must be paid in advance on or before the date of this agreement for the period from the commencement date of this agreement until the next payment is due. After that time, the Agistment Fee will be payable by monthly instalments in advance on those dates unless otherwise stated in the schedule.
2.3.
If this agreement is extended under clause 2.2 2.3.1. The
Agistment Fee payable throughout the extended period will be payable in the same manner as in clause 3.2; and
2.3.2. Ebony
Park may alter the Agistment Fee after the end of the initial 3 month Period by giving the owner one month’s written notice of the altered fee.

Ebony Park has the sole discretion to determine from time to time the Agistment Areas;
1.3.
When required by Ebony Park, the Owner must immediately shift the Stock to another part of the Land as directed by Ebony Park;
1.4.
Unless otherwise agreed by Ebony Park, the gates to the Agistment area must not be locked by the Owner;
1.5.
Access to the Stock without vehicles is permitted at all reasonable times, but access to the Land by vehicles is not permitted beyond any loading facility provided by Ebony Park without prior written approval by Ebony Park;
1.6.
Arrangement for hand feeding Stock after normal hours are subject to approval in advance by Ebony Park.
Owner’s Covenants The Owner Must:2.1.
Produce on demand to Ebony Park, sufficient written evidence of the Owner’s ownership of any or all of the Stock;
2.2.
At the owner’s expense 2.2.1. Properly
and efficiently tend and care for the Stock to the satisfaction of Ebony Park and in accordance with accepted methods of agistment and practices in the area in which the Land is situated;
2.2.2. Comply
with all legal requirements and all reasonable directions of Ebony Park personnel with respect to the tending to can caring for the Stock; and
2.2.3. Comply
on time and with all laws and legal requirements concerning the tending and caring for the Stock on the Land by the Owner;
2.3.
Ensure that the Stock are accustomed to electric fences which Ebony Park may in its discretion use around Agistment Areas;
2.4.
Ensure that no Stock are ridden or exercised in the Agistment Areas or elsewhere on the Land unless otherwise agreed to by Ebony Park, in areas clearly delineated for that purpose;

2.
1.
Not permit anyone else to ride or handle Stock on the Land – the Owner agrees that Ebony Park will not be held liable in the event any illness, injury or death caused by any Stock on the Land to the Owner the Owner’s Agent;
2.
Remove any dead Stock from the Land within 24 hours of being notified by Ebony Park;
3.
No do or permit to be done anything which is or may be a nuisance of annoyance to Ebony Park or any persons allowed by Ebony Park to use any other part of the Land;
4.
Not bring any equipment, apparatus or other property belonging to the Owner on to the land without prior written approval of Ebony Park;
5.
Not bring any hay onto the land without prior approval of Ebony Park;
6.
Not bring or allow to be brought onto the Land any dog; and
7.
Not bring or consume or allow to be brought or consumed on the Land any alcohol.
Dangerous or Diseased Stock 2.1.
The Owner must not allow any dangerous, injured, sick or diseased Stock to graze on the Land;
2.2.
If the Owner becomes aware of any Stock becoming dangerous, injured, sick or diseased, the Owner must immediately notify Ebony Park and provide Ebony Park with such information concerning the Stock as may be required. Ebony Park may then in its absolute discretion require the removal or veterinary attendance of the Stock from the Land;
2.3.
If Ebony Park becomes aware of any stock becoming diseased, injured, sick or dangerous or likely to become so, then: 2.3.1. Ebony
Park must make reasonable efforts to notify the Owner; and
2.3.2. In
the event of an emergency, or if the Owner cannot be notified, Ebony Park will be entitled to call in a veterinary surgeon and all costs incurred will be borne by the Owner or reimbursed to Ebony Park within seven says of demand.
2.4.
If as a result of any of the Stock becoming diseased or dangerous, the Stock must be slaughtered, or the Land cleaned up, placed under quarantine or decontaminated in any way (the “Clean Up Exercise”), the Owner must:2.4.1. Observe
all directions of, cooperate with and assist Ebony Park and any persons nominated by Ebony Park in the Clean Up Exercise including the removal of dead Stock from the Land; and

Be responsible for all costs connected with the Clean Up Exercise and reimburse Ebony Park for all costs expended by Ebony Park associated with the Clean Up Exercise.
Insurance 2.1.
The Owner must not do anything on the Land which may cause:2.1.1. Any
policy of insurance affecting the Land or any property on the Land to become void or voidable, or prejudiced in any way; or
2.1.2. Any
claim on any policy of insurance affecting the Land or any property on the Land being rejected or a premium to be increased.
3.
2.2.
If the Owner causes an increase in premiums payable by Ebony Park for any Insurance affected by Ebony Park for the Land of any property on the Land, the Owner must pay Ebony Park, on request, the difference between the increased premium and the premium payable before the increase.
2.3.
The Owner must comply with the requirements of any insurer under any insurance for the Land or any property on the Land (whether effected under this agreement or otherwise).
Release and Indemnity 3.1.
The Owner accepts all risks for injury to or death of Stock as a result of any event, accident or illness.
3.2.
The Owner hereby releases Ebony Park (Althoff Nominees Pty Ltd and/or H & G.D. Althoff) and their servants, agents, contractors and invitees from all liability, for any legal liability, loss, damage, injury or illness including death, sustained or incurred by the Owner, the Stock or any of the Owner’s Agents arising in any way from the agistment or pasturage of Stock on the Land or any escape of Stock from the Land. However this clause does not apply in respect of any liability arising out of any negligent or unlawful act or omission of Ebony Park, its servants, agents and contractors or invitees.
3.3.
The Owner indemnified Ebony Park and its servants, agents, contractors and invitees against any legal liability, loss, damage, claim or demand which might be made or suffered by any person or body for injury, loss or damage arising in any way form the agistment or pasturage of Stock on the Land or any escapees of Stock from the Land. However this clause does not apply in respect of any liability arising from any negligent or unlawful act of Ebony Park, its servants, agents and contractors or invitees.

1.
Breach of Agreement 1.1.
If the Owner:1.1.1. Breached
any provision of this agreement; or
1.1.2. Does
not act immediately in accordance with the directions of Ebony Park in regards to the Stock as provided in this agreement,
Then Ebony Park will be immediately entitled to:1.1.3. Take
all steps necessary to remedy the breach without notice to the Owner, and/or
1.1.4. Terminate 1.2.
2.
this agreement by written notice to the Owner.
If Ebony Park takes steps to remedy any breach by the Owner, all costs incurred by Ebony Park must be borne by the Owner. The Owner must also pay Ebony Park reasonable compensation to Ebony Park’s satisfaction for the breach.
End of Agreement Upon Termination of this agreement, the Owner must:-

Return all keys to the gates to the Land to Ebony Park; and
2.2.
Remove all Stock and any property belonging to the Owner from the Land within seven days.
Lien on Stock The owner grants Ebony Park a lien over the Stock as security for any moneys owing by the Owner to Ebony Park under this agreement. If the Owner does not pay to Ebony Park any monies owing to Ebony Park within seven days of demand by Ebony Park, Ebony Park will be entitled to sell the Stock in any manner and at any such price as Ebony Park in its sole discretion thinks fit. Any surplus monies after recoupment of all costs to Ebony Park, will be refunded to the Owner.
4.
Indemnities Each indemnity in this agreement is a continuing obligation, separate and independent form the other obligations of the Owner and survives expiry or termination of this agreement.

Antecedent breaches and obligations The expiry or termination of this agreement does not affect:-

1.1.
Ebony Park’s rights in respect of a breach of this agreement by the Owner before the expiry or termination; or
1.2.
The Owner’s obligation to make any payment under this agreement before the expiry or termination.
No Assignment 2.1.
The rights granted to the Owner under this agreement are personal and must not be assigned by the Owner. Without limiting the effect of this clause, the Owner’s rights under this agreement cannot be assigned upon change of ownership of any of the Stock.

Veterinary Treatment In the event that a staff member at Ebony Park notices that a horse has an injury, every effort will be made to contact the owner so that a decision can be made in regards to treatment. In the event that a) The owner cannot be contacted, or b) Ebony Park makes a decision that the injury is serious enough to need the vet, a veterinarian of Ebony Park’s choice will be called the treat the horse. This will be at the discretion of Ebony Park. Ebony Park will take no responsibility veterinary fees, either immediate or ongoing, for any injuries occurring to horses agisted on the property. If the owner is not able to attend while the vet is examining the horse, the owner agrees to pay a veterinary assistance fee to Ebony Park. If there are ongoing treatments needed, or the horse needs to be stabled for a period of time, Ebony Park staff need to be informed in advance (as far as is possible), as to the type and length of treatment or stabling.

Agreement to Insure We agree to insure the horse being purchased on a payment plan with Ebony Park, for the full purchase price as organized by Ebony Park. This insurance cost can be split up into monthly repayments, but please note in the event that the horse is paid off early and taken home, the full year of insurance will also need to be paid in full, as partial payments of insurance are not accepted by the insurance company. The insurance costs have been quoted below: First Year (when the foal is born until the foal is 1 year of age) = $ monthly payment of $ per month).

Please note that a vet check will need to be performed for insurance purposes. The approximate cost of this is $200.00, and payment will be the responsibility of the purchaser. This veterinary exam for insurance is to check that the foal is in good health, and involves taking blood from the foal to check immunity (IgG/antibody) levels. Yearly costs for insurance after this time will drop or stay the same (as the horse is older). Second Year (when the foal is 1 year old until 2 years of age) = $ (this can be split into monthly payments of $ per month). The third year of insurance is generally the same as the second year of insurance.
