SECTION II: OBJECT OF THE CONTRACT II.1) DESCRIPTION II.1.1)

Title attributed to the contract by the contracting entity Supply of electrical energy for grid losses.

Type of contract and location of works, place of delivery or of performance Supplies Purchase Main place of delivery The delivery point for this electrical energy is the Belgian "hub" i.e. a non-physical spot where electricity can be exchanged between ARP’s (cfr. II.1.5) through internal energy transfers as defined in the "Access Responsibility Contract" (cfr. II.1.5). To reach this spot, an ARP can either: import this electrical energy. Therefore, it has to obtain capacity on the Belgian Northern or Southern border in accordance with the access responsibility contract, and this at its own costs. Produce this electrical energy in Belgium and this in accordance with the access responsible contract. Buy this electrical energy from (an)other ARP(‘s) on the "hub" A combination of the possibilities mentioned above.

Short description of the contract or purchase(s) Elia, in its capacity of officially designated grid operator for its networks with a voltage 70 kV in Flanders, Wallonie and Brussels, intends to conclude with one (or several) ARP(‘s) ( "Access Responsible Party") an agreement for the supply of electrical energy in order to compensate the losses generated by the distribution networks under Elia’s operation. A party approved by Elia as an "Access Responsible Party" or "ARP" is a party validly holding an "Access Responsibility Contract". This party can be a supplier, a consumer or a third party.

The Access Responsibility Contract mainly concerns the balancing responsibilities of an ARP on the network.

Other particular conditions to which the performance of the contract is subject Yes As mentioned in II.1.5, the supplier will have to be an ARP. The applicant will therefore have to become an ARP and fulfill all conditions of an ARP, i.e. be a valid holder of an "Access Responsibility Contract" at the latest on the 19.12.2009. Economic and financial capacity The applicants have to submit the following documents: a calculation sheet with the financial ratio’s proving their financial solvability (based on e.g. liquidity ratio, solvency, efficiency ratio, etc) for the past three years (2009,2008,2007). This calculation sheet is available on demand at the following e-mail address: karine.samson@elia.be.

Technical capacity Information and formalities necessary for evaluating if requirements are met Information and formalities necessary for evaluating if requirements are met: The applicants need to provide the following documents and/or information for the Contracting entity to be able to evaluate their technical capacity in the light of the requirements of the supplies: - proof of a Quality System taking into account the return of experience with the clients through corrective acts; - proof of the ability of the contact person and the person in charge of the supplies to communicate orally and in writing in Dutch, French or English; - A list indicating the main activities of the last three years; - A document proving that the applicant has been active as an electricity supplier during the last 3 years (2007, 2008,2009); - Description of the amount of electricity supplied per year for the last three years or a list and description of all supply contracts concluded during the last three years for the supply of a minimum amount of 30 GWh; - An overview of the contracts for the supply of electricity concluded with producers and/or traders during the last 2 years. The absence of requested documents and/or sufficient proof will not automatically result in the exclusion of the applicant but will influence the evaluation of the file of the applicant with regard to the selection process.
