A LITTLE SHOE HISTORY

A criação do sapato se deu como uma consequência natural da necessidade que o homem sentiu em proteger seus pés do incômodo de andar sobre pedras e sujeira ou do perigo de pisar em algum animal peçonhento. Pinturas feitas em cavernas da Espanha e do sul da França 10 mil anos antes de Cristo mostram que nessa época (Paleolítico) o homem pré-histórico já fazia uso de espécies rudimentares de calçados feitos de palha e madeira, provavelmente o primeiro modelo da história do sapato.

Com a introdução da cultura árabe na idade média na Europa, o uso de diferentes materiais, a coloração do couro, as costuras trabalhadas e o design apurado deram origem a diferentes e inovadores tipos de sapatos, tendo como base a sapatilha integral com o fechamento das costuras pela parte de cima, usada tanto por homens como por mulheres. Já no século XVI na França, na corte de Luís XIV os saltos eram objetos exclusivamente masculinos, um símbolo de ostentação e riqueza, onde os homens usavam saltos altíssimos. O rei Luís XV, devido a sua baixa estatura, encomendava sapatos de salto alto.

First of all, it is a pleasure to be able to write for Elite Magazine. Publication that I have followed and respected for many years. The focus of this conversation will be on what is fundamental for a hotel to promote a memorable experience for guests. Precisamos cuidar muito deste primeiro contato e nosso cuidado vai além do hardware - que seria a mecânica e engenharia de receber, valorizando um tratamento muito humanizado também na parte de software.

We have 4 standard environments in our hotels. In the lobby, reception and bar, we have the first contact with our client. As they say, “the first impression is what remains”. Paulista ou em New York City.

HOW TO SAVE THE AUTHORITY ABUSE LAW? Após breve tramitação e pouquíssimo debate com a sociedade, em 03 de janeiro de 2020, a Lei 13.869/2019 – a Lei de Abuso de Autoridade – entrou em vigor. Além de chamar atenção pela inusual eficiência, o processo legislativo foi marcado por ingerências de cunho ideológico e partidário, nem sempre compatibilizadas com a busca pelo interesse público que deve nortear toda e qualquer ação legislativa.

After brief processing and very little debate with society, on January 3, 2020, Law 13.869/2019 - the Law of Abuse of Authority - became effective. In addition to attract attention to unusual efficiency, the legislative process was marked by interference of an ideological and partisan nature, not always compatible with the need of public interest that should guide any and all legal actions.

What is left for us is the effort to minimize the negative effects and enhance possible successes.

Afortunadamente, a intenção por vezes inconfessável do legislador nem sempre se confunde com a “vontade da lei” – que deve prevalecer no momento de sua aplicação. Neste sentido, a análise de eventual ato abusivo do servidor deve ser orientada pela presunção inocência e boa-fé, garantindo-se assim sua liberdade de sua atuação.

VIRTUAL RAPE, A PRESENT MANACE Centenas de mulheres são vítimas e sofrem abusos com os casos de revenge porn (divulgação de imagens íntimas como vingança), assédio e até estupro virtual. O problema é que grande parte dos casos não chega a ser denunciada.

Hundreds of women are victims and abused with cases of revenge porn (disclosure of intimate images for the purpose of revenge), harassment and even virtual rape. The problem is that most cases are never reported.

A redação do artigo 213 do Código Penal não cita o ‘estupro virtual’, mas caracteriza estupro como o ato de “constranger alguém, mediante violência ou grave ameaça, a ter conjunção carnal ou a praticar ou permitir que com ele se pratique outro ato libidinoso”. O estupro virtual ocorre, por exemplo, quando uma pessoa, por meio da internet, venha a constranger ou ameaçar a outra a tirar a roupa na frente de uma webcam, praticar masturbação ou se fotografar nua, por exemplo. “Tudo sem a presença física do agressor. Com a atualização da lei, fica caracterizado o crime no uso das vias digitais para exercer um domínio psicológico, por meio de constrangimento e grave ameaça, obrigando a vítima a manter ato libidinoso”.

CESARE BECCARIA, em 1764, insuflado pelos postulados iluministas, ao tratar da tortura, em sua obra magistral Dos Delitos e das Penas afirmava: “Um homem não pode ser considerado culpado antes da sentença do juiz; e a sociedade apenas lhe pode retirar a proteção pública depois que seja decidido que ele tenha violado as normas em que tal proteção lhe foi dada. Apenas o direito da força, pode, portanto, dar autoridade a um juiz para infligir uma pena a um cidadão quando ainda se está em dúvida se ele é inocente [1] ou culpado”.

CESARE BECCARIA, in 1764, inflated by the Enlightenment postulates, when dealing with torture, in his masterful work Dos Delitos e das Penas stated: “A man cannot be found guilty before the judge’s sentence; and society can only withdraw public protection after it is decided that it has violated the rules under which such protection was given. Only the right of force, therefore, can give authority to a judge to inflict a sentence on a citizen when there is still doubt as to whether he is innocent or guilty. ”[1]

O STF, por maioria de votos, autorizou a execução provisória e a prisão antecipada sem instrumentalidade acautelatória do processo. Limitou o alcance do princípio do estado de inocência (CF, art. 5º, LVII) e equiparou decisão colegiada de segundo grau recorrível a encerramento definitivo do processo (HC n.º 126.292/2016, rel. Ministro Teori Zavascki [2] do STF ). Em matéria de direitos fundamentais, retrocedeu em relação à jurisprudência da própria Côrte (HC n.º 84.078-7/2009, rel. Ministro Eros Grau, informativo n.º 534), o qual já havia concluído que, enquanto não houvesse o trânsito em julgado da condenação, não seria possível a execução provisória da pena.
