The unions, unsurprisingly, plan to appeal. Joshua Pechthalt, the president of the California Federation of Teachers, said, "We believe the judge fell victim to the anti-union, anti-teacher rhetoric and one of America's finest corporate law firms that set out to scapegoat teachers for the real problems that exist in public education." (2) Beyond the question of whether tenure hurts students, however, this case raises another issue: Should the courts be deciding that question at all? Consider this case in light of a case in New Jersey that continues to serve as a fulcrum on which New Jersey's courts and its Legislature vie for control over school funding. The state Supreme Court has repeatedly ordered the Legislature to draft a law that will achieve "substantially equivalent funding" for schools; time and again, the Court has found the Legislature's attempt unsatisfactory. Or consider a decision by the Kansas Supreme Court this March, which similarly found that disparities between school districts' funding violated the state Constitution. The Court ordered legislators to potentially appropriate tens of millions of dollars for the benefit of poorer school districts. It rejected the argument that judiciary lacks authority to make such education funding decisions.

But I am inclined to find more merit in having judges examine structures that might impair educational quality, including tenure among others. The two scenarios are not quite the same. A given amount of money may be adequate or inadequate, depending on how effectively it is spent. When a state constitution establishes a right to an adequate education, to whom does it implicitly assign the responsibility of determining what level of education is adequate? Logically, since defining educational adequacy is a policy matter, that determination falls to the legislature. Courts, including California's, have tried to sidestep this argument by applying equal-protection arguments, saying poor students suffer when funding is inadequate. However, this again equates education spending with education quality, which is a determination courts are not in a good position to make. As the policy-making branch of government, a state's legislature should set educational standards, not its judges. A governor who believes legislators' standards are inappropriate might have standing to bring that argument to the courts. If the executive and the legislature deadlock, it is entirely appropriate for the judicial branch to referee the conflict.

enough money is being spent, the results are different. As was the case in New Jersey and Kansas, such actions can result in judges second-guessing both legislators and executives. Judges thus put themselves in a policy-making, money-appropriating role that is incompatible with that of the judiciary. Do judges also overreach when they second-guess laws that provide tenure protection for teachers? That is probably an argument the teachers unions will make when they appeal Treu's decision and others like it that may arise in its wake. Students Matter is reportedly considering filing lawsuits in other states to tackle their tenure laws as well. But if unions successfully argue that judges are overreaching by striking down tenure laws, they will be implicitly asking the courts to stay

out of the role of setting educational policy altogether. They will have no further credibility if they come back to court to ask for more money. If the California Constitution's education requirement means anything, it means that every student is entitled to a good education, which, among other things, is an education that does not come from a tenure-protected burnout who goes through the motions until it is time to collect a pension. The vast majority of teachers do not fit this description. Union objections notwithstanding, it will not shake the educational firmament if tenure laws are stricken. It might even be one step toward making public education operate in the interests of students who attend school, rather than in the interests of the adults who work there.

Going Out In Style With any other U.S. goalkeeper …The U.S. looked almost dead on Besler's exhausted defensive lapses between the posts last Tuesday, their feet in the first 15-minute led to both Belgian goals. Red Devil Belgium would have beaten the crap out of Team America. But Tim Howard was an absolute beast against the Red Devils. He notched a World Cup record 16 saves (they only started keeping the stat in 1966) as the Waffles won, 2-1, in extra time. But the U.S. Men's National Team (USMNT) headed home with their heads held high. By surviving the WC's “group of death” (with Germany, Portugal and Ghana) and holding Belgium scoreless for 90 minutes of regulation time (plus some “stoppage time”), Juergen Klinsmann's squad gained worldwide respect… mini-half of added time. Matt substitute Romelu Lukaku left Besler in a heap near midfield before galloping into the box and delivering a crisp pass to goalscorer Kevin DeBruyne. To be fair, the other U.S. defenders recovered pretty well before DeBruyne made a nice turn and drilled the ball past Howard and into the bottom right corner. A few minutes later, DeBruyne's beautifully-weighted pass gave Lukaku a volleyed shot that Howard had no time to block… …Down 2-0 headed into the final 15-minute “mini-half” of extra time, I halfway expected the U.S. to concede another goal… or two. But Klinsmann brought on Julian Green for a clearly cashed-out Graham Zusi and the 19-year-old made an instant impact. Midfielder Michael Bradley's chipped pass into the box was dead solid perfect. into the net… …The game's final minutes were unbelievable to watch. The U.S. team that had looked like zombie extras from “The Walking Dead” earlier were seemingly replaced by fresh meat. Jermaine Jones missed just outside the right post. Courtois took the ball off of Clint Dempsey's boot after an incredibly intricate set-piece play. It all turned out to be a sad case of “too little, too late.” To be fair, Belgium dominated the match in almost every possible way. The Red Devils took 38 shots to the USMNT's 14 - with 27 shots on goal to a mere nine for the U.S. Belgium took 19 corner kicks. The U.S. took just four. But Tim Howard's incredible performance kept the overachieving Americans in the match… …There is already a lot of speculation about the long-term effects of the USMNT's strong performance in this World Cup. Soccer made some new fans this summer. I doubt avowed soccer-hater (and Adam's apple-owning right wing wacko) Ann Coulter will jump on the futbol bandwagon, but a lot of Americans are now sold on “the beautiful game.” We'll see if fan support grows by the time 2018 rolls around. The World Cup will be played in Russia next time… and Howard, now 35, will have retired by the time it begins. His historic accomplishment will live on, however. Dear Rocco, I live next door to a lady who would lay out naked in the summer. That wouldn’t be so bad except for the fact that she had two small boys and also kept another couple of children. JUNEAU, Alaska (UPI) - A 180pound bear crashed through an Alaska couple’s skylight and ate the cupcakes they had out for their child’s birthday party. The homeowners quickly vacated the room and allowed the bear to devour the tasty treats. “I was literally in the room, and I heard this cracking,” homeowner Glenn Merrill told the Juneau Empire. “And the next thing you know, there’s this bear that, I mean, lit-

erally, fell right from (the skylight). It was like one meter away from me.” Merrill’s house is on a mountainside that overlooks downtown Juneau. “There probably isn’t a neighborhood or place where we have homes where the potential isn’t there for you to run into a bear or observe a bear,” Ryan Scott of the Alaska Department of Fish and Game told the CBC. “There is really no place where the potential isn’t there.” The bear eventually left the residence after being yelled at, but it lingered in the backyard and con-

tinued to look in the window. “He wanted back in, that’s for sure,” Merrill said. The same bear allegedly entered another home in the area, so authorities thought it was best to have the animal destroyed because it was a threat to humans. “We don’t take killing or destroying bears lightly,” Scott said. “People were inside that building. While the 20-year-old was being arrested, he told police that he could have “tackled that car and could have crushed it if he wanted to,” according to the Muskegon Chronicle. “He also claimed he was from the Planet Zoltron and that his father sent him.” Burr appeared to be on “mind-altering drugs” and a witness said that he seemed “drunk or high and was talking about seeing blue orbits.” The suspect was charged with malicious destruction of property, damaging police property, assault and other charges. CHINA - A Chinese hospital in Nanjing, capital of Jiangsu Province, has introduced a new machine that makes sperm donation even easier—an automatic sperm extractor. The effortless machine features a massage pipe that can be adjusted to suit the height of the user. All the gentleman has to do is plug in the frequency, amplitude and temperature and insert. The pipe does the rest with a gentle back-and-forth motion. It is even equipped with a small screen for those feeling uninspired. According to the director of the urology department of the hospital, the machine

is designed to help individuals that are finding it difficult to retrieve sperm the old fashioned way. BREVARD COUNTY, Fla. (UPI) - A Florida woman was caught on surveillance video attempting to eat a bag full of marijuana during an arrest for DUI. Tavish Smith was pulled over on suspicion of DUI after she allegedly crashed her truck two times and was seen driving the wrong way. During the stop, officers searched the vehicle and discovered a sandwich bag full of marijuana. After the suspect was placed in the back of a squad car, she asked the officer to go get her flip-flops from her truck. Smith was then able to wriggle out of her handcuffs and grab the bag from the front seat of the squad car. She then quickly chowed down on its contents. “My car’s smelling like the stuff you had in your seat,” the arresting trooper says in the video. “I hope that’s not why this marijuana bag was open over here. Bags of weed just don’t go missing inside a police car. And I’ve got it all on video.” Smith denied eating the pot, but she allegedly left marijuana crumbs everywhere. The 45year-old allegedly ate about 12 grams of grass. According to WTSP, “at the moment she eats the evidence, her misdemeanor charges for minor hit-and-run, DUI and marijuana possession bump up to a felony.”

KUNA, Iowa (UPI) - What do you have to do to get arrested in Iowa? A Kuna family is upset that a naked, drunken man who allegedly pooped on their carpet and flooded their kitchen was only cited with two misdemeanors but not arrested. The Gillaspys woke up to a naked man walking around in their bedroom early on Sunday morning, but he quickly sprinted off into another room. “My husband grabs the gun because we have no idea who this guy is,” Tricia Gillaspy told KTVB. “He’s like, ‘Get out of my house, now!’ But the guy wouldn’t leave. So, he puts the gun to his head, and says, ‘I said, get out!’” The suspect, Matthew Coomes, left the home after 911 was called, but he was still milling around outside when police arrived. Then everyone saw what the 25-year-old allegedly did downstairs. “He took this sink sprayer out and this drawer was in there. He put it in the drawer, turned it on full blast hot water, it filled that entire drawer full. It flooded my entire kitchen,” Gillaspy said. “He craps on my floor, and he must have been playing in it because he streaked it down the side of my walls. The stain is gone finally, thank goodness.” Instead of being arrested, Coomes was cited with two misdemeanors. The Kuna Police have since admitted that the responding officer probably should have arrested Coomes and it’s possible that Ada County pros-

ecutors could charge him with a felony count of malicious injury to property. SULPHUR, LA. - A Louisiana man’s decision to jump on an 11-foot alligator left him with a gash on his hand that required 80 stitches. “I’ve always been the kind of guy who learns the hard way,” said Glen Bonin in the understatement of the year. Bonin and three of his friends tried to move the gator off a road in Sulphur, La., because why drive around a gator when you can pretend to be The Crocodile Hunter and have one hell of a story to tell. The encounter was captured on video if you want to look it up on the Internet for a good laugh. “(We) took our shirts off, threw it on (the gator’s) face, and we were going to come from behind it and jump on it. In the process of doing that, it spun around and grabbed my hand seconds before we jumped on it,” Bonin said. Bonin told the local news it felt like someone was pulling his arm out. “I thought I was about to lose something,” he said. Bonin advised others against doing what he did. “Call wildlife and fisheries, call the sheriff, call somebody, stay in your vehicles don’t try to play with them or move them,” he said. “Leave it to the professionals, that’s what they say.”

From Heartbreaker to Working Class Dog Benatar/Giraldo and Springfield Still Have the Magic Saturday night was going back in time. It was as if I rode with Doc Brown in the ole DeLorean as I headed to Chastain Park Amphitheatre in Atlanta to see Rick Springfield and Pat Benatar with Neil Giraldo in concert.

Pat and her husband Neil Giraldo, her guitarist since her 1979 debut album, In The Heat of The Night was in top form. For a long time there I thought I was back in the ‘80s. To this day I still remember my best friend Chuck bringing over Benatar’s second album to the house, Crimes of Passion. She was a beautiful girl who could sing. We spent many hot summer nights lusting after her and singing along (as best as we could).

cally trained Benatar’s voice is still intact. The mezzo-soprano hit every note with ease as her vocals soared through a series of one hit after another. A lady sitting next to me gushed, “Gosh, she can still hit the high notes!” Indeed she can. I was also impressed by Giraldo’s guitar playing. I never really paid attention to him in the day and to be honest until I saw the show and started doing my research. I thought he was riding her coattails. But that is farthest from the truth. Truly a badass he took charge of the stage many tines with such deft and skill on guitar. Benatar I now believe was the benefactor in this relationship.

Instead it was me in my trusty Volvo, but it did seem like I went back to the future. Before I left one of the guys in my office reminded me of the lunchroom scene in “Fast Times At Ridgemont High”. In that scene at the movie there was a shot of girls all with the Pat Benatar hair and dress. Pat was the rocker chic(k) of her day. ship. The more I read about Giraldo the more impressed I get as he had definitely left a stamp on popular music for more than just being lead guitarist in Benatar’s band. From the first note of “Shadows of the Night” to the final chord of the encore “Heartbreaker” the show rocked the entire time. Benatar’s set chronicled her singles between the years 1979 and 1988. The “newest” song performed was “All Fired Up” the lead single from 1988’s Wide Awake In Dreamland and the oldest “Heartbreaker” from her 1979 debut In The Heat of The Night. Her big breakthrough album Crimes of Passion was well represented with singles “Hit Me


Saturday was the first chance I got to see him live. It was worth the wait. Despite being his age, he looked at least 20 years younger. Rockers half his age should be in such good shape. And Rick rocked. He started the night off with the hard rocking “I’ve Done Everything For You”. After bringing the crowd to it’s feet with his rollicking opening number Springfield shed his leather jacket telling the crowd “It’s hot!”. Indeed it was, as was his show. He rocked through old favorites like

The show ended as Springfield and the band brought down the house (or amphitheatre) with “Jessie’s Girl”. I was indeed back from the future. If only Doc hadn’t shown back up. Great Scott! Opening the show was William Beckett. Beckett is the former lead singer of The Academy Is… a sort of emo pop punk band. Beckett, playing solo showcased a set of upbeat musical pop with a lot of punch and not so much emo or punk.

Included with Springfield’s hi-jinks was him being handed a bouquet of flowers from one of his admirers. Bennett seemed a little out of place as he was playing to a bunch of people who could have been his parents. He was the good sport and heads eventually started to turn towards the stage as the early opener played one pop/rock tune after the other. His set was warmly received by a crowd that was looking to relive part of their youth. Rock on.

Sterling Performances By Stirling and AJR Highlight A Hot Summer Night As the temperatures rise as summer set in around Chattanooga, the heat was intense Monday at Track 29 and the biggest of industrial fans could not cool it off. A soldout crowd one of the hottest acts both figuratively and literally.

Lindsey Stirling took the stage as if she owned it. Stirling is a violin virtuoso mixing classical and at times Celtic sounding riffs and melodies to dubstep. Odd as it may sound, it works. Quite well actually. And to ENIGMA

top it, she’s a whirling dervish on stage. The spritely redhead ran, leapt around and jumped all over the place with grace and without missing a beat – or in her case a stroke. Accompanied by only a drummer and a pair of backup 2014

Wilson brothers a.k.a. the Beach Boys. At times chills were running down my back as their harmonies had that Beach Boys sound except the lyrics weren’t about surfing or hot rods, they are very modern. But they CAN sing, a rarity in today’s popular music, that unfortunately not required to be successful in popular music. But these guys are. Amen.
