NFHA Statement After Supreme Court Rejects Challenge to Consumer Financial Protection Bureau Funding Structure
Washington, D.C. — The National Fair Housing Alliance® (NFHA™) released the following statement from Executive Vice President Nikitra Bailey in response to the Supreme Court rejecting a challenge to the Consumer Financial Protection Bureau (CFPB) funding structure.
“Today’s 7-2 ruling by the United States Supreme Court is a victory for consumers and sends a resounding message once and for all that the CFPB’s legitimacy is incontrovertible. For more than two years, opponents – led by payday lenders – have steered ongoing attacks to undermine the agency’s legitimacy and efficacy. NFHA was one of the key leaders that worked to create the CFPB after the Housing Crisis of 2008 ravaged communities of color and triggered the Great Recession, resulting in a loss of $1 trillion in wealth for Black and Latino households. Because of the impact of the crisis, NFHA played a leading role in developing the CFPB’s Office of Fair Lending and Enforcement. Time and again, the CFPB has unequivocally demonstrated the importance of its mission through groundbreaking efforts, such as enforcement actions that have provided billions of dollars in relief to millions of victims of financial abuse, robust regulations that protect consumers in today’s complex financial environment and leadingedge research that provides insights into consumer financial behavior. The CFPB has played and will continue to play an indispensable role in our communities.

Congress Must Take Broader, Swift Action to Protect People and Communities Against AI Harms
Washington, D.C. — Lisa Rice, President and CEO of the National Fair Housing Alliance® (NFHA™), issued the following statement in response to the Senate AI Working Group’s report, A Roadmap for Artificial Intelligence Policy in the United States, released yesterday by a bipartisan group of senators:
“We applaud Majority Leader Charles Schumer (D-NY), Senator Mike Rounds (R-SD), Senator Martin Heinrich (D-NM), and Senator Todd Young (R-IN) for taking an important first step to address the rapidly evolving AI landscape. We need this type of bipartisan collaboration to put in place proper guardrails for technologies that impact every aspect of our lives including determining whether we can secure housing, access credit, be gainfully employed, or get medical treatment.
“As I shared in my testimony last year during the Senate AI Insight Forum on High Impact AI, automated systems hold significant risks, including bias and discrimination risks, which can severely harm people. The risks are not insurmountable if the proper controls are put in place. The National Fair Housing Alliance Commends the Federal Housing Finance Agency’s Bold Leadership in Promoting Equitable Housing Finance
Washington, D.C. — Yesterday, the Federal Housing Finance Agency (FHFA) issued several groundbreaking announcements designed to promote a fairer and more inclusive housing finance system. Specifically, FHFA announced:
The creation of a new Division of Public Interest Examination, which will be responsible for supervisory oversight of FHFA’s regulated entities in the areas of fair lending, affordable housing, community development, diversity and inclusion, and consumer protection (including unfair or deceptive acts or practices). The new division will be on par with the safety and soundness examination division and will report to the Director.
The issuance of a final rule, which will codify in regulation:
The fair lending oversight requirements for Fannie Mae, Freddie Mac, and the Federal Home Loan Banks;
The Equitable Housing Finance Plans (Plans) for Fannie Mae and Freddie Mac;
The collection of homeownership education, housing counseling, and language preference information on the Supplemental Consumer Information Form (SCIF), which will be reported to servicers; and
New requirements for the Federal Home Loan Banks to report voluntary actions taken to address barriers to sustainable housing opportunities.
Nikitra Bailey, Executive Vice President of the National Fair Housing Alliance® (NFHA™), issued the following statement regarding FHFA’s announcement:
“The National Fair Housing Alliance applauds Director Thompson and FHFA for this bold
leadership. As we celebrate the 56th Anniversary of the Fair Housing Act this month, we commend FHFA’s efforts to ensure access to mortgage credit on fair terms for all creditworthy borrowers, regardless of their race, national origin, gender, disability, familial status, or other protected characteristics. Although we have made some significant strides as a society since passage of the Fair Housing Act in 1968, we clearly still have a long way to go in fully dismantling the systems that continue to perpetuate inequality in the national housing finance market.
“NFHA has long advocated for FHFA to elevate its fair lending and consumer compliance supervision on par with the safety and soundness supervision, and to ensure that Fannie Mae, Freddie Mac, and the Federal Home Loan Banks fulfill their responsibilities to promote equitable housing finance. The new Division of Public Interest Examinations reflects FHFA’s efforts to prioritize fair lending and consumer protection along with safety and soundness. Moreover, the final regulation is consistent with FHFA’s obligation under the Fair Housing Act to Affirmatively Further Fair Housing. These actions are essential to closing racial homeownership and wealth gaps that have long plagued America’s housing finance system, and they also make good business sense. The demographics of the nation are undergoing a dramatic shift, and the majority of new households formed over the next decade will be households of color. Actionable plans are critically important to support borrowers and communities of color as well as older Americans who plan to sell their homes for a comfortable retirement. FHFA’s actions will promote a robust housing market that benefits all borrowers and communities.
“Removing bias from the home purchasing process strengthens individuals, families, communities, and the economy. Research has shown that we can grow the economy by $5 trillion over a five-year period just by addressing the discrimination that targets Black consumers. National Fair Housing Alliance Responds to OMB’s RFI on AI Procurement in Government
Washington, D.C. – Today, The National Fair Housing Alliance (NFHA) submitted a response to the Office of Management and Budget’s (OMB) Request for Information (RFI) on Responsible Procurement of Artificial Intelligence in Government. The request seeks input from various stakeholders on how to strengthen and incentivize market competition in the AI procurement process to combat monopolization, and how to incorporate risk management requirements to enforce the responsible acquisition and use of AI systems in the federal government. The request follows the finalized OMB memorandum directing agency executives to implement and comply with the minimum risk management requirements for AI, ensuring safety and safeguarding rights impacts.
NFHA’s response addresses the following issue areas:
1.The respective responsibilities of the vendor and the adopting agency in testing, evaluation, and impact assessments.
2. Establishing accountability through a clear and standardized set of transparency requirements.
3. Considering existing tensions and incentives within the public-private actors that may challenge the integral process of implementing responsible AI solutions.
4. The importance of developing standardized reporting tools and assessment templates to ensure compliance.
5. Emphasizing the need for detailed and accessible transparency in AI development

and testing, rather than imposing restrictive benchmarks that may not be domain applicable or appropriate.
6. Building AI expertise within the agency to ensure vendor compliance.
7. Designing procurement actions to ensure that AI systems in the government protect privacy, civil rights, and civil liberties.
NFHA applauds OMB’s diligent efforts in engaging a wide array of stakeholders to procure AI systems responsibly for government use. “Their focus on addressing major procurement challenges, particularly market competition and risk management, is crucial for responsibly mitigating, managing or avoiding risks of adverse consumer outcomes and unstable marketplaces that come with the procurement of third-party AI solutions and data,” says Michael Akinwumi, NFHA’s chief responsible AI officer.
The questions posed in the OMB’s RFI effectively highlight essential considerations for creating detailed procurement guidelines. These guidelines are designed to foster market participation and implement stringent risk management measures in alignment with the latest OMB directives on AI governance, which emphasize the minimum requirements for safety and rights-impacting AI within federal agencies. “OMB’s initiative to require precise testing and evaluation protocols for both vendors and agencies sets a standard of accountability for developers and deployers. This emphasis is essential in ensuring that AI technologies are safe, secure and trustworthy,” says Lusine Petrosyan, AI policy researcher at NFHA. We support the ongoing initiatives to mitigate risks and enhance the benefits of AI, highlighting the importance of equity and civil rights in the OMB’s guidance to promote safe and fair AI systems that prevent algorithmic bias.
