Police say the Apple store’s manager told them Grant refused to leave Monday night despite being asked multiple times. They say his cross was blocking an aisle. (AP)

A portion of a busy rail corridor that has been shut down since a freight train derailed Sunday morning in Northeast Washington could reopen by this morning, CSX Transportation said Tuesday. Officials say the investigation continues, but have offered no clues into what caused the 175-car train to derail. The early Sunday wreck at Rhode Island Avenue and Ninth Street NE closed the tracks shared by Amtrak, MARC and CSX trains.

Board appeals ruling on transgender restrooms

TRANSPORTATION A fire that caused a Metro train to fill with smoke inside a downtown tunnel last year, killing one passenger and sickening dozens, can be traced to poor maintenance and ineffective inspection practices by the city’s beleaguered transit authority, federal investigators said Tuesday. The National Transportation Safety Board issued its final report on the January 2015 fire at a meeting on Tuesday, placing the blame on the Metro transit authority for failing to properly install and maintain third-rail power cables, causing them to become damaged by water and other contaminants. The NTSB also faulted Metro for a lack of smoke detectors in its tunnels, for ventilation fans that didn’t work properly and for not training its employees on how to use the fans. It also blamed D.C.’s fire department and its 911 call center for delays in responding to the fire. Passengers waited on the smoke-filled train for more than 30 minutes before the first emergency responders arrived. NTSB Chairman Christopher Hart said Metro did not make meaningful safety improvements between a deadly collision in 2009 and the 2015 fire, and investigators said some of the system’s safety problems date back to its first fatal accident in 1982. The 2009 crash between two trains was the worst in Metro’s history, killing nine people. The board made several recommendations to Metro after that crash,

but Hart said its warnings were not heeded. “Little or no progress has been made toward building a meaningful safety culture,” Hart said, later adding: “When the NTSB finds itself issuing a continuous stream of accident reports to address the basic safety management of a single transit rail system, something is fundamentally flawed. Here, that

something is safety oversight.” Most of the facts surrounding the 2015 accident had already been made public by the NTSB. One disturbing detail that emerged at Tuesday’s meeting, however, was that Metro lacked any way to pinpoint the location of smoke or fire in the system’s tunnels and that trains full of passengers were routinely sent into tunnels to figure out where smoke was coming from. That practice has been discontinued and trains are now offloaded before operators move them into tunnels with possible smoke or fire, Metro general manager Paul Wiedefeld said Tuesday. “This just seems reprehensible,” said Bella Dinh-Zarr, the board’s vice chair. “The use of inadequately trained [Metro] employees and passengers as essentially canaries in the tunnel, that seems a very dangerous and risky practice.”

D.C. launches lead-testing blitz of water sources at schools, recreation centers

After the meeting, Hart said there was no evidence that the train in the 2015 accident was sent to investigate the source of smoke. Instead, he said, the operator continued into the tunnel despite the presence of smoke. Metro’s standard operating procedures call for all trains to be stopped after a report of smoke, investigators said. But that wasn’t done, and the train was unable to back up into the L’Enfant Plaza station in part because another train was sitting on the platform behind it. Since the 2015 fire, the U.S. Department of Transportation has temporarily granted safety oversight of Metro to the Federal Transit Administration. Hart and other NTSB members criticized that move, saying that Metro should be overseen by the Federal Railroad Administration, which has stronger enforcement powers. BEN NUCKOLS (AP)

A Virginia school board has asked the full 4th U.S. Circuit Court of Appeals to review a panel’s ruling that a transgender teen must be allowed to use the boys’ restroom at school. The Gloucester County School Board argued that the case warrants a second look because it could affect schools far beyond the county. A federal judge had rejected a sex discrimination claim by a Gloucester High School student who was born female but identifies as male. In last month’s 2-1 ruling, the appeals court said schools are bound by Department of Education guidelines stating that students must be allowed to use restrooms corresponding to their gender identity. Fla. businessman paid for Va. senator’s Syria trip The Virginia state senator who met with Syrian President Bashar al-Assad last week made his unlikely journey at the expense of a Florida businessman, who estimated the cost was $10,000. State ethics officials signed off on the gift to Sen. Richard H. Black, R-Loudoun, ahead of his trip to the war-torn country, finding that it complied with state ethics laws. local THE DISTRICT Authorities say a pedestrian was struck and killed by a Metrobus that was hijacked Tuesday morning in Northeast Washington. D.C. Police Chief Cathy Lanier said a man was taken into custody at a gas station when the bus was stopped. The pedestrian who was killed was not immediately identified. She said the suspect was “violent and resistant.” The entire incident lasted less than three minutes, she said. Lanier described the event as bizarre, saying it was rare occurrence for someone to take a bus

and attack the driver. It was not immediately clear what weapon was used in the attack. The bus driver suffered nonlife-threatening injuries, but there were no injuries to passengers, according to Metro Transit Police. Dustin Sternbeck, the chief spokesman for the D.C. police, said a man boarded the bus about 10:30 a.m. in the 3800 block of Jay Street NE and stood next to the driver. At the next stop, Sternbeck said, the man attacked the driver and the passengers were able to get out the back entrance.

BAGHDAD A U.S. Navy SEAL was killed Tuesday by fire from the Islamic State group, or ISIS, outside the ISIS-held city of Mosul, and Defense Secretary Ash Carter acknowledged it as a “combat death” as the United States expands its role in the northern part of Iraq. The SEAL, who has not been identified, is the third U.S. serviceman to die while fighting in Iraq since the U.S.-led coalition launched its campaign against the Islamic State in the summer of 2014. In October, a special operations soldier was killed in

a raid on an ISIS prison in northern Iraq. In March, an American Marine was killed in an ISIS attack at a newly established U.S. base outside Mosul. Over the course of the nearly two-year U.S.-led campaign against the Islamic State group, the Pentagon has slowly expanded the American role in Iraq and increased the presence of U.S. troops. The number of troops has risen from an initial contingent of 170 to 4,087, The Washington Post reports, noting that because some operations are undisclosed, the total is likely higher. The Islamic State launched the attack on Teleskof, about 14 miles north of Mosul, just after 6 a.m., said Lt. Col. Manav Dosky,

MILITARY The Marine Corps says it has begun investigating whether it mistakenly identified one of the men shown raising the U.S. flag at Iwo Jima in one of the iconic images of World War II after two amateur history buffs began raising questions about the picture. The Marines announced its inquiry more than a year after Eric Krelle, of Omaha, Neb., and Stephen Foley, of Wexford, Ireland, began raising doubts about the identity of one man. In November 2014, the Omaha World-Herald published an extensive story about their claims and Saturday was the first to report the Marines were

but the photo immediately was celebrated in the U.S. and President Franklin Roosevelt told the military to identify the men. After some confusion, the Marines identified the men as John Bradley, Rene Gagnon, Ira Hayes, Harlon Block, Michael Strank and Franklin Sousley. All were Marines except Bradley, who was a Navy corpsman. After examining the famous photo along with other pictures taken that day of the men, Krelle and Foley concluded that the man identified as Bradley was actually Harold Henry Schultz, a private first class from Detroit. Bradley’s son, James Bradley, author of “Flags of our Fathers,” a best-seller about the flag-raising, told The New York Times Tuesday he now no longer believes his father was in the iconic photo. Unneeded antibiotics: 1 in 3 New study offers first concrete numbers on dangerous glut of meds

HEALTH Nearly a third of antibiotics prescribed in doctors’ offices, emergency rooms and hospitalbased clinics in the United States are not needed, according to the most in-depth study yet to examine the use and misuse of these life-saving drugs. The finding, which has implications for antibiotics’ diminished efficacy, translates to about 47 million unnecessary prescriptions given out each year to children and adults. Most are for conditions that don’t respond to antibiotics, such as colds, sore throats, bronchitis, flu and other viral illnesses. Although health officials have been warning for decades about the overuse of antibiotics and its contribution to drug-resistant bacteria, the research from the Centers for Disease Control and Prevention and the Pew Charitable Trust is the first to quantify the problem’s depth. “We’ve all been hearing, ‘This is a problem, this is problem,’ and we all understood the general concept that there is a lot of antibiotic use,” said David Hyun, a senior officer with Pew’s antibiotic resistance project and one of the authors of the report published Tuesday in JAMA. Pew published a companion report. “Why this study is so important: It actually provides

Those prescriptions represent the majority of dollars spent on antibiotics in the United States. Doctors often wind up prescribing antibiotics because of pressure from patients or parents, said Katherine FlemingDutra, a CDC medical epidemiologist and report’s lead author. “Clinicians are concerned about patient satisfaction and the patient demand for antibiotics,” she said. But the majority of individuals do trust their doctors to make the right diagnosis, and better communication by doctors about the dangers of antibiotic overuse can lead to more appropriate prescribing, she said. An editorial in JAMA noted

that the numbers likely are an undercount because they don’t include all scenarios, such as times antibiotics are given when patients talk to doctors’ offices over the phone and prescriptions written by nurse practitioners. The overuse of antibiotics has led to the frightening rise of drug-resistant superbugs. Last year, the White House announced an aggressive plan to combat antibiotic-resistant bacteria, which already cause an estimated 2 million illnesses and 23,000 deaths every year just in the United States. HEALTH A new study finds that many competitors on NBC’s “The Biggest Loser” leave the show with a slower metabolism, making it more difficult to keep off the pounds. The National Institutes of Health study finds participants come out of the weight-loss reality competition burning about 500 fewer calories a day than expected, and the contestants who drop the most weight see the greatest slowing of their metabolisms. Researchers say many contestants experience substantial weight gain in the years after the show. Lead author Kevin Hall, a researcher with the National Institute of Diabetes and Digestive and Kidney Diseases, said 500 calories is the size of a big lunch and the results mean participants have to reduce their daily calorie intake by that much to avoid gaining weight. He said the study doesn’t mean dieting is a lost cause but that show participants must change their lifestyles to fight weight gain. The news isn’t all bad for “Biggest Loser” competitors, however. The study notes that participants have been quite successful at long-term weight loss when compared to people in other intervention programs. The jury deliberated eight hours Monday before ordering Johnson & Johnson to pay $55 million to a South Dakota woman, Gloria Ristesund, who blamed her ovarian cancer on years of talcum powder use. The ruling follows a $72 million award in February from another St. Louis jury to the family of an Alabama woman who died from ovarian cancer after using talcum powder for decades.

Talc is naturally occurring, mined from soil and composed of magnesium, silicon, oxygen and hydrogen. It’s widely used in cosmetics and personal care products, such as talcum powder, to absorb moisture, prevent caking and improve the product’s feel. The International Agency for Research on Cancer classifies genital use of talc-based body powder as “possibly carcinogenic to humans.”

Jim Onder, attorney for plaintiffs in both cases, said researchers began connecting talcum powder to ovarian cancer in the 1970s, and that documents show Johnson & Johnson was aware of those studies. “Instead of giving a warning, what they did was targeted the groups most at risk for developing ovarian cancer,” specifically marketing to overweight women, blacks and Hispanics, Onder said.

Johnson & Johnson cites other medical evidence showing its products are blameless. “Unfortunately, the jury’s decision goes against 30 years of studies by medical experts around the world that continue to support the safety of cosmetic talc,” a Johnson & Johnson spokeswoman said. The company plans to appeal. At least 1,200 other talcum powderrelated lawsuits are pending, said Onder.

That kind of image of distress has defined the Eastern Conference semifinal series between Washington and the Penguins. A game earlier, the image was of Penguins defenseman Olli Maatta, looking dazed, his teammates helping him to the bench. He hasn’t played or practiced since. The Penguins’ 3-2 victory at home Monday night gave them a 2-1 lead in the series, which was supposed to be the marquee matchup of the second round, two rivals loaded with superstar talent — and it has mostly

delivered with competitive and entertaining games. But the series has also spotlighted a harsh part of the game. The series might be swayed because of suspensions for illegal hits, with Capitals defenseman Brooks Orpik receiving a threegame sentence for interference on Maatta, his hit described by the Department of Player Safety as “unacceptably high and excessively late.” And then Tuesday afternoon came the news that Pittsburgh’s top defenseman, Kris Letang, had been suspended one game for interference on Johansson. The hit came late in the first period Monday. Johansson had dumped the puck before Letang drove his left shoulder up and

under Johansson’s head. He was knocked briefly into the air and then collapsed to the ice. Letang was whistled for a two-minute minor for interference. Johansson returned for the second period but did not practice Tuesday. Letang will have to sit out tonight’s Game 4 in Pittsburgh (8 p.m., NBCSN). So suspensions have come to define the matchup. “I think every series has its own storyline, and it’ll change as this series goes on,” Capitals coach Barry Trotz said. “But that’s how it’s started.” Delivering hits to wear an opponent down over the course of a long series is part of the Capitals’ strategy. They’re a bigger team

than the Penguins and want to use that as an advantage. “It’s unfortunate that the guys are laying on the ice in pain from hits that aren’t classified as legal,” Capitals defenseman Karl Alzner said. “If they’re just a hard forechecking hit or a good battle and a hit and a guy gets hurt, then that’s something you can handle a lot better.” Orpik took responsibility for his hit on Maatta, calling it a “bad mistake.” Orpik said the team had emphasized hitting the Penguins’ defensemen, and that was something in the back of his mind as he hit a player who was no longer eligible to be checked because he had released the puck a full second earlier. The bullpen of Jonathan Papelbon, Shawn Kelley, Oliver Perez, Felipe Rivero, Yusmeiro Petit, Sammy Solis (swapped in for injured Matt Belisle) and Blake Treinen has been the best in the National League. The bullpen’s strength was displayed Monday night in a 2-0 victory at Kansas City. Four relievers combined for three innings and allowed only one man to reach base. The bullpen’s collective ERA dropped to 2.48 — best in the NL (but sixth overall). Entering Tuesday night’s game against the Royals, the Nationals’ relievers had struck out 73 in 722/3 innings. BUSINESS Nationals outfielder Bryce Harper signed a multi-year extension with Under Armour on Tuesday, a contract that, according to a person familiar with the deal, is believed to be the largest endorsement deal for an MLB player. Although terms weren’t disclosed by the Baltimore-based sportswear company, ESPN said the deal is for 10 years. Harper has been with Under Armour since he entered pro baseball in 2010 as the Nationals’ first-overall pick. His agent, Scott Boras, has popularized the use of opt-outs in contracts, and the extension is believed to have one. Harper, 23, has become a superstar of both baseball and marketing. He uses social media to share his interests with fans, has designed his owns shoes and hats, and happily displays his flair on the field, pushing to “make baseball fun again.” In addition to his Under Armour deal, Harper sponsors Gatorade and New Era. Baseball players haven’t received endorsement dollars comparable to some other athletes, but Harper could be helping to change that. Crudo awakening TRENDS Sushi and seviche are household names when it comes to raw fish. But how well do you know crudo? Chef Michael Schlow (Tico, The Riggsby) would like to introduce it to you at Conosci, his new crudo bar, where the nightly menu includes 10 to 12 variations available a la carte or as part of the tasting menus. (Conosci also serves soup, vegetables and other dishes.) “It’s about trying to showcase the fish … in a way you may not have seen before,” says Schlow, who recently opened the intimate 30-seat venue, attached to his new Italian restaurant, Alta Strada, near Mount Vernon Square. Crudo (the word means “raw” in Italian and Spanish) is essentially raw fish that has been sliced and seasoned lightly with spices, citrus and/or oil. Since the preparation is so pared down, it’s important to select fish that is firm and not too oily, says chef John Melfi of The Oval Room. His tuna crudo comes with

THEATER The megahit musical “Hamilton” has grabbed a record-breaking 16 Tony Award nominations, the biggest haul in Broadway history and another step in the show’s march into theatrical history. Lin-Manuel Miranda’s hiphop-flavored biography about the first U.S. treasury secretary on Tuesday broke the 15-nomination record held jointly by “The Producers” and “Billy Elliot.” “Hamilton” earned seven acting nominations — for Miranda, Leslie Odom Jr., Phillipa Soo, Daveed Diggs, Jonathan Groff, Christopher Jackson and Renee Elise Goldsberry.
