A judge known for unique sentences has ordered a man who knocked over a port-a-potty and other objects at a park to clean animal pens at a fairgrounds in Painesville, Ohio. Judge Michael Cicconetti suspended most of a 120-day sentence for Bayley Toth, who was convicted of criminal mischief, in favor of cleaning animal waste at Lake County fairgrounds. The judge said, “You act like an animal, you’re going to take care of animals.” (AP)

ANIMALS Poor Smoke. The 10-year-old hound dog has terminal cancer, so the caregivers at Arlington’s animal shelter and humane society made him a bucket list. No. 1: Find a new home. Shelter officials described him in a July 26 post on Facebook as a “ridiculously handsome hound” who has been at the facility for about a month. But they recently got bad news about his health. “We don’t know how long Smoke has left with us — it could be six months, or it could be just a few weeks,” they wrote. “What we do know is that Smoke deserves to live the rest of the time he has left in a home, with a family that loves him.” They posted his bucket list, which includes activities such as going on a hike, eating a cheeseburger, meeting Santa, appearing on TV and riding in a convertible.

THE DISTRICT At an Irish pub on H Street, a room full of restaurant workers and owners lobbied Charles Allen. They wanted the D.C. Council member to support a repeal of Initiative 77, a ballot measure voters approved in June that raises the minimum wage for servers, bartenders and others who earn tips. Allen, D-Ward 6, agreed that Initiative 77 is bad policy. But the idea of overturning the will of the voters gives him pause. “I don’t rush headlong into saying, ‘Voters just voted, now let’s overturn it,’ ” Allen said last month. “I want to respect the fact that there was a ballot initiative. There was an outcome.” A majority of the D.C. Council — seven of 13 members — shows no such hesitation and has backed a bill to nullify Initiative 77. A public hearing is set for Sept. 17. If the voters’ decision is reversed, the D.C. Council would join a growing number of legislative bodies nationwide that have moved to overrule their constituents’ decisions at the ballot box. In the last two years, lawmakers filed more than 100 bills to overturn voter initiatives in 24 states, according to Chris Melody Fields Figueredo, executive director of the Ballot Initiative Strategy Center, a progressive group. “It’s a power grab,” he said. “It’s an attempt to take that

Council approved a 2016 minimum wage hike but did not eliminate the tipped wage, which allows employers to pay some workers $3.89 per hour as long as tips make up the difference between that and the city’s current $13.25 minimum wage. Initiative 77 will gradually increase the hourly pay for tipped workers to $15 by 2025, so that there is a standard wage for all workers. Council members say overturning initiatives happens on a case-by-case basis and is about the particular law, not the ballot measure process. Paul Jacob, president of the nonpartisan organization Citizens in Charge, doesn’t think Initiative 77 is a good law. But most voters supported it, and the council should respect that, he said. “Voters are the boss, the legislators are not. VA whistleblowers: New report reveals retaliatory culture where managers investigated themselves for misconduct, presenting a conflict of interest.” VA has a policy against such a clearly flawed practice but does not have appropriate oversight measures to ensure the policy is enforced. Rep. Michelle Lujan Grisham, D-N.M., who requested the report along with two other House members, has urged the Justice Department to appoint a federal monitor to examine the misconductadjudication process. “The findings from this nearly three-year investigation are beyond disturbing and reflect complaints from VA employees, veterans and their loved ones that I have received for years,” she said. “The investigation describes an agency in crisis that has failed to protect whistleblowers and hold senior VA officials accountable for misconduct, jeopardizing veteran health and well-being. The investigation also uncovered that VA allowed several individuals to investigate their own accusations, which is a glaring conflict of interest and completely unacceptable for the adjudication process.” Whistleblower advocate Tom Devine, legal director of the nongovernmental Government Accountability Project, is no fan of in-house whistleblower projects like the VA’s office. He said they too often “are a trap” for employees who are subjected to an investigation because they exposed waste, fraud or abuse.

While the Department of Veterans Affairs prides itself on running the nation’s largest integrated health system, the agency suffers from a chronic disease of its own making — whistleblower retaliation. Each year, 9 million veterans get good care at VA’s 1,243 health care facilities, but they would be better served if the ingrained culture of retribution were remedied. It was whistleblowers who exposed the scandal in 2014 involving the cover-up of long patient wait times. That led to ongoing efforts, with some success, to fix the system. For whistleblowers facing management revenge, it’s not fixed yet. A new Government Accountability Office (GAO) report reveals serious problems related to holding employees accountable, particularly when it comes to whistleblowing. Correcting that should be a top item on the agenda of Robert Wilkie, who was sworn in Monday as the new VA secretary. As my colleague Lisa Rein has reported, he is taking over a department that has become highly politicized under President Trump. One sentence leaps from the GAO’s findings: “Whistleblowers were 10 times more likely than their peers to receive disciplinary action within a year of reporting misconduct.” Another disturbing finding — the GAO “found instances

If you raise a concern, you will be subjected to retaliation,” said Stephen M. Facebook foils political plot

TECHNOLOGY Facebook has shut down a sophisticated disinformation operation on its platform that engaged in divisive messaging ahead of the U.S. midterm elections, the company said Tuesday, an escalation of what a top executive described as an “arms race” to manipulate the public using its tools. Facebook said it discovered 32 false pages and profiles that operated from March 2017 until this May. They lured 290,000 people with ads, events and regular posts on topics such as race and feminism — and sought to stir opposition to President Trump. The company deleted the profiles and notified law enforcement and lawmakers of the activity, as well the real Facebook users who were swept up in the operation. The pages had links to the Internet Research Agency (IRA), the Kremlin-backed organization of Russian operatives that flooded Facebook with disinformation around the 2016 election, Facebook said. Yet the operators of the newly banned pages, who Facebook said it was not in a position to identify, were more clever about covering their tracks. Lawmakers and experts attributed the activity to Russia, and Facebook itself found that some of the pages had connections to IRA. The disclosure is a sign that manipulation continues to be an active problem for Facebook and

its billions of users, even after the company has spent heavily to prevent it. Facebook, which detected the most recent pages through manual investigations, artificial intelligence and leads from law enforcement, has taken a more aggressive approach to rooting out and disclosing political abuse. The deceptive accounts have also modified their tactics. They used third parties to buy ads on their behalf and didn’t use Russian internet protocol addresses or pay with rubles, according to Facebook. And they relied heavily on promoting events, which Facebook doesn’t scrutinize as closely as ads. One such event was organized to counter-protest a far-right rally planned Aug. 10

The new revelations could worsen Facebook’s political headaches in Washington, where the Senate Intelligence Committee is set to hold a hearing today on efforts to spread political discord on social media ahead of the 2018 midterms. Two clues tied the IRA to the 32 new accounts. Facebook found that one of the most popular pages, “Resisters,” had a coadministrator that was a known IRA account. Another known IRA account shared an event associated with the same page. Some of the Facebook pages existed as far back as March 2017, suggesting that Facebook had missed some accounts in its initial sweep in early 2017 and through the fall. In total, the operatives put out 9,500 posts. Other most-followed pages were “Aztlan Warriors,” “Black Elevation” and “Mindful Being.” The most popular page had 18,000 followers — and the least popular, 16 followers. The 32 accounts ran 150 ads, which cost $11,000 and were paid for in U.S. and Canadian dollars. They promoted 30 events. Alaska Airlines is under fire after a man said he and his boyfriend were told to sit apart on a California-bound plane so a straight couple could sit together. David Cooley, owner of a popular Los Angeles gay bar, said he and his partner were in their assigned premium seats aboard Flight 1407 at John F. Kennedy International Airport when a flight attendant approached them. His partner, Cooley said, was asked to relinquish his seat and move to economy class so another couple could sit next to each other. Cooley told the attendant that they, too, are a couple and they wanted to sit together. But still, he said, his partner was given a choice: Move to coach or get off. “We could not bear the feeling of humiliation for an entire cross-country flight and left the plane,” Cooley said in a Sunday Facebook post recounting the incident. POLITICS John Kelly plans to remain as White House chief of staff through President Trump’s 2020 re-election campaign, a White House official confirmed Tuesday, quieting speculation that Kelly was nearing the exits because of tensions with the president. Kelly, who on Monday celebrated his first anniversary as chief of staff, told West Wing staff Monday that he will be staying in his post at Trump’s request through the remainder of the president’s first term.

In the dining room at his exclusive club, he turned to club members at a nearby table. “You all just got a lot richer,” Trump told them, no doubt to an enthusiastic reaction. That casual aside from Trump was the flip side to his excoriation of Charles and David Koch on Tuesday. After the Kochs announced that they wouldn’t support Sen. Heidi Heitkamp’s, DN.D., challenger for the time being, Trump lashed out on Twitter. “The globalist Koch Brothers, who have become a total joke in real Republican circles, are against Strong Borders and Powerful Trade. But Trump’s pitch is twofold: I have conservative judicial picks, and I cut their taxes and made them richer. How on earth could the Kochs take issue with Trump when he made them richer? It defies understanding. Thanks to a combination of hyperpartisanship, Trump’s willingness to say things that others wouldn’t and a stronger economy, his tenure as president has been an explicit manifestation of what

During his opening statement, Assistant U.S. Attorney Uzo Asonye told the jury that Manafort considered himself above the law as he funneled tens of millions of dollars through offshore accounts. That “secret income” was used to pay for personal expenses such as a $21,000 watch, a $15,000 jacket made of ostrich and more than $6 million worth of real estate paid for in cash, Asonye said. It’s the first trial arising from special counsel Robert Mueller’s investigation into potential ties between Donald Trump’s presidential campaign and Russia. Defense attorney Thomas Zehnle said in his opening statement that Manafort trusted others to keep track of the millions of dollars he was earning from his Ukrainian political work. But his track record doesn’t quite match that rhetoric. Where the cuts have been effective is where critics suggested they would be. Corporate executives are getting massive payouts from companies that are flush with cash that once would have gone to pay taxes. At the same time, Trump’s other economic moves are introducing other uncertainties for lower-wage Americans. The tariffs imposed by his administration have had the desired effect of destabilizing international trade

Revisiting tax-cut pitch The tax cuts were pitched as “rocket fuel” for the economy, spiking job creation and wage growth. Neither has happened. Real earnings — wage increases relative to inflation — are flat over the past year. Job growth is squarely in line with where it had been for months. Now, freshwater fish could be its next victims. Some regions in Germany sweltered as the mercury hit 102 degrees Tuesday. Rivers like the Rhine and the Elbe have soaked up so much heat that fish are beginning to suffocate. “I’m expecting a tragedy as soon as next week,” Philipp Sicher from the Swiss Fishery Association told German news agency dpa.

Archaeologists say a third-century sarcophagus found in what is now western Germany contained the remains of a young Roman woman who was buried along with perfume bottles, a makeup palette and a silver hand mirror. MLB Monday evening, with Tuesday’s 4 p.m. nonwaiver trade deadline looming, Bryce Harper mania seized the baseball world. Word spread that the Nationals were listening to offers for the six-time All-Star who becomes a free agent after the season. Late Monday, people familiar with the Nationals’ plans said the club hadn’t ruled out trading Harper. But, after what he said was a sleepless night, Nationals general manager Mike Rizzo texted The Washington Post. “Bryce is not going anywhere,” he wrote. “I believe in this team.” The Nationals never seemed likely to be big sellers. The club had also received interest in high-priced relievers such as

Kelvin Herrera and Shawn Kelley, but deals weren’t pursued. According to people familiar with the talks between the Nationals and the Marlins, Miami rejected an upgraded offer for catcher J.T. Realmuto. The Nationals were in touch with multiple teams Monday about Harper, according to people familiar with their plans. One team got the sense the Nationals got cold feet late Monday night, and that they would not give up Harper. Rizzo always said they would have to be blown away, and apparently they were not. Kintzler dealt to Cubs The Nationals traded reliever Brandon Kintzler to the Cubs on Tuesday, exactly a year after the right-hander arrived from Minnesota in another deadline deal. Chicago sent minor league pitcher Jhon Romero in the deal that came at the trade deadline. Kintzler, who turns 34 today, had a 3.59 ERA this season. The winds of change Hard rock band Halestorm looked to push boundaries with new album ‘Vicious’ MUSIC When the four-piece hard rock band Halestorm went back into the studio to work on its fourth album, the group had already thrown out a bunch of tracks it felt sounded too much like songs it had recorded before. Halestorm has been dealing with critics for years saying the group leaned too pop. But the band just wanted to evolve on new album “Vicious,” which came out Friday, leading Halestorm to make a record that captured a live sound as much as possible. “We’re on our fourth record on a major label and we won a Grammy Award, and there’s this misconception that you’ve had the success and therefore it gets easier,” frontwoman Lzzy Hale says. “It really doesn’t

because you’ve put so much out in the world and you’re like, ‘OK, what’s next?’ ” In an interview, Hale and guitarist Joe Hottinger spoke about dealing with those critics and finding new inspiration.

What was it like in the studio this time? Hottinger: We were really like, “How do we push this band forward? How do we do something interesting that’s hard rock these days?” Because it seems like it’s really hard to find good rock music and something that is pushing the boundaries a little bit.

‘Making It’ crafts us a lifeboat TV REVIEW “Making It,” a crafting competition show that premiered Tuesday on NBC, is so genuinely good-hearted and adorably inventive that it’s darn near impossible to criticize. But let’s at least try. Sooner or later, American culture will need to have a strong talk with itself about adult-onset cutesiness, which started about 20 years ago, then gained hold as a comforting response to frayed 9/11 nerves and never stopped. But now is obviously not an ideal time to reckon with our addiction to all this flowers-andbirdies sweetness and clever, hipster-hacked smarm, because
