D.C. spins in a new direction TRANSPORTATION Love it or hate it, more electric scooters are on the way. San Francisco-based startup Spin, one of several companies that arrived in D.C. as part of the dockless bike-share hype last September, says it’s removing its bright orange bikes from city sidewalks and replacing them with scooters, an attempt to catch up with competitors that have found the scooter to be a more lucrative option than the bike. “When given the option, demand for scooters is 10 times more than for bikes,” said Brian No, Spin’s head of public policy. “We need to focus on what the consumers really want.” Most companies that are now operating a dockless personal transportation system in the city offer scooters as their primary product — a major shift from a year ago, when they arrived in the city with bike fleets promising to expand bike-sharing and bike commuting. The exception is Jump, the Uber-owned

But the personal travel devices have added a level of complexity to Washington’s grid. If the

Currently, companies are allowed to have a maximum of 400 bikes or scooters or a combination of both. No said this week that Spin scooters are likely to arrive in the District this fall. The company is awaiting more details from the city about what comes after the conclusion of the pilot, he said. “We are evaluating when to bring and operate scooters in D.C.,” he said. In an interview last month, No said that the company supports “common-sense regulation.” “It would be naive for us to think that this is something that can go unregulated,” he said.

Report: D.C. among worst in mosquitoes Complaints about mosquitoes in D.C. are as common as the insects themselves. Now, a pest-control company is pointing to data that quantifies the region’s mosquito problem. According to Terminix, D.C. is the third-worst city for the critters, with Dallas first and New York City second. Baltimore ranked 10th. Terminix based its list on “mosquito services rendered” between July 1, 2017, and July 1, 2018. Federal team evaluating state’s election system
REGION The deluge of storms throughout the D.C. area over the past several months has done more than ruin summer plans — it has wreaked millions of dollars in damage to the region’s national park lands. Weather-related damage this year is among the worst in recent memory, National Park Service officials said. Parks in the region have been pummeled by storms since early spring, officials said, causing floods, downed trees, washed-out trails and waterways so bloated that repairs have remained nearly impossible. In many cases, the damage has outpaced the agency’s ability to fund fixes and hampered basic maintenance tasks like cutting grass and emptying toilets. Since the beginning of June, the Washington area has been doused with more than a foot of rain, largely concentrated during the months of July and August. That is more than twice the average for this time of year. The first issues arose in March, when high winds forced Prince William Forest Park to close for weeks as crews removed debris, downed power lines and more than 600 fallen or hazardous trees. It cost more than $600,000 to clear the area, Park Service spokeswoman Jenny Anzelmo-Sarles said. Starting in May, several storms hit the Chesapeake and Ohio Canal National Historical

Kevin Brandt said. Fixing the damaged portion of the trail is expected to take several weeks once work begins. Preliminary estimates indicate the park might have incurred more than $14 million in damage from storms this year, Brandt said. The agency already has
spent $1 million trying to assess and contain the damage along the canal, a number Anzelmo-Sarles said is likely to increase. Toilets along muddy trails also posed a problem. The pump trucks used to clean park bathrooms are heavy, and attempting to drive through muddy trails could cause more damage. Other times, water made the trails impassible. For Park Service officials, the wet weather has done more than cause months of headaches — it has made them think critically about the future. “This is the first time in a long time we’ve seen the storms going on and on all summer like they have this year,” Brandt said. “We’re thinking we’re going to have to look at entirely new strategies for how to deal with that when it happens again.” MARISSA J. A silent problem: Should agencies use secrecy pacts? nondisclosure policies, forms, and agreements include a specific statement on individuals’ obligations and rights concerning disclosure of evidence of fraud, waste, or abuse to permissible recipients.” Those recipients include the inspector general and Congress. Yet many DHS forms and agreements contain provisions that could discourage whistleblowers from reporting abuse because the required statement was not included. The inspector general found that just 25 of 88 settlement agreements included the required statement about employee rights. DHS told the inspector general that forms without the required statement will be “updated in the near future.” Preventing employees from disclosing confidential and sensitive information is a no-brainer. But a more essential question is: Why should information that is critical of or embarrassing to an agency have the cover of a nondisclosure agreement? Rep. Elijah Cummings, D-Md., pointed to this basic issue last week when he spoke of “the Trump administration’s abuse of nondisclosure agreements.” The DHS OIG report

Change allows for a speedier hiring process

As we know from President Trump’s relationships with adult film and reality television stars, he likes nondisclosure agreements. But should NDAs, as the agreements are known, be used by government agencies? Using them to keep illicit sexual affairs secret is one thing. Pushing public employees into such agreements, outside of classified and sensitive information situations, is quite another. A new report by the Department of Homeland Security’s (DHS) Office of Inspector General (OIG) covers the failure of officials to notify employees confronted with secrecy pacts of their rights under whistleblower protection law. But the OIG didn’t explore a more fundamental point — do secrecy agreements, in personnel settlements for example, have an appropriate role in government if confidential information is not involved? If there’s a good reason for the pacts, DHS won’t say what it is. The report says the Whistleblower Protection Enhancement Act of 2012 (WPEA) requires “that Federal agencies’
suggests the department uses NDAs to avoid criticism. It cites a personnel settlement agreement template that says the employee “shall not make any comments or take any actions with the effect of disparaging or undermining [DHS], including undermining the operations or leadership of [the component].” The department’s public affairs office would not answer questions about that language or the appropriate use of secrecy agreements. Heather White, a partner with The Federal Practice Group, a law firm that
specializes in federal employment law, said it is not right for government agencies to use nondisclosure agreements outside of classified and sensitive information situations. “I don’t regard protecting an agency from embarrassment as valid,” she said. “And I don’t see any other valid reason” to use nondisclosure agreements in non-confidential cases. Q. Doesn’t the government realize that its hiring process is too slow, especially for those of us with student debt? A. It does, and a recent change in law should help at least a little. That change allows agencies to bypass standard hiring processes for qualified applicants who have graduated from college within the past two years. Similarly, agencies can now offer temporary jobs to qualified students and later convert them directly to permanent status if they meet certain standards. However, implementing rules are needed first, and even then, the policies will apply only in entry- to mid-level professional or administrative jobs, and only to 15 percent of such vacancies. Other requirements also continue to apply, such as the need to qualify for a security clearance in certain positions. Still, the Partnership for Public Service, an organization that advocates for efficient government, predicted the changes will help expand the slim ranks of younger federal employees — 6 percent are younger than 30, a quarter of the private-sector rate. “By giving highly qualified students and recent graduates a leg up in the hiring process, agencies can begin to close the gap,” said Max Stier, president and chief executive. EPA aims to ease up on coal WASHINGTON The Trump administration moved to dismantle another major piece of former President Obama’s environmental legacy Tuesday, proposing to dramatically scale back restrictions on climate-changing emissions from coal-fired power plants even as it acknowledged that could lead to more premature deaths and serious illnesses. The Trump plan broadly increases the authority given states to decide how and how much to regulate coal power plants. The bodies of Watts’ wife and children were found last week on the property of the oil and gas company he worked for. The new documents said Watts, 33, told detectives he and his wife, Shanann, 34, discussed ending their marriage on Aug. 13. From crisis to a record bull market

STOCK MARKET The bull market in U.S. stocks is about to become the longest in history. If stocks don’t drop significantly by the close of trading today, the bull market that began in March 2009 will have lasted nine years, five months and 13 days, a record that few would have predicted when the market struggled to find its footing after a 50 percent plunge during the financial crisis. The long rally has added trillions of dollars to household wealth, helping the economy, and stands as a testament to the ability of large U.S. companies to squeeze out profits in tough times and confidence among investors as they shrugged off repeated crises and kept buying. “There was no manic trading, there was no panic buying or selling,” said Jack Ablin, chief investment officer of Cresset Wealth Advisors. “It’s been pretty steady.” For such an enduring bull market, it shares little of the hallmarks of prior rallies. Unlike earlier rallies, individual investors have largely sat out after getting burned by two crashes in less than a decade. Trading has been lackluster, with few shares exchanging hands each day. Private companies have also shown little enthusiasm, with fewer selling stock in initial public offerings than in previous bull runs.
Yet this bull market has been remarkably resilient. After several blows that might have killed off a less robust rally — fears of a eurozone collapse, plunging oil prices, a U.S. credit downgrade, President Trump’s trade fights — investors soon returned to buying, avoiding a 20 percent drop in stocks that by common definition marks the end of bull markets. “I don’t think anyone could have predicted the length and strength of this bull market,” said David Lebovitz, a global market strategist at JPMorgan Asset Management. The question now is when the rally will end. The Federal Reserve is undoing many of the stimulative measures that supported the market, including keeping interest rates near zero. There are also mounting threats to global trade that have unsettled investors. For all its longevity and gains, the final verdict on the bull market won’t be known until it ends. The financial crisis of 2008 that ended the last bull market laid bare just how much debt and risk-taking had fueled gains in the previous seven years. The dot-com bust that ended the ’90s rally showed how reckless investors had been. This time, many of the unanswered questions concern the Fed’s monetary stimulus. How much did it help boost stocks, and thus the broader

His prediction is that stocks will plunge by the end of the year and a bear market will begin. Others are more optimistic. JPMorgan’s Lebovitz takes comfort in the fact investors have been skeptical of the rally all along, which he says has allowed none of the excesses of prior bull markets to build up. “This is a bull market that people love to hate,” he said. “Blind exuberance hasn’t been a characteristic.” Asked how much longer the rally will last, he said: “At least another year, but two might be a bit of stretch.” BERNARD CONDON (AP)

In 1913, Julian Carr, a prominent businessman and supporter of the Ku Klux Klan, spoke at the unveiling of a statue of a Confederate soldier on the campus of the University of North Carolina. It had been placed there by the Daughters of the Confederacy. Carr’s speech made clear the symbolism of the statue. He credited Confederate soldiers with saving “the very life of the Anglo-Saxon race in the South.” He also boasted of publicly whipping a black woman shortly after the end of the Civil War. On Monday night, the statue that he had dedicated was toppled from its pedestal by a crowd of protesters. The rally began as a demonstration of solidarity with Maya Little, a graduate student in history, who was arrested in April after reading aloud from Carr’s speech and covering the statue, known as “Silent Sam,” with red ink and her own blood. Leaders of North Carolina’s university system spoke out Tuesday to condemn the protesters’ action. The system’s president and the chair of the Board of Governors promised a full criminal investigation. Gov. Roy Cooper, D, has called for removing rebel symbols on public land, but said the protesters took the wrong approach. A state historic panel is set to meet today to debate Cooper’s request. POLITICS Michael Cohen, P resident Trump’s former personal lawyer and “fixer,” pleaded guilty Tuesday to campaign finance violations and other charges, saying he and Trump arranged the payment of hush money to porn star Stormy Daniels and a former Playboy model to influence the election. Cohen’s account appears to implicate Trump himself in a crime, though whether — or when — a president can be prosecuted remains a matter of legal dispute. In a deal reached with federal prosecutors, Cohen, 51, pleaded guilty to eight counts in all, including tax evasion and making a false statement to a financial institution. He could get about four to five years in prison at sentencing Dec. 12. In entering the plea, Cohen did not name the two women or even Trump, recounting instead that he worked with an “unnamed candidate.” But the amounts and the dates all lined up with the payments made to Daniels and Playboy Playmate Karen McDougal in the weeks and months leading up to the 2016 presidential election. Manafort guilty on 8 counts Mueller gets a victory in tax, fraud conviction of former Trump aide ALEXANDRIA A jury on Tuesday found former Trump campaign chairman Paul Manafort guilty on tax and bank fraud charges — a major if not complete victory for special counsel Robert Mueller as he continues to investigate the president’s associates. The jury convicted Manafort on eight of the 18 counts against him and said it was deadlocked on the other 10. U.S. District Court Judge T.S. Ellis declared a mistrial on those charges. Manafort, who led Trump’s election effort during a crucial stretch of 2016, stood impassively and showed little reaction as the clerk read the word “guilty” eight times. As through most of the three-week trial, Manafort showed no emotion as he looked at the six women and six men who convicted him. Manafort, 69, was found guilty of filing a false tax return in each of the years from 2010 through 2014, as well as not filing a form to report a foreign bank account as required in 2012. He was also convicted of two instances of bank fraud, related to a $3.4 million loan from Citizens Bank and a $1 million loan from Banc of California. The charges on which the jury deadlocked were three counts for not filing a form to report a foreign bank account, and seven for committing bank fraud or conspiring to commit bank fraud. After the clerk read the verdict, Ellis asked the jurors if they wanted to keep their names confidential. They said he hid millions of dollars in foreign bank accounts that went unreported to the IRS, and then later lied to banks in order to get millions of dollars in loans. His lawyers had argued that Gates, not Manafort, was the real criminal, pointing to Gates’ admitted lies, theft and infidelity. Gates pleaded guilty in February to lying to the FBI and conspiring against the U.S., and has said he hopes to get a lesser sentence by cooperating against Manafort. Prosecutors, in turn, told the jury that the most compelling evidence in the case were the dozens of documents, many of them emails, showing Manafort oversaw the false statements to the IRS and banks. Manafort’s lawyers called no witnesses, arguing that prosecutors had failed to prove beyond a reasonable doubt that he intended to defraud the government or banks, suggesting their client might not have known the law. Manafort faces a second trial in September in Washington on charges of conspiracy against the U.S., conspiracy to launder money, making false statements and acting as an unregistered foreign agent for Ukraine. Undocumented man charged in student’s death BROOKLYN, IOWA A man from Mexico living in the U.S. illegally has confessed to kidnapping college student Mollie Tibbetts while she was running in her Iowa hometown, killing her and dumping her body in a rural field, authorities said Tuesday. Cristhian Bahena Rivera, 24, was arrested and charged with first-degree murder in the death of Tibbetts, whose July 18 disappearance set off a massive search involving state and federal authorities. Rivera led authorities Tuesday to the body in a cornfield 12 miles from Brooklyn, Iowa, where Tibbetts was last seen running, Division of Criminal Investigation special agent Rick Rahn said. “I can’t speak about the motive. I can just tell you that it seemed that he followed her, seemed to be drawn to her on that particular day, for whatever reason he chose to abduct her,” Rahn said. Investigators said they zeroed in on Rivera after obtaining footage from surveillance cameras, which showed a Chevy Malibu connected to Rivera that was driving back and forth as Tibbetts was running, Rahn said. An affidavit alleged that Rivera said he started running alongside her. Tibbetts said she was going to call the police and Rivera panicked and blacked out. In so doing, Washington all but waved a white flag on a season that began with World Series hopes and a roster talented enough to fulfill them. This team, under this general manager, has never before given up on a roster this talented. “These moves allow us financial flexibility going into the 2019 season, to allocate our resources in that direction,” general manager Mike Rizzo said. “… These are tough decisions.” Three weeks ago, at the trade deadline, the Nationals decided against selling off. In his team’s second game of the preseason, Redskins coach Jay Gruden opened up his playbook and gave fans a peek into how he’ll use quarterback Alex Smith this fall. Smith directed just one series Thursday in a 15-13 win over the Jets at FedEx Field, but the six passes he threw to five different targets spoke volumes. Smith is expected to play extensively when the Broncos visit the Redskins on Friday. Although he’s seen little game action so far, the new franchise QB has delighted Gruden by quickly picking up the playbook since arriving in an offseason trade from Kansas City. Rookie running back Derrius Guice is already out for the season with a torn ACL, so Smith will have to shoulder even more of the offense. But what will that offense
look like? Will Smith concentrate his attention on throws over the middle to Jordan Reed and Jamison Crowder? Or is he likely to take more deep shots to Paul Richardson? Can Smith flash a little more of his running ability to keep linebackers guessing? Perhaps the Redskins will just dinkand-dunk down the field. “I don’t think there is anything we can’t do or won’t do,” Smith said. His one series against the Jets proved that. Smith went 4-of-6 for 48 yards, and rookie receiver Trey Quinn dropped a pass in the end zone. Smith looked like he was playing chess while the Jets were playing checkers, maneuvering much like he did in practice throughout training camp. His first throw was a quick strike to Richardson on a naked bootleg that he released as he was being hit by linebacker Jordan Jenkins. The pass gained

Overall, Smith showed a lot of capabilities in just one series. He didn’t find Richardson long, but did connect with the deep threat on a short pass. Smith was patient on an inside pass to Doctson. And as for the attempt to Quinn, Smith trusted a rookie to reach an assigned spot. That’s also something Cousins might not have done. It was a small taste, and Smith probably won’t show much more against Denver. But the 14th-year pro is obviously ready for the regular season and has already established chemistry with his targets. A new community takes advantage of an H Street alley space
BUYING NEW Spurred on by the strong demand for housing in the District, developers are racing to unlock the value of Washington’s alleys, the shadowy passageways that run for hundreds of miles between and behind its streets. Among them is Monarch Urban, which recently completed four brick townhouses and a commercial space as part of a redevelopment project at Linden Court NE, an alley off H Street. “Linden Court was a diamond in the rough, a unique find,” said Matt Kennerknecht, vice president of Monarch Urban, a division of Monarch Building & Development Corp. “The building
originally had 10 rowhouses, six of which were converted into a workshop and then later into a body shop.” To reconfigure the body shop for the project, Kennerknecht and others from Monarch Urban talked to neighbors in the alley and asked them to support several zoning variances providing relief from height and other regulations. The resulting four townhouses, with about 1,600 square feet across four floors each, have been outfitted with features that keep them from feeling too dark or, frankly, like they’re in an alley. Each townhouse has a narrow balcony off the kitchen and a roof deck off the master bedroom suite. Additional design elements help to maximize light and privacy in the townhouses’ outdoor spaces. VMAs bring stars, skip the drama The MTV Video Music Awards show is known for drama, but Monday night’s ceremony was pretty tame. Here are some top highlights from the telecast:

“Sweetener,” which came out Friday, marks Ariana Grande’s first album since the fatal bombing at her May 2017 show in Manchester, England. It serves as Grande’s way of saying that everything is going to be all right, a message woven through 47 minutes of pop and R&B. She also dedicates 40 seconds of silence to the Manchester victims on “get well soon,” bringing the track to 5 minutes and 22 seconds — a nod to the events of May 22. Grande promised fans that “Sweetener” would be different from her past synth-pop hits, telling The Fader in May, “I’ve always just been like a shiny, singing, 5-6-7-8, sexy-dance … sexy thing. But now it’s like, ‘OK … issa bop — but issa message.” Producers Max Martin and Ilya contributed a great deal to Grande’s 2016 album “Dangerous Woman,” and they split the task this time with Tommy Brown, Pharrell Williams and a few others. Martin and Ilya are responsible for singles “no tears left to cry” (she uses lowercase for her titles) and “God is a woman,” which recall some of Grande’s older dance-pop work. So does the Brown-produced R&B track “better off.” But Williams switched things up by bringing his trademark funk and eclectic beats to six tracks, including those featuring Nicki Minaj (“the light is coming”) and Missy Elliott (“borderline”).
We are more aware of Pete Davidson than ever before, which the “Saturday Night Live” star attributes to his being engaged to “a super-famous person.” He’s right — tabloids have spent the entire summer obsessing over the whirlwind relationship. (Their best couple name is “Grandson,” if you were wondering.) Neither one has shied away from addressing the relationship on social media, but Grande went a step further by literally singing Davidson’s praises in “Sweetener.” She calls him her soulmate and says that the “universe must have my back.” The track was once just named “Pete,” but Grande tweeted in July that she likes the way “pete davidson” looks better: “music lasts forever. it’ll outlive any tattoo, any memory, any anything, even myself so i want my love for him and how i feel to be a part of that.”
The album’s “R.E.M” sounds like another Pharrell production that first surfaced online last year — a Beyonce demo called “Wake Up.” A fan asked on Twitter about the connection after Grande teased her song in July, to which the singer responded, “it’s an entirely new song now but the hook was so dreamy … it had to find a home i think it’ll be one of your favs.” (The tweet also includes some lovely cloud emoji.) It is unclear why the song hopped from one diva to another, but the Pharrell connection probably has something to do with it. “Sweetener” also includes a nod to Grande’s professed idol, Imogen Heap, turning the latter’s “Goodnight and Go” into “goodnight n go,” a radio-friendly, bass-heavy rendition. Grande referred to it as a “remix & a cover” of a song by “the woman who inspired my every move.”
The last track, “get well soon,” guides listeners through an anxiety attack and back to stability: “They say my system is overloaded / Girl, what’s wrong with you? Come back down. I’m too much in my head, did you notice?” Grande tweeted to a fan in May that her anxiety made her feel like she was outside of her body: “i felt like i was floating for like 3 months last year & not in a nice way.” She told The Fader in a piece published the next day that she wrote the lyrics to “get well soon” right after an attack. “The thing that makes me feel OK with opening up and finally allowing myself to be vulnerable is that I know [my fans] feel the same feelings,” she said. “I have fans that have become friends of mine. … I played [the song] for them before I played it for my label. They were like, ‘Thank you,’ when they heard that one.”

A deep dive into the otherworldly Animal Collective’s new album is an audiovisual tribute to coral reefs MUSIC If there’s one thing that has been consistent about the members of Baltimore-bred indie rock band Animal Collective, it’s that they will almost assuredly zig when you expect them to zag. Case in point: “Tangerine Reef,” a new audiovisual album featuring images of the sexual reproduction of coral reefs created to coincide with
the celebration of 2018 as the “International Year of the Reef.” When you watch the video, you’re sucked into an almost uncanny valley of coral reef imagery in its natural state. The figures appear to be too vivid and acting in such an oddly patterned and discernible way, as though you’re watching computer-generated imagery. You’re not. “Some of our initial inspirations for making music were ... the unknown and the mysterious,” says Dave Portner, the band’s covocalist and guitarist. “It’s cool to be able to remind yourself and
to remind people that there’s still otherworldly and unknown things out there to be seen or heard.” This is Animal Collective in a nutshell: an amorphous musical entity that seems allergic to any casual adoration from fans and critics. Rather than regurgitating the same sounds and thoughts every album, the band’s members have given themselves the runway to evolve from four guys who used to take the stage in animal masks to having the freedom to be themselves. The genesis of “Tangerine Reef” came about in 2017 as a one-off art exhibition called “Coral Orgy” in Miami, which was billed as “a site-specific performance celebrating the cosmic synchronicity of sex on the reef.” This theme becomes evident when viewing the album, because the imagery of coral is rife with mouthlike orifices enchantingly swaying. That imagery was filmed by art collaborative Coral Morphologic, an art-science duo formed by marine biologist Colin Foord and musician J.D. McKay. Brian Weitz, who mans the band’s synthesizer sounds, and Josh Dibb, the group’s multiinstrumentalist, have been avid scuba divers for about two decades. (Drummer and co-vocalist Noah Lennox sat out this project.) “I think everybody is aware of the direction the environment is headed over the last few decades — and the ocean has been hit particularly hard for a lot of reasons,” says Weitz, who used to work for a Senate subcommittee on oceans, fisheries and the Coast Guard. “We thought this project could help highlight that.” HAU CHU (THE WASHINGTON POST)
