Camping out for the court THE DISTRICT Earlier this month — once again — folks had to sleep on the sidewalk for days to see or hear the Supreme Court at work. Some of those in line for Masterpiece Cakeshop v. Colorado Civil Rights Commission, the case of the Colorado baker who refused to make a wedding cake for a same-sex couple, waited for four days. In the end, about 50 or so got a golden ticket, according to those in line. Some who waited were turned away. This is becoming the norm when the court takes up big issues. Cases with lesser profiles can also be cause for all-nighters. The first people seeking admission to recent oral arguments in New Jersey’s bid for legalized sports betting got in line at midnight for a 10 a.m. argument. Some of those who care about the court are disturbed by the scenes of paid line-sitters. Kannon Shanmugam, a lawyer who frequently argues before the court, says there must be a better way.

In a tweet, he said: “Paid line-sitting at #SCOTUS is unseemly. But more generally, people shouldn’t have to line up in the cold for days to get into a public court hearing.” Cameras are not allowed in the Supreme Court, and years of calls from Congress, the media and the public to open up the proceedings have left the justices unmoved. Not one of the nine favors televising the court’s arguments. No live audio, either, or even the same-day release of a tape.
“I don’t think this is exactly what democracy looks like.” MARTIN NAUNOV, who slept outside the Supreme Court ahead of the Masterpiece case. When he first saw the line, Naunov thought, “OK, this is what democracy looks like.” But that view changed when he learned many of those in front of him were professional line-sitters.
Gabe Roth, executive director of Fix the Court, a group that seeks greater Supreme Court transparency, suggests some sort of lottery as an improvement over the current situation. It was line-standers who started the rush in Masterpiece. At noon the Friday before the Tuesday argument, 18 people began the queue, holding spots for members of Alliance Defending Freedom, the conservative legal organization representing Jack Phillips, the baker in the case. Martin Naunov, who wrote his college dissertation on the Masterpiece case, was on the bus from New York when he learned the line had already started. He had meant to stay with a friend for a day or so. But he went straight from Union Station to the court and got in line with nothing but his bag. The professionals became mentors. They held his spot — he was No. 25 — and sent him to the Walmart on H Street NW to buy an umbrella, tarp, sleeping bag and blanket. He found the oral arguments “excellent” and loved the experience. A new home for Children’s Museum The National Children’s Museum will re-emerge in 2019 in a specially designed space in the Ronald Reagan Building and International Trade Center, officials announced Tuesday. The 33,000-squarefoot space will house interactive exhibitions with a focus on STEAM (science, technology, engineering, arts and math) subjects. The museum will have its own entrance from the Woodrow Wilson Plaza, a cafe and gift shop. Officials hope to open it in March 2019. (TWP)

Federal judge apologizes to falsely convicted men A federal judge has personally apologized to two men who were convicted after a police officer charged with corruption allegedly planted drugs on them. The Baltimore Sun reports that U.S. District Court Judge Richard D. Bennett on Monday vacated the convictions of Umar Burley and Brent Matthews. The two spent years in prison based on police work done by a Gun Trace Task Force. Bennett, who had previously accepted Burley and Matthews’ plea deals, stepped down from the bench and shook both men’s hands Monday while saying he was apologizing on behalf of the government. (AP)
VIRGINIA The balance of power in Virginia’s legislature turned on a single vote in a recount Tuesday that flipped a seat in the House of Delegates from Republican to Democrat, leaving control of the lower chamber evenly split. The outcome, which reverberated across Virginia, ends 17 years of GOP control of the House and forces Republicans into a rare episode of power sharing with Democrats that will refashion the political landscape in Richmond. It was the culmination of last month’s Democratic wave that had already diminished Republican power in purple Virginia. Democrat Shelly Simonds emerged from the recount as the apparent winner in the 94th House district, seizing the seat from Republican incumbent David Yancey. A three-judge panel still must certify the results, an event scheduled for today. Of the 23,215 votes cast in the district on Election Day, Yancey held a tenuous lead of just 10 votes going into Tuesday’s recount. But five tedious hours later, after painstaking counting overseen by local elections officials and the clerk of court, Yancey’s lead narrowed before it gradually disappeared and then reversed. The final tally: 11,608 for Simonds to 11,607 for Yancey. “I knew it was going to be a roller-coaster ride and the

Terry McAuliffe, a big cheerleader for his party, had thought the Republican edge was insurmountable. That wave hit a new high mark with Tuesday’s recount. “I don’t even live in the district but I am so excited, I can’t believe it,” said Susan Mariner, a Democrat who had come over from Virginia Beach just to see the recount. Even election officials who had spent the day keeping order seemed rattled by the fact that such a momentous race could be settled in such dramatic fashion. The old adage about how every vote counts is true, said Newport News Electoral Board Chairman Sean Devlin as he announced the official result. “Please make sure to stress that,” he told the gathered reporters. The amount Gov. Larry Hogan has announced in new traffic relief initiatives for the Baltimore region. Hogan said Tuesday it includes adding lanes to 27 miles of highway on the Baltimore Beltway and I-95. The plan includes $151 million for congestion relief on both the inner and outer loops of I-695 from I-70 to Route 43. Part of the plan also includes $210 million to extend the northbound I-95 Express Toll Lanes for nearly eight miles from north of Route 43 in Baltimore County to Route 24. (AP)

Purple Line construction to continue after ruling A federal appeals court ruled Tuesday that Maryland’s Purple Line project does not require further environmental review, allowing construction to continue on the 16-mile light-rail line. The ruling by a three-judge panel for the U.S. Court of Appeals for the D.C. Circuit ends a three-year legal battle over the project, unless its opponents try to appeal to the Supreme Court. The ruling reversed a 2016 order that had required officials to hold off on building the line until it updated its environmental study. (TWP) MARYLAND
State gives Indian status to Accohannock Tribe Maryland Gov. Larry Hogan has signed an executive order granting the Accohannock Tribe Indian status. Hogan’s office said Tuesday that the designation means the tribe qualifies for federal, state and nonprofit assistance to tribal members and for cultural education. The Accohannock Tribe mostly lives on the Eastern Shore. Maryland Indian Status has also been granted to the Piscataway-Canoy Tribe and the Piscataway Indian Nation. (AP)

The attorney who has led Charlottesville’s legal response to lawsuits over a white nationalist rally and the city’s efforts to remove two Confederate monuments is stepping down. The city announced in a statement Tuesday that City Attorney Craig Brown will leave his position at the end of January to pursue an undisclosed opportunity. The statement said Brown was promoted to city attorney in 2001. The news came a day after the city announced the abrupt retirement of Police Chief Al Thomas. The statement said Charlottesville will begin a search for its next city attorney immediately. (AP)
A firefighter and five residents of an apartment building were injured Tuesday in a fire in Prince George’s County, authorities said. At about 7:15 a.m., firefighters responded to a fire at a two-story apartment building in Hillcrest Heights. Five residents of the building who were rescued were injured, authorities said. The firefighter suffered a minor injury and returned to duty. Of the injured residents, two were transported for treatment of injuries. Most of the residents in the two buildings damaged by the fire were likely to be displaced, authorities said.

Instead, a jury agreed that Terry Millender and his wife, Brenda Millender, who together ran Victorious Life Church, defrauded their friends and flock out of millions of dollars. At the trial, the pastor argued that he was guilty only of financial mismanagement, not fraud. Workers’ wallets: Labor adviser has plans to slash pay The Trump administration’s consideration of a wage freeze for federal employees is one piece of a renewed multi-front Republican push to shrink those workers’ pay, benefits and workforce. That effort has been around for years, but it now has an intellectual champion in the White House, and I don’t mean President Trump. James Sherk joined Trump’s team as a labor adviser early this year after working for the conservative Heritage Foundation. His co-authored report, “Why It Is Time to Reform Compensation for Federal Employees,” was published by Heritage days after the 2016 Republican National Convention nominated Trump. The bottom line: Feds would get less pay and benefits for more work. “Our paper was intended to serve as a framework for any … elected official who wants to improve the way the federal
government operates,” Rachel Greszler, a Heritage economist who wrote the report with Sherk, said by email. “Reform” really does not convey the serious bite of their proposals. The central thesis is that federal workers are overcompensated compared with those in the private sector. The authors outlined a plan to cut those costs — a blueprint that Sherk can now follow from a position of influence in the White House. Rather than making the government a model employer, the proposals would unite Uncle Sam with employee-regressive business practices designed to maximize profits. But Sam is in the business of service, not propelling profits. Sherk and Greszler want to: Restrict within-grade increases, also known as step increases. These pay hikes are based largely on tenure, rather than performance. “Limiting the size of step increases would, over time, lower pay for all federal employees.”
Extend the probationary period to three years, giving managers more time to fire workers at will. Speed the firing process by limiting the opportunity to appeal terminations and lowering the proof needed to give workers the boot from “a preponderance of evidence” to “substantial evidence.” Cut paid time off, including vacation and sick time. The authors noted that few private employers provide paid time off for every federal holiday, implying that federal employers also should not provide it. “These policies would boost federal employees’ productivity by increasing the number of days they work,” Greszler and Sherk wrote, “and thus could reduce the number of federal employees needed to carry out government functions.” Although Sherk has a longstanding interest in federal compensation, none of several federal employee organizations contacted said he had spoken with them since he joined the White House. “We don’t know him,” said Steve Lenkart, executive director of the National Federation of Federal Employees. “He doesn’t represent the values that working people share, nor does he understand the complexities of the federal workforce.” Follow Joe Davidson on Twitter @joedavidsonWP

GOP close to passing tax bill Republicans celebrate new legislation despite rules hiccup in Senate

POLITICS Republicans are on the verge of passing a massive tax overhaul plan this week. They appeared to have the votes they needed to pass the measure through the Senate, after holdout Republicans Marco Rubio of Florida and Bob Corker of Tennessee said last week they’d support it. “Congress is standing at the doorstep of a historic opportunity,” Majority Leader Mitch McConnell, R-Ky., said Tuesday. “Here’s what we set out to do: Take money out of Washington’s pockets and put it back in the pockets of middle-class Americans.” House Republicans thought they had finished their tax work after they passed a version of the bill Tuesday. The measure passed 227 to 203, with all except 12 Republicans voting for the bill. Zero Democrats supported it. But the plan hit a snag when the Senate parliamentarian ruled that three of its provisions violated the chamber’s Byrd Rule — guidelines on what types of legislation can pass with 50 votes. Senate Republicans still aimed to pass the measure Tuesday night with a series of minor changes. None of the changes were expected to cost the plan any GOP support, but it will require the House to vote again, as identical versions of the bill must pass the

House and Senate before the president can sign it into law. House GOP leaders asked members to be ready to vote by 10 a.m. today. The parliamentarian took issue with a provision allowing for taxincentivized accounts for homeschooling expenses, as well as one dealing with exempting certain universities’ endowments from a new excise tax. The third had to do with the abbreviated name of the legislation. Democrats raised the provisions with the parliamentarian in a bid to delay the bill, but they lack the votes to prevent it from becoming law. Despite the delay, Republicans celebrated the anticipated passage of their tax plan, which would be their first major legislative victory since taking control of government in January.
“This is one of the most important pieces of legislation Congress has passed in decades. … For all those millions of Americans struggling paycheck to paycheck, help is on the way,” House Speaker Paul Ryan, RWis., said after the House vote. President Trump has for months pushed Congress to send him a tax plan by Christmas. The core of the plan is a big, permanent cut to the corporate tax rate, lowering it from 35 percent to 21. The plan would also cut individual rates for all income tax levels. The largest cuts would go to the wealthy, but in 2018 nearly all Americans will see their income taxes drop, according to a nonpartisan analysis of the plan released Monday. Families earning less than $25,000 a year
would receive an average tax cut of $60; those earning more that $733,000 would see an average cut of $51,000, according to the nonpartisan Tax Policy Center. Many of the individual tax breaks are set to expire in coming years. Republicans set those expiration dates to comply with limits on how much their bill could add to the nation’s deficit. They say a future Congress will extend them or make them permanent. Amid outrage, EPA ends $120K “media tracking” contract with conservative opposition-research firm
HEALTH The government lifted a threeyear moratorium Tuesday on funding for research into ways that certain viruses can be made more virulent and transmissible, announcing a new plan for assessing applications to study these and other pathogens. The new policy for pathogens capable of creating a pandemic will allow researchers who want to study them to apply for funding through the new process outlined by the Department of Health and Human Services. The end of the moratorium applies to research on SARS (pictured above), MERS, influenza and other dangerous viruses that researchers might want to investigate, such as Ebola. The 2014 pause was put in place after a series of lab incidents. Francis Collins, director of the National Institutes of Health, estimated that only a “handful” of facilities with the “highest level of containment” would qualify to conduct this kind of research, which is aimed at developing vaccines and understanding how viruses mutate. He said 10 of the 21 research efforts that had been stopped obtained waivers to resume their work. New requirements include that the potential risks of the research be justified by the potential benefits; that there is no other feasible way to answer the same question that poses less risk; and that the proposed experiment be reviewed by an independent expert panel. House Republicans are proposing to direct $81 billion in taxpayer funds to respond to this year’s hurricanes and wildfires, in what would be the single largest emergency spending bill since 2009’s supplemental funding for the war on terrorism. A bill filed Monday by House Appropriations Committee Chairman Rodney Frelinghuysen, R-N.J., includes $28 billion for Federal Emergency Management Agency programs, $26 billion in disaster recovery block grants and $12 billion for infrastructure repairs, as well as billions for agriculture, education and smallbusiness loans. If passed, it would be the third installment of federal disaster aid aimed at victims of hurricanes Harvey, Irma and Maria and more recent wildfires in California and other western states. Congress previously appropriated $15.2 billion in September and $36.5 billion in October; the House bill would bring total disaster funding for the year to more than $130 billion. The request comes as Congress races toward a midnight Friday deadline to extend federal funding and avert a partial government shutdown. On Tuesday, major differences remained between the House and Senate on the funding, not to mention between Republicans and Democrats.
As the cryptocurrency grows, so does its drain on the world’s electricity resources ENVIRONMENT The exploding price of the cryptocurrency bitcoin in recent months has triggered doubts not only about the financial sustainability of the rally, but also about the environmental sustainability of the currency itself. One alarmist article in Newsweek said that bitcoin computer operations could consume “all of the world’s energy by 2020.” The website Digiconomist claims that bitcoin operations use as much energy as Denmark, or enough to power 3,071,823 U.S. households. Other analysts say the true figure is smaller, albeit hard to measure because it is spread around the world, generated by an unclear mix of machines and co-mingled with other sources of electricity demand. But several experts told The Washington Post that bitcoin probably uses as much as 1 to 4 gigawatts, or billion watts, of electricity, roughly the output of one to three nuclear reactors. That would amount to less than 1 percent of U.S. electricity alone and no more than 0.14 percent of global electricity generation. That won’t devour the world’s entire electricity resources, but it’s a significant drain — and it’s
growing fast. Moreover, some of the electricity used, in China in particular, may come from burning coal — a fossil fuel that contributes most heavily to climate change. The reason bitcoin uses a lot of energy is rooted in the way the bitcoin network operates. A digital currency, bitcoin is not controlled by any central bank or commercial clearinghouse but by a network of users who expend large amounts of computing power, and thus energy, building a so-called “blockchain” of bitcoin payment transactions. To compile this comprehensive record, the bitcoin network relies on “miners.” Bitcoin miners have to perform a phenomenally large number of computer calculations to track and verify transactions and solve complex puzzles to obtain bitcoin rewards. As bitcoins become more popular and valuable, the puzzles miners face grow more difficult, and therefore the demand for highpowered computer processing grows as well. That means more energy usage. “If the price of bitcoin continues to rise, it will continue to use more energy,” said Mike

Ethereum, the second most widely used cryptocurrency, is changing its protocol to reduce energy use, said Claire Henly, a manager at the Rocky Mountain Institute, a nonprofit energy research and consulting group. She said that bitcoin, unlike many other digital currencies using blockchains, is difficult to change because it is decentralized. However, she added, “There are definitely changes that can be made that would reduce energy use and not make this a fatal flaw for bitcoin.” (TWP)

Malone thinks the usage has gone up a lot more since his 2014 report, estimating that 1.2 gigawatts is now probably the lowest the number can be — and that assumes everyone is using the most efficient computing hardware, which they certainly are not. That’s roughly comparable to the electricity generated steadily by one of the larger utility-scale nuclear reactors in the U.S. (There are 99 U.S. nuclear reactors in total, which provide about 20 percent of the nation’s electricity.) Harald Vranken, a professor in the Netherlands, thinks that with the bitcoin explosion this year, energy usage has increased to between 1 and 4 gigawatts. “It will only go up if things increase like they have been doing in the last four months,” Vranken said. “So at some point in time, I think, this situation cannot hold. I think that is clear.”

Investigators are looking into whether the Amtrak engineer whose speeding train plunged off an overpass in Washington state, killing at least three people, was distracted by the presence of an employee-in-training next to him in the locomotive, a federal official said Tuesday. The official, who spoke on condition of anonymity, said investigators want to know whether the engineer lost “situational awareness” because of the second person in the cab. The train was hurtling at 80 mph in a 30 mph zone Monday morning when it ran off the rails along a curve south of Seattle, sending some of its cars plummeting onto an interstate highway below, National Transportation Safety Board member Bella Dinh-Zarr said late Monday. The engineer, whose name was not released, was bleeding from the head after the crash, and his eyes were swollen shut, according to radio transmissions from a crew member. The Saudi-led coalition fighting Yemen’s Shiite rebels said it intercepted a missile fired Tuesday over southern Riyadh. It was the second time in two months that a rebel projectile had reached as far inside the kingdom as Riyadh. Saudi state TV said the intercepted missile caused no damage Tuesday. HEALTH In a historic move, the Food and Drug Administration on Tuesday approved a pioneering gene therapy for a rare form of childhood blindness, the first such treatment cleared in the United States for an inherited disease. The approval signals a new era for gene therapy, a field that struggled to overcome setbacks but is pushing forward in an effort to develop treatments for genetic diseases. Yet the products, should they reach patients, are likely to carry stratospheric prices. Philadelphia-based Spark Therapeutics, which makes the childhood-blindness treatment, said it will not announce the price until January. Analysts speculate it could be as much as $1 million. Earlier this year, the FDA
approved two other similar treatments. Those approaches, which target blood cancers, involve removing cells from patients, reprogramming them to attack cancer then returning them. The eye remedy cleared Tuesday would directly treat disorders that are caused by a faulty gene. The patients in the study have a defective gene called RPE65, which is responsible for making light receptors work in the eye. The new treatment, Luxturna, is injected into the eye and uses a benign virus to deliver healthy copies of the gene to the retina. The treatment was approved for both children and adults. Selling Panthers amid scandal attracts suitors who might move team NFL The stunning news of the rare opportunity to purchase an NFL team has quickly garnered the attention of sports figures, business investors and politicians alike. Amid reports of sexual and racial harassment by Panthers owner Jerry Richardson, he announced he is selling the NFL franchise he founded in Charlotte, N.C., after this season. The team promoted Tina Becker to COO on Monday, giving her full control of day-to-day operations while Richardson shifts his focus to the sale of the team — which will come with a multibillion-dollar price tag. His decision to walk away after nearly 25 years as owner has left more questions than answers about the franchise’s future — most notably, who will buy it and will they try to move the team. Mayor Vi Lyles said she is
committed to working to keep the team in Charlotte. “The City of Charlotte values its long-running relationship with the Panthers after more than 22 seasons of NFL football,” Lyles said in a statement. “The Panthers are part of Charlotte’s fabric. ... We understand transitions are inevitable, and we look forward to working with current and future ownership.” The chance to purchase an NFL team has potential suitors emerging. Rapper and actor Diddy indicated his interest in purchasing the Panthers on Twitter right after Richardson’s announcement. Two-time NBA MVP Stephen Curry, a Charlotte native, chimed in with “I want in!” Former NFL quarterback Colin Kaepernick also expressed interest. Local businesspeople may have better prospects. LOUDOUN COUNTY, VA. Redskins safety Su’a Cravens has accused the Loudoun County Sheriff’s Office of racial profiling during a recent traffic stop. The second-year pro, who is inactive this season and went on the reserve/left squad list after the Redskins talked him out of retiring, posted videos to Twitter on Monday in which he says officers singled him out, treated him roughly and falsely accused him of smelling like marijuana. “I’ma sue the s--- out of this man, racial profiling a-- man,” he said to the camera. Cravens said he was followed to an Ashburn parking lot, pulled out of his car, “slammed” against it, handcuffed and put in a squad car for “supposedly doing 39 in a 35.” In a statement provided to The Washington Post, a spokesman for the Loudoun County Sheriff’s Office said Cravens was issued a summons for traveling at 39 mph in a 25 mph zone and cited for having illegal tint on his car’s windows on Nov. 29. Bjork, Future and jazz’s brightest minds use the instrument to say what they can’t
MUSIC Someone recently asked Bjork about the ideas that animate her new album, and the visionary singer gave a visionary answer. She said she wanted to conjure a “post-Trump” world where listeners could “escape to an island, and there’s a lot of women there with children, and everybody’s playing flutes, and everybody’s naked, and there’s all these plants you’ve never seen before and all these birds you’ve never heard before, and orchids, and it has that feeling of pioneering into a new world.” Click on the title track of Bjork’s “Utopia,” and you’ll hear what she sees. Or at least all the flutes. This year’s brightest jazz recordings featured some astonishing flute work, while various
flute samples wafted through the year’s hottest rap hits, most notably Future’s “Mask Off,” the highest-charting hit of his career. So the sound is all around us — up on the bandstands, out on the airwaves, high on the pop charts, deep in our dreamtime. Take Nicole Mitchell, a flutist, jazz composer and the leader of Black Earth Ensemble. Her commanding new album “Mandorla Awakening II: Emerging Worlds” aims to reconcile dreams of a Bjork-adjacent paradise with the global miasma we’re living in. “I’m curious about discovering what happens if we unify duality by smashing together two worlds: a dystopic world and utopic world,” Mitchell writes in the album’s liner notes. “Can human consciousness be transformed by c
embracing fears and establishing balance?” Musically, Mitchell asks that question most directly during a piece called “Listening Embrace,” in which the musician breathes heavy into a fragile melody, as if trying to speed up the song’s stubborn drumbeat. The friction feels heroic. Other rappers have pointed their flutes — some of them synthetic — in different directions. On Kodak Black’s “Tunnel Vision,” the flute sits high in the mix, twisting like steam. On “Get Right Witcha” by Migos, it moves differently, like a steady breeze. On Tay-K’s “The Race,” a thrill ride of a hit about the life of a teenage fugitive, the flute sounds bright and urgent — like an alarm that can’t be shut off.
If there’s a commonality here, it’s this: Instead of evoking fantasy worlds, these flute lines seem to be engaging rappers in sonic conversation. There’s an idea in country music that the keening sounds of the steel guitar help to convey the sorrow that unflappable singers won’t allow themselves to express. In this year’s rap music — and perhaps in Bjork’s and Mitchell’s new music, too — these potent flute sounds appear be doing something similar. Spending our lives in the dehumanizing airlessness of digital space has made it easier than ever to absorb the heaviness of an ugly world, but there’s still a lightness to be felt on our every breath.
Stars shine on G-Eazy’s latest album G-Eazy’s fifth album, “The Beautiful & Damned,” has so much star power that its breakout status was guaranteed — though he overcompensates. The hard-hitting first single “No Limit,” featuring A$AP Rocky and Cardi B, has already crashed the Top 10 on Billboard’s Hot 100, while the pop-leaning “Him & I,” with Halsey, seems set to surpass it on the strength of her haunting chorus. With so much strong material, including “Charles Brown,” featuring E-40 and Jay Ant, and the jazzy “Summer in December,” there’s no need for throwaway songs like “That’s a Lot” or lines like “To the beach, I don’t bring sand” in “The Plan.” Some smart cutting and rewriting could have made this album g great.
