FAMILY LIFE

What are your rights as a step-parent?

B

lended families are on the rise and a common feature of modern family life. An increasing number of couples are entering into relationships or remarrying where one person has children from a previous relationship and their new partner will often form a close bond with the children and play an important role in their day to day life. Despite this, the legal relationship between a stepparent and child is often misunderstood or not known.

What rights does a step-parent have? A step-parent is a person who is married to or in a civil partnership with a child’s parent. Contrary to popular belief marrying a child’s parent does familiesonline.co.uk

not give the stepparent the same legal rights as a biological parent. A step-parent may be a significant figure in a child’s life and play an active role in their upbringing yet they will not automatically have the right to make important decisions about their welfare even if they have lived together as a family unit for many years. This means that if the

relationship is not formally recognised, a step-parent would not be able to consent to a child receiving urgent medical treatment in the event of an emergency or even sign consent forms for school.

READ MORE *This is not legal advice; it is intended to provide information of general interest about current legal issues. 26
