Never has so little allowed so much to be done for you and your business. I thank you in advance for your contribution. Housing starts and sales have rocked along the bottom for most of this year. Many potential home buyers have decided to wait and see if the home prices are really at the bottom before they buy. One way you might persuade them to buy now is to enlighten them about the relationship between interest rate and home price. In 1st Quarter of 2007, the median national home price was $235,257 and the interest rate was 6.55% for a 30-year fixed mortgage. The median household income could only qualify for a $173,454 home. In 1st Quarter of 2011, the national median home price was $187,500 and the interest rate was 4.5%. The median household income could qualify for a $203,000 home. The message is buyers have unprecedented home buying power now with this low interest rate environment. Avoiding even a slight rise in interest rate is more important than waiting to see if home prices decline. Run the math in your area and use this as a buy now tool. The 21CBEC provides the best educational conference experience in the Southeastern United States with more than 50 courses and seminars being offered over three days. These cutting-edge NCBI, NAHB, and general session courses will be taught by experts who will provide information that will be useful in helping you survive. Many of these instructors have presented these same courses at the International Builders Show and at other events across the nation. I invite each of you to read through our conference schedule found on page 8. In selecting our conference schedule, our goal was to offer courses and seminars that will allow you to gain critical knowledge about the current marketplace and learn how best to position your company in a way that will significantly increase your prospects for success. A few highlights of the educational conference include: • Green Building for Building Professionals and Basics of Building will be offered for those interested in earning your Certified Green Professional designation. Under the LeadBased Paint Repair, Renovation and Painting (RRP) program rules in North Carolina, beginning January 1, 2010, dust sampling technicians, firms, contractors, property managers and others performing renovation, repair and painting projects for compensation that disturb lead-based paint in homes and childoccupied facilities built before 1978 must be certified and must follow specific work practices to prevent lead contamination. Examples of groups that may need training include, but is not limited to, carpenters, painters, electricians, sheetrock/drywall installers, plumbers, HVAC, window replacement and maintenance workers. This eight-hour course will fulfill the education requirements of the NC RRP program. Basic Accounting for Builders NCBI BM103 • 8 a.m.–11:30 a.m. This course will start at the beginning with the basic concept of debits and credits and proceed to develop an understanding of how accounting records are structured and how the records flow into financial statements (balance sheet, income statement, cash flow statement, etc.). Methods of constructing job cost systems, preparing cost budgets, and analyzing cash flow by job as well as overall cash flow will be explored.The basic concepts of implementing and setting up accounting software will be introduced. NCDOL Issues Updated Fall Protection Directive
stablishing a feasible Fall Protection standard has been an ongoing process for OSHA since 1995. The most recent standards were contained in the 1999 Interim Fall Protection Compliance Guidelines for Residential Construction. Since that time, OSHA has continued to evaluate the feasibility of the original Fall Protection standard (29 CFR Part 1926, Subpart M). Recently, OSHA rescinded the 1999 directive and implemented the fall protection standard as originally intended. In response to OSHA’s newly established fall protection standard, which went into effect June 16, 2011, the North Carolina Department of Labor (NCDOL) established and implemented Operational Procedure Notice (OPN) 109B. OPN 109B references and follows many of the guidelines set forth in the OSHA Fall Protection standard (29 CFR Part 1926, Subpart M). However, there are some differences in the state standard.
Definition of Residential Construction Within OPN 109B, the NCDOL provides a clear definition of Residential Construction. The end use of the structure must be as a home or dwelling and the structure must be constructed using traditional wood frame construction materials and methods (limited use of steel I-beams to support wood framing does not disqualify a structure from being considered residential construction).
What this means for you According to OPN 109B, all companies engaged in residential construction must follow the OSHA fall protection standard which states that workers “engaged in residential construction activities six feet (1.8 m) or more above lower levels shall be protected by guardrail systems, a safety net system, or a personal fall arrest system,” or by alternative fall protection measures allowed under 1926.501(b) for particular types of work. Alternative methods include: • Controlled access zones and control lines • Covers • Positioning devices • Barricades, fences and covers • Equipment guards • Warning line system and safety monitoring system (combination)
Written site specific plans If the employer can demonstrate that it is not feasible or creates a greater hazard to use required fall protection systems, they may instead develop and implement a written fall protection plan. The fall protection
plan does not need to be singularly site specific, but must be applicable to the site, structure and design/elevation for which it is being used. The written plan must be prepared by a qualified person and: • Address all issues related to fall protection at that site. • Be applicable to the site where the work is being performed. • Be maintained up to date and on the site. • Be implemented under the supervision of a competent person. • Include documentation of reasons why conventional fall protection systems are infeasible. • Include a written discussion of the alternative work practices used to eliminate or reduce the possibility of a fall (slideguards may be used in conjunction with a written plan only and may not be used when complying with the fall protection standard). • Include documentation of employee training records. • Identify each location where conventional fall protection systems cannot be used and designate them Controlled Access Zones (CAZ). • Implement a safety monitoring system where no other alternative measure has been implemented and identify all workers designated to work in the CAZ. • Be reviewed and updated as appropriate if an accident, or near miss occurs.
Inspections The NCDOL is not going to increase the number of inspections due to these changes and all fines remain the same. To avoid citations and fines, all companies engaged in residential construction must implement the revised standard. However, if your company is inspected, the NCDOL will consider the following prior to issuing a citation and/or fine: 1. History of inspections 2. Effort to comply to the standard 3.
