Commissioner Tom Kaase was elected chairman for 2012 at the board’s January 3 meeting. Commissioner Randy Dahl was elected vice-chairman. Kaase thanked the board for the vote of confidence. Kaase, beginning his fourth year as a county commissioner, said that he has observed past chairmen and learned from them over the years. He wanted to start the year as Commissioner Duane Bakke had a couple of years ago by detailing a list of items for the board to continue to work on or start to work on during the coming year. At the end of the year
Kaase expects to reflect on their progress. First, the board should continue their efforts to make a Veterans Cemetery to be located on the county farm a reality. Kaase thanked Commissioner Chuck Amunrud for his work toward that end. Second, the mining of silica (fracking) sand is becoming an issue and Bakke and Zoning Administrator Chris Graves have been looking into that. Third, the county has made some strides in redesign and he expects that effort to continue in the future. Redesign, or the restructuring of local government, is an effort to become more efficient, accessible, and effective in serving the public.
Fourth, there is the ongoing change over to narrow band radio as mandated by the Federal Communications Commission (FCC) by January 1, 2013. Kaase said he believes the county and Sheriff Daryl Jensen have gone about this the right way, saving the county a lot of money. Fifth, the board should take a look at court room security making sure it is safe. Sixth, Kaase wants to maintain and improve public accessibility. He suggested the board consider broadcasting on cable TV or with a live video stream as See COUNTY Page 3

During the Preston City Council’s January 3 meeting, the council approved a threeyear contract (2012- 2014) with the Preston Public Employees Association (PPEA). Councilwoman Kay Spangler, Councilman David Collett and Public Utilities Commissioner Heath Mensink served on the Labor Committee which worked on the contract details with the PPEA. The Utilities Commission also approves the contract. The Cost of Living Adjustment (COLA) will have increases of 1.5 percent in 2012, 1.75 percent in 2013, and two percent in 2014. Changes that were approved by the council include but are not limited to a reduction in the electric lineman apprentice program to four years instead of five years, and the elimination of the requirement that employees take five
consecutive days off per year. After some discussion, the requirement to take five consecutive days off was also eliminated for the non-union office staff. The requirement will be eliminated for all Preston employees. The COLA adjustments were approved for non-union employees at the same levels as they were for the PPEA. Other adjustments were approved as recommended by the Labor Committee. A new Paid Time Off policy was approved as recommended by the committee to be offered as an alternative to traditional sick leave and vacation policy. Participation in this new program will be a requirement for those hired after January 1, 2012. C ommentary Goodbye, so long 2011 By Eunice Biel A new year has begun already. Where did the 2011 go? It was a year of sadness, tragedy, accomplishments and new beginnings. As we look back at the events in our lives, many of us seek to begin the New Eunice Biel Year with wellmeaning resolutions for change and personal renewal. As Dr. Suess exclaimed in Oh the Places You’ll Go: “You have brains in your head; you have feet in your shoes; you can steer yourself any direction you choose; you’re on
your own. And you know what you know. And YOU are the guy who’ll decide where to go.” There have been many angry op-eds written about all of the many troubles we have in our country this past year, about who is to blame, and who doesn’t do enough. We are told that we are on the brink of ruin; challenges are viewed with frustration, our hands are tied with anger and mistrust. Some choose to believe that anyone with a different opinion is against us. Some choose to believe in common opinions that are set forth by opinion polls, news media, and email chains. This anger is not productive; it ties our hands and clouds our judgment. One of my favorite quotations is

Our lives will always be filled with challenges; it is best to admit this to ourselves and decide to be optimistic anyway. There will always be some obstacle in the way, something to be gotten through, some unfinished business, time still to be served, and debts to be paid. Then life will be better, but as Robert Kennedy observed: “One-fifth of the people are against everything all the time.” American author, physician and Supreme Court judge Oliver Wendell Holmes observed, “It is not so much where we stand as in what direction we are moving.” We convince ourselves that there is nothing we can do, but we should remember the words of anthropologist Margaret Mead: “Never doubt that a small group of thoughtful, committed citizens can change the world; indeed, it’s the only thing that ever has.” So stop waiting, get involved, listen and examine many viewpoints. The next time you meet someone who is really annoying, who is absolutely certain they are right about everything, remember the words of British philosopher Bertrand Russell: “The trouble with the world is that the stupid are cocksure and the intelligent are full of doubt.”
Video and sculpture artist Dave Beck will be artist in residence in January 2012 at Lanesboro Arts Center
Coming soon! Video and sculpture artist Dave Beck will come to Lanesboro January 3 – 17, 2012, as Artist in Residence with the Lanesboro Arts Center. He will be working on a project examining the history of place, people, and culture—specifically our Norwegian roots in the region. From Menomonie, Wisc., Dave visited Lanesboro in November and started research at the Lanesboro Public Library and with some local residents; his initial investigations sparked his interest in many historical stories and events, including Olaf Tegin’s Lock and Hair Wreaths. In creating his video and sculptural work, Dave uses digital technology (video and 3D animation), the arts, and historical events, coming together in an approachable product such as a film that community members can easily relate to. In culmination of Dave’s residency project, he will return to Lanesboro for an Artist Talk and Presentation about his project; this free event will take place on Saturday, Feb. 18, 7 p.m. at the St. Mane Theatre. Dave Beck teaches art at the University of Wisconsin—Stout, after having taught at Clarkson University in New York for four years. He received his MFA in Sculpture & Extended Media at the University of Wisconsin—Madison, an MA in Studio Art also at UW—Madison, and a BA in Studio Art & Ancient Studies at St. Olaf College in Northfield, Minn. His work has been featured in numerous exhibitions, from Spokane, WA to Philadelphia, PA. He has also completed several
residencies, including one in at the Kimmel Harding Nelson Center for the Arts in Nebraska City, NE, where he created the Nebraska City Portrait Series. of them, but get confused about “writing on the wall”, as I wouldn’t want to say anything personal, which is the whole point in my opinion. I’d like to get my girlfriends together more often, as friends are fun and an important part of mental health, attributes we all need in winter in Minnesota. Smiling at people you see, and keeping a positive attitude will add to the “good vibes” in your life. I love the whole concept of random acts of kindness. Not only would this idea be a worthwhile resolution, but if you ask the recipient to pass it on, imagine the ripple effect it might make across our communities. Trying to be more “green” is a good goal for all of us, as we are stewards of our earth, and we should take care of it. After all, we are just borrowing this space for our time on earth, and it is considered very bad manners to destroy borrowed property. My favorite goal is to write more, something I like to do anyway. A class I took on writing your memoirs was an inspiration; something definitely needed in the winter brain freeze ahead. If anyone has a writing class in their future, please let me know. Although all of these resolutions are worth keeping in mind, I know the resolution I will make this year in 2012. I will vow to have more fun. This resolution I can keep, will sometimes involve friends, put a smile on my face, and will definitely make my attitude more positive!
Vegetable Soup for a Cold Winter’s Day
1 tablespoon olive oil 1 onion, chopped 6 mushrooms, sliced 1 red pepper, seeded and diced 2 garlic cloves, diced 2 corn tortillas, cut into pieces (to thicken, may use tortilla chips instead, but add later) 4 cups chicken broth (I like low sodium, low fat) 1 (14 ½ oz.) can stewed tomatoes, with juice 1 (10 oz.) bag of frozen corn herbs of your choice, salt and pepper Heat the olive oil in a large saucepan. Sauté the onion, mushrooms, red pepper and garlic until the onion is tender, about 5 minutes. Add the tortillas, chicken broth, tomatoes and corn. Bring to a boil, cover and reduce the heat. Simmer until the vegetables are tender, about 10 minutes. Stir in the herbs. I like to use lemon thyme from my window, but use any herbs you like. Salt and pepper to taste. Add grated Parmesan cheese on the top of your bowl of soup and eat with crackers or homemade bread.

I remember that they believed in massaging their babies, an idea that still sounds calming. I feel peaceful even thinking back to this whole experience. Throw, throw, throw is another theme for the year. Throwing feels good and I definitely do not want my children to have to clean out truckloads of stuff as we have had to do with depression-era, save everything parents. The trouble is I always throw something I didn’t know I couldn’t live without until later. From a former column, you already know I didn’t inherit the organization genes in my family. According to reports on preventing Alzheimer’s, we should try something new and outside our comfort zone, like using your left hand instead of your right. I don’t know about this idea, but I have vowed to try new recipes, instead of cooking the same tried and true, go-to recipes in my file or in my head. As I browse the seed catalogs, I’d like to try a new plant. I think of my friend, Opal, who always tried a different and sometimes exotic plant each year. A reception and dance were held at the Lanesboro Memorial Community Center. Parents of the groom are Steve and Shawn Gorder and the late Michael Cady of Rushford. Parents of the bride are Kevin and Terri Scott of Lanesboro. The couple took a week-long Caribbean wedding cruise to St. Martin, St. Thomas, and Nassau, Bahamas. The couple will reside in Mankato.

Buster is a handsome young man. He is a little timid at first, but loves for you to pet him. He likes to shake with both paws and will hand you one paw, then the other. Buster is doing very well at going potty outside here at the shelter and I think he would make a wonderful house dog. He is mellow, intelligent and very friendly. Buster lived on a farm prior to coming into the shelter. His owner was getting ready to retire and said he needed to travel so he had to get rid of his dogs.

explained they will need to purchase the meters, but the software will be provided. O’Connor also mentioned the possibility of someday switching to time of day pricing. This would mean a person would have to pay more for electricity at certain peak times of the day than other times. Julie Charlebois, owner of Riverside on the Root, asked if this means business owners would have higher electricity rates since their business hours are during peak hours. City Administrator Bobbie Vickerman said that has been discussed and they are still looking at the issue. The city finds significant savings from the hydro, as the electricity generated from that means they have to purchase less electricity. Chamber Report Julie Kiehne, Executive

Director of the Lanesboro Chamber of Commerce, gave her annual presentation and updated the council on what’s in store for the upcoming year. Kiehne explained the Chamber has been doing workshops for social media for businesses, and did a retail market survey where they gathered information from shoppers to better access strengths and weaknesses. They also secured legacy grant funding for the trailhead landscape beautification project. She thanked the council for their support with the 2012 Lanesboro Visitor’s Guide. Kiehne also mentioned some projects the Chamber is working on for the future. There will be an annual trail celebration, as well as a Taste of the Trail celebration in September that will highlight local foods. She mentioned Explore Mississippi Bluffs as a new project, which is a project that goes along the Mississippi River from its start
in Lake Itasca to the Gulf of Mexico. Ten states are participating. The trail in Houston is not connected, but is only 20 miles from the trail. Kiehne reminded everyone of the Chamber’s annual meeting is on January 11 at 7pm in the gym at the community center. There will be a presentation on the economic impact of bicycle touring. Street Project Concerns Resident Robert Thompson approached the council with concerns about the assessments made to residents for the Whittier Street project. The street project at Maple Drive was assessed 100 percent, as it was new construction. The people on Whittier Street were assessed 25 percent of the project. Thompson said it wasn’t fair the way the project was assessed, as some of the people on the street were assessed for the storm sewer that they did not even receive. O’Connor said he wasn’t sure of Thompson’s point, as the storm sewer benefits everyone. Mayor Rahn agreed the storm sewer benefited the whole area. Thompson said there was no storm sewer installed on the west two blocks, only on the east end. He also said it was the worst job of engineering he had ever seen, as his street has no gutter and the water runs into the street. He said he has never seen residents assessed that much money, and he thinks it’s outrageous.
“I don’t know what the city was thinking,” said Thompson. “It’s a very bad deal, and I’m very unhappy about it.” Rahn read a response from the engineer with an explanation of the project and the assessments, and said that Thompson also received the letter. He said if the council felt they assessed the residents fairly they would not pursue this any further. Nobody had any objections. Other Business The city has an old police handgun, a Smith and Wesson that they will be putting up for sealed bids. Bids will be accepted until January 31. Council member Ceil Allen informed the council that the library will be reopening on January 17, with a grand reopening celebration at 7pm. They

Private pesticide certification workshops Jerrold Tesmer, Extension Educator for Fillmore/Houston Counties Six Private Pesticide Applicator Certification Workshops have been scheduled for Fillmore, Houston, and Winona Counties. If Jerrold Tesmer you are one of the 207 in Fillmore County, one of the 70 in Houston County, or one of the 101 in Winona County due for recertification, you should have received a reminder postcard from the Minnesota Department of Agriculture in mid-December. That card had some incorrect information. A corrected copy with 2012 information should have been sent in early January to remind you to

When attending a recertification workshop, you must bring an official photo identification card, (driver’s license, passport or some type of official document). Bringing your Private Pesticide Applicator Certification ID card, too, assists in the registration process. Persons who don’t have their Applicator Card may obtain their applicator number on-line at the MDA website (www. mda.state.mn.us) or by contacting MDA at 651-201-6633. For those choosing to take the test there is a new 2012 Manual – the NEW 19th Edition of the Private Pesticide Applicator Training manual. All 18th Ed books can be recycled. Rosemount, MN 55068 Bill No. ______1_____ Ordinance No. 10032011--1 An Ordinance granting Minnesota Energy Resources, a subsidiary of Integrys Energy Group, a Delaware corporation, its successors and assigns,a natural gas franchise and the authority to construct, operate, maintain, and extend a natural gas distribution plant and system,and granting the right to use the streets, alleys, and other public places within the present or future corporate limitsof the City, of Lanesboro, Minnesota. Be it ordained by the City Council of the City of Lanesboro Minnesota, as follows: FRANCHISE GRANTED The City of Lanesboro, Minnesota, (hereinafter referred to as “Grantor”) hereby grants a non-exclusive franchise to Minnesota Energy Resources, a subsidiary of WPS Resources, a Delaware corporation, (hereinafter called “Grantee”), its lessees, successors and assigns. Grantee is hereby granted the right, privilege, franchise, permission and authority to lay, construct, install, maintain, operate and extend in, along, over or across the present and future streets, alleys, avenues, bridges, public rights-of-way and public places as are now within the present or future limits of said Grantor, a natural gas distribution system and all facilities necessary for the purpose of supplying natural gas or processed gas for all purposes to the inhabitants of said Grantor and consumers in the vicinity thereof, and for the distribution of natural gas from or through said Grantor to points beyond the limits thereof. Such facilities shall include, but not be limited to, all mains, services, pipes, conduits and appliances necessary or convenient for transmitting, transporting, distributing and supplying natural gas for all purposes for which it may be used, and to do all other things necessary and proper in providing natural gas service to the inhabitants of Grantor and in carrying on such business. TERM The rights and privileges granted by this Ordinance shall remain in effect for a period of Twenty-five (25) years from the effective date of this Ordinance. GOVERNING RULES AND REGULATIONS This Ordinance is granted subject to all conditions, limitations and immunities now provided for, or as hereafter amended, and applicable to the operations of a public utility, by State or Federal law. The rates to be charged by Grantee for service within the present or future corporate limits of Grantor and the rules and regulations regarding the character, quality and standards of service to be furnished by Grantee shall be under the jurisdiction and control of such regulatory body or bodies as may, from time to time, be vested by law with authority and jurisdiction over the rates, regulations and quality and standards of service to be supplied by Grantee. Provided however, should any judicial, regulatory or legislative body, having proper jurisdiction, take any action that precludes Grantee from recovering from its customers any cost associated with services provided hereunder, then Grantee and Grantor shall renegotiate the terms of this Ordinance in accordance with the action taken, so as to allow Grantee to be made whole economically. In determining the rights and duties of the Grantee, the terms of this franchise Ordinance shall take precedence over any conflicting terms or requirements contained in any other Ordinance enacted by the Grantor. If an energy supplier is unable to furnish an adequate supply of energy due to an emergency, an order or decision of a public regulatory body, or other acts beyond the control of the Grantee, then the Grantee shall have the right and authority to adopt reasonable rules and regulations limiting, curtailing or allocating extensions of service or supply of energy to any customers or prospective customers, and withholding the supply of energy to new customers, provided that such rules and regulations shall be uniform as applied to each class of customers or prospective customers, and shall be nondiscriminatory as between communities receiving service from the Grantee. CONSTRUCTION AND MAINTENANCE OF COMPANY FACILITIES Any pavements, sidewalks or curbing taken up and any and all excavations made shall be done in such a manner as to cause only such inconvenience to the inhabitants of Grantor and to the general public as is reasonably necessary; and repairs and replacements shall be made promptly by Grantee, leaving such properties in as good as condition as existed immediately prior to excavation. Grantee agrees that for the term of this grant, it will use its best efforts to maintain facilities and equipment sufficient to meet the current and future energy requirements of Grantor, its inhabitants and industries. While maintaining its facilities and equipment, Grantee shall obtain permits as required by ordinance, except that in emergency situations, Grantee shall take immediate unilateral actions as it determines are necessary to protect the public health, safety, and welfare; in which case, Grantee shall notify Grantor as soon as reasonably possible. Grantor will give Grantee reasonable notice
of plans for street improvements where paving or resurfacing of a permanent nature is involved that affect Grantee’s facilities. The notice shall contain the nature and character of the improvements, the rights-of-way upon which the improvements are to be made, the extent of the improvements and the time when the Grantor will start the work, and, if more than one right-of-way is involved, the order in which this work is to proceed. The notice shall be given to the Grantee a sufficient length of time, considering seasonable working conditions, in advance of the actual commencement of the work to permit the Grantee to make any additions, alterations, or repairs to its facilities. EXTENSION OF COMPANY FACILITIES Upon receipt and acceptance of a valid application for service, Grantee shall, subject to its own economic feasibility criteria, make reasonable extensions of its distribution facilities to serve customers located within the current or future corporate limits of Grantor. RELOCATION OF COMPANY FACILITIES If Grantor elects to change the grade of or otherwise alter any street, alley, avenue, bridge, public right-of-way or public place for a public purpose, Grantee, upon reasonable notice from Grantor, shall remove and relocate its facilities or equipment situated in the public rights-of-way, if such removal is necessary to prevent interference and not merely for the convenience of the Grantor, at the cost and expense of Grantee. If Grantor orders or requests Grantee to relocate its facilities or equipment for the primary benefit of a commercial or private project, or as a result of the initial request of a commercial or private developer or other non-public entity, and such removal is necessary to prevent interference and not merely for the convenience of the Grantor or other right-of-way user, Grantee shall receive payment for the cost of such relocation as a precondition to relocating its facilities or equipment. Grantor shall consider reasonable alternatives in designing its public works projects so as not arbitrarily to cause Grantee unreasonable additional expense in exercising its authority under this section. Grantor shall also provide a reasonable alternative location for Grantee’s facilities. Grantor shall give Grantee written notice of vacating of a public right-of-way. Vacating of a public right-of-way shall not deprive the Grantee of its right to operate and maintain existing facilities, until the reasonable cost of relocating the same are first paid to the Grantee. Any person or corporation desiring to move a building or other structure along, or to make any unusual use of any street, alley, avenue, bridge, public right-of-way or public place which shall interfere with the facilities or equipment of the Grantee, shall first give notice to the Grantor and the Grantee and a pay a sum sufficient to cover the expense and damage incident to the moving of Grantee’s facilities and equipment. CONFIDENTIAL INFORMATION Grantor acknowledges that certain information it might request pursuant to this franchise may be of a proprietary and confidential nature. If Grantee requests that any information provided by Grantee to Grantor be kept confidential due to such proprietary or commercial value, Grantor and its employees, agents, and representatives shall maintain the confidentiality of that information, to the extent allowed by law. If Grantor is requested or required by legal or administrative process to disclose any such confidential information, Grantor shall promptly notify Grantee of such request or requirement so that Grantee may seek an appropriate protective order or other relief. Grantor shall use all reasonable efforts to ensure that the confidentiality of Grantee’s confidential information is maintained. FORCE MAJEURE It shall not be a breach or default under this franchise if either party fails to perform its obligations hereunder due to Force Majeure. Force Majeure shall include, but not be limited to, the following: 1) physical events such as acts of God, landslides, lightning, earthquakes, fires, freezing, storms, floods, washouts, explosions, breakage or accident or necessity of repairs to machinery, equipment or distribution or transmission lines; 2) acts of others such as strikes, work-force stoppages, riots, sabotage, insurrections or wars; 3) governmental actions such as necessity for compliance with any court order, law, statute, ordinance, executive order, or regulation promulgated by a governmental authority having jurisdiction; and any other causes, whether of the kind herein enumerated or otherwise not reasonably within the control of the affected party to prevent or overcome. Each party shall make reasonable efforts to avoid Force Majeure and to resolve such event as promptly as reasonably possible once it occurs in order to resume performance; provided, however, that this provision shall not obligate a party to settle any labor strike. HOLD HARMLESS Grantee, during the term of this Ordinance, agrees to save harmless Grantor from and against all claims, demands, losses and expenses arising directly out of the negligence of Grantee, its employees or agents, in the constructing, operating, and maintaining of distribution and transmission facilities or appliances of
Grantee; provided, however, that Grantee need not save harmless Grantor from claims, demands, losses and expenses arising out of the negligence of Grantor, its employees or agents. SEVERABILITY If any clause, sentence or section of this Ordinance is deemed invalid by any judicial, regulatory or legislative body having proper jurisdiction, the remaining provisions shall not be affected. NON WAIVER Any waiver of any obligation or default under this franchise shall not be construed as a waiver of any future defaults, whether of like or different character. REPEAL CONFLICTING ORDINANCES This ordinance, when accepted by Grantee as provided below, shall constitute the entire agreement between the Grantor and the Grantee relating to this franchise and the same shall supersede all prior ordinances pertaining to this franchise agreement, and any terms and conditions of such prior ordinances or parts of ordinances in conflict herewith are hereby repealed. Ordinance No.1-A of the City of Lanesboro Minnesota, is hereby repealed as of the effective date hereof. EFFECT AND INTERPRETATION OF ORDINANCE The captions which precede each section of this ordinance are for convenience in reference only and shall not be taken into consideration in the interpretation of any of the provisions of this ordinance. EFFECTIVE DATE AND ACCEPTANCE This Ordinance shall become effective and be a binding contract between the Grantor and Grantee, upon its final passage and approval by Grantor, in accordance with applicable laws and regulations, and upon acceptance by Grantee by written instrument within sixty (60) days of passage by the governing body, and filed with the City Clerk of the City of Lanesboro, Minnesota. The City Clerk shall sign and affix the community seal to acknowledge receipt of such acceptance, and return one copy to Grantee. If Grantee does not, within sixty (60) days following passage of this Ordinance express in writing its objections to any terms or provisions contained therein, or reject this ordinance in its entirety, Grantee shall be deemed to have accepted this ordinance and all of its terms and conditions.
