Once again, ambulance service issues consumed most of the nearly two hour September 20 Preston City Council meeting. The meeting was closed for about half an hour to confer with attorney Peter Regnier (Jardine, Logan & O’Brien) who has been appointed by the League of Minnesota Cities to advise the city in its response to the Emergency Medical Services Regulatory Board (EMSRB) Stipulation and Consent Order and possible associated litigation. The order from the Complaint Review Panel of the EMSRB was sent to the city in June and is an agreement issued by the EMSRB that outlines requirements imposed on the Preston Area Ambulance to stay a suspension of the service’s license. City Attorney Dwight Luhmann had suggested some amendments to the EMSRB order in August, which were all later rejected by the board. At the September

6 city council meeting it was decided not to take any action on the Stipulation and Consent Order, giving Regnier time to see what could be worked out with the Attorney General. The council preferred to negotiate a settlement more favorable to the city rather than to sign the order as presented. Regnier explained this day, before the meeting was closed, that they would have to respond to the EMSRB the next day, Wednesday September 21. He expects the EMSRB to proceed with the Contested Case Hearing if the impasse is not resolved. He advised they close the meeting to protect attorney-client privilege. Mayor Kurt Reicks, after the meeting was reopened, announced they were advised by Regnier to resubmit a counter proposal to the EMSRB.
