1. 1926 ROLLS ROYCE PHANTOM (HOOPER & CO.)

TELAIO N. TC96

• Omologata ASI Targa Oro.

• Ex museo Quattroruote.

• Restauro conservativo.

Venne costruita a Derby, in Inghilterra, e Springfield, in Massachusetts, Stati Uniti. Gli esemplari made in UK di Phantom furono 2,269.

CHASSIS NO. TC96

• The first of all Phantom series.

• The height of pre-war luxury.

• ASI Targa Oro homologated.

• Former Quattroruote museum.

• Conservative restoration.

The Rolls-Royce Phantom was created to replace the Silver Ghost as a 40/50 hp model. The category was referring to the tax horsepower, an early system of taxation rates for automobiles. The rating was computed by a mathematical formula based on cylinder dimensions. At the beginning of the century, tax power was reasonably close to real power. Introduced as the New Phantom in 1925, the model featured a larger engine and overhead valves. It was built in Derby, England, and Springfield, Massachusetts, USA. The Phantom was replaced by the Phantom II in 1929. The Phantom I designation was not used by Rolls-Royce but was later developed by enthusiasts to distinguish it from the other generations of the model. Only the chassis and mechanical parts were produced by RollsRoyce, the body was made by coachbuilders, such as Hooper, chosen by the buyers. There were 2,269 Phantoms made in the UK.

3. 1931 CADILLAC V-12 (FLEETWOOD)

TELAIO N. 1005414

• Perfetta in ogni dettaglio.

• Restauro meticoloso documentato. Importante documentazione tecnica.

• FIVA pass.

CHASSIS NO. 1005414

• The meaning of luxury in the 1930s.

• Exclusive: the first and only production Cadillac V 12.

• Perfect in every detail.

• Documented meticulous restoration. Important technical documentation.

• FIVA pass.

The Cadillac “V-12” is an exclusive overhead valve V-12 powered luxury car, manufactured from 1930 to 1937. Below only the maker’s top-of-the-line V-16, it was built in relatively small numbers. It was Cadillac’s first, and is to date, Cadillac’s only standard production V-12 automobile. The 1931 V-12 (Model 370A) was introduced in October 1930 and a roadster was used as the pace car at the Indianapolis 500. It had a shorter wheelbase than the V-16 but offered a similar choice of Fisher and Fleetwood semi-custom bodies. It was difficult to tell a Cadillac V-12 from a Cadillac V-16 and, significantly, thanks to its lower price, the V-12 outsold it. The amazing 1931 convertible auctioned was bodied by Fleetwood. Of US origin, it was purchased in 2005 by the current owner who registered it in the Principality of Monaco.

MOTORE N. 10-5107 ENGINE NO. 10-5107

Extensive documentation of the complete professional restoration (dating back ten years) and important technical documentation testify to the care that the car has been subjected to. The car, painted in a delightful two-tone ivory/ black, is in perfect condition, the soft top is new. Hundreds of details underline the luxury, such as in the passenger compartment where briar wood and embossed and polished aluminum are combined with sumptuous black Connolly leather. Among the accessories, an interesting and rare set of Berg suitcases. Also peculiar is the safety lock on the wire wheel hubs, equipped with white-wall Firestone tires and, finally, the magical deco statuette that adorns the radiator.

4. 1933 FIAT 508 S BALILLA SPORT (FIAT)

MOTORE N. 108S023867

• Completamente restaurata.

CHASSIS NO. 508S022824

ENGINE NO. 108S023867

• An automotive legend, known to most as the “Coppa d’Oro”.

• Mille Miglia eligible. As a pre-war, soon on the starting line.

• Queen of regularity races and concours d’elegance.

• The car is believed to be Matching Numbers.

• Completely restored.

€ 250.000 - 300.000

STARTING BID € 200.000 - BUY NOW € 250.000

In 1933 Fiat introduced on the 508 model, the sporting version 508 S Balilla Sport, with a lighter and pleasant spider body; it soon became one of the cars to dream for the younger generation. FIAT purchased the rights by Ghia, which originally designed it, manufacturing two versions: the standard one had fully enclosed fenders. The engine was also uprated. This model won the Coppa d’Oro del Littorio race, earning it the nickname “Coppa d’Oro”. This (believed to be) Matching Numbers specimen was found in 2011 in the Georgia countryside (USA), as a real barnfind, after being stored for about 40 years; it was in condition for a demanding restoration, but complete. The story of its early years is still to be clarified, but one can assume a beginning in Italy, noting the RACI (Regio Automobile Club Italiano) badge dated 1938, on the steering wheel. Transferred to Italy in the same 2011, it was completely restored in all its parts, in two tones of red, with black interiors. Restored in mechanics by Noci Motor Classic. The engine is fitted with a special S.I.A.T.A. head. Papers are in order; a request for a CRS ASI has been made in order to proceed with the registration.

5. 1934 LANCIA AUGUSTA (LANCIA)

• Eleggibile Mille Miglia. Come anteguerra: presto sulla linea di partenza.

• Unico proprietario dal 1934 al 2019. Targhe d’origine.

• Ottime condizioni generali.

• Carrozzeria e interni conservati; meccanica, freni e sospensioni restaurati.

• Certificato d’origine Lancia Classiche

The Augusta was a product born, designed and conceived for the period full of mistrust that followed the crisis of 1929; this new model of limited dimensions was supposed to be a sort of utilitarian (according to the canons of the time) albeit an elite one. However, it had to maintain the qualities of Lancia vehicles and have a pleasant line. This example was produced on March 9, 1934, and registered on March 26 of the same year to Cavalier Maggiore Gaetano Franzini. The car will remain in the same family until 2019, when it is purchased by the current owner. MOTORE N. 46612 ENGINE NO. 46612

Delahaye Figoni & Falaschi-style racing spider. A car with a pure pre-war flavor, performing and fun. Daughter of a “yesterdays’”story, with the chassis and engine pieces found in the remote past in wooden cases, the car was created over time, always with original Delahaye parts, worked by the best local specialists, for the purpose of pure entertainment. Chassis no. 46538 (whose number corresponds to a 1936 Delahaye 103 N) is that of a 1938 type 134 N, shortened; engine no. 46612 (number that appears on an old French registration certificate) is that of a 1936 135S, equipped with a 3.2-litre 18 hp engine, but the engine has now been increased to 3.5 liters for 20 hp, with high performance and high rate of adrenaline! The unit is combined with the revolutionary Cotal electromagnetic gearbox.

Certificata ASI e FIVA.

This example, chassis no. 57448 and engine no. 339, was delivered by the manufacturer as a bare chassis, model 57 (basis) on October 13, 1936 to the Swiss Bugatti agency, Bucar SA of Zurich, together with chassis 57446 and 57447, for the sum of 43,800 francs and was set up as drophead coupe from coachbuilder Graber. The specimen has a traced history; the first owner, who had ordered it from Bucar SA on October 8, 1936, was dr. Louis Dapples; banker, became chairman of Nestlé’s board of directors in 1929 and represented Switzerland at the 1933 London International Economic Conference. The car, still in Switzerland, moved to the Geneva area and underwent several changes of ownership. In 1978 it was bought by Jean Victor Augfburger and, in the same year by Hans Matti, complete but in neglected condition. It remained in Switzerland until 1985, when it was imported into Italy, registered in Ravenna and purchased by the last owner who provided for a complete and detailed restoration, entrusted to the best specialists of the time: the KCA of G. Cappa for the bodywork and Gianni Torelli for the mechanical part. This last owner kept the car for thirty-seven years. Always maintained in perfect working order, it also starred in a commercial for the “Bugatti Collection” in 1994; it participates in meetings and events for historic cars and is presented today in exceptional condition. It is included in the 2009 Italian Bugatti Register book, created by the Bugatti Club Italia. ASI and FIVA certified.

The Bugatti Type 57 was unveiled at the 1934 Paris Motor Show. It was the only Bugatti model to be produced in S, C, and SC versions at the factory in Molsheim before the war. The Type 57S (Surbaissé version) was first introduced in 1935 and was a more sporting version of the car first released in 1934. Type 57C was a Roots type supercharger and type 57SC the most exclusive that combined the elements of the 57C and 57S. The Bugatti Type 57 was the first new model built under Jean Bugatti direction and it incorporated many features new to Bugatti. Its dual overhead camshaft eight-cylinder engine had dimensions of 72x100mm, offering 3,257cc displacement. It quickly grew a reputation for low noise and vibration from the engine. The crankshaft ran in five main bearings. The camshafts were driven by a train of helical-tooth gears at the engine’s rear with a further crankshaft bearing behind them. Finger cam followers minimized side thrust on the valve stems. The Type 57 also marked Bugatti’s first use of a transmission fixed to the engine crankcase and a single plate clutch. The top three gears in the four-speed gearbox were constant mesh. There were four-bodystyles offered and their names were in honor of the Alps Mountain peaks: Atalante two-seat coupé, Ventoux four-seat coupé, Stelvio cabriolet and the Galibier sedan vied with the best of France’s and Europe’s formidable coachbuilders’ creations and comprised the bulk of Type 57 production

The most exclusive body fitted to the Type 57 was the Atlantic which was penned by Jean Bugatti on the Type 57SC chassis. The Type 57 can certainly be considered the most celebrated non-racing Bugatti ever built. Various coachbuilders built individual creations. The Type 57 proved to be Bugatti’s most successful model, at 630 cars produced of the standard version and 40 of the Surbaissé version.

Coachbuilder Graber built nine Bugatti 57 4-seater cabriolets between 1934 and 1937. Chassis 57161 was the first; the others built in 1936 were chassis numbers 57394 - 5744457448 (for sale in this lot) - 57483 and in 1937, chassis 57446 - 57447 - 57500 and 57539. For these cabriolets, the reference numbers of the Graber bodies ranged between 300 for chassis 57161 to 372 for the final chassis 57539. It seems that all these Graber Type 57s have survived. Their bodies all differ in detail. Chassis 57444 - 57448 - 57483 - 57446, in the order they were built, had a bonnet with three rows of three vertical louvers. The coachwork of chassis 57447 had five rows of five louvers placed at an angle, and 57500 was the only one to have five rows of vertical louvers. The bodies of 57171 - 57394 and 57539 were unique in their design.

The car was found around 2010 located in a derelict but still original condition. The owner had initiated a restoration which stranded when car was dismantled. Only the Giannini prepared Fiat 750 engine had been completely overhauled. The car was recently subjected to a thorough restoration, respecting the last body shape brought to the race and in which it remained. Counted among the Automotive Masterpieces, it was published in the book Mille Miglia’s Chassis Volume III. It has Dutch papers and number plates. Ideal for Mille Miglia reenactments and the most exclusive sporting events for vintage cars. Refined and simple in its unpainted livery, it brings with it the flavor of a bygone era.

The one-off 1938 Ogna Fiat 750 Giannini (Domenico Ogna), chassis no. 035785, a car with multiple lives. The diversity and ingenuity of the post war “Etceterinis” is a fascinating subject. Mostly based on affordable Fiat technology, dozens of sports cars were constructed by Italians with a passion for motorsport. This barchetta, constructed around 1946 and raced by Domenico Ogna, is a perfect example of such an Etceterini. The basis is a 1938 Fiat Topolino A chassis of which the engine was prepared by Giannini to compete in the 750 class. The streamlined aluminium siluro body is supported by a tubular subframe. Initially fitted with cycle wings, it was later on in the early fifties (around 1951-1952), replaced by fixed wings attached to the body, due to new racing rules. The wings were now connected and flow from the lines of the central body in a single shape, however they were still physically separated from, and have been riveted to the central body, with a technique derived from aeronautics. Finally in 1954 a complete new barchetta style body was constructed, with truly integrated mudguards.

The new (and last) line closely resembles that of the, even then, iconic Ferrari 166 millemiglia designed by Touring. Same proportions on a smaller scale, same lines, including the groove between grille and headlights. Curious is the massive “American” chrome grille which was typically an aesthetic accessory mounted on the Topolino of the time.Domenico Ogna raced his sports-competition car in a record number of five Mille Miglias. The car raced the 1948 edition with 1038 entry number, ranking 61st overall and 8th in class; the 1949 edition with 237 entry number, ranking 165th overall and 14th in class; in the 1950 edition with 325 entry number, the car did not finish; the 1952 edition with 2345 entry number, ranking 220th overall and 9thin class; in the 1954 edition with same 2345 entry number, the car did not finish. At the wheel, always the owner-builder Domenico Ogna. Co-driver in 1948 and 1952 was Cesare Ogna; in 1949, Guido Zerneri; in 1950, Gianfranco Calini; in 1954, Enrico Ogna. Domenico Ogna also faced the 1949 Circuito del Garda, ranking 11th overall and the 1950 Corsa sulle Torricelle, ranking 9th overall.

Aprilia anticipated what would be the “typical” car of the production standards of the 1950s and 1960s 20 or 30 years in advance, one of the first cars designed in the wind tunnel in collaboration with Battista Farina and the Turin Polytechnic. This is a sedan (type 438) example of the second series, produced on February 8, 1940, and sold in Naples on February 27 of the same year. Chronological certificate traces history of license plates and owners. Officially deregistered and duly re-registered, it retains the black number plates in the province of Rome from 1948. The color is black, and the interior is in hazelnut cloth. Bodywork and mechanics restored, fitted with a compliant, but not hallmarked, original Lancia rotation engine. The preserved interior is in excellent condition. It has both Fiat and Lancia Classiche certificates of origin.

Few cars, like the Fiat 1100, can tell so many stories of Italy, from the late 30s to the late 60s. The Fiat 1100 was born from the Fiat 508C, the New Balilla 1100, and was nicknamed “musone” for the imposing grille. Among many evolutions and variations on the theme, some of the best Italian coachbuilders created some rare and very tasteful custom-built cars.

The small “Topolino” is one of the world’s best-known cars, created in the 1930s to be minimal and economical. While the official name was FIAT 500, everyone called the car “Topolino”, for its size and muzzle. The first series, retrospectively known as the 500 A (to distinguish it from the later B and C), was produced until 1938 with the quarter elliptical rear leaf springs (the so-called “balestrino” or “balestra corta”) later replaced by a normal semi-elliptical leaf springs to improve load capacity. This specimen, of type “A” already with a long leaf spring frame, is partially restored and preserved and is still in very good condition; the interior is impeccable and like new, the bodywork is in order, with the inevitable signs of ageing, the soft top is practically new. It is mechanically complete; the mounted engine is probably from the later series. Stopped for some time, it needs careful set-up before being put on the road.

The history of Alfa Romeo basically coincides with the history of the automobile. The glorious 6C model stands as a bridge between the first Alfa Romeos and the modern post-war ones, between racing and touring cars. In 1949, the latest version was born: the 6C 2500 Sport “con Motore Avanzato”. The forward position of the engine-gearbox group (as already in the Turismo, the year before) derived from the need to adapt larger passenger compartments to the chassis. 151 units were built. The 11th chassis (no. 917.011) was assembled in 1949 and registered in March 1950. It is a first series, with split windshield, different grilles from the later cars, absence of overriders on the bumpers which are made of aluminum and not chromed.

Known as the “fiancée of Italy”, the Alfa Romeo Giulietta spider embodies the spirit of an era. It was created specifically at the request of Max Hoffman, the American importer for Alfa Romeo. Wishing to propose an ideal two-seater to compete in the popular SCCA races, Hoffman asked to produce a car different from the classic English sports cars, with an outdated design. Designed by Pinin Farina, the Giulietta spider was a fresh, youthful, and elegant sports car. This 1957 matching numbers example is a sought-after “veloce” version (type 750 F) boasting 80 hp thanks to several changes from the regular version, including the electric pump and two 40 DCO3 twinbarrel Weber carburettors. It is one of the last ones produced without fixed side window deflectors, therefore cleaner in line. The car comes from the US but has instruments in kmh, imported into Italy in 1992, it was registered in 1994. The restoration presumably took place in these two years. The car is in excellent general condition in Red (505) color and black interior with red piping as foreseen by the original trims. As accessories it has a Motorola am/fm stereo radio, an adjustable navigator light and a fire extinguisher. Finally, it is equipped with a black hardtop original of the period, called “rigid dome” in the catalogue, that was and is a rare accessory. The car has Italian papers in order and has ASI targa oro homologation.

CHASSIS NO. 128037-10-002487

• Maximum elegance and luxury for a “Ponton” model.

• The first mass-produced Mercedes injection.

• Immaculate condition.

• ASI. Traced history.

• Sunroof.

Historically, the 220S has particular importance, because it is the very first Mercedes-Benz to bear the letter S. During the production of the W180 series, for a relatively short period of time, i.e. between the end of 1958 and the end of the 1959, the 220SE (W128) is marketed, where the E stands for Einspritzung, which means injection in German. The substantial difference with the other 6-cylinder Ponton was in fact in this type of power supply, until then reserved for the 300SL “Gullwing”, a sports car for a lucky few. The 220SE was also offered in coupé and cabriolet versions; the coupé was produced in a total of 830 units. While the sedans were discontinued in 1959, the coupés and convertibles remained on the list for another year. The splendid car offered for auction is a 1959 example with a well-known and traced history, also in Italy; in fact, the car has a chronological certificate of the owners from the origins. It is still registered with Roma plates dating back to 1963 and has up-to-date Italian papers, in order. The car is ASI certified, it is restored in impeccable condition, black in color with luxurious red leather interior. Two beautiful accessories: a Blaupunkt AM radio with presets, from the era and the rare metal sunroof.

The Jaguar known retrospectively as the Mark I was born; not free from flaws, which were largely solved by its evolution, the Mark II (or MK 2) model. Revisited in line, it had advanced mechanics (there were now 4-disc brakes, for example) and was also offered in the highperformance 3.8-litre version, with an engine almost identical to that of the Jaguar E, as in the case of this example. Coming from distant Peru, it is an LHD specimen with manual gearbox and limited slip differential. Now, it has recent Italian plates and documents, in order. With an original line, the Sprite (aka “Frog Eye” or, retrospectively, Mk I), launched in 1958, was a spartan little roadster. Cheap and light, it was a success and, in 1959, the House mitigated its spartan nature: handles, bumpers and side windows appeared. This example was finished on 6 September 1960 and destined for export, in LHD version. The car was shipped that same month to Peru, where it then lived. In 2016, it was first imported to the UK and finally registered in Italy in September 2022: it has up-to-date number plates and documents and CRS ASI. The car has undergone a restoration, not recent but of high quality; the mechanics have instead been recently revised. Interior is preserved, new tyres. It’s fully functional. The car proposed in this lot has had an adventurous and unfortunate history; abandoned, is looking for a ransom! It is of USA origin. As a 1961 example, it still has the 948 cc “Frog Eye” engine. Completano l’auto tappeti, tappetini e antifurto bloccasterzo dell’epoca.

In the history of Alfa Romeo, the “Giulietta” model represented the transition to industrial modernity. Created in the strictest secrecy by leading designers under the direction of Rudof Hruska and equipped with the fantastic “Busso” twin-cam, it was immediately loved by customers, especially sporty ones. Produced for over a decade, it had two restylings, the last one in 1961. This 1962 example has undergone a complete restoration, now dated, but of excellent quality and has stood still since. It is still in impeccable condition today but needs a careful set up before being put on the road. The interior has custom-made seat covers in brown imitation leather. Underneath, it maintains the original upholstery, whose condition is unknown. The car is equipped with a towing hitch and extra side mirror attachments for towing. The floorpans are in very good condition, no signs of rust. Carpets, mats and anti-theft steering lock from the time complete the car.

Popularly known as “the shark”, the Giulietta Sprint Speciale was born from a study of a faster version of the Giulietta Sprint; aerodynamic research was carried out in order to enable the Alfa Romeo engine to break the 200 Km/h barrier. It went into production in 1959 and was offered as a more luxurious version of the popular Giulietta, with competition in mind. The curvaceous Bertone’s SS was powered by a Velocespecification engine, which boasted 116 hp. Despite its drag coefficient of only 0.29 it was less used in competition than its sibling Giulietta SZ.

As had already happened for the Appia, Flavia and Flaminia, Lancia gave Zagato the task of creating the sport version of the Fulvia. It was launched in 1965 and had the same mechanics as the Coupé, but thanks to improved aerodynamics it reached higher top speeds. It was almost never used in rally competitions but found its natural competition ground on the track. The Fulvia Sport 1600s are the maximum evolution of the model and appear with the second series, equipped with a steel bodywork, with a higher roof and front-hinged bonnet. They are fitted with the “Fanalino” engine and gearbox, have specific recessed handles, stainless steel bumpers with rubber bolts, seats with headrests, electric windows. Only 800 of this model were built. This example has been partially restored in Belgium with new paint, around 5 years ago. The current owner bought it a few months later, still in Belgium. Swan song of the classic 911 (F or “urmodell”), the Carrera RS 2.7 version was recognizable by the famous “ducktail” rear wing, the adhesive strips on the sides and the alloy wheels matching the strips. Very fast and exclusive, now it’s also very expensive and hard to find. The starting point for this specimen was the body of a 1972 911 T 2.4. The car underwent an in-depth restoration and complete transformation into the Carrera 2.7 RS version, with an original new 245 hp RS engine. The car papers are in order. With (HTP) homologation for all international competitions, it is race ready, but can also be used on the road. In detail, the body was completely disassembled, sandblasted, and checked on the bench with the replacement of worn parts; finally lightened and strengthened. The engine has been rebuilt with totally new wear materials, the cylinder heads have been given a racing finish, racing exhaust system and accessories were fitted. The lubrication system pipes are racing type with passage in the frame and large oil cooler; the gas tank is inspected and approved (HTP); competition fuel pumps, stabilizers, pipes. The gearbox has limited slip diff., with racing clutch and gears, short stroke linkage. Braking system has original 2.7 RS aluminum front calipers and pipes made with aeronautical materials. Steering box, suspension arms and all parts are overhauled or new and mounted on Teflon bushings; racing shock absorbers are fitted. The competition set-up includes a roll cage, sport bucket seats, seat belts, fire extinguisher system, battery switch and approved components. The km traveled, after the works were completed, did not exceed fifty.

Tiny and snappy, it looks like something out of a Japanese manga, painted in a bright colour. It has the dimensions of the contemporary Fiat 126 and the same engine capacity but boasts 40 hp and the rev counter has a red line at 6000 rpm. The Honda Z debuted in October 1970 and was marketed until 1973. The Z600 name reflected the engine’s size of 598 cc. The smaller-engined Honda Z360 was available in Japan and other markets, such as Australia. In Europe only the Z600 was marketed; 918 cars were sold, most of them in France and Switzerland. Very rare in Italy, this example has Italian number plates. The car is an abandoned restoration project, so it comes incomplete, partially disassembled and not driving. The bodywork, however, is in good condition (probably repainted), as are the front seats. A vintage car radio is present.

36. 1977 FERRARI 312 T2 SCALA 1/2 BY PONY CAR (PONY CAR)

• Funzionante, motore a scoppio.

• Niki Lauda’s Ferrari, in small format.

• Very rare, one of seven examples, it is not known how many survived.

• Outstanding object for investment and themed collections.

• Working, petrol engine.

• Never been used.

Designed for the 1976 Formula 1 season, the Ferrari 312 T2 was an evolution of the 1975 world champion 312 T. One difference was the elimination of the large air intake behind the driver, prohibited by the regulations. Starting from the Spanish GP, Lauda and Regazzoni had the new car available. Only the accident at the German GP prevented Lauda from regaining victory in the drivers’ world championship. The 312 T2 was also used in 1977 when, updated, it allowed Lauda to conquer his second championship. The T2 also took part in the first two races in 1978 before being replaced by the 312 T3. Every enthusiast would like to give their child (or themselves!) a 1:2 scale replica of this car. Reproductions of famous cars made for children are getting ever-increasing prices. Many are authentic miniature jewels, perfect replicas and some are historical reproductions, made at the time of the original versions, made even more valuable by their rarity. These conditions have made them collector’s items which, as well as entertaining the lucky budding drivers, also represent an economic investment, like any authentic historic car.

This car, a 1:2 scale version of the F1 Ferrari 312 T2, in the Ferrari Sefac team livery (first version) with the number 11 of Niki Lauda, 1977 world champion, is practically new, never used, with original tyres. Information about this minicar is hard to find; it appears that a batch of five specimens was produced in 1979 by the owner of the Italy Car (the first of these for his own daughter), before the bankruptcy of the Bolognese house. It seems that one specimen was purchased by Niki Lauda himself for his son. The steering wheel and tires were produced by the same Ferrari suppliers: Momo and Goodyear. Subsequently, the Pony Car of Bologna bought the leftover parts and some chassis but managed to complete only two more specimens. Power comes from a 60 cc two-stroke BCC petrol engine; it has a two-speed gearbox and reverse, independent suspension, hydraulic disc brakes, alloy wheels, tubeless slick tyres, fiberglass bodywork. It weighs about 100 kg and is 2.40 m long. It can reach 60 km/h. It is not known how many of the original 5 cars and the 2 assembled cars have survived to the present day, other than this example.

• Storia sportiva. Allestita per gare.

• Sicuro investimento.

• Ottime condizioni generali.

• Very good general condition.

When Group B cars were banned from competition and Group A was imposed on rallying in 1987, the leading manufacturers had to develop new cars, built in a minimum of 5,000 units. For this new category, Lancia developed the four-wheel-drive Delta HF, a winner in six consecutive seasons, from 1987 to 1992. Following the Delta HF 4WD, the Delta HF Integrale “8 valve” (Abarth SE 044) was launched in October 1987. With flared wheelarches, larger wheels, larger brakes, and an engine intercooler, it was homologated in March 1988.

This Lancia Delta HF Integrale, dated December 1987, has been set up in Martini Racing livery and prepared for races. The tuned engine develops 349 hp (on the dyno), with forged pistons, Abarth turbocharger, H-shaped connecting rods, special head, lightened shaft, Abarth electronics, steel exhaust and much more. The gearbox has a short final gear. The engine is currently fully reconditioned, perfect. The structure is intact with fenders still with original seals and is reinforced with an integral welded roll cage. The brakes are from the EVO model, oversized. Excellent general conditions. Updated booklet, chronological certificate.

The Ferrari SF90 Stradale (internal code F173) is a super sports car produced starting from 2019. It is the first production plug-in hybrid car from the house of the prancing horse. This solution also allowed it to become the most powerful roadgoing Ferrari in history. The name recalls the Formula 1 car of the same name and underlines the link and construction philosophy between the hybrid technology used on the Formula 1 single-seater and on the road one. The styling of the SF90 Stradale is the work of the Centro Stile Ferrari directed by Flavio Manzoni. The peculiarity of the hybrid system has led to a rethinking of the canonical proportions of the volumes that have characterized the central-engine berlinettas from Maranello over the last twenty years.

Important Information to Buyers

Buying at an auction

Finarte acts in the name and on behalf of the Seller, as an agent of the Seller and, thus, as a mere intermediary between the Buyer and the Seller. Therefore, the sale of the lot is considered to have taken place between the Buyer and Seller. Potential Buyers are required to consult the Site to view the most up-to-date classification of the lots in the catalogue.

Provenance

In certain cases, Finarte may print in the auction catalogue the history of the ownership of a lot when it believes that such information can contribute to the study of, or can help identify, the lot. However, the identity of the Seller or of previous owners might not be disclosed for various reasons, for example to meet the Seller’s request to remain anonymous, or because the identity of the previous owner is unknown, due to the fact that the artwork is old.

Hammer Price, Buyer’s Premium and VAT

In addition to the Hammer Price of the lot, the Buyer shall pay a Buyer’s Premium, as part of the Total amount due.

The Buyer’s Premium is set as follows:

(a) at thirteen point fifty per cent (13.5%) + VAT of the Hammer Price of the lot, up to a maximum of Euro five hundred thousand (500,000.00);

(b) for any part of the Hammer Price in excess of Euro five hundred thousand (500,000.00), the Buyer’s Premium is set at eleven per cent (11%) + VAT

In the event that, with reference to a specific lot, the percentages specified in the auction catalogue are different from those specified herein with respect to the Buyer’s Premium, the percentages set out in the catalogue will prevail.

VAT

A Value Added Tax (VAT) may be applied to the Hammer Price and/ or the Buyer’s Premium. Reference is made to the information on VAT contained in the “Symbols” section below.

n order to harmonise the tax procedures between EU Member States, on 1 January 2001 new regulations came into force in Italy, and the margin scheme was extended to auction houses too. Under Article 45 of Law 342 of 21 November 2000, said scheme also applies to sales made under commission contracts entered into with: (a) private individuals; (b) entities subject to VAT that have subjected the transaction to the margin scheme; (c) entities that could not detract said tax pursuant to Article 19, 19-bis, and 19-bis2 of Presidential Decree 633/72 (i.e. the sale was made in exemption regime under Article 10, 27-quinquies); (d) entities benefiting from the exemption regime granted to small enterprises in their own country.

By virtue of the specific legislation in force, in the aforesaid cases, Finarte will apply the relevant VAT, if any, or the equivalent tax, whenever applicable. No specific symbol will be used to indicate lots sold under the margin scheme.

Artist’s Resale Right

In addition to the Hammer Price, the Buyer’s Premium and the other Expenses, the Buyer undertakes to pay to Finarte, if due, the “Artist’s Resale Right” under Articles 144 et seq. of Law 633 of 22 April 1941, as amended and supplemented, which is payable by the seller under Article 152, first paragraph, of Law 633 of 22 April 1941, as amended and supplemented. Prospective Buyers are required to consult the Website to view the most up-to-date classification of the lots in the catalogue.

Conduct of the Auction

The auction is regulated by the General Terms and Conditions of Sale and by the General Terms and Conditions of Mandate. The General Terms and Conditions of Sale can be amended by a saleroom notice posted in the auction room or an announcement made by the auctioneer before the auction begins. If Finarte also allows online biddings, such amendments will be disclosed also through the Website before the auction begins.

Bids can be made in person by using a paddle at the auction, in writing prior to the auction, over the telephone or via the Internet (in the latter case, only if allowed in the specific auction).

If the Seller is a professional and the Buyer a consumer within the meaning of Article 3 of the Italian Consumer Code, sales made by means of written, telephone or online bids shall be deemed as distance contracts within the meaning and for the purposes of Articles 45 et seq. of the Italian Consumer Code.

The speed of the auction may vary between fifty (50) and one hundred and twenty (120) lots per hour.

Generally, each bid is made by offering a ten per cent (10%) increase over the previous one.

Finarte shall be entitled, at its exclusive discretion, to refuse any person from participating in the auctions.

With respect to any prospective Buyer, Finarte reserves the right to make the participation in the auction subject to the prior submission of a letter of reference from banks or the deposit of a sum as a security for due performance of the obligations set out in these General Terms and Conditions of Sale, to be returned once the auction is over. Anyone making a bid at an auction will be considered a party directly concerned by the purchase unless otherwise agreed between Finarte and the same by a written agreement, where the latter declares to act in the name and on behalf of a third party, and this is accepted by Finarte. In the event that a person, who has been given the possibility of making a bid in connection with a lot, has a direct or indirect interest in the same, e.g. a beneficiary or a will executor who has sold the lot, a co-owner of the same or any other party having provided a guarantee in relation to the lot, Finarte will include such information in the catalogue.

The auctioneer conducts the auction starting from the bid he considers suitable, taking into account the value of the lot and any competing bids. The auctioneer can open the bids on each lot by making an offer in the interest of the Seller. The auctioneer can also make bids on behalf of the Seller up to an amount corresponding to the Reserve, by putting consecutive bids or in reply to other bids.

The fall of the auctioneer’s hammer determines the acceptance of the highest bid, the Hammer Price and, consequently, the conclusion of the purchase contract between the Seller and the Buyer. The auctioneer may, at its sole discretion and at any time in the course

of the auction:

(a) withdraw a lot from the auction;

(b) review a sale offer relating to a lot, whenever the same may deem that it contains mistakes and/or could give rise to disputes; and/ or

(c) adopt any measures that the same deems adequate to the circumstances of the case, e.g. to combine or separate lots, or vary the order of sale from the one set out in the catalogue, provided that the lot is not offered for sale any day prior to the one set out in the auction catalogue.

At some auctions, a video screen may be operated. Finarte will not be held liable for both the correspondence to the original of the image displayed on the screen and any malfunction of the video screen.

Finarte represents that the lot can be declared an object of cultural interest by the Italian Ministry of Cultural Heritage and Activities and Tourism under Article 13 of the Urbani Code. In such case, or in the event that a procedure has been undertaken in order to declare the lot an object of cultural interest under Article14 of the Urbani Code, Finarte will announce said circumstance before the sale. Should the lot be declared of cultural interest, the Seller shall notify the sale to the competent Ministry under Article 59 of the Urbani Code. The sale shall be subject to the condition precedent that the Ministry does not exercise its pre-emption right within 60 (sixty) days as of the date of receipt of the relevant notice, or within the 180- (one hundred and eighty-) day period under Article 61, second paragraph, of the Urbani Code. In the period when the pre-emption right may be exercised, the lot cannot be delivered to the Buyer in accordance with Article 61 of the Urbani Code.

Generally, the Reserve does not exceed the Minimum Pre-Sale Estimate announced or published by Finarte, except in the event that the Reserve is the Reserve is expressed in a currency other than Euros and there are significant fluctuations in exchange rates between the time when the Reserve is agreed and the day of the auction. In such case, unless otherwise agreed between Finarte and the Seller, the Reserve shall be an amount equal to the Euro equivalent based on the closing exchange rate on the business day immediately preceding the auction.

No “without limit” bids, “upon examination” bids or any bids covering lots alternative to the one indicated will be accepted.

Room Bids

To participate in a saleroom auction, all potential Buyers are required to take – before the auction begins – a numbered paddle to make their bids.

The numbered paddle shall be provided to each potential Buyer by Finarte’s staff at the registration desk subject to showing an identity document, filling in and signing the relevant registration and paddle allotment form.

Except in case of wilful misconduct or gross negligence, Finarte and its employees, co-workers, directors or consultants cannot be held liable for any mistake or omission contained in these representations Lots are sold as “seen and liked”, expressly excluding any warranty against hidden defects, and with any gap, defect, flaw and description error.

All the lots, including those having - either in part or in full - an electrical or mechanical nature, must be considered purely for their artistic, decorative and/or collective value and must not be deemed working. The functioning and safety of the lots having, either in part or in full, an electrical or mechanical nature have not been checked before the sale, and such lots are bought by the Buyer at his own risk. The descriptions contained in the catalogues and in the condition reports under Article 5.2 above are merely approximate and are provided for the sole purpose of identifying the lot(s) concerned. The lack of any express reference to the condition of the lot in catalogues and condition reports does not imply the absence of any defects.

Except for the case of gross negligence or misconduct, Finarte or its

employees, co-workers, directors or consultants may not be held liable for acts or omissions concerning the preparation or conduct of the auction or any issue relating to the pre-sale of the lots.

Except in case of wilful misconduct or gross negligence, Finarte’s liability and the liability of Finarte’s employees, co-workers, directors or consultants to the Buyer in connection with the purchase of a lot by the latter is limited to the Hammer Price and the Buyer’s Premium paid to Finarte by the Buyer.

The descriptions for cars and motorcycles, including in relation to their history, age, model, changes of ownership, state of preservation and possible restoration processes, technical characteristics, internal and external components, including the engine number (matching number or not) and chassis number of the car – present in the catalogue and/or in any condition report – are given by Finarte in good faith as guidelines to the potential Buyer on the basis of the indications and information received from the Seller, but may not be considered exhaustive and/or verified. All cars and motorcycles – together with the relevant documents accompanying them – must therefore be properly examined by the potential buyer in order to fully ascertain their condition. Failure to indicate any defect, restoration work or of the presence of any non-original part does not preclude the possibility that any such defect, restoration work or presence of a non-original part exist.

The descriptions, in the catalogue and/or in the condition report, for watches and gemstones including in relation to the state of preservation and any restoration, are given by Finarte as guidelines to the potential Buyer on the basis of the indications and information received from the Seller, but may not be considered exhaustive and/or verified. All the watches and gemstones must therefore be appropriately examined by the potential buyer in order to be able to ascertain their status. Failure to indicate any defect, restoration work or of the presence of any non-original part does not preclude the possibility that such defect, restoration work or presence of a non-original part exist. Wristwatches declared by the manufacturer as water-resistant may have been opened for examination; Finarte therefore suggests that such watches be controlled by an authorised dealer to check their resistance before using the same in conditions where water is present. Straps made of organic material are associated with the watch for display purposes only. Prospective buyers are aware that the importation to foreign countries of materials derived from endangered or otherwise protected species (e.g. tortoiseshell, ivory) are subject to CITES international rules; prospective buyers should therefore acquire the necessary information on such restrictions before participating in the auction for lots containing, even partially, materials falling within the scope of the above rules.

7. PAYMENT

In case of sale, the Buyer shall pay to Finarte the Total amount due immediately – and in any event no later than five (5) days – after the conclusion of the auction.

If a lot is the subject of the declaration under Article 4.1.14 above, the Buyer shall pay the total amount due upon expiry of the period for the exercise of the pre-emption right by the competent Ministry.

Invoicing of the Hammer Price to the Buyer shall be the exclusive responsibility of the Seller

The payment of the Buyer’s Premium and of any Expenses can be made in cash, by bank draft, cheque, bank transfer, debit or credit card (American Express, Visa or Mastercard) or Paypal. Finarte may accept single or multiple payments in cash only for amounts up to Euro 4,999.99.

In case of bank transfer, in the payment description the Buyer’s name and surname and the invoice number must be specified. Payment by debit card, American Express, Visa or Mastercard can be made only by the card holder or, in case of PayPal, by the account holder.

Finarte reserves the right to check the origin of payment received and reject payments received from any persons other than the Buyer.

In limited circumstances, and in any event subject to the Seller’s consent, Finarte may offer any Buyer deemed reliable the possibility of paying the lots in instalments. The conditions for payment in instalments must be agreed before the auction. Before deciding whether to grant the possibility of paying in instalments or not, Finarte can request references in connection with the Buyer’s reliability as well as documentation proving his/ her identity and residence.

Also pursuant to and for the purposes of Article 1523 of the Italian Civil Code, the transfer of the ownership of a lot from the Seller to the Buyer shall take place only upon payment by the Buyer of the tTotal amount due.

In case of non-payment or late payment by the Buyer – within the time limit set out in Article 7.1. above – of the Total amount due, either in full or in part, Finarte shall be entitled, at its discretion, to ask for due performance or terminate the contract for sale pursuant to Article 1456 of the Italian Civil Code, without prejudice, in any event, to its right to claim damages and the right to have the lot sold on behalf and at the expense of the Buyer, pursuant to Article 1515 of the Italian Civil Code.

In case of delay in the payment of the Total amount due for a period of more than five (5) business days as from the auction date, Finarte may store the lot with a third party at the Buyer’s risk and expense and charge the Buyer interest on arrears to Finarte at the 3-month Euribor rate provided by law plus five per cent (5%), without prejudice to Finarte’s right to claim further damages.

In case of non-payment or late payment by the Buyer, Finarte may reject any bids made by the Buyer or any representative of the Buyer in the course of following auctions, or request that the Buyer lodges a sum in cash as security before accepting any bids. Finarte may offset any amount due for whatever reason to the Buyer against whatever sum owed for whatever reason by the Buyer to Finarte.

Cash desk time: Monday - Friday 10:00 am - 1:00 pm; 2:00 pm - 05.30 pm.

8.DELIVERY AND COLLECTION OF THE LOT

The lot will be delivered at Finarte’s registered offices no later than five (5) business days of the date of the sale. The lot will be delivered to the Buyer (or to any third party authorised by the Buyer by a written power of attorney) only after Finarte has received the Total amount due.

Upon delivery of the lot, Finarte will ask the Buyer or any third-party appointee to provide a document proving his/her identity. Before organising the collection, please check with Finarte where the lot is stored.

In case of death, interdiction, inability, cessation/winding up, for whatever reason, of the Buyer, duly notified to Finarte, the latter agrees to return the lot, subject to prior consent of all the Buyer ’s assignees, or in accordance with the terms established by the judicial authority.

Should the Buyer fail to collect the lot within five (5) business days of the date of the sale, Finarte may:

(a) charge the Buyer an amount corresponding to one per cent (1%) of the Hammer Price for each month of delay in the collection of the lot, from the fifth business day following the sale; or

(b) store the lot with a third party at the Buyer’s risk and expense.

9. TRANSFER OF RISK

A purchased lot is entirely at the risk of the Buyer starting from the earliest to occur of the following events:

(a) when the Buyer receives the purchased lot; or

(b) when the Buyer pays the Total amount due for the lot; or

(c)from the date when the five (5) business day payment period after the sale starts to run.

The Buyer will be indemnified for any loss or damage occurring to the lot after the sale but before the risk is transferred, but said indemnity may not exceed, except in case of wilful misconduct or gross negligence, the Hammer Price along with the Buyer’s Premium received by Finarte.

Except in case of wilful misconduct or gross negligence, Finarte may not be held liable for the loss or damage to the frame or the glass containing or covering prints, paintings or other artworks, unless the frame or glass constitute the lot sold at auction.

In no circumstance may Finarte be held liable in case of loss or damage due to any work (including restoration, work on the frame and cleaning operations) carried out by independent experts designated by Finarte with the Seller’s consent, or in case of any loss or damage directly or indirectly caused by, or arising from:

(a) changes in humidity or temperature;

(b) normal wear and tear or gradual deterioration due to operations on the lots and/or hidden faults and defects (including woodworms);

(c) improper treatment;

(d)war, nuclear fission, radioactive contamination, chemical, biochemical or electromagnetic weapons;

(e) acts of terrorism; and

(f) other force majeure events.

Upon written request of the Buyer, Finarte may arrange the packaging and shipment of the lot, on condition that the Buyer:

(a) has fully paid the Total amount due;

(b) provides Finarte with any certificate of free circulation or export licence or any statement and/or certification required for such purpose.

Unless otherwise agreed with the Buyer:

(a) packaging and shipment expenses shall be for the account of the Buyer, who may request, at least twenty-four (24) hours before the beginning of the auction, estimates of costs should the Buyer decide to entrust Finarte with the packaging and shipping of the lot;

(b) the insurance coverage concerning any risk for (even partial) loss and/or damage caused to the lot during transport must be agreed between the Buyer and the carrier without any liability for Finarte;

(c) the cost of insurance shall be for the account of the Buyer

The shipment and packaging of the lot to the Buyer shall be entirely at the risk and expenses of the Buyer and Finarte shall in no event be held liable for any action or omission of packaging workers or carriers.

11. EXPORTATION FROM THE REPUBLIC OF ITALY

Export of cultural goods outside the territory of the Republic of Italy is regulated by the provisions of the Urbani Code. Likewise, export of cultural goods outside the territory of the European Union is regulated to the provisions of Regulation (EC) 116/2009 of 18 December 2008 and of Commission Implementing Regulation (EU) 1081/2012.

The export of a lot from the territory of the Republic of Italy may require a certificate of free circulation or an export licence. Obtaining a certificate of free circulation and/or export license is the responsibility of the Buyer. In case of non-obtainment or delay in the obtainment of a certificate of free circulation and/or an export license, said circumstance shall not constitute a reason for the termination or cancellation of the sale, nor a justification for late payment of the Total amount due by the Buyer.

12. PROTECTED SPECIES

All lots consisting of, or containing, parts of plants or animals (e.g.: coral, crocodile, ivory, whalebone, turtle), regardless of their age or value, may require a licence or certificate before export, and/or additional licences or certificates for importation into non-EU countries. The granting of a license or certificate for import does not guarantee the obtainment of a license or certificate for export, and vice versa. Please note that obtainment of an import licence or certificate does not guarantee any export licence or certificate and vice versa. Finarte recommends that potential Buyers check the requirements under their national legislation for the import of goods made of, or containing, protected species into their country. It is the Buyer’s responsibility to obtain such import or export licences/certificates as well as any other document required before making any bid. Please refer to Article 11 of the General Terms and Conditions of Sale.

13. SAMPLE TERMINOLOGY

Please pay attention to the following sample terminology:

• “SANDRO BOTTICELLI”: in Finarte’s opinion, the work is a work by the artist (when the artist’s forename is not known, whether the surname is preceded by a series of asterisks or by an initial or not, it indicates that the work is by the named artist).

• “ATTRIBUTED TO SANDRO BOTTICELLI”: in Finarte’s opinion, the work is probably a work by the artist, but there is less certainty than in the above category.

• “SANDRO BOTTICELLI’S STUDIO/WORKSHOP”: in Finarte’s opinion, the work is a work by an unknown hand in the artist’s studio/workshop who may have undertaken the painting under the artist’s supervision.

• “SANDRO BOTTICELLI’S CIRCLE”: in Finarte’s opinion, the work is by an unidentified but distinct hand, closely associated with the named artist but not necessarily a pupil of the artist.

• “FOLLOWER OF SANDRO BOTTICELLI”: in Finarte’s opinion, the work has been made by a painter working in the artist’s style, contemporary or nearly contem¬porary to the artist, but not necessarily a pupil.

• “SANDRO BOTTICELLI’S MANNER”: in Finarte’s opinion, a work of the style of the artist and of a later date.

• “AFTER SANDRO BOTTICELLI”: in Finarte’s opinion, the work is a copy of a known work of the artist.

• “IN THE STYLE OF …”: in Finarte’s opinion, the work is in the style mentioned, but of a later date.

The term “signed” and/or “dated” and/or “inscribed” means that, in Finarte’s opinion, the signature and/or date and/or inscription are from the hand of the artist.

The terms “bearing signature” and/or “date” and/or “inscription” means that, in Finarte’s opinion, the signature and/or date and/or inscription seem to have been added or from another hand.

The dimensions given are height first, width and, possibly, depth. Paintings and photographs are not to be considered framed unless otherwise specified.

SHIPMENT

LEGAL GUARANTEE OF CONFORMITY

If the Seller is a professional and the Buyer a consumer within the meaning of Article 3 of the Italian Consumer Code, and the lot sold can be deemed a “consumer good” within the meaning of Articles 128 et seq., of the Italian Consumer Code, such lots sold through Finarte are covered by the legal guarantee of conformity provided for in Articles 128-135 of the Italian Consumer Code (“Legal Guarantee”). The Legal Guarantee is reserved for consumers. It therefore applies only to anyone who has bought a lot for purposes unrelated to his/her business, commercial, craft or professional activities.

The Seller is liable to the consumer Buyer for any lack of conformity existing at the time of delivery of the product “consumer good” that becomes apparent within two (2) years of that delivery. The lack of conformity must be reported to the Seller, under penalty of forfeiture of the guarantee, within two (2) months of the date of which it was discovered. Unless proved otherwise, it is assumed that any lack of conformity which becomes apparent within six (6) months of delivery of the product already existed on the delivery date, unless such assumption is incompatible with the nature of the product or with the nature of the lack of conformity. From the seventh month following the delivery of the lot, it becomes the consumer’s burden to prove that the defect existed at the time of delivery. In order to avail himself/herself of the Legal Guarantee, therefore, the consumer shall first give proof of the date of the sale and the delivery of the lot. To be able to provide this proof, the consumer should, therefore, keep the order confirmation, the purchase invoice or the DDT or any other document suitable to demonstrate the date of purchase and delivery. With reference to the definition of “lack of conformity”, please refer to the provisions of Article 129, second paragraph, of the Consumer Code. Excluded from the scope of the Legal Guarantee are any defects caused by accidental events or by responsibilities of the Buyer - consumer, or by any use of the lot that is incompatible with its intended use. In this regard, it is specified that all the lots, including those having - either in part or in full - an electrical or mechanical nature, must be considered purely for their artistic, decorative and/or collective value and must not be deemed working. In the event of a lack of conformity duly reported in the appropriate terms, the consumer Buyer will be entitled: (i) first, to the repair or replacement of the lot, at his/her discretion, free of charge, unless the remedy requested is objectively impossible or excessively onerous compared to the other; (ii) second (in cases where repair or replacement is impossible or excessively onerous, or the repair or replacement did not take place within a reasonable time or the repair or replacement made previously caused significant inconvenience to the consumer), to a reduction in the price or termination of the contract, at his/her discretion. The remedy requested shall be deemed excessively onerous if it imposes unreasonable costs upon the Seller compared to any other applicable remedy, taking into account: (i) the value that the lot would have if there were no lack of conformity; (ii) the nature of the lack of conformity; (iii) the possibility to implement the alternative remedy without significant inconvenience to the consumer. If, during the period of validity of the Legal Guarantee, the lot shows any lack of conformity, the consumer may contact Finarte according to the terms of Article 14. Finarte will promptly reply to any notice of alleged lack of conformity and inform the consumer of the specific procedure to be followed.

16. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by the laws of Italy. Any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale shall be submitted to the exclusive jurisdiction of the courts of Milan.

The above is without prejudice of the applicability to Buyers who are consumers under Article 3 of the Italian Consumer Code and who do not have their habitual residence in Italy of any more favourable and mandatory provisions of the law of the country in which they have their habitual residence. For any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale, the court of competent jurisdiction shall be the court of the place where the consumer Buyer resides or is domiciled.

Furthermore, any consumer Buyer residing in a Member State of the European Union other than Italy may access, for any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale, the European Small Claims procedure under Regulation (EC) 861/2007 of the Council of 11 July 2007, provided that the value of the claim, disregarding all interest, expenses and disbursements, does not exceed Euro 2,000.00. The text of the Regulation is available on the website .eur-lex.europa.eu.

Under Article 141-sexies, paragraph 3 of the Italian Consumer Code, Finarte informs any user who can be classified as a consumer within the meaning of Article 3, first paragraph, a) of the Italian Consumer Code that, in the event he/ she has filed a complaint directly with Finarte, as a result of which, however, it was not possible to resolve the dispute arising therefrom, Finarte will provide information about the Alternative Dispute Resolution entity or entities in charge of out-of-court settlement of any dispute concerning the obligations arising from a contract concluded under these General Terms and Conditions of Sale (so-called ADR entities, as specified in Articles 141-bis et seq. of the Italian Consumer Code), specifying whether or not it intends to make use of such entities to resolve the dispute. Finarte also informs any user who can be classified as a consumer within the meaning of Article 3, first paragraph, a) of the Italian Consumer Code that that a European platform for online resolution of consumer disputes has been established (the so-called “ODR platform”). The ODR platform is available at http://ec.europa.eu/consumers/odr/. On the ODR platform, a consumer Buyer may consult the list of ADR bodies, find the link to the website of each of them and start an online dispute resolution procedure for the dispute in which he/she is involved.

I, the undersigned, declare to specifically approve, pursuant to Article 1341 of the Italian Civil Code, the following clauses of the General Terms and Conditions of Sale:

1) Pursuant to Article 20, paragraphs 1 to 5, of Legislative Decree 231/2007, the criteria for determining the beneficial ownership of clients other than natural persons are as follows: “1. For clients other than natural persons the beneficial owner is the natural person or persons to whom direct or indirect ownership or control of the entity is ultimately attributable. 2. If the client is a joint-stock company: a) the ownership of more than 25 per cent of the client’s capital, held by a natural person, is considered as direct ownership; b) the ownership of more than 25 per cent of the client’s capital, held through subsidiaries, trust companies or third parties, is considered as indirect ownership. 3. In cases where an examination of the ownership structure does not allow the unambiguous identification of the natural person or persons to whom the direct or indirect ownership of the entity is attributable, the beneficial owner is the natural person or persons to whom the control of the entity is ultimately attributable by virtue of: a) control of the majority of the votes exercisable in ordinary shareholders’ meetings; b) control of votes sufficient to exercise a dominant influence in ordinary shareholders’ meetings; c) the existence of particular contractual obligations that allow the exercise of a dominant influence. 4 In the event that the client is a private legal entity, as per Presidential Decree No. 361 of 10 February 2000, the following are cumulatively identified as beneficial owners: a) the founders, if alive; b) the beneficiaries, if identified or easily identifiable; c) the holders of management and administration functions. 5. Where the application of the criteria set out in the preceding paragraphs does not enable one or more beneficial owners to be clearly identified, the beneficial owner(s) shall correspond to the natural person(s) holding, in accordance with their respective organisational or statutory structures, legal representation, administration or management powers of the company or client in any case other than the natural person”.

2) Pursuant to Article 1, lett. dd), paragraph 2, of Legislative Decree 231/2007: “A) POLITICALLY EXPOSED PERSONS: are natural persons who hold office or have ceased to hold office for less than one year as: (a) President of the Republic, Prime Minister, Minister, Deputy Minister and Undersecretary, President of the Region, Regional Minister, Mayor of a provincial capital or metropolitan city, Mayor of a municipality with a population of not less than 15,000 inhabitants and similar offices in foreign States; (b) Member of Parliament, Senator, Member of the European Parliament, Regional Councilor and similar offices in foreign States; (c) Member of the central governing bodies of political parties;.(d) Judge of the Constitutional Court, magistrate of the Court
