ELDER LAWYERS - WHO ARE THEY AND WHY DO YOU NEED ONE Elder Law - What is it? Elder law is an area of practice which focuses exclusively on senior issues, from Medicaid to estate planning, social security to elder abuse. With this said, it is usually a euphemism for Medicaid planning. An elder law attorney is one that is knowledgeable in the legal matters that must be understood to provide a client with a well rounded view of the steps necessary to protect and preserve the family assets when a long term medical care situation arises. It is often the client with Alzheimer, Parkinson and other long term and often debilitating illnesses that seek the advice of an elder law attorney. And to think, you thought elder law was an area of practice for attorneys more than 80 years of age. Just kidding. Elder Lawyers - Where can I find one? Anyone can call himself an elder law attorney. However, under the Florida Bar rules you cannot call yourself a “specialist,” unless you are Board Certified by the Florida Bar. While this certification is now available, there are very few attorneys that choose to take this path. In the alternative, an estate planner, like myself or another type of attorney, who deals extensively with more mature clients, often will gather a wealth of knowledge in this highly regulated and specialized area and refer to themselves as an elder law attorney. Through membership in the National Academy of Elder Law Attorneys (NEALA) and participating in the NAELA LISTSERV, an attorney can stay current on the unique and difficult issues that face clients who need medicaid to pay for their long term (medical) care needs. An elder law attorney can be found by contacting the Local Bar, the Florida Bar or the National Academy of Elder Law Attorneys. Always ask the attorney if they have practiced in this area for an extended period of time and whether or not they have handled many cases in this area. Qualifying for and obtaining medicaid on time

is essential when your money runs out (or sooner if elder law/estate planning techniques are utilized). Is it Necessary to Go to an Attorney that Practices in the Area of Elder Law? The short answer is yes. The long answer is your attorney should know when to hand the ball off to an elder law attorney when it is necessary. It is my personal experience, that it is wise to draft every estate plan for a client with modest assets with an eye toward long term care and elder law. “What if,”scenarios must be run to cover the possibilities that may arise if you (or, if you are married, your spouse) become ill with a long term medical condition. Keeping the estate plan flexible to allow for necessary transfers to avoid the erosion of the client’s estate is necessary. Knowing the client’s goals and expectations regarding long term care and the preservation of their assets is essential. An elder law attorney will know the techniques and possibilities that may be utilized to protect your assets without spending down your assets to $2,000 as required by the so-called “Asset Test,” imposed on an individual who tries to qualify for medicaid. Avoid the pitfalls of planning too late. There are numerous hurdles to jump and timeframes that must be met. As always, plan early for the potential long term care cost that may arise.

It’s March and it’s time to starting thinking baseball. This is an exciting time as the spring training season begins for the Minnesota Twins and Boston Red Sox here in Southwest Florida. If you look carefully there are similarities between the baseball swing and the golf swing. This comparison to a swing many of us are familiar with can be a great visualization for anyone new to the game of golf.

If you want to generate more power in your swing to hit the home run winning drive and increase accuracy of all your shots fully extend your arms down the intended target line on the follow through, continue to rotate your body through the shot and finish on your left side. If you fail to finish your swing you sacrifice maximum distance and accuracy.

Practice Drill

You have my permission, go ahead and throw your clubs! Try this club throwing drill that not only helps with extension and release but creates focus on the target rather than the ball. Find a couple of used clubs and a wide open area of the driving range. Begin by making a full swing and gently throw the club towards your intended target on the follow through. Your body will turn forward, arms extend and your weight transfers to your left side. This can be fun to do and teach you the correct feeling of full extension.

COSMOS CAFE AND PIZZERIA Ingredients Fregola pasta, 300 g 4 Artichokes 6 Tablespoons of Bottarga 1 Clove of garlic 1 Packet of saffron powder Parsley Extra Virgin Olive Oil (EVOO) Salt White wine Preparation – Fregola Pasta Bring 1 Liter of water in a pan to a boil and add the 300 grams of Fregola Pasta Boil for 10 minutes Preparation – Sauce Clean Artichoke Cut artichoke into quarters, or 4 pieces for each artichoke Soak the artichoke quarters in water and lemon juice Chop and mince the 1 clove of garlic In a large saucepan, sauté garlic in 3 Tablespoons of EVOO When brown, add the artichoke quarters Add a pinch of salt Add saffron packet Add a dash of white wine Stir around and sauté briefly Allow simmering for a bit Final Preparation Drain water from Fregola Pasta Add Fregola pasta to the large saucepan with the sauce Stir around and allow to simmer for a few minutes on low heat Add Parsley and Bottarga Ready to serve – 4 people
