Steven landed in Naples after a successful run cooking in one of Washington DC’s finest restaurants, 1789, located in Georgetown. After leaving the kitchen, Steven helped conceive, develope and grow one of the first food truck brands in the District. Subsequently, his efforts contributed to the creation of the food truck industry in DC, new legislation and an industry administration which paved the way for the over 250 branded trucks currently in business. The self-directed IRA used to hold (among other items) real estate is an incredible opportunity for the right investor who understands the rules and uses appropriate experts in the industry. However, there have been numerous lawsuits against companies that administer self-directed IRAs and the dishonest advisers who sell unsuitable investments to owners of these IRAs, including several Ponzi schemes. You see, you are in control and you therefore can choose to make uninformed decisions. Ergo, the term self-directed. Self-directed IRAs are nothing more than a carved-out provision that permits you the investor to set aside all or a part of your traditional IRA into a separate account administered by a trust company that is set up to hold these special accounts. The administrator handles the compliance work and you the investor select the investment(s). While you are prohibited from holding certain items in a self-directed IRA, such as collections and S corporation stock, you can hold many types of investments -- including real estate -- that a traditional IRA custodian would not be able to handle. So what is the big deal? The big deal is that IRAs and other qualified plans are exempt from paying current income
taxation. The internal tax-free growth in an IRA can be tremendous over the period years. [Ask your advisor about the greater tax benefits of the Roth IRA – where you pay tax now and then the future growth and the distributions are tax free]. To ensure the income earned on your investment real estate held in the self-directed IRA is not subject to tax, it is critical to avoid certain traps for the unwary: Avoid Debt-Financed Property. While investment income generally is not taxable, in certain instances, a tax will be imposed on that income if it is derived from an unrelated business (called unrelated business taxable income, or “UBTI”). The tax laws treat investment income that is derived from debt-financed property as UBTI. So if the investment property is purchased using debt, some tax may be imposed. Avoid Self-Dealing. If you in any way personally benefit (even indirectly) from the investment real estate, say for example, by living or working in the real estate held in the IRA, then certain penalties would apply. An experienced advisor would help you navigate these rules to ensure your real estate investment grows tax free in the IRA. So, the big deal is that it is not complicated to set up or maintain a self-directed IRA and it will afford you the opportunity to diversify into asset classes that are not available in traditional IRA custodial accounts.
