May Real Estate Market Stays a Steady Course The housing market momentum continues to remain strong heading into summer Naples, Fla. (June 20, 2014) – The housing market momentum continues to remain strong heading into summer. NABOR® leaders cite four key indicators: 1) Pending sales are up; 2) Closed sales are up; 3) Median closed prices are up; and 4) Days on the market have decreased. Activity for the 12-months ending May 31st reflects consumer confidence in the Naples area real estate market. In a report released by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), overall pending sales increased 2 percent yearover-year from 10,723 to 10,905 pending sales in the 12-months ending May 2014, overall closed sales increased 3 percent year-over-year from 9,447 properties to 9,739 properties in the 12-months ending May 2014, and the overall median closed price rose a comfortable 15 percent overall year-over-year from $220,000 to $253,000 in the 12-months ending May 2014. This slow and steady growth trend contributes to the stability factor in our local real estate market. “May is what Realtors consider a transitional month,” said Mike Hughes, Vice President and General Manager of Downing-Frye Realty. “Seasonal residents are leaving town and the international visitors haven’t arrived yet. It’s not surprising that overall pending and closed sales were down compared to last May due to restricted inventory this year. But over a thousand sales took place in May which is still quite significant.” “An inventory shortage usually drives down pending home sales,” said Glenn Ginsberg, Broker/Owner of A Delta Realty of Naples, Inc. “For May, a 2 percent increase in overall pending sales is very good considering inventory decreased 8 percent.” According to the report, May’s inventory was the lowest it’s been since NABOR® started tracking activity in 2007. But the decrease is mainly in the condominium market where inventory decreased 19 percent from 2,294 units in May 2013 to 1,850 units in May 2014. Inventory in the single family home market actually increased 5 percent from 1,968 in May 2013 to 2,069 in May 2014. New home construction is helping to relieve the inventory pressure and moderate price gains, according to NABOR analysts. “Brokerages are seeing a significant increase in new construction,” said Brenda Fioretti, Managing Broker at Berkshire Hathaway HomeServices Florida Realty. “And Realtors are involved in new construction sales. Agents have access to all new properties and can present a comparative and objective view to homebuyers.” Another positive indicator that the Naples area real estate market is balanced was pointed out by Dr. Lawrence Yun, PhD, Chief Economist National Association of Realtors® (NAR®), at NABOR®’s annual Economic Summit in April 2014, where he stated that a market becomes stable when its non-traditional (short-sale

or foreclosed homes) sales activity remains under 10 percent. For the second month in a row, non-traditional closed sales in the Naples area are 9 percent of the total closed sales. The NABOR® May 2014 Report provides comparisons of single-family home and condominium sales (via the Southwest Florida MLS), price ranges, and geographic segmentation and includes an overall market summary. The NABOR® May 2014 sales statistics are presented in chart format, including these overall (single-family and condominium) findings: • Closed sales for single-family homes in the $2 million and above market increased 73 percent from 22 in May 2013 to 38 in May 2014. • Closed sales for condominiums in the $2 million and above market increased 123 percent from 13 in May 2013 to 29 in May 2014. • The overall median closed price of homes $300,000 and under increased 13 percent from $150,000 in the 12-months ending May 2013 to $170,000 in the 12-months ending May 2014. • The median closed price for condominiums in the $2 million and above market increased 5 percent from $2,770,000 in the 12-months ending May 2013 to $2,900,000 in the 12-months ending May 2014. • The overall average days on market are at 96 for May 2014. • Overall pending sales increased 34 percent for homes $2 million and above from 41 contracts in May 2013 to 55 contracts in May of 2014. • Overall inventory decreased 8 percent from 4,262 units in May 2013 to 3,919 units in May 2014. • Overall inventory for properties under $300,000 decreased 18 percent from 1,761 units in May 2013 to 1,448 units in May 2014. • Inventory of single family homes in the $300,000 - $500,000 price segment increased 15 percent from 438 homes in May 2013 to 502 homes in May 2014. * Analysts at NABOR® explain that the ongoing activity in the high-end of the market every month is in part a result of continued stock market gains which, coupled with continued low mortgage interest rates, is boosting consumer confidence in investing in the housing marketing and allows a good climate for diversification in real estate investment.

Real Estate Law 101: How Should a Married Couple Take Title to Florida Real Property? Tenants by the Entireties vs. Joint Tenants with Rights of Survivorship The Question of the day is whether Tenants by the Entireties (T-by-E) is the same thing as Joint Tenants with Rights of Survivorship (JTROS)? The simple answer is that they appear to be very similar and therefore, they are often mistaken for one another. Buyer beware; they are not similar. While JTROS may be desired, if you are married, you will most often prefer the protections of T-by-E. Read on! Tenants by the Entireties (we use T-by-E as a short cut in the business) is a “unity” of ownership that is only available for a married couple (I will leave the definition of marriage to the DOMA experts). T-by-E is a form of joint tenancy (like JTROS) but it has some very unique characteristics and benefits. It is easier to point out the similarities of JTROS and T-by-E than the differences, so we will first tackle the similarities. Both JTROS and T-by-E are an efficient way to pass assets to a spouse and avoid probate on the death of the first spouse. The title to the property immediately is vested (owned) by the survivor upon the death of the spouse by operation of law (very little legal paperwork is necessary to clear title to property upon this event). The other similarity is that it requires both joint tenants (spouses) to sign the deed if the entire property is to be sold to the third party. That is about the sum total of the similarities. T-by-E is the more common form of ownership by a married couple unless there are extenuating circumstances or if you are in a state that does NOT recognize this special form of ownership. T-by-E was established hundreds of years ago under the old English common law based on the fact that a husband and a wife were considered a “Unity” of One. It is considered a special tenancy or bond that cannot be broken without two signatures. Benefits of T-by-E 1) Asset Protection - The first key benefit of T-by-E ownership is the protection from creditors if only one of the owners (spouses) is deemed liable for damages in a lawsuit. You see, like chocolate and vanilla swirl ice cream, you cannot determine who owns T-by-E property because it is considered owned 100% by both parties. So, in a lawsuit environment, you cannot take assets from a spouse if the spouse is not liable as well. 2) Control of Disposition - Unlike JTROS, T-by-E requires both parties to sign any deed transferring ANY interest in the

property. One spouse cannot sell or dispose of that spouse’s one-half interest without the other spouse’s consent/ signature as they could with JTROS. Therefore, this provides an innocent spouse protection from losing the house for financial actions taken unilaterally by the other spouse. Example, one spouse cannot mortgage the house for a business deal without the other spouse’s consent. 3) Lifetime Gifting and Disposition at Death - T-by-E will pass to the surviving spouse by operation of law at the death of the first spouse to die (same as JTROS). But, unlike JTROS, one spouse cannot gift away their respective interest in the real estate without the consent/signature of the other spouse. This protects the other spouse from losing an interest in the property without their knowledge. Example, one spouse wishes to gift their interest to their children from a prior marriage. This may be a great idea, but it is impossible with T-by-E without consent. Second Marriage Scenario’s As you can glean from the above, in a second marriage scenario, you very well might want to hold real property as Tenants in Common (whereby you each control your exact interest) so that you can ultimately dispose of the real property as you deem appropriate. This is what we call heavy lifting. How you take title to property is as important as making a Will or entering into a contract. It should not be a decision made at the real estate closing. It should be well thought out with the advice of counsel and other professional help. Finally, if the real property is your “Homestead,” the plot thickens and you should slow down once again to evaluate how to best title your real estate. Homestead has its own unique advantages and you may have more decisions to make. Please look forward to this topic in future articles.

“Breaking the Cycle of Poverty through Education” The Guadalupe Center began more than 30 years ago as a soup kitchen to feed and clothe the impoverished in Immokalee. Today’s focus is educating the children in Immokalee in an effort to break the cycle of poverty through education. Today the Center provides: w Early Childhood Education w After-school & Summer Educational Programs w Tutor Corps Program The Early Childhood Education program serves 270 at-risk children, six weeks to five years of age, most living in low income households in Immokalee. Currently there are over 300 children on the wait list. The After-school & Summer Educational Programs serve 650 and 300 at-risk students, respectively. These programs provide students with a safe environment after school and in the summer where learning can continue with the help of our qualified teachers and our Tutor Corps students. The main components of Tutor Corps include: Employment, Adult Mentors, College Prep, Scholarships and Long-Term College Support. For the past 8 years, 100% of our Tutor Corps students have graduated from high school; 90% of the students attending college complete their schooling and obtain rewarding careers.

Back to School Shoes & Supplies Drive

Each year, children in Immokalee lack the basic supplies they need to make a successful start to the new school year. For parents in Immokalee, new shoes and supplies for school are not options when competing with other necessities such as food and rent. That is why each year, the Guadalupe Center holds its annual Back to School Shoes & Supplies Drive. Between August 11th and August 15th, 50 children a day will be brought to Snyderman’s Shoes in Naples to be fitted for brand new shoes. This trip to Naples is a highlight of their summer, and for many, this is their first pair of new shoes. You can help these children get the shoes and supplies they need by donating new child-sized shoes, school supplies or by making a monetary donation.
