IN HONOUR OF HON’BLE JUSTICE UU LALIT EWS quota is valid and constitutional. Amendment as a separate class is a reasonable classification. Legislature understands needs of people, it is aware of economic exclusion of people from reservation. —Justice Bela Trivedi
The EWS amendment does not violate equality code or essential features of Constitution. Reservation is an instrument of affirmative action so as to ensure an all-inclusive march for goals of an egalitarian society. —Justice Maheshwari
I have concurred with view taken by Justice Bhat. In view of the decision rendered by majority, challenge raised to 103rd amendment fails. Writ petitions and other proceedings stand disposed off accordingly. —CJI UU Lalit
Reservation on an economic basis is permissible, excluding SC/STs and Other Backward Classes from EWS cannot be permitted and amounts to discrimination against them. —Justice S Ravindra Bhat
The ones who have moved ahead should be removed from backward classes so that ones in need can be helped, ways to determine such classes need a re-look so that ways are relevant in today’s time. —Justice Pardiwala
