The path for elections in the Union Territory of Jammu and Kashmir has been cleared with the Supreme Court rejecting a petition against the proposed delimitation of constitution which, the state parties alleged, was done keeping the BJP’s interests in mind. The petitioners had argued that the Jammu & Kashmir Reorganisation Act, 2019, empowers only the Election Commission of India to conduct the delimitation exercise. Refuting the point, the Centre said that the Act does not preclude the setting up of a Delimitation Commission by the government.

The path for elections in the UT of J&K has been cleared with the SC rejecting a petition against the proposed delimitation of constitution which, the state parties alleged, was done keeping the BJP’s interests in mind cratic Party (PDP) — were opposed to the delimitation exercise as assembly constituencies in the Jammu region will increase from the existing 37 to 43 and from 45 to 47 in the Kashmir region. The delimitation panel has recommended four additional seats for Kashmiri migrants. For the first time nine seats have been reserved for Scheduled Tribes. The redrawn assembly seats in favour of Jammu region are likely to have a significant political impact as it may tilt the balance of power against the Muslim voters.
Kashmir region has a little over 96% of Muslim population and a mere 2.5% of Hindus, whereas Hindus account for 62.6% and Muslims 33.5% in Jammu. Compared to its population Jammu region will have a disproportionate number of assembly constituencies. And that is what State parties were not ready to accept. Following these major changes the BJP can now look forward to being part of UT’s power structure.
In major gubernatorial changes the Central government appointed Justice SA Nazeer, a retired judge of the Supreme Court and two army officers among others as governors. If the appointment of Justice Nazeer, who was part of the five-judge SC bench which delivered the Ayodhya verdict in 2019 and later on demonetisation, has raised the hackles of the opposition, shifting Ramesh Bais from Jharkhand to Maharashtra is no less significant. Union Law Minister Kiren Rijiju hit back at the Congress which quoted late Arun Jaitley’s remark that “pre-retirement judgments are influenced post retirement jobs” to criticise Justice Nazeer’s appointment. “The Whole Ecosystem is once again in full swing on the appointment of a governor,” Rijiju said.
