Challenging the Validity of a Will

Sometimes, when a loved one passes away, there are circumstances where the family left behind do not accept that their loved one’s last Will accurately reflects their intentions. This could be for a number of reasons and you may want to investigate further, particularly when something doesn’t look quite right. There are steps that can be taken in those circumstances, to investigate the circumstances under which the Will was prepared.

Lodging a Caveat

In order to deal with the assets of a deceased, the executors of a Will would need to apply for a “grant of probate” which is a document that provides the executor (who is named in the Will) with the legal authority to deal with the administration of a deceased’s estate.

If you have concerns about the validity of the last Will, you can stop a grant of probate being taken out by entering a “caveat” at the probate registry. This is a relatively simple procedure that requires a short application to be made to the Probate Registry and prevents a grant of probate from

being taken out. A caveat lasts 6 months from the date of entry and can be renewed every 6 month periods for the same period. This allows you time to raise enquiries about the circumstances under which the Will was prepared in the secure knowledge that your loved one’s estate is not being administered.

Types of challenge

The most common reasons for challenging the validity of a Will are dealt with below.

Want of due execution

To be valid, a Will must be executed in accordance with s. 9 of the Wills Act 1837. In short

• The Will  must be in writing and the testator must sign it, or another person must sign it in their presence and at their direction.

• It must appear that the testator intended by their signature to give effect to the Will.

• The signature must be either made or acknowledged in the presence of at least two witnesses present at the same time.

• Each witness must sign the Will, or acknowledge their signature, in the presence of the testator (but not necessarily in the presence of any other witness).

If the Will fails to comply with the above, it will be considered invalid.

Lack of testamentary capacity

For a testator to make a Will, they must have sufficient testamentary capacity to do so. The test set out in Banks v Goodfellow provides that a testator must understand:

1. the nature of the act of making a Will and the effects of the Will;

2. the extent of the property of which they are disposing of;

3. the claims on their estate to which they ought to give effect; and

There should also be no disorder of the mind so for example, if the testator had severe dementia at the time he or she made his Will, they are unlikely to have had the necessary capacity.

Want of knowledge and approval

The testator must have known and approved the contents of their Will in order for the Will to be valid. Proof of the testamentary capacity of the testator and due execution of the Will provides an inference that the testator knew and approved its contents. However, issues under this head may arise in the following circumstances:

1. the testator is deaf, dumb or blind;

2. where the party who writes or prepares the Will takes a benefit from it;

3. where there is an obvious mistake in the Will.

Undue Influence

A Will that has been procured by undue influence is not valid because it does not represent the testator’s true wishes. In Edwards v Edwards [2007] EWHC 1119, undue influence was described as coercion which is a: ‘pressure that overpowers the volition without convincing the testator’s judgment. It is to be distinguished from mere persuasion, appeals to ties of affection or pity for future destitution, all of which are legitimate.’

Establishing undue influence is difficult as by its very nature, it takes place behind closed doors. The court recognises this and will take a holistic view of all the circumstances before reaching its conclusion.

Fraudulent Calumny

Fraudulent calumny differs from undue influence in that the offending party changes the testator’s mind by casting dishonest aspersions on a potential beneficiary. The following factors must be established:

1. There must be a false representation;

2. To the testator;

3. About the character of an existing or potential beneficiary;

4. For the purpose of inducing the testator to alter their testamentary disposition;

5. In the knowledge that the representation is untrue, or recklessness as to its truth; and

6. The fraudulent calumny induced the testator to make the disputed will.

Forgery

The most common form of fraud pleaded in Will validity claims is forgery which usually involves a claim that the signature to a Will that is forged. Other types of fraud on a Will include where sections or pages of the Will are removed, inserted, replaced or if the entire document is forged.

Sundays for Steaming Days and Special Events, is also open Monday to Friday 9.30am-2pm when the rest of the site is closed. What’s more, there is no entry fee on these weekday café-only days.

Welcome to one of the world’s oldest and most famous amateur sporting events.

Watched by thousands along the banks of the River Thames and by millions more on TV around the world, The Boat Race is the world’s most famous rowing race, and one of the biggest free sporting events in London. 2025 will see the 170th Men’s Boat Race and 79th Women’s Boat Race.

The first ever race took place in 1829 in Henley on Thames, a challenge between old school friends. The Women’s Boat Race first took place in 1927. The contest between two rowing crews from the UK’s two greatest universities, Oxford and Cambridge, now spans nearly 200 years of sporting rivalry - and established itself as the epitome of amateur sport, raced by student athletes who combine academic rigour with elite physical prowess.

The Railway Café is located inside their stunning glass-roofed visitor centre and provides a nostalgic heritage railway atmosphere with vintage carriages and beautiful loco (pictured above) on display. The interior décor reflects railway heritage, with vintage photographs and

memorabilia adding to the historic charm. Large windows and the glass roof let in plenty of natural light and offer views of the historic trains and surrounding countryside. Visitors can wander around the visitor centre and gift shop and the area outside with many other carriages and locos to admire, and there’s a lovely play area for the children to enjoy. (NB The bridges are closed during the week so there is no access to the railway museum and there are no train rides.)

The Railway Café menu caters to a variety of tastes, featuring their famous hearty full English breakfasts and good value lunch options from jacket potatoes and toasted paninis to freshlyprepared sandwiches, chicken nuggets and chips. They also offer a good selection of snacks, crisps, chocolate and ice creams, as well as hot and cold drinks, with options available for dietary restrictions.

Tring Brewery have announced The Repair Shed as their ‘Charity of Choice’ for 2025.

The Repair Shed is a charity programme which brings local, older men together to combat social isolation, offering them welcoming sheds to make and mend, forming bonds with like-minded ‘Shedders’. Tring Brewery will produce monthly special beers to raise awareness for The Repair Shed and plans to host unique fundraising events throughout the year. Each monthly beer will enjoy namesake and imagery inspired by hardware and ‘elbow grease’, finished with The Repair Shed’s official logo.

Launched in 2015, The Repair Shed is just one arm of Community Action Dacorum, a local charity who’s tenets are “Community | Wellbeing | Employability”. Using the Repair Shed’s venues, which are situated in Hemel Hempstead, Northchurch, Kings Langley and Redbourn, “Shedders” can work on personal projects alongside community builds and refurbishments. Amongst other things, these include eco-friendly ‘bug hotels’, and planters which adorn local towns centres.

Shedders are also given time to work on income generation projects on behalf of the charity, although additional fundraising opportunities are vital for the longevity of the sheds.

The Repair Shed offers tools, materials and a warm welcome to dozens of older men, who have access to sheds in Hemel Hempstead, Kings Langley, Northchurch and Redbourn. Alongside special beer releases, Tring Brewery will raise funds through bi-annual members’ evenings, their annual ToadFest beer festival, an exciting online raffle and further ventures yet to be revealed. Wild garlic season stretches from mid-February to April, and with the recent spell of glorious sunshine, the tender shoots are already emerging, weaving through the leafy, shaded, and damp hedgerows of the countryside. This simple yet exquisite soup highlights the delicate, aromatic flavor of this seasonal gem. The addition of a poached quail egg and crisp pancetta elevates the dish, making it feel truly special.

Alternatively, a small hen’s egg works just as well, and crisp croutons make a delightful substitute for the pancetta. If you are fortunate enough to come across an abundant patch of wild garlic, the leaves can be carefully harvested, washed, blanched, refreshed in iced water, and then frozen in batches for future use. To ensure a sustainable harvest, pick only some of the leaves from each plant, leaving the roots undisturbed so they can flourish for seasons to come

RECIPE: WILD GARLIC SOUP, POACHED QUAILS EGG AND CRISPY PANCETTA

Ingredients

Serves 4

• 1 small onion

• 1 stick celery

• 1 white of leek

• 1 clove of garlic

• 1 medium potato, peeled and finely sliced

• 1kg wild garlic

• 2 pints chicken stock

• 4 soft poached quail’s eggs

• 4 shards of crispy pancetta

• 10g butter

• Salt and pepper

Method

1. Pick the wild garlic leaves and then blanch in salted boiling water for 4 minutes, then immediately plunge into ice cold water. When cool squeeze out excess water.

2. Roughly dice the onion, celery and leek and sweat in a saucepan with a little butter until soft. Add finely chopped garlic and sweat for a further minute.

3. Add the potato and just cover with chicken stock, cook for a further 10 minutes.

4. When potato is soft put into a blender and blend until smooth so it becomes a thick paste.

5. Blend in the blanched wild garlic leaves.

6. Pass through a fine sieve and adjust the consistency with chicken stock. Season to taste.

To Serve

Ladle into a soup or glass bowl and finish with a soft poached quails egg and a shard of crispy pancetta. (See opposite).

Chefs Tip

When poaching your quail’s egg, never put salt in the water as this will break down the white. Bring the water to a rolling simmer and add a tiny splash of white wine vinegar, using a spoon swirl the water to create a vortex, drop in your egg and poach. If you want to use your egg later place into ice cold water to halt the cooking. For your bacon shard simply thinly slice a piece of a pancetta and cook between two baking sheets at 180°C for approx 12 minutes or until crisp.

Will trusts – unfair treatment for spouses?

A ‘life interest’ or ‘interest in possession’ trust in a Will allows the testator, on death, to benefit someone (eg their surviving spouse) from their estate but in a way that protects the capital to pass to someone of the testator’s choosing (eg the testator’s children from an earlier relationship). It entitles the lifetime beneficiary (eg the spouse) to receive income from the trust and occupy any trust property. This structure avoids the risk of the surviving spouse inheriting the testator’s estate, on death, and then leaving it to whomever they please (and not who the testator intended) on their later demise.

Sometimes, to provide more flexibility on the testator’s death, assets are instead left to a ‘discretionary trust’ in which the surviving spouse has no life interest but is one of a few potential beneficiaries. These types of Will give the executors/trustees discretion as to how to distribute the estate taking into account the circumstances at the time as well as any Letter of Wishes the testator has left giving them

guidance. They can take account of the value of the estate, the tax rules and the personal circumstances of the potential beneficiaries. There are certainly good reasons to include these trusts in Wills and they can give significant peace of mind to a testator, but what of the surviving spouse who may have no knowledge of the trust or that their home of many years is even held in trust? With no immediate entitlement to receive capital from their late spouse, they have to rely on the decision making of the trustees to make provision for them. This process can work well where the trustees are professionals or the couple’s shared children. Where, however, they are the children from the testator’s earlier relationship and those in line to eventually inherit, it would be an unusual situation where the trustees’ decisions are not impacted by their emotion and attitude towards the surviving spouse.

Let’s examine a scenario; Bob and Marilyn are married. Bob has adult children from his first marriage. Bob brought most of the assets to the marriage, not an uncommon scenario in ‘traditional’, marriages and wants to provide for Marilyn on his death and preserve his wealth for his adult children. His Will

grants Marilyn a life interest in his estate and it passes to his children on Marilyn’s death. There’s no inheritance tax when Bob dies and the trust fund isn’t treated as part of Marilyn’s capital if she needs local authority care fee funding later on. Perfectly fair, one might think, but is it? Marilyn might have had children with Bob, she might have spent years of her life devoted to caring for those children enabling Bob to work and build his business and estate. Had they divorced it is not inconceivable she would have received more. Perhaps Marilyn wants to pay for private care but does not have enough of her own assets to do so, Bob’s adult children might feasibly have their own assets and income whilst Marilyn cannot afford to meet her own costs.

Had Marilyn and Bob divorced, consideration would have been given to ensuring she was in the same financial position following divorce as she was in during the marriage. The Court would consider a variety of factors. Yet in the above scenario Bob’s trustees are able to make their own assessment as to what is ‘reasonable provision’ for Marilyn. In my experience, this often involves Marilyn having to enter into negotiations with the trustees whilst she is still coming to terms with the loss of Bob to negotiate some form of provision from his estate. Whilst the trustees might have a discretion to make provision for Marilyn, they are sometimes reluctant to do so in case this causes upset with the other beneficiaries, often the trustees themselves. In a situation where reasonable financial provision is not made for Marilyn she would have to bring a claim against Bob’s estate under The Inheritance (Provision for Family and Dependants) Act 1974.

As a spouse Marilyn is eligible to claim under the Inheritance Act and in considering her claim the Court will first consider whether an interest in a trust or life interest constitutes ‘reasonable financial provision’, if not, then what provision is ‘fair in all the circumstances’. At this point the court will take into account similar factors to any family court on divorce; including the length of the marriage, the age of the claimant and the size of the estate.

I am not suggesting there should be some form of forced heirship for spouses. That said, across the border in Scotland the position is very different, a surviving spouse has legal rights to inherit a share of the spouse’s estate including the matrimonial home (depending on value). A spouse’s rights cannot be completely disinherited unlike in England and Wales. The position is similar in other European countries which have forced heirship regimes.

Neither am I suggesting we abolish trusts or life interest trusts for spouses, there are usually good reasons for making such trusts and they often work well. What I am suggesting is there needs to be better communication and advice to

spouses when they set up the trusts and draft their Wills. They should carefully consider whom to make their trustees, it should be of no surprise that adult children from an earlier marriage, are not always sympathetic to the surviving spouse. Professional trustees can be more expensive but are less emotionally involved. They should have the conversation with their spouse whilst they are still alive so that nothing comes as a surprise when one of them dies. Joint consideration of shared assets and who brought what to the marriage is a discussion better had when both parties are still able to contribute to that discussion.

Providing detailed guidance to trustees in this regard is likely to assist the trustees in considering what provision should be made. One thing is clear we will continue to see claims being brought by spouses where an interest in a trust fails to make reasonable provision for them.

Have you been unfairly left out of a will?

Being left out of a will by a loved one or a relative can be fractious for family relationships and leave legitimate feelings of hurt. Where the circumstances apply, there are well established frameworks for challenging wills to which you believe you have an entitlement. Below,  B P Collins’ contentious probate team deal with the grounds for such challenges and identify things to consider when making a claim of this kind. Contesting the will of a relative or loved one is never a decision to be taken lightly, but B P Collins can be by your side every step of the way.

Contesting the will document itself is the first ground to consider for disputing a will.  In order to be valid, a will must meet the following criteria:

• The will must be properly signed and witnessed;

• The will must have been made without undue influence;

• The testator (the person who is making the will) must have known and approved the contents of the will;

• The will must not have been forged; and

• The testator must have made the will with full testamentary capacity.

The first can be proved on the face of the document itself. There are strict requirements for a will to have been properly signed and witnessed. In summary, the will must be in writing and signed by the

testator, or by another person in their presence and at their direction, and it must appear that the testator intends for the will to take effect as written. The signature must be made or acknowledged in the presence of two or more witnesses who each sign the will in the presence of the testator (though not necessarily the other witnesses).

The other items on the list require detailed investigation. For example, proof of testamentary capacity or undue influence will require analysis of the file compiled by the solicitor instructed in the preparation of the will. In circumstances where the will was drafted by the testator, this naturally becomes more difficult to prove.

There is no time limit for contesting a will on its validity. The usual rules of limitation do not apply. So even if the will was relied upon a number of years ago, action can still be taken.

A successful claim against the will’s validity results in that particular will being disregarded in the estate administration. Should the testator have a previous will, it is that earlier will which becomes relevant for the estate administration. Alternatively, where there is no former will, the intestacy rules shall apply for distribution.

What is a declaration of presumed death?

A declaration of presumed death is a legal ruling by the court that recognises a missing person as deceased, even in the absence of a physical body. The Presumption of Death Act 2013 provides the legal framework for such applications in England and Wales.

Who can apply for a declaration of presumed death?

Typically, family members such as a spouse, parent, child, or sibling are entitled to apply. However, if you are not directly related to the missing person, you may still be eligible to apply if you can demonstrate “sufficient interest” in the case.

The process for making a declaration of presumed death application

Step 1: Establishing the period of absence

Before applying, you must show that the missing person has been absent for a significant period. In most cases, this means they must have been missing for at least seven years.

Step 2: Gathering evidence

To support your application, you must provide strong evidence to the court, which may include:

• The missing person’s last known location and the circumstances surrounding their disappearance.

• Details of any efforts to locate them, including police investigations, search efforts, and media appeals.

• Statements or testimonies from individuals with relevant knowledge.

• Personal and financial documentation, such as the missing person’s will, assets, and outstanding liabilities.

Step 3: Filing the application

Once you have compiled the necessary evidence, you must submit an application to the High Court.

Step 4: Attending the hearing

Following submission, a court hearing will be scheduled. During this hearing, a judge will review the evidence and determine whether to grant a declaration of presumed death. Spring is almost upon us, bringing with it birdsong, flowers, longer days – and, alas, pollen. If the season’s blooming beauty has you reaching for a tissue and retreating to the great indoors, you’re likely among the one in four Brits afflicted by hay fever.

With tree pollen season already underway, symptoms for sufferers will be too – and scientists warn they could be more severe than normal this year due to heightened pollen production.

An allergic reaction to pollen from trees, grasses and weeds can mean misery for millions, causing a stuffy, itchy nose, an irritated throat and eyes. For those unlucky enough to also be triggered by indoor allergens like dust mites and pet dander, hay fever can be a year-round problem.

To combat it, experts suggest a variety of remedies from oral antihistamines, eye drops and nasal sprays, to ingesting bee pollen to build up a resistance, and immunotherapy which involves exposing the body to small amounts of allergens, gradually reducing the severity of symptoms.

One newer – and sometimes overlooked –treatment works in a different way. The Kenalog jab releases an anti-inflammatory steroid slowly into the bloodstream. This dose of corticosteroids temporarily suppresses the immune system to halt hay fever’s haywire effects.

Not only is it credited with a success rate of up to 90 percent, it provides longer-term relief than other treatments and also avoids the need for daily medication. Most patients report relief within 48 hours of receiving the jab, which is administered into the muscle of the buttocks.

Kenalog injections are available from select private healthcare providers, including Regents Park Aesthetics in Berkhamsted. The clinic is headed by acclaimed nurse practitioner Kay Greveson whose sterling standards in patient care saw her named Best Aesthetic Nurse Practitioner 2024 at the prestigious Safety in Beauty Diamond Awards in December.

Former specialist nurse Kay worked for the NHS for 23 years before opening Regents Park Aesthetics’ first clinic in Wimpole Street in 2012. Today, the

“Hay fever really booms over the summer, reducing people’s ability to enjoy the sunshine and outdoor activities we look forward to over the colder months,” Kay says.

“Kenalog can suppress the immune system’s response to allergens like pollen, by reducing inflammation in the body and alleviating symptoms of hay fever.

“Jabs are typically given once or twice a year which means patients can go for months without needing additional treatment,” she explains.

A number of myths surrounding Kenalog might cause some patients to hesitate.

Many believe its use is only applicable in the most severe cases when actually, Kay explains, it can also be highly effective in people with moderate symptoms. The convenient, one-time treatment reduces reliance on frequent antihistamines and nasal sprays.

As with any medication, there are potential side effects, like mild soreness at the injection site or temporary changes in blood sugar levels, but serious side effects are rare. Patients should discuss any concerns with their GP to ensure Kenalog is suitable for them.

Another myth is that the jab is less effective than oral antihistamines. Studies show Kenalog in fact offers longer-lasting relief than these meds which often come with unpleasant downsides such as drowsiness, dry mouth and dizziness.

Who carries out orthodontics?

We believe Orthodontic treatment should ideally be carried out by a specialist called an orthodontist. At Sorriso Dentistry, our in-house orthodontist is both an NHS consultant and specialist in private practice.

The British Orthodontic Society released figures in 2016 that emphasised that trend, with 75 per cent of respondents reporting an increase in adult treatments.

Meanwhile, in the US, more than 1.2 million adults underwent orthodontic treatment in 2012 – a 39 per cent increase since 1996.

There have been significant improvements in orthodontic technology over that period, with new materials and techniques providing options that make braces less conspicuous, more affordable and work better.

Celebrities with adult braces such as Tom Cruise, Gwen Stefani and Serena and Venus Williams, have also played a part in increasing the popularity of adult orthodontics.

Whatever the reason, be it technological improvements or increased awareness, the change in attitude is a reason to smile.

What does it involve?

First and most important, a consultation appointment- we listen to your treatment needs and carry out a comprehensive examination of your jaw, your teeth and your bite to determine which orthodontic appliance would best suit your teeth. Once you decide to go ahead with treatment, we will arrange an appointment to collate further information and records, including X-rays, photographs and impressions of your teeth. These are used to plan your treatment and monitor its progress, as well as then comparing against the final results. Braces are then fitted and checked every 6-8 weeks. This is to monitor the progress of treatment and to tighten or adjust the brace as planned. Once we are happy with the appearance of your teeth we will remove the brace and provide you with retainers to hold your teeth in the new position.

2K CRIMPING IS COMING BACK, ACCORDING TO FASHION WEEK RUNWAYS

Chet Lo’s autumn/winter show brought back hair crimping. By Lara Owen

Chet Lo brought back Y2K crimping at London Fashion Week, steering away from the hyper-natural hair trends of the moment, and leaning into style nostalgia.

The Asian-American designer, known for his clashing textural designs, collaborated with celebrity hairstylist Anna Cofone and Authentic Beauty Concept to create a textbook Noughties look.

Cofone combined pin-straight hair with uniform crimps, creating a quintessentially Y2K look for Lo’s autumn/winter 2025 collection.

“The inspiration for today’s look is very much a continuation of patterns and panels,” said Cofone, “we wanted to mimic the patterns in Chet’s clothes, so we’ve got these cool, crimped panels appearing at the back of the model’s hair and on some of the sides.”

As for the products, the goal was to look shiny and slick, so Cofone used Authentic Beauty Concept’s hair balms and glow serums to calm any flyaways and add that Y2K-style shine.

While flat and shiny hairstyles are reminiscent of the early Noughties, crimping also recalls the trends of the Eighties, which have been observed on this season’s runways.

“I think it’s great that it’s got this reference to the Eighties,” says Cofone. “Do I think [crimping] is going to come back? I think people can definitely play with crimps and see what shape they get – for sure.”

The nostalgic crimped hair was the perfect accessory for the low-rise skirts and asymmetric tops that flooded this season’s runway – ushering the return of early 2000s fashion – much to Gen Z’s happiness.

How Old Notes Become Fascinating Historic Displays

Preserving the Past at Farnham Common Village Hall

Village halls are the heart of a community, hosting celebrations, meetings, and events for generations.

But many of these spaces have histories stretching back centuries, quietly preserving the stories of the past. Farnham Common Village Hall, dating back to 1889, recently uncovered a treasure trove of historic documents—including wartime letters and handwritten trustee notes—hidden in its archives.

Bringing History to Life

Following the passing of Marilyn Rolfe, the hall’s

chair of trustees, the committee discovered these fragile records, which revealed the hall’s role in supporting evacuees and wartime communication. Determined to honour this legacy, they set out to create a History Wall, transforming old documents into a visual time line of the hall’s past.

The Challenge of Preservation

Turning decades-old papers into an engaging display was no easy task. The documents were delicate and faded, requiring careful digitisation. The committee also needed expert help with framing, displays, and installation, all on a limited budget.

The Solution

With support from local businesses, the project came to life:
