Sheriff pulls the plug on Constable’s deputies By SESHADRI KUMAR Fort Bend County Sheriff Troy Nehls has denied access to the law enforcement computer system to two deputies in the office of Precinct 3 Constable Rob Cook. The two deputies cannot get access to the facilities under the control of the sheriff. Sheriff’s Chief Deputy David Marcaurele sent a memo to Cook on March 2 citing ‘security concerns.’ I have been informed that your Deputy Constable Bruce Denney recently posted information via facebook to the general public concerning staffing at the Sheriff’s Office. Further, your Deputy Constable Frank Cempa Jr posted similar information to the general public via facebook. In one particular instance a posting was made on 02-21-16 at 10:00 a.m that lists the patrol units on duty for that day and the area where they were working. Releasing where on duty patrol units are located to the general public in this “real time” manner is an act that can only be described as unprofessional and shows a wanton disregard for the safety of our Deputy Sheriffs. Further, securing information about our agency that I can only surmise was obtained due to their official capacity as your Deputies and then releasing this to the general public is inappropriate and erases a key element in any functioning and ongoing professional relationship – trust. I fully understand that the actions taken by these Deputies were coordinated and connected to a political agenda; however, it does not excuse such unprofessional actions and I would be remiss to allow them to hide behind politics when their actions serve to compromise the security of personnel under my command. It is very disturbing that your personnel make statements that their concern is for the safety of our Deputy Sheriffs and then follow this with actions that could very well place our Deputy Sheriffs in peril (the words spoken are hollow while the actions taken speak volumes). Our Office cannot trust that these Deputies will refrain from similar actions in the future. It is therefore necessary that effective 03-03-16 both of these Deputy Constables will have their access to the RMS and CAD systems revoked. Further, grant of access to facilities under the control of the Fort Bend County Sheriff’s Office is revoked. The sheriff’s action followed his victory in the Republican Party primary on March 1. Frank Cempa, Jr., lieutenant in

Cook’s office, is the son of Frank Cempa, who ran against Nehls for sheriff in the Republican primary. Deputy Bruce Denny also worked in the campaign for Cempa. Frank Cempa, Jr. said he had worked on his father’s campaign outside his working hours and his postings on Facebook were that of a son to support his father in the campaign. He did not do so in his capacity as a deputy constable, Cempa,Jr. said. His postings on Facebook were not real time data and posed no danger to deputies, he said. If there was a security concern, why should the sheriff wait until after the election to retaliate, Cempa, Jr. said. He should have acted on Feb. 22 when the alleged security concern arose, he said. The law enforcement computer system in the sheriff’s office belongs to the county and is used by all constables and Justice of the peace courts and county emergency management system. By denying access, the sheriff has virtually deactivated Constable Cook’s office. The deputies cannot safely do patrolling or stop anyone for search or respond to an emergency call, Cempa said. The license plate of a vehicle or driver’s license of a suspect cannot be checked via computer from the deputy’s computer terminal. Reports on incidents are transmitted to the sheriff’s office via the computer terminal, after the supervisor approves the reports. At least 36 reports are now waiting in queue at Constable Cook’s office for transmittal to the sheriff’s office. Cempa said the sheriff’s action has now affected public safety and the safety of the officers. He cannot locate where his patrol units are at any given time in the absence of GPS. Under the contract deputy program, homeowners associations have hired the constable to provide extra security. Now, that protection cannot be provided effectively. For example, last week, there was an accidental shooting and the discovery of a body. The deputies could not do anything instantly, but communicate via cell phone and wait for the sheriff’s deputies to arrive. By crippling the constable deputies, the sheriff has left the county wide open for liability arising out of any criminal act or danger to the public and law enforement officers, Cempa said. Cempa said the sheriff has overreached his powers and he has sent his response to the county commissioners, county attorney and the sheriff. He is waiting

for some action by the commissioners court and the county attorney. Constable Rob Cook said he is waiting on advice from County Attorney Roy Cordes. Previously, Nehls had asked Cook to rein in his deputies from posting negative things about the sheriff on FaceBook. Cook said he had sought the county attorney’s opinion on the matter and the county attorney said that Cook had no control over what the deputies wrote on FaceBook in their personal time. This area is from Damon, Texas to Simonton, to Kendleton, Texas and Weston Lakes area. Two units to cover 5 master patrol districts. (2) patrol units to cover district 4 which covers Mission Bend, Town West, Pheasant Creek, the Hwy 6 corridor from Beechnut to the Hwy 90 area, and all the businesses along Hwy 6. (2) patrol units to cover the Fresno/ Arcola area, unincorporated areas of Stafford and Missouri City. (3) patrol units to cover district 3 which is Pecan Grove, New Territory. (2) patrol units to cover district 2 which covers an area north of FM 1093 to IH-10, FM 1489 on the west, FM 1463 on the east. The (3) contract units are in Greatwood, Sienna Plantation, and Grand Lakes. Helen Cordes Award A record-breaking Seventh Annual Cordes Award Dinner was held by Fort Bend Regional Council on Substance Abuse (FBRC) on Feb. 25th at the Stafford Centre. Event Co-chairs were Roberta Avery and Dr. Betty Baitland. The 2016 honoree was Fort Bend I.S.D. Superintendent Dr. Charles Dupre. Two hundred and seventy attendees heard speaker Kevin Price share insights into the family disease of alcoholism and addiction. Yolanda Green served as the emcee. Haynes and Boone was the Presenting Sponsor, along with 30 other local sponsors. A highlight of the event was a Special Tribute to Helen Cordes, for whom the event was founded and the Annual Award is given. The Helen Cordes Award honors her generous community spirit and community achievements. Helen served on the Fort Bend Regional Council’s Board of Directors from 1991–1997 and as President from 1992– 1995. During that time and long afterward, Helen served with such a sincere passion for FBRC’s mission that she has inspired all who have shared the privilege of working with her. All funds raised benefit Fort Bend Regional Council’s programs for adults and youth who are impacted by alcohol and drug abuse. Proceeds are used to further efforts to restore families and break the cycle of addiction, as well as help students in Fort Bend County build coping skills so they won’t fall victim to substance abuse.
