VHPA sues protesters who disrupted World Hindu Congress

By SESHADRI KUMAR The Vishwa Hindu Parishad of America has filed a civil lawsuit against several individuals who disrupted the World Hindu Congress held at The Westin Chicago Lombard in Illinois on Sept. 7, last year.

The complaint was filed at the 18th Judicial Circuit Court, DuPage County on September 11 this year, marking the first anniversary of the episode.

The lawsuit is styled as Vishwa Hindu Parishad of America vs Samay T. Gheewala, Anar Parikh, Tara Raghuveer, Nath Deb Robindra aka Robindra Deb Nath, Jitendra Christian Kadirgamar Skanda aka Skanda Kadirgamar, and John Does Nos. 1-10.

The complaint alleges four counts: trespass, fraud, conspiracy to commit trespass and conspiracy to commit fraud. The law firm of Lawrence Kamin, LLC is representing the VHPA. India Herald carried extensive reports of the 2018

World Hindu Congress, including the protest during a panel discussion in which the Rashtriya Swayamsevak Sangh General Secretary Mohan Bhagwat participated.

At least six activist members of Chicago South Asians for Justice sneaked into the hall. The group was part of a coalition of South AsianAmerican organizations called the Alliance for Justice and Accountability, which coordinated several actions in addition to the disruption.

Two of the protesters and one member of the Congress, who retaliated against the protesters, were arrested at that time.

Most Seniors, Retiree’s and soon-to-be Retiree’s desire to live a happy, healthy, worry free and comfortable retired life, travel to exotic places on their bucket list, and spend quality time with family and friends.

However, in order to achieve their goals and objectives, they need to make several strategic choices, and plug the gaps that exist in their retirement plans.

For the most part, these choices fall into major areas such as: managing health issues, ensuring financial comfort, decisions about primary residence and living options, and the impact on taxation.

Their next seminar will fo-

cus on two important and timely topics. Now is the Medicare Open Enrollment period from October 15 to December 7.

To help assess this opportunity, SOS plans to have an update and highlight the changes to 2020 Medicare plans.

The second topic of the seminar is centered around the question “do we need to downsize/right size, if so, when and where to.”

This is a very complex issue with several personal factors influencing the decision and the approach will be first to declutter the home, and then to downsize.

The seminar is scheduled for Sunday, November 10, 2019 from 4 – 6.30 p.m at the India House, 8888 Bellfort Avenue, Houston.

Presentations will be made by experts in the field followed by a panel discussion and robust Q&A session.

Selected individuals will share their personal experience, challenges dealt with, and lessons learned.

The program is for audiences who are approaching retirement as well as those currently in retirement.

As these decisions require family consensus, we encour-

age both the spouses to attend.

The organizers believe that this topic should have multigenerational relevance.

Younger generation may also find the seminar useful as it helps them to understand the issues facing their parents.

As in our previous seminars, the event will conclude with small group-huddle sessions, allowing the attendees to raise more specific questions with the speakers/panelists.

The 6th annual International Media Conference 2019, an annual gathering of media professionals hosted by the Indo American Press Club, IAPC Houston and Dallas Chapters, was held at The Double Tree Hilton at Greenway Plaza, Houston, from Oct. 11 to 14.

About 500 patrons from North America participated in this professional development and networking event.

media dignitaries of the Indian Diaspora and prominent media professionals from India, who made their thoughts heard and noticed via their active participation at the 8 seminars conducted across the conclave.

Titled “Partiality and political bias in professional reporting.” was the topic of another panel.

Dr. Arun Kumar, of 24X7 News channel, Saneesh P. Elayaduthu, of News18, noted independent journalist Saji P. Dominic and political observer, dominant secular panelist and debater Adv. Jayashankar graced the discussions.

All participants were congenial in admitting the fact that impartiality is the one thing that doesn’t exist in contemporary media professionals and the essential factor that economically sustains the industry is the vested corporate partiality and affinity to political thought streams of the respective media houses.

It was a great effort using Bharatanatyam, folk dance and contemporary dance forms to make this program educational, meaningful and enjoyable to the 800-plus audience present from different cultural backgrounds.

With only narration and no spoken words by the performers, the story was well communicated both visually and musically.

Studio Mudra School of Dance was founded in 2012 in the Houston Area by Artistic Director Rashmi Shashi.

Vibha’s Garba night, celebration for a better future

The term Navratri means “nine nights” and it symbolizes the victory of positivity, truth and goodness over evil.

This year, VIBHA organized their Navratri Garba celebrations at the University of Houston (UH) on Saturday, October 5th in partnership with BRC International.

The VIBHA – BRC Garba Night 2019 was attended by more than 1,500 people, from all age groups and cultural backgrounds. It was enjoyed by hundreds of university students from UH and Rice University as well.

The whirling dancers, clapping hands, distinct sound of dandiyas striking each other, toe tapping music and vibrant colorful traditional attire marked the celebrations.

The event was completely sold out with the venue changed to the biggest facility

available with UH Recreation to accommodate the crowds at the last moment. The response from the community was overwhelming and the organizers did an outstanding job to process everyone as quickly as possible, so they can enjoy their time to the fullest.

The center stage was decorated with Goddess Amba Maa’s statue where the divine traditional aarti and prayers were performed. Rishabh and Kashmira Nayak rocked the stage with live singing of traditional garbas, raas, famous sanedo and Bollywood songs along with their musicians, assisted by Master of Ceremony Malikka Ghei. Building wealth: A dependable and time-tested approach

By Ranvir Biki Mohindra One of the biggest problems with investing in the stock market is the emotional roller coaster that one experiences as the market goes up and down.

For this reason, many individuals buy and sell stocks at the worst times and have much lower returns than the market averages.

Most of us are aware that there are many great approaches that work in the short term … like the ten bagger new company stock, the real estate that doubles in value quickly, and the historical rise in value for the great companies of our time such as Apple, Amazon and Facebook. But these are often counter balanced with the great losers of our time such as Sears, JCPenney, Countrywide Financial, Enron, AIG, Lehman Brothers, Smith Barney and many more. All of these companies were stars at one time, but failed at another time. After riding the roller coaster of ups and downs in the financial markets, I decided to look for something better.

I asked myself that there must be some strategy that allows your money to grow safely and effortlessly. I began my search for a strategy that was geared to my temperament and answered all the following questions: •What is the safest path to having money and making money, over the long term, for somebody who is risk averse?

•Is there a way to grow wealth predictably without losing sleep?

•Is there something out there that is simple?

•Is there something that is foolproof and does not involve either luck or skill?

•Is there something that can operate on autopilot?

I spent a lot of time and effort to find a strategy that met all the above criteria. There were many people who offered products and approaches, but none met the above requirements. These products looked

good on the surface, but they all had a dark side.

One example of such deceptions were different kinds of annuities. They promised all kinds of financial security, but hid the dark side and the high costs associated with these products.

Finally, I found a strategy that seemed to meet all the above criteria. But instead of being happy, I became very skeptical and asked questions like how come I never heard about it for all these years? And if these products are so good, why are they hidden from the public domain.

Then I read a book titled Bank on Yourself (BOY) by Pamela Yellen that gave me satisfactory answers to all these questions. She fully explains this unorthodox approach and why it is hidden from the public. Then she outlines in practical terms, how anyone can get started on this path and build wealth over time, without the normal perils of investing in conventional products like stocks, bonds and real estate.

I decided to put a small part of my assets to test Pamela Yellen’s strategy. To my surprise, it worked, and it did not have hidden surprises.

I adapted her approach to fit my situation and mind set (and that of most South Asian immigrants). It has performed for me better than expected and I have gradually increased my investments in the system. I am proud to tell you that it continues to work and now I sleep easier and every single day my wealth increases and so far, there have been no exceptions.

To my surprise, I found out that these products have actually existed for nearly 100 years, but they have been limited to the domain of people who are ultra-wealthy. These products have never had a single down year in their entire existence!

Neither in the depression of 1929 nor in any of the financial busts that have followed. Even 2008 was a positive year for

them! How is this possible? I will explain this in a future article.

When I got to the end of the discovery, I found that Warren Buffett had already gained this wisdom and had adapted it to his portfolios, which consist of very large investments.

Since my situation was different, I found a way to adapt it to more modest wealth levels, that apply to me and most other

ordinary people.

I am not a salesperson and do not sell any of these products.

I have worked hard to learn about these products and have them designed specifically for my needs and are optimized in terms of costs and benefits. I have helped many people build their own plans suited to their needs. I have been asked if this approach can double a person’s wealth. My answer is that in this system you do not need luck and with some patience and time it can do much better than that. I will be explaining more about this amazing approach to building wealth in future articles.

That address was the first proclamation explaining the Hindu religion to an international audience.

VHPA was selected to host the 2018 Congress as a tribute to that. Plaintiff incurred over $1.2 million in costs and expenses in planning, organizing and managing the 2018 WHC. Over 450 volunteers, including many professionals, contributed significant time, energy, and funds towards ensuring the success of the Congress.

VHPA coordinated and put in place a comprehensive security plan that was designed to protect attendees and participants.

Amongst other things, the security plan required every attendee to have an officially authorized credential in order to gain access to the WHC or the Exclusive Premises at The Westin.

WHC limited credentials to (a) registered (paying) attendees, (b) invited guests and speakers, (c) Sponsors, (d) people affiliated with VHPA, who were responsible for managing the Congress and (e) pre-approved members of the press and media.

VHPA hired private security contractors to implement its security protocol and to maintain and prevent unauthorized access to the WHC, including insuring that only individuals with valid credentials enjoyed access to

the Congress and the Exclusive Premises.

VHPA alleged in the complaint, “Upon information and belief, at the time Defendant Kadirgamar made a false representation that he and Robindra were members of the media, he intended for Plaintiff to rely upon the misrepresentation, and, in fact, VHPA did rely upon the misrepresentation and did issue press credentials to Defendants Kadirgamar and Robindra.

“At the time Kadirgamar requested the press credentials, he acted in coordination with Robindra and the other known and unknown Defendants with the intent to and for the purpose of gaining access to the 2018 Congress and disrupting the 2018 Congress proceedings.

Using the press credentials obtained through false pretenses from organizers of the 2018 Congress, Defendants Kadirgamar, Robindra and others created additional, counterfeit press credentials, which were distributed to other known and unknown Defendants,” according to the VHPA. “On September 7, 2018, at approximately 7:40 pm to 7:45 pm, one of the Congress’s opening panel presentations began in a conference room located within the Exclusive Premises, which Plaintiff had reserved from The Westin for exclusive use by the 2018 Congress attendees.

“Acting in coordination, Defendants, including a group of protestors whose identities are presently unknown and who are therefore denominated as Defendants “John Does No.1-

10,” interrupted the presentation by shouting incendiary and false anti-Hindu statements and distributing incendiary antiHindu propaganda. Some of the Defendants also displayed a banner including messages intended to disrupt the 2018 Congress.

“Defendants Parikh and Raghuveer were part of the group of protesters that disrupted the Congress on September 7, 2018. Both Defendants were arrested for trespassing by the Lombard Police Department. Upon information and belief, unknown defendants, named herein as John Does No. 1- 10.”

VHPA, submitted in the lawsuit that it is “a national organization that seeks to promote unity amongst Hindus through a network of Parishad chapters and like-minded organizations. In addition to providing community service to people in distress or need without consideration of race, religion or nationality, VHPA seeks to cultivate Hindu values, including a spirit of self-respect for the Hindu way of life, and to serve as a bridge between communities and people of different faiths and religious beliefs.”

“Defendants, a collection of virulently anti-Hindu radicals, conspired to sabotage and disrupt Plaintiff’s peaceful, international gathering. Although the WHC accommodated protesters and dissenters outside the Congress proceedings, Defendants plotted to infiltrate the WHC, using counterfeit and forged press credentials to evade the WHC’s admissions and security systems. “Once inside the WHC event, itself, Defendants staged a coordinated disturbance, during which they shouted down and intimidated WHC guests and participants.

The result was immediate and severe: many attendees, some of whom had travelled tens of thousands of miles, departed the conference early to avoid the confrontation.

VHPA spent hundreds of hours and thousands of dollars on increased security and reissued press credentials in an effort to rescue the compromised gathering.

“This action seeks to hold the Defendants—both the conspirators known by name and those whose identities have not yet been divulged—liable for the damages they inflicted on VHPA in the disruption of the Congress. Plaintiff requests that judgment be entered in its favor and against each of the Defendants, jointly and severally, as follows: (a) Compensatory damages, in an amount to be determined at trial, in an amount greater than $50,000; (b) Exemplary damages in an amount of $100,000 per tortfeasor; (c)

The costs and expenses of this litigation; and (d) Such other, further and different relief this Court deems just and proper.

Similar damages are being claimed on three other counts.

Notice of the lawsuit has been served on Skanda Kadirgamar and Robindra Deb Nath and service is still in process for the remaining defendants, according to the attorneys for the VHPA.

Daya’s fall fundraiser: “Women we admire with Chloe Dao”

HOUSTON On October 13, 2019, Daya held “Women we Admire with Chloe Dao” to raise funds to support South Asian victims of domestic and sexual violence in Houston.

As a result of outreach by the Daya board of Directors, especially Sheela Rao, Aparna Asthana, Shree Hardikar Nath, and Annu Naik, this high tea fundraiser welcomed over 75 community members.

Against a gorgeous backdrop of fall colored blooms, Daya’s Executive Director Rachna Khare welcomed the audience and acknowledged the many admirable women in the room, giving special thanks to Viji Raman, one of the co-founders of Daya, who saw an issue in her community and created this platform to address it.

Since its inception 24 years ago Daya has saved hundreds of lives and helped thousands of women break free from the cycle of abuse.

The current Board President Sheela Rao, then introduced Chloe Dao, guest of honor for the afternoon. Chloe Dao is a Project Runway winner and internationally renowned fashion designer, based in Houston. Hailing from an immigrant family of eight sisters, Chloe told her story of moving to New York to follow her dreams of becoming a fashion designer.

With grit and hard work, she carved out a space for herself in the high intensity world of fashion. She spoke of her struggles, her triumphs, and the importance of self-confidence. Throughout her story, she spoke of the value of sisterhood, reminding the audience to count on the women around them through difficult times.

After her speech, she welcomed questions from a captivated audience. The women and men in the room were eager to know more about Chloe’s journey and jumped at the opportunity to get some fashion tips from this innovative designer. What ensued was a lively discussion about fashion, women in business, entrepreneurship and female solidarity.

The afternoon ended guests taking photos with Chloe Dao against the gorgeous floral backdrop set up by EventPls. Guests mingled, while feasting upon a luscious buffet of crispy bruschetta with feta and juicy tomatoes, delicious spring rolls, rich mini-quiches and a mouthwatering array of delectable desserts.

Maharashtra Chief Minister Devendra Fadnavis on Tuesday said the Shiv Sena was not promised the CM’s post for two-anda-half years when the alliance was formalised before the 2019 Lok Sabha polls.

Amid the ongoing tussle between the BJP and Shiv Sena over sharing of power in the next state government, Fadnavis asserted he will be the chief minister for next five years.

He also expressed displeasure over the Shiv Sena’s mouthpiece ‘Saamana’ frequently targeting the BJP, saying its role of the “derail” the talks.

“There should be no doubt in anybody’s mind that it will be a BJP-led government for next five years,” Fadnavis told reporters at his official residence ‘Varsha’ here.

Sena chief Uddhav Thackeray last week reminded the BJP of the 50:50 formula “agreed upon” between himself, BJP president Amit Shah and Fadnavis ahead of the Lok Sabha polls.

The Sena demanded a written assurance from the BJP for implementing “equal formula for sharing of power” before holding talks on staking the claim to form the next alliance government in the state.

Commenting on the issue, Fadnavis said, “I have confirmed with Amit Shah and he told me that the BJP has not given any assurance for the chief minister’s post for twoand-a-half years (each for the

A senior Sena leader told PTI the meet, scheduled to be held here at 4 pm, was cancelled by Thackeray after the CM’s statement on sharing of power.

“Union minister Prakash Javdekar and party leader Bhupendra Yadav were supposed to attend the meeting to start discussions on formation of the next government from the BJP side, while the Sena would have been represented by Subhash Desai and Sanjay Raut,” the Sena leader said.

He said the BJP Legislature Party will elect its new leader on Wednesday.

On who will be the chief minister, Fadnavis said, “You have any doubt? It has already been decided. Prime Minister

Narendra Modi has already announced the name and now it is a mere formality.”

He was apparently referring to Modi’s statement during campaigning for polls that Fadnavis will lead the coalition.

Fadnavis said Amit Shah will not be attending the legislature party meeting on Wednesday.

To another question, the chief minister said he is satisfied with the mandate.

“We expected to be in the first merit, but got first class first. Since 1990, no political party has got a good strike rate like the BJP in 2019,” he said.

Asked when the government formation will take place, he said, “You will know soon.”

The Sena has won lesser seats, 56, this time but has scented blood with the BJP tally down from 122 to 105. It desperately wants to claim the notional status of being “big brother” and dominate the alliance government and hence the State. Even if both parties get Independents in their shopping carts, the numbers wouldn’t be enough.

Of course the BJP could opt for a minority government, as it had done with Chief Minister-elect Devendra Fadnavis before, but would find itself horribly exposed from within and without — the Sena chomping away at its authority if not included, the Opposition Congress-Nationalist Congress Party (NCP) combine now a force with 98 seats. It is because of this predicament of

the BJP that the Sena, now with an elected family member, is settling for nothing less than a written commitment for 50:50 chief ministership. And though the wily Pawar has decided to sit in the Opposition rather than toy with the arithmetic of the Congress-NCP-Sena understanding, he has lent moral heft to Aditya Thackeray’s right to chief ministership. This underlines an endorsement of Maratha leadership. At this point, the BJP cannot afford a hitback of the Jat kind in Haryana. And whether Aditya becomes a deputy CM or a halfCM, the fact is Sena has never been better placed to recover lost ground. But Uddhav’s waiting game, which has done nothing so far, may not hold with Sainiks now that they have come so close to power.

This internecine push and pull dynamic is something that the BJP has to live with. This could turn problematic in day-to-day governance with the Sena pos-

And as he thundered in Marathi through blinding rain in Satara, it was enough to defeat the BJP who had thought poaching his man Udhayanraje Bhosle was as good as getting the old warhorse. Symbolically and numerically, he has the winning card now, one that he will use for his own benefit. Unless the ED cases against his kin bother him too much. Besides, with 20 of its rebel candidates winning in the State, the BJP is in quite a pickle. It still has the edge though but the course ahead is on a rocky mountain high.

Musical treat on Diwali eve

by HYMA - Houston Youth Music Association under the guidance of Vidushi Smt Rajarajeshwary Bhat.

On October 26th, 2019, the audience gathered at Sri Krishna Vrindavana, Houston, to witness a brilliant carnatic concert, which had a unique entertaining format admixed with laya and melody elements.

The concept format was conceptualized and led by the renowned ghatam Vidwan Dr. S. Karthik and ably supported

by percussion Vidwans Sri Trivandrum S. Balaji and Sri Sarvesh Karthik and vocal Vidwan Sri Vinod Krishnan and Violin Vidwan Sri Kamalakiran Vinjamuri.

The concert songs were Dr. Karthik’s compositions or arrangements, which illustrated his mastery as not only a performing artist, but also as a composer with expertise in Indian languages.

The concert began with a traditional Mallari in Gambheera naatai set to Kanda Triputa Talam. Mallari traditionally brings in the deity in the utsavam, which was an apt introduction for the concert, bringing in Nandikeshwarar,

the God of percussion.

The lilting pada varnam in Hamsadhwani was presented in praise of Lord Vinayaka in Adhi talam. Next followed a very interesting composition on Lord Shaneeshwara, in the ragas Begada, Sama and Kedaram, the lyrics bejeweled with raga mudras and swaraksharams, showcasing the Vidwan’s musical and lyrical mastery.

The “Pulse” in Rathipathipriya in Adhi talam on Vishnu Avatarams laid emphasis on laya aspects fantastically performed by Vidwans Karthik, Balaji and Sarvesh Karthik, intricately woven with ragamalika

kalpanaswarams exchanged effortlessly between the vocal and violin artists.

In the next presentation titled “Shuddha layam” set to Kanda Chapu & Kanda Gathi, after a brilliant display of percussion combinations, Vidwan Karthik intelligently interacted with the audience and included their participation by clapping to the rhythm at appropriate interludes.

Unai Maravene, in the rare raga Rasika Ranjani ensued next, followed by an interesting medley kindling the audience’s memory about a variety of popular musical segments and compositions, akin to the combo sweet treat for Diwali!

The concert had lovely interludes when Krishna Gana Sudha Music Academy students beautifully presented a few compositions of Dr. Karthick, Mayilaapuri Valar Karpagame in Nalinakanthi raga, Adhi Tala by the “Balambikas”, Kapaaleeswaram in Vaasanthi Raga, Adhi Tala by the “Kapaleeshwaras” and Bhairavi Shatkam, a 6 Ragamalika song, by both groups.

The concert concluded with the Purandara Dasa composition in Madhyamavathi, Bhaagyada Lakshmi Baaramma.

Hindu Mandir Executives’ Conference brings temples together

The World Hindu Council of America (VHPA) sponsored historic 14th annual ‘Hindu Mandir Executives’ Conference (HMEC)’ in New Jersey concluded with resounding success on Sept.22 in East Hanover, N.J. This annual gathering takes place in different regions of North America, (includes Caribbean Islands).

The primary objective of this eminent gathering is to collectively enhance their relevance to the Hindu society-at-large and to the rising second generation.

According to Vipul Patel, the Convener, the theme of this year’s HMEC was – “Sustaining Temples and Institutions by Building Security and Strength through Community Outreach and Seva programs”.

This years’ 3-day affair had 35 speakers and approx. 200 delegates representing more than 75 Mandirs and Institutions.

The coordinators of the entire conference were Ami Patel of ON, Tejal Shah of NJ, Sohini Sircar from New York and Vallabha Tantri from Minnesota.

The conference began on Friday, September 20, with Swami Pratyagbodhanandaji, along with other seers, blessing the event with Sanskrit shlokas and lighting the auspicious lamp. A special session was devoted to safety initiatives and emergency precautions in case of medical crisis, fire, vandalism or an active shooter prowling on the premises.

This was expertly handled by representatives of ‘Homeland Security’, Chief Officers of local firefighting unit and emergency management unit.

Mark Curcio (Emergency Mgmt.) recommended that all places of worship should have a ‘crisis management team’, adequately installed surveillance gadgets, properly established rapport with local concerned authorities, and periodic safe evacuation drills under their supervision. Most of the temples it seemed lacked this preparedness.

Swami Pratyagbodhananji and Bharat Vedak of S Carolina, released a new book titled ‘Hindu Temple Security Guidelines’ that details the steps that need to be taken by the members of HMEC for the safety of their institutions and gatherings.

Sanjay Mehta, General Secretary of VHPA, summarized the action items that the members had agreed on.

The gathering resolved to (1) to create ‘Hindu Seva and outreach portal’, after database collection is complete (2) publish visitor’s guide for various Temples spread across the landscape (3) establish ‘HMEC Library’ to catalogue progressive ideas, suggestions and practical projects.

NEWS Expelled Kerala nun writes to Vatican, seeks to present case before Pope

A Kerala nun, who has challenged the Franciscan Clarist Congregation’s decision to expel her, has written to the Vatican, alleging the ‘disciplinary action’ was taken for participating in protests by a group of nuns seeking arrest of a bishop accused ofraping a fellow nun.

In her letter toLeonardo Cardinal Sandri, Prefect, Congregation for the Oriental Churches, Sister Lucy Kalappura also sought an opportunity to her to appear in person before a tribunal which would consider her appeal against the Congregation’s decision.

She has also sought an opportunity to present her case to the Pope Francis.

The Congregation for the

Oriental Churches in Vatican had dismissed Sister Lucy’s first appeal challenging the Franciscan Clarist Congregation’s decision to expel her for “failing to give a satisfactory explanation for her lifestyle in violation of FCC laws”.

However, it allowed her to present a new recourse to the Supreme Tribunal of the Segnatura Apostolica in Vatican.

“I am deeply obliged for providing me the opportunity for a further appeal to the Supreme Tribunal of the Signatura Apostolica. It is desired, in this connection, that an opportunity be granted to me to appear in person before the Tribunal to enable me to present to its honourable members my

side of the situation.

“It is requested, further, that I be granted an opportunity to present my case to the Pope Francis, whom I venerate and in whose sense of justice I have absolute faith”, the nun said in her letter to Leonardo Cardinal Sandri.

Sister Lucy Kalappura, who took part in a protest by nuns belonging to Missionaries of Jesus Congregation, seeking the arrest of Bishop Franco Mulakkal, accused of raping a nun, was expelled by the FCC in August this year.

In her letter, the nun said the FCC congregation initiated’disciplinary action’ against her.

“In my case too, what pur-

ports to be ‘disciplinary action’, and what in reality are reprisals, against me commenced only after I stood by the sisters of the Missionaries of Jesus in their efforts to secure justice for the outraged nun. This is amply evident from the show cause notice issued to me, a copy of which is attached for ready reference,” she said.

“I wish to urge strenuously that the actions initiated against me, and the vindictiveness it reeks of, cannot be understood aright, if they are seen in isolation from the Franco Mulakkal matter as the trigger.

“I fervently hope that the honourable members of the Tribunal would appreciate the truth that I am a collateral victim of this Franco Mulakkal scandal, in regard to which the mettle of the Church’s commitment to truth and justice is be-

ing tested in full public view,” she wrote.

“It does not have to be argued that the Holy See being made to be seen as partisan in this case, or as hostile to justice being available to a rape victim, is sure to discredit the witness and integrity of the Catholic Church for the years to come.

“It is shortsighted to coerce nuns to perjure in legal proceedings in the hope that the ends of justice can be stalled thereby. It is bound to result in extreme and undying infamy to the Church,” Sister Kalappura said in the letter.

She submitted that the Franco Mulakkal case has already attained unprecedented public attention and people of diverse persuasions are seized of how it is going to pan out.

Jacobite faction prevents Orthodox priests, followers from entering church in Kerala Authorities on Monday failed to implement a court order directing to facilitate entry of Orthodox faction priests and followers into a church in Kothamangalam to offer prayers following strong resistance from Jacobite faction priests and faithful.

The Orthodox faction priests and followers withdrew from the scene after their hours-long stand-off with Jacobite faction in front of the church.

They accused the police of failing to provide them security.

Gates of the church were closed from inside by the priests and followers of the Jacobite faction when the Or-

thodox faction priests reached the church, known as Kothamangalam Cheriyapalli, armed with a court order directing the police to provide protection to their priests to conduct religious services in the church.

Even though the Supreme Court had nearly two years ago allowed the Orthodox faction to offer prayers at the church, members belonging to the rival faction allegedly prevented them from entering it.

The Orthodox faction reached the church to take its possession after a court in Muvattupuzha directed the police to provide protection to their priests to conduct religious services in the church.

Amid high drama, the district administration declared the assembly of the Jacobite faction inside the church and the church premises as “illegal” and urged them to leave the place.

However, the Jacobite priests and followers continued to remain in the church and its premises, forcing the Orthodox faction priests to wait outside.

“We hope that the authorities will take steps to implement the Apex Court order granting ownership of the Church to the Orthodox faction,” an Orthodox priest said as they abandoned their Monday’s plan to take the control of the church.

ing to the Jacobite faction were camping in the church, considered to be a major pilgrim centre of Jacobite Church followers, preventing the implementation of the apex court’s verdict when the Orthodox faction priests reached there to enter the place of worship.

Slogans were raised against the Orthodox faction to enter the Church located in Kothamangalam, a Jacobite stronghold in Kerala.

A large number of police forces were deployed in the premises.

Orthodox faction priests said the Supreme Court order should be implemented.

moved the court after the state government failed to implement the top court order.

Last month, priests and followers of Malankara Syrian Orthodox Church had entered the Piravom Valiyapalli near here and took its possession amid strong protests by the Jacobite faction members.

The Orthodox faction could enter the church following a High Court directive to the state police to implement the Supreme Court order.

Two years ago, the Supreme Court ruled in favour of the Orthodox faction on a dispute with rival Jacobite faction over control of over 1,000 churches and properties in Kerala.

Justice Sharad Arvind Bobde named to succeed CJI Gogoi; set to retire on April 23, 2021 Justice Sharad Arvind Bobde is what lawyers call a “practical judge”. A judge who crafts a well-thought-out solution in a knotty case, which may otherwise have taken years to resolve.

In his hearings, one witnesses Justice Bobde listen carefully to both sides before suggesting a remedy suitable to all.

Eminent American jurist Benjamin N. Cardozo, in a compilation of lectures titled ‘The Nature of Judicial Process’, quotes W.G. Miller to describe what a boon a practical judge is to the litigant. “The client cares little for a ‘beautiful case’! He wishes it settled somehow on the most favourable terms he can obtain.”

Justice Bobde, appointed the 47th Chief Justice of India by the President, has shown his propensity for practical and amiable resolutions twice recently.

It was Justice Bobde on the Constitution Bench who first pushed for mediation of the Ayodhya dispute in order to “heal hearts and minds”. He said the dispute had seen many bitter decades. He believed that talks rather than adversarial judicial proceedings may cool tempers across the religious divide.

Again, in the long-drawn BCCI dispute, Justice Bobde took the practical path. Rather than countless court hearings, in a case which seemed to grow new branches of dispute every

time, Justice Bobde appointed an amicus curiae to resolve the problems of the stakeholders and ordered the holding of elections in the BCCI. This he accomplished in a handful of hearings.

Justice Bobde’s cause list on a normal working day is not chock-a-block with cases. He hears a reasonable number in a day. To these, he devotes himself and usually comes up with a solution grounded in logic and law. His normal workday is a page lifted from Marguerite Yourcenar’s ‘Memoirs of Hadrian’, where the emperor selects a few cases, from the many he hears a day, to deliver complete justice.

Recently, Justice Bobde was heard saying in his courtroom that it was only lately that the judges had understood the benefits of hearing a case continuously, without a break, as they had heard the Ayodhya dispute.

This may be an indication that, in future, important cases may be heard on a day-to-day basis in the apex court.

KKNPP Site Director Sanjay Kumar said the totally isolated network of KKNPP could not be accessed by any outside network from any part of the globe. Hence, there was no question of it being hacked.

Asked if power generation was stopped last week in the second reactor due to a possible compromise, Mr. Kumar said it was purely due to the malfunctioning of a mechanical device in the turbine section, and not due to any electronic complication.

“While the first reactor of KKNPP is generating 1,000 Mwe power, the capacity of the Russian supplied VVER reactor, the second unit is produc-

ing 670 Mwe electricity [as on Tuesday morning],” Mr. Kumar said.
