Diwali at BAPS Mandir in Stafford

Houstonian Kanchan Kabad finishes New York marathon

On Sunday Nov. 3, a mother and recent grandmother, Kanchan Kabad who is 63, was one of the 50,000 runners who completed the New York City Marathon in 6 hours and 17 minutes.

There were tears of joy in the eyes of her family and friends as they watched Kanchan run past the finish line, a smile on her face, and her hands in the air in celebration.

Running the New York City Marathon was a dream come true for Kanchan.

You can’t help but feel inspired after witnessing the New York City Marathon.

The Marathon is one the world’s premier sporting events and brings together top elite runners as well as over 50,000 runners, representing 150 countries, to race through the five boroughs of New York City – covering 26.2 miles to make a full marathon.

The constant cheering gave the runners that extra push as they started at the iconic Verrazzano-Narrows Bridge in Staten Island and went through the different neighborhoods of this massive city.

OFBJP-USA welcomes Supreme Court verdict on Ramjanmabhoomi Temple Case

November 9, 2019 will be written in golden letters in the history of Independent India.

In a historic and landmark judgment delivered today by a five Judge bench comprising of Chief Justice Shri Ranjan Gogoi, Justice Sharad Arvind Bobde, Justice Ashok Bhushan, Justice S Abdul Nazeer, Justice DY Chandrachud.

In a unanimous landmark verdict, the bench declared that the entire land of 2.77 acre be given to the Hindus for Lord Ram as the Hindus have a firm belief that Lord Ram was born at that place.

It was also ruled that the disputed Babri mosque was not built on vacant land and the scientifically conducted survey in 2003 by ASI confirmed in their findings the existence of a temple-like structure underneath.

The bench also ordered that the Muslim community be given in Ayodhya 5 acre land to construct a mosque and associated facilities.

Overseas Friends of BJP (OFBJP)-USA welcomed this historic Supreme Court verdict putting an end to 491 years old Ramjanma Bhoomi – Babri Masjid dispute and thanked the Supreme Court of India for delivering a just and fair judgment.

Hindus consider Ayodhya as the birthplace of Lord Ram. “Faith of Hindus is undisputed that Lord Ram was born in Ayodhya,”.

OFBJP President Shri Krishna Reddy Anugula hailed the verdict as the victory of faith of crores of Hindus.

The verdict will also put to rest one of the most and longest contentious issues that have caused friction among communities for centuries.

OFBJP Vice President Shri Adapa Prasad said that the verdict is historic and unanimous, the SC bench has closed all the matters related to this case and gave a clear judgement in favor of Ram Mandir.

OFBJP Organizational Secretary Shri Vasudev Patel said that the prayers and faith of crores of Hindus has been upheld by the SC judgement and this was such a sensitive case and the SC bench had handled it very well and settled centuries old dispute.

Former OFBJP President, Prof. Dinesh Agrawal said that this verdict had a very special significance for OFBJP since OFBJP was founded in 1991as the byproduct of RJB Movement mainly to counter the false and misleading propaganda in the Western media against Hindu cause and to inform the Western countries about the truth of Ramjanmbhoomi issue.

He further said that this very day also 30 years ago the foundation (Shilanyas) was laid at the disputed site, and also the Berlin wall was brought down

to unify East and West Germanies on Nov. 9, 1989, and coincidently further the Corridor for Kartarpur (Resting place of Guru Nanak Dev) has been opened, bringing down a wall between India and Pakistan. Hence November 9 will remain a historic day as a symbol of “Unity in diversity”.

Hailing the Supreme Court judgment on the Ayodhya issue, RSS chief Mohan Bhagwat on Saturday asserted “truth and justice” have prevailed and stated that the verdict should not be seen as anybody’s victory or defeat.

The decision is in line with the sentiments of the whole nation and Rashtriya Swayamsevak Sangh (RSS) joins the people of the nation in welcoming the verdict, he said.

Addressing a press conference at the Sangh’s central office here in Jhandewala, Bhagwat said,”We welcome this decision of the Supreme Court.

This case was going on for decades and it has reached the right conclusion. This should not be seen as a win or loss.

We also welcome everyone’s efforts to maintain peace and harmony in society.”

He suggested that the RSS may not take up similar disputes involving temple sites in Mathura and Varanasi, saying the organisation was associated with Ram temple as it had a historical background but its primary job is character build-

ing and not launching agitations.

“There was a historic background to the RSS being involved with Ayodhya, as an organisation we don’t otherwise involve ourselves in agitations and we will revert to our man making mission,” he said.

MEA briefs envoys of various countries The Ministry of External Affairs on Saturday briefed diplomats of various countries and key allies of India after the historic verdict in the Ayodhya case.

Senior officials of the ministry explained the decision of the apex court to the envoys in the backdrop of the sensitivities related to the long standing issue, sources said.

The Supreme Court, in its verdict pronounced earlier in the day, backed the construction of a Ram temple by a trust at the disputed site in Ayodhya, and ruled that an alternative five-acre plot be allotted for building a mosque in the Hindu holy town.

known how many diplomats were briefed and what specifically was conveyed to them.

The briefing assumed significance given the government undertaking several steps to maintain law and order all over the country ahead of the apex court verdict.

You see so many runners of different abilities – young, old, with two legs or no legs, on a pair of crutches or wheel chairs, running or walking or a mix of both. Regardless, their participation shows the beauty and strength of the human mind.

For Kanchan, who had never run before, it all changed in 2010 when her father passed away after cancer surgery. In early 2011 at the age of 55, she started walking a mile or two to cope with the grief and in an effort to move on with life.

She joined a local running club, and made time every week to run on a training schedule. She would run for a few minutes, then walk for a few minutes, until over time, she could start running for a longer period of time. Her races started with 5K, increased to 10K races and then to half marathons. In 8 years, she has run over 30 races, of which 6 are full marathons (26.2 miles) and others are half marathons (13.1 miles).

For someone who had never run more than a mile at best, she has come a long way in 8 years. “It is all in the mind,” she said. She also observed that every race she runs is for a cause, as she dedicates each race to someone who is going through the cancer journey or a survivor who has overcome cancer. She feels

Kanchan started her race at 11 am and at 5:17 pm as the sun was setting, she crossed the finish line of the New York City Marathon. However, at the end of the race, it looked like she could run the race all over again. “I love the New

York City Marathon,” she later commented. “There is nothing like this marathon. It is the best!”

This is the energy that the New York City Marathon creates.

The motto of the Marathon is “It will move you.” And everyone, whether running or cheering were motivated by Kanchan and the other runners that day, runners who were driven by determination, hard work, and inspired by the many causes they represented. Kanchan proved that even grandmothers can run marathons!

NEWS Raj Salhotra, ready for the runoff election to Houston City Council Seat With 44,408 votes cast in his favor, Raj Salhotra is headed to a runoff election for Houston City Council, At Large Position 1.

The son of Indian immigrants, Salhotra, 28, ran up against incumbent Mike Knox as well as three left-leaning candidates in the general election in Harris County. Election results trickled in throughout the night on Tuesday, with final results showing Salhotra in second place with 22.11 percent of the votes, and Knox leading with 36.47 percent. Because no candidate received more than 50 percent of the votes, the top two candidates – Salhotra and Knox – will face off in a runoff election, to be held on Saturday, Dec. 14.

“We always knew this would be a two-step process,” Salhotra said to a room full of supporters during his watch party on Tuesday night. “We’re looking good on step one, and we’re ready for step two.”

Salhotra officially announced his candidacy for Houston City Council in March, and he has been campaigning rigorously for the past nine months. The son of Atul and Poonam Salhotra, Raj grew up in Houston and graduated from Rice University. He then went on to serve as a Teach for America corps member, teaching high school calculus and statistics at a charter school serving predominantly low-income, minority students.

Seeing students struggle to achieve academic success because of systemic barriers outside of the classroom inspired Salhotra to enter public service. After graduating from Harvard Law School in May 2018, Raj decided to return to his hometown and serve his community.

“I’m running for this position because of my family and because of my students,” Raj said in a statement. “The city of Houston, and this country more broadly, has helped my family live the American Dream. But as a teacher and non-profit leader, I have worked with hundreds of students who have the exact same aspirations as I do, whose parents work just as hard as my parents do, but unfortunately, because of policy issues and structural inequalities, are trapped in poverty. I’m running for City Council to build one Houston, where everyone has an opportunity to succeed.”

If Salhotra wins the runoff, he will become the first Indian to hold a Houston City Council At-Large seat. He said he hopes to serve as an example to other minority students who are striving to enter politics.

Salhotra also serves as the president of the Young Hindus of Greater Houston, and he is the founder of a mentorship non-profit called SWAG to College.

Indo- American Miss World America Shree Saini to raise funds to prevent drug overdose deaths

The 23-year-old Indian American student and anti-bullying activist was crowned Miss World America Washington, and the winner of 5 award at Miss World America 2019. She is known for her anti-bullying social work, now Shree working on raising awareness about suicide prevention, drug addiction prevention and drug rehabilitation programs.

Shree Saini said, “It is an honor to serve our community. I hope everyone takes the time to go out in their local school, city halls and do their part of improving our world.”

In particular, to solve the drug-addiction epidemic, Shree is working together with organizations on the local, state and national level. Drug overdose takes 129 lives victims every day “I am speaking with school students to never start drug experimentation, so they can lead a life free of drug addiction,” Shree Saini said.

Rep. Ilhan Omar is at it again – denouncing democracy and taking a pro-terrorist stand – this time on Kashmir.

At a subcommittee hearing held by Congressman Brad Sherman and in follow-up tweets, Omar is putting forward a false narrative about Kashmir, which has real-world consequences for victims of persecution.

In the last three decades, over 42,000 people have lost their lives along the Line of Control (LoC) that now separates India and Pakistan in Kashmir due to Pakistani sponsorship of terrorist organizations including the safe harboring of al-Qaeda, Jaish-e-Mohammed (JeM), the Taliban, Lashkar-eTaiba (LeT),

Hizbu-ul-Mujahideen (HM) and more.

When Aarti Tikoo Singh, among the persecuted Kashmiris and a journalist of Indian descent, testified at the US House of Representatives Foreign Affairs Subcommittee hearing on Human Rights in South Asia on October 22, 2019, Omar accused the highlycredentialed journalist of making “dubious claims” and sharing a “version” about “what you call militants…nefariously backed by Pakistan,” implying that Singh was “a mouthpiece” for the Indian government.

Unlike Omar, India is against terrorism, not religion.

When it comes to Kashmir, Omar lacks understanding –

just like she lacked understanding about 9/11, casually and disgracefully referring to 9/11 as an event where “some people did something.” It is time for Rep. Omar “to behave in a manner that reflects creditably on the House” (Code of Official Conduct).

The Indian American community calls upon Rep. Omar to check her contempt for democracy at the door. Telfair Indian American Community celebrates Diwali

Sugar Land residents donned their beautiful ethnic Indian attire and joined the nearly 1000 others in celebrating Diwali hosted by the Telfair IndianAmerican Community Association at Cornerstone Elementary in Telfair on Oct. 27.

Attendees were welcomed by a large statue of Lord Ganesh, the Hindu God of prosperity. The statue was surrounded by a beautiful Rangoli, the Indian festive art, and flanked by a spectacular arch.

“Diwali is a special holiday for Indian families, and here at TELICA, we try our best to make it special for all our attendees,” said Suhas Narendrula, the event’s Lead Coordinator.

As the little ones busied themselves with arts and crafts activities including building paper lanterns with LED lights, the older kids put their skills to work at the beanbag game. The “Giant Jenga” game was a huge draw for teens and tweens alike.

“The fun environment is so reminiscent of our childhood in India, it is so wonderful to see the kids just having a great time,” said Devi Koppulu, Activities Coordinator.

As the children enjoyed themselves, the Telfair women took advantage of traditional favorites such as the Henna and Nail Art booths to give their hands a festive treat.

The afternoon merriment started with TELICA Officers, Srilatha Vutalooru, Deepak Kanwar, and Raju Mupalla handing plaques to event coordinators Suhas Narendrula, Sowmya Erukulla, Devi Koppolu, Ravi Ranjan, Ananya Bommakanti and Anika Bajpai. They were joined on stage by KP George, Fort Bend County Judge, Naushad

Kermally, Sugar Land City Council member, and Ibrahim Khawaja, First Assistant to the Fort Bend District Attorney.

Telfair Community Association board members including Board President Srini Chittaluru and elected delegates also joined them on the stage to participate in the celebratory Diya lighting.

Following the soulful Ganesh Vandana, the audience was treated to over three hours of exhilarating performances that included classical Indian dances, folk dances and Bollywood Dhamaka. The amazing choreography was provided by dance hobbyists and professional dance schools.

“Telfair’s immense talent pool never ceases to amaze me; children and adults alike come well-prepared and deliver an amazing performance,” said Sowmya Erukulla, the event’s Cultural Coordinator.

The event concluded with a high-energy Fashion Show parade featuring over 50 participants. The 5-year-olds to 65-year-olds paraded down the stage exuding confidence and proud to be part of this wonderful Telfair tradition.

Diwali at BAPS Shri Swaminarayan Mandir in Stafford: Time for reflection and introspection

The physical act of lighting lamps on Diwali symbolizes an individual’s efforts to remove the darkness from one’s self in forms of anger, envy, greed, arrogance, and resentment. Through its thought-provoking customs and traditions, Diwali presents a time to reflect and introspect for individuals, families, and communities.

Community members gathered at BAPS Shri Swaminarayan Mandir in Stafford to celebrate Diwali from October 19-28.

Arya Samaj of Greater Houston celebrates Diwali

Arya Samaj Houston celebrated Diwali on the evening of Saturday, November 2nd in a grand manner as a fitting tribute to its founder Maharshi Dayanand Saraswati. Diwali symbolizes the spiritual victory of “Light Over Darkness, Good Over Evil, and Knowledge Over Ignorance”.

Several versatile Indian cultural performances were presented by different age groups performing different activities in the Main Hall. Children played the Tabla accompanied by Chiddanand ji, sang and danced and demonstrated many unique yoga poses and sequences. These children attend Arya Samaj DAV Sanskriti school every Sunday or DAV Montessori School year around and they practiced all year to put on such an amazing show. The performances help children learn more about their culture and enjoy fun activities at the same time. The last event was the Raffle organized with the help of AYM Youth group.

The festivities saw numerous booths lined along the front of the DAV Montessori with activities ranging from face painting and games to kulfi stands and pizza. DAVSS & DAV Montessori students, AYM kids, and adults all enjoyed the booths. A wide variety of delicious Indian foods like Pav Bhaji, Papdi Chaat, and Chole Bature were also served throughout the evening. The evening concluded with the announcement of the Diwali raffle winners and a beautiful display of fireworks.

Arya Samaj has been emphasizing the importance of bone marrow donations over the past few years. Recently, Rita Gulati gave a life-saving bone marrow donation. Her selflessness serves as a reminder that those of us who are able to donate should definitely do so. In order to further promote this, Arya Samaj hosts a health fair annually where volunteers can sign up to donate. The health fair will be held in the spring.

Diwali at La Centerra in Katy

Nithya Hari of Bollywood Dancing Stars Bollywood Dancing Stars, in association with Mirchi Radios, hosted a spectacular cultural festival recently celebrating Diwali at the Central Green at La Centerra in Katy. Central Green was festive with vendor booths selling ethnic apparel, paintings, jewelry and catered Indian food. The celebration was marked with festivities of dance and entertainment which culminated with the spectacular ceremony of diyas (lights). The event, hosted by Nithya Hari and Prasad Maragani, was brought to Katy thanks to the support and effort of Willowfork Drainage District’s Vice President Wendy Duncan and Manager of the park Yvonne Arceneaux. Nithya Hari of Bollywood Dancing Stars was the star of the event. The event was opened by Fort Bend County Judge K. P George. The next three hours was an amalgamation of exciting Bollywood dance performances from Nithya Hari’s students and other traditional and folk dances from various other groups, an Indo-western fashion show and musical performance.

Star Promotions brings star singers from Bollywood

Houstonians were treated to an entertaining night of Bollywood music on Nov. 8 at the Arena Theater titled “Throwback 90s.”

The event, which was sold-out, brought together for the first time, three well known singers - Kumar Sanu, Alka Yagnik and Udit Narayan. As the hit songs from the 90s rolled out in quick succession, the entire arena was euphoric and the ecstatic audience jumped out to dance on the aisles. Rajinder Singh of Star Promotions, who has more than two decades of experience in bringing outstanding Bollywood shows to Houston, capped the year 2019 with this show and was praised by the audience for bringing this show to Houston. The state of Manipur in the northeast corner of India is known for its rich and colorful culture. “Ningol Chakouba” is the largest and most popular festival of Manipur. Married women are invited to their parents’ house along with their children for lunch. The festival is observed on the second day of the new moon in the Maniouri month of Hiyangei (October/November). In 2018, Manipuri families in Dallas hosted this traditional event for the first time for Manipuris across Texas. On November 2nd, 2019, the festival was hosted in Houston, for close to 30 families who gathered together in the western suburbs of Houston, Texas. Ladies and girls came dressed in colorful traditional dresses. A lavish lunch was enjoyed by everyone and was followed by the traditional gift giving. All the Ningols and their children received gifts and played games. Everyone left looking forward to Ningol Chakouba in 2020.

Historical reconstruction of the Ayodhya plot

The Supreme Court’s landmark judgment on the disputed site in Ayodhya rests on historical evidence; the gains of which are civilisational A learned member of the five-judge Bench (not Constitution Bench) wisely collated the evidence regarding Sri Ram’s birthplace and appended it to the Supreme Court’s verdict of November 9, granting the disputed site to Ram Lalla Virajman. The 116-page addendum highlights the Vishwa Hindu Parishad’s (VHP) gigantic efforts to collect every scrap of evidence to legally establish Hindu belief in the birthplace of Vishnu’s avatar. The evidence is compelling. Critics, who allege that the judgment privileged one community, have not read the 1,045-page document.

As the dispute centres on the destruction of the Ram Janmabhoomi temple at Ayodhya

by Babur’s general, Mir Baqi, evidence proving the sacredness of the shrine prior to 1528 is critical. The Janma Sakhies (biographies) of Guru Nanak Dev show he visited Ayodhya in 1510-1511 AD, before Babar’s invasion of India. Later, Guru Tegh Bahadur and his son, Guru Govind Singh, also visited the temple at Ayodhya.

Though the Janma Sakhies do not identify the exact place of the Janmabhoomi, Guru Nanak’s visit shows that pilgrims were visiting Ayodhya prior to the temple’s destruction. Thus, the faith and belief of Hindus regarding the location of Lord Ram’s birthplace, as asserted in scriptures and sacred books, including Valmiki Ramayana and Skanda Purana, is not groundless.

During emperor Akbar’s reign (1556-1605), Tulsidas composed the Ramcharitmanas (1574-75). The Balakanda shows Brahma urging Vishnu to save the gods, sages, gand-

harvas and Earth from Ravana’s terror; Vishnu promises: “Fear not, o sages, Siddhas and Indra; for your sake I will assume the form of a human being. In the glorious solar race, I shall be born as a human being along with my part manifestations.” (Doha 186-7) Vishnu grants a boon to sage Kasyapa and his wife Aditi to be born in Ayodhya as Dasaratha and Kausalya; Vishnu would take birth in the form of four brothers, “the ornament of Raghu’s line.”

Akbar’s biography, Ain-iAkbari, mentions Ayodhya as the residence of Ramachandra and one of the holiest places of antiquity. Traveller William Finch visited India from 1607 to 1611 AD and mentioned the ruins of Ramachandra’s castle.

Father Joseph Tieffenthaler visited India between 1766 and 1771 AD and found in Oudh (Awadh) a famous place called Sita Rasoi on a mud hill.

Emperor Aurangzeb got the fortress called Ramcot (Ramkot) demolished and a Muslim mosque, with triple domes, constructed at the same place.

Tieffenthaler recounts that some said the masjid was constructed by “Babor” (Babur) and 14 black stone pillars of five span high from the fortress are visible there; 12 support the interior arcades of the mosque.

He describes the bedi (cradle) of Ram and says Aurangzeb or Babur razed the temple “to deny the noble people, the opportunity of practicing their superstitions”. However, the people “go around three times and prostrate on the floor.” This is clear evidence that Hindus at the time of Tieffenthaler were worshipping the janamsthan as a deity.

The East India Gazetteer of Walter Hamilton (1828) notes that pilgrimage to Oudh are chiefly by the Ramata sect.

Montgomery Martin in His-

tory, Antiquities, Topography and Statistics of Eastern India (1838), mentions the glory of Ayodhya. Edward Thornton’s Gazetteer of India (1854) and Gazetteer of the Territories under the Government of the East Indies Company of the native States on the Continent of India (1858) gives details of Oudh.

Mirza Jaan’s Hadith-e-Sehba (1856) states, “The above mentioned place is called seat of father of Lord Rama. Places of idol worshiping situated here were demolished…The place of worship is called the birthplace of Lord Rama and the place which is adjacent to it is called “Sita Ki Rasoi”…

At that place, Babar Shah got constructed a very big masjid under the supervision of Sayyad Musha Ashiqan in the year 923 Hijri and its history is still maintained. Today, the above-mentioned “Sita Ki Rasoi” is called the “masjid.” The learned judge observed, “The book candidly accepts that at the janamsthan of Lord Ram, (a) mosque was constructed by Babar.”

In 1858, the British Government annexed Awadh, after which all official reports, correspondences and orders cite the “Mosque” as “Mosque Janma Sthan.” The Historical Sketch of Tehsil Fyzabad, Zillah Fyzabad by P Carnegy, Officiating Commissioner and Settlement Officer of Ayodhya and Fyzabad (1870), states that Ayodhya is to Hindus what Mecca is to the Mohammedans and Jerusalem to the Jews.

Carnegy categorically stated that at the place of janamsthan, emperor Babar built a Mosque, which still bears his name, in AD 1528. These facts are repeated in several subsequent Gazetteers.

The report of the Archaeological Survey of India (ASI) of North West Provinces and

Oudh (1889) states, “The old temple of Ramachandra at janamsthanam must have been a very fine one, for many of its columns have been used by the Musalmans in the construction of Babar’s masjid.”

Alois Anton Fuhrer’s report of the ASI (1889), The Sharqi Architecture of Jaunpur; with Notes on Zafarabad, SahetMahet and other places in the North-Western Provinces and Oudh, states that Babar’s Masjid at Ayodhya was built on the very spot where the old temple janamsthan of Ramchandra was standing. Fuhrer reiterates this in Monumental Antiquities and Inscriptions in the NorthWestern Provinces and Oudh (1891). Obviously, Prof BB Lal’s excavations followed ASI precedents.

The Gazetteer of Bara Banki, Vol 48 (1921), mentions that in 1853, the Bairagis seized the janamsthan temple land (pg 169), prompting Muslims led

by Amir Ali, to march towards Ayodhya. They were intercepted by Col Barlow of the First Regiment of Oudh; the regiment was wiped out and Amir Ali and many others were killed.

On November 30, 1858, Syed Mohammed Khatib Moazzim of the Babri Mosque complained that one Nihang Singh had constructed an earth chabutra (platform), written “Ram Ram” inside the mosque, and was conducting havan (rituals) there. There are several pleas by mosque officials for the removal of the chabutra. In 1866, Bairagis placed an idol inside the premises. In 1877, the Deputy Commissioner, Ayodhya, granted permission to Khem Das, Mahant, janamsthan, to open the door in the mosque’s northern wall to give Hindus a separate route to the site. In 1934, a dome was damaged in a riot, which the administration got repaired.

These accounts prove that Hindus continuously struggled to access and worship the site; hence the Sunni Wakf Board could not establish possessory rights over it. The judgment rests on historical evidence; the gains are civilisational.

Settling a fractious issue that goes back more than a century, the Supreme Court in a historic verdict on Saturday backed the construction of a Ram temple by a trust at the disputed site in Ayodhya, and ruled that an alternative five-acre plot must be found for a mosque in the Hindu holy town.

Delivering a unanimous judgement on a case that has long polarised the country and frayed the secular tapestry of Indian society, a five-judge bench of the apex court headed

by Chief Justice of India Ranjan Gogoi said the faith of Hindus that Lord Ram was born at the site was undisputed, and he is symbolically the owner of the land.

Yet, it is also clear that the destruction of the 16th century three-domed structure by Hindu kar sevaks, who want to build a Ram temple there, was a wrong that “must be remedied,” the ruling said.

The judgement was widely welcomed by Hindu politicians and groups, while the Muslim leadership said they will accept the verdict, even though they described it as flawed. Still, they called for peace and calm, and leaders across the political spectrum noted that it was now time to move on.

“Whether it is devotion to Ram or Rahim, now is time for everybody to strengthen devotion to India,” Prime Minister Narendra Modi said in a tweet.

The dispute over the site of Babri Masjid, a three-domed mosque built by or at the behest of Moghul emperor Babur, dates back centuries with Hindus contending that the invad-

ing Muslim armies had razed an existing Ram temple to erect the mosque. However, it turned into a legal dispute in 1885 when a mahant went to court seeking permission to build a canopy outside the mosque.

The plea was dismissed. In December 1949, unidentified miscreants spirited an idol of Lord Ram into the mosque.

The structure was destroyed by a large mob of kar sevaks on December 6, 1992.

The demolition triggered nationwide Hindu-Muslim riots, more so in north India and Mumbai, which left many hundreds dead. Subsequently, Muslim extremists angered by the demolition and the riots, carried out a series of bombings in Mumbai on March 12, 1993, which left hundreds dead.

“The Constitution must ensure that a wrong committed must be remedied. Justice would not prevail if the Court were to overlook the entitlement of the Muslims who have been deprived of the structure of the mosque through means which should not have been employed in a secular nation committed to the rule of law,” the judgement said.

To remedy that wrong, the court asked the government to allot a five-acre plot in a “prominent” location in the holy town of Ayodhya in Uttar Pradesh for constructing a new mosque. months. The trust will be tasked with the construction of the temple.

The judgement said it is not concerned with faith and belief, and instead treated the case as a title dispute over land between three parties -- the Sunni Muslim Waqf Board, the Nirmohi Akhara, a Hindu group, and the symbolic Lord Rama designated as Ram Lalla Virajman.

“The dispute is over immovable property. The court does not decide title on the basis of faith or belief but on the basis of evidence,” the judgement said, delivered at the end of a marathon 40-day hearing-- the second longest in the history of apex court.

Justice Gogoi is due to retire on November 17.

“On the balance of probabilities, there is clear evidence to indicate that the worship by the Hindus in the outer courtyard” has continued unimpeded even before 1857 when the British annexed Oudh region.

“The Muslims have offered no evidence to indicate that they were in exclusive possession” of the mosque before 1857, it said.

“The faith of the Hindus that Lord Ram was born at the demolished structure is undisputed,” it added.

The verdict in the politically-sensitive Ram JanmbhoomiBabri Masjid land dispute case, one of the most important and most anticipated judgements in India’s history, runs into 1,045page pages. The apex court bench also comprised Justices S A Bobde, D Y Chandrachud, Ashok Bhushan and S Abdul Nazeer.

As security was tightened at communally sensitive places across the country, Mohan Bhagwat, the chief of ruling BJP party’s parent organisation RSS, said the verdict should not be seen as anybody’s victory or defeat. The building of a Ram temple is a long-held objective of the BJP. There were no reports of violence or unrest from Ayodhya, where a massive police force was deployed, or any other part of the country.

The verdict was pronounced on 14 appeals filed in the apex court against the 2010 Allahabad High Court judgment, delivered in four civil suits, that the 2.77-acre land in Ayodhya be partitioned equally among the three parties -the Sunni Waqf Board, the Nirmohi Akhara and ‘Ram Lalla’.

court wrongly decided the title suit by resorting to partitioning of the disputed land in three parts.

“The disputed site was government land in the revenue records,” the court said adding,” The fact that there lay a temple beneath the destroyed structure has been established by the Archaeological Survey of India(ASI) and the underlying structure was not an Islamic structure.”

C S Vaidyanathan, lawyer for deity ‘Ram Lalla’, said the verdict is very balanced and it is a victory of people. But, the Sunni Waqf Board, one of the main parties, said it was not satisfied and will seek a review.

“The verdict holds no value for us, It has lot of contradictions,” Zafaryab Jilani, lawyer for the Board, told reporters.

The Nirmohi Akhara said it has no “regrets” regarding the verdict.

Home Minister Amit Shah appealed to all communities to accept the verdict and maintain peace and remain committed for ‘Ek Bharat Shreshtha Bharat’ while Defence Minister Rajnath Singh urged everyone to take the verdict with equanimity and magnanimity.

The Congress said it respects the verdict and is in favour of construction of Ram temple.

Former VHP president Praveen Togadia said giving Ram Lalla’s birth land for Ram Temple is a salute to the sacrifice of lakhs of workers.

Prominent Muslim leaders appealed for peace and harmony even as they expressed surprise.

“I was surprised to see the ruling and it’s beyond my understanding. I feel there were enough evidences in favour of the mosque but these were not taken into consideration,” Mufti Abul Qasim Nomani, the current Mohtamim (ViceChancellor) of the Islamic seminary Darul Uloom Deoband, told PTI. Prohibitory orders were issued across the national capital to maintain public order, according to Delhi Police while an emergency Operations Centre was set up in Lucknow to keep an eye on reports from media, social media and other sources on the verdict.

Ayodhya verdict: end of a long chapter Balance is integral to the idea of justice. The Supreme Court believes that it has been able to strike a balance in its verdict on the Ramjanmabhoomi-Babri Masjid case, a legal dispute that had continued to fester for decades. In a unanimous judgment passed by a five-member Constitution bench that dismissed Allahabad High Court’s earlier decree apportioning the contested site among three claimants, the Supreme Court has ordered that the disputed strip of land — it measures 2.77 acres — should be handed over in its entirety for the construction of a Ram temple.

The Centre has been directed by the court to constitute a board of trustees within three months for this purpose. The Centre has also been instructed to allot land for the construction of a mosque — the Babri Masjid was demolished by an unprovoked, allegedly orchestrated, assault by kar sevaks — at a ‘prominent’, but alternative, site.

The apex court has held this wanton act of destruction and the earlier desecration of the mosque to be an infringement of the law. It is to be hoped that the investigation and the preparation of the charge sheet against the offenders — the Central Bureau of Investigation had been asked by the Supreme Court to complete the hearings without intervals in the sessions court way back in 2017 — would be expedited. A further delay in justice in this case could seriously undermine the claim of the arbitration being fair. Balance, after all, is also predicated on the swiftness of the edifice of justice.

The Ayodhya case and, arguably, the verdict exhibit certain singular features. A tiny patch of land in the course of its contentious history inflicted serious damage to the inclusive fabric of the country. Much of the credit for this dubious accomplishment must go to the majoritarian political project that had chosen to ride piggyback on the Ayodhya movement that inflamed public sentiments. Yet, at its heart, Ayodhya represented a title deed dispute. Religious sentiments or, for that matter, frenzy should have had no place in it. The Constitution bench ostensibly made this very point when the Chief Justice of India stated that a land title should remain immune from faith and prioritize proof. The court — it acknowledged the faith of Hindus in Ram — agreed with the archaeological evidence that the mosque had not been built on vacant land. Significantly, the findings of the Archaeological Survey of India do not expressly state that a Hindu structure had been razed to build the mosque.

The Supreme Court’s pronouncement, it is being hoped, would bring a sense of closure. But this can only be possible if sympathizers of the Hindutva fraternity choose to act responsibly. The judgment — a review had been considered initially — should not be used as a licence for further polarization or violence. The prime minister’s appeal to view the verdict beyond the prisms of loss or win needs to be honoured. (By The Editorial Board, The Telegraph.)

Peace and justice: On Ayodhya verdict

There comes a time when the need for peace and closure is greater than the need for undoing an injustice. In allowing a temple to come up through a governmentappointed trust at the disputed site in Ayodhya, the Supreme Court has apparently chosen a path most conducive to social harmony. To compensate the Muslim litigants, who were deprived of the centuries-old Babri Masjid through an illegal act of demolition, the court has asked for the allotment of a five-acre plot of land elsewhere in Ayodhya that may be used for building a new mosque. That this is more of moral consolation by way of a political compromise and less of adjudication in recognition of their religious rights is obvious. The final award will always be a source of discomfiture for those to whom closure goes beyond ensuring peace in a communally polarised environment.

But what is most welcome about the 1,045-page verdict of a Bench of five judges is its unanimity. For, it sends out a message that the judiciary has, with a single mind, ventured to give legal burial to a prolonged dispute that began as a minor litigation, expanded into a divisive political cause, and became a festering wound on the body-politic for years. The fact that the case is over at last must come as great relief to all peace-loving people.

This sense of relief masks the bitter truth that the fear of a Hindu backlash if there was an adverse verdict was genuine. After nearly three decades of unrelenting pursuit of communal polarisation, the majoritarian, revanchist forces in the country have fatigued their secular adversaries into passive acquiescence. The Bench indeed has done well to record its revulsion at two incidents that represented an onslaught on the psyche of secular India: the desecration of the masjid in

1949 when Hindu idols were planted surreptitiously under its central dome, and the planned destruction of the whole structure by the foot soldiers of Hindutva on December 6, 1992. But what is most disappointing about it is that the relief spelt out by the Bench may amount to legitimising the very demolition it unequivocally condemns. Having declared that the suits are representative of the two communities, organised violence by one party ought not to have been ignored. It is common knowledge that the Vishwa Hindu Parishad, which spearheaded the temple movement with the active backing of the Bharatiya Janata Party and organised the demolition of the mosque, got a foothold in the litigation through an individual who represented the deity, Ram Lalla, as “a next friend” in a fresh suit filed in 1989.

A reading of the judgment reveals that the outcome is not wholly in line with the evidentiary conclusions the court itself reaches. It notes that archaeological evidence — procured only because excavation was made possible by the demolition and as such not available to the parties at the time of institution of the suits — only shows the existence of a 12th century Hindu religious structure underneath, but does not prove any demolition or explain what happened in the intervening centuries. It acknowledges that namaz was offered at the mosque between 1857 and 1949, and declares that Muslims did not abandon it, but offers no relief even though their religious rights stand proved. The entire disputed area covering both the inner and outer courtyards are awarded to one side contrary to its own conclusion that Muslims had a right, albeit a contested one, in the inner courtyard.

While it holds that Hindus had possessory right over the entire outer

courtyard to the exclusion of Muslims, it does not decide whether they had exclusive title; on the other hand, it rejects the Muslim claim solely on the ground that they failed to prove “exclusive title”. Also, the court says evidence of Hindu worship was available for a period prior to 1857, while there was proof of namaz only after 1857, without accounting for the fact that it was in that year that a massive riot took place that led to the British administration putting up a railing to divide the mosque from the Hindu shrines in the outer courtyard. The case has been decided on the balance of probabilities that Hindus have proved a better title than Muslims.

While it is true that “preponderance of probablities” is the standard of proof in civil law, it is doubtful whether this can be invoked to the exclusion of an acknowledged right belonging to the other side.

It will be disappointing to the country as a whole if the judgment in favour of Hindu litigants does not end the belligerence of Hindu organisations that ran the movement to build a temple at the very spot on which the Babri Masjid stood until that fateful day in 1992.

The rulers of the day owe this much to the nation. And in the spirit of the ‘new India’ put forward by Prime Minister Narendra Modi, it would be in the fitness of things if the VHP and other organisations which participated in the demolition are expressly excluded from the proposed trust to build the temple. In paving the way for the building of a temple for Ram on the spot believed to be his janmasthan, the Supreme Court held up the faith of millions of Hindus. But it cannot allow the judgment to be perceived as an endorsement of any challenge to the rule of law in the name of faith.

NEWS Lata Mangeshkar in ICU, sister says she is recovering Legendary singer Lata Mangeshkar was admitted to Breach Candy Hospital’s Intensive Care Unit in the early hours of Monday after she complained of breathing problems, hospital sources said. The singer, who turned 90 on September 28, is in a critical condition, they said.

“She was brought to hospital at about 2 am. She is critical and in the ICU,” a hospital insider told. Mangeshkar’s younger sister Usha said the singer had a viral infection and should be discharged by Tuesday.

“Lata Didi is still in hospital. She is under observation. She is doing absolutely well and is stable. She will be discharged by tomorrow. “We thought it’s better to treat her at a hospital because of the viral infection so she is there for today,” Usha Mangeshkar told amid reports that the musical icon had already been discharged and was recuperating at home.

In a career spanning over seven decades, the Indore-born Mangeshkar has lent her voice to thousands of songs in over 1,000 Hindi films as well as in various regional and foreign languages. The indefatigable Mangeshkar recorded her last song this year. “Saugandh mujhe is mitti ki” was released on March 30 as a tribute to the Indian Army.

Her last full album was “Veer-Zaara”. She started her journey as a playback singer in 1942 with Vasant Joglekar’s Marathi movie “Kiti Hasaal”. Her first song to release was “Natali Chaitraachi Navalaai” from “Pahili Mangalaa-gaur”. She also acted in the movie. Mangeshkar was awarded the Bharat Ratna, the highest civilian honour in the country, in 2001. She was given the Dadasaheb Phalke Award in 1989.

Mini buses start plying in Srinagar, train service on Srinagar-Baramulla stretch to resume

Mini buses began plying on some routes in the city on Monday while railways conducted two successful trial runs on the Srinagar-Baramulla stretch ahead of resumption of the train service on Tuesday, officials said.

The train service has been suspended since 5 August when the Centre decided to abrogate Article 370.

A railway official said that railways conducted the trial run of the service for the first time in over three months since the shutdown in the valley.

“The train service on Srinagar-Baramulla stretch will resume tomorrow (Tuesday), while Srinagar-Banihal train service will resume in a few days after checking the track safety and conducting trial runs,” he said.

The railways conducted two successful trial runs on the stretch on Monday after conducting a thorough safety audit of the line.

Train services in the valley were suspended on the morning of 5 August — hours before the Centre announced its decision to abrogate Article 370 of the Constitution and to bifurcate the erstwhile state into two Union territories.

The Centre’s decision led to an unannounced shutdown in the valley even as authorities imposed severe restrictions which were later gradually eased out.

Officials said that on Monday few mini-buses plied on Batwara-Batamaloo route through the city centre for the first time since 5 August.

Inter-district cabs and auto-rickshaws also plied in the city and elsewhere in the valley, they added.

The officials said private transport was plying unhindered and several areas of the city witnessed traffic jams.

Case justified The Centre justified in the Supreme Court on Monday the abrogation of provisions of Article 370 of the Constitution, which gave special status to Jammu & Kashmir, saying the militants and separatist elements, with the support of foreign forces inimical to India, were taking advantage of the situation.

A five-judge Bench of Justice NV Ramana, Justice SK Kaul, Justice R Subhash Reddy, Justice BR Gavai and Justice Surya Kant is scheduled to take up for hearing a batch of petitions challenging abrogation of provisions of Article 370 and Article 35A on November 14.

In its reply to the batch of petitions, the Centre said that Article 370, in its original form, was constitutionally described as a temporary provision with respect to Jammu & Kashmir, formed a part of the Constitution of India as adopted by the Constituent Assembly on November 26, 1949.

The Centre’s affidavit said it was observed over the years that the existing regime under Article 370 of the Constitution, and the exceptions/modifications carried out to other provisions of the Constitution of India by Presidential Orders issued under Article 370(1)(d), were impeding, rather than enabling or facilitating, the full integration of the erstwhile State of Jammu & Kashmir with the rest of the country which was neither in the national interest nor in the interest of Jammu & Kashmir.

Seshan had brilliant career as civil servant Thirunellai Narayana Iyer Seshan, popularly known as T N Seshan, who passed away Nov. 10 due to old age related problems was given a tearful farewell on Monday at Basanth Nagar crematorium in Chennai by thousands of citizens who had gathered to bid au revoir.

The 1955 batch IAS officer breathed his last late Sunday night and had desired to be cremated at Chennai itself, where his wife too has the last resting place. Seshan who shot into international fame with his six year stint as Chief Election Commissioner was known for his no-nonsense approach to the job in his hands. After retirement from the post of CEC, Seshan used to tell the people that his final wish was to see the Government of India funding the election process in the country.

When he was appointed as the CEC, the general Election and Assembly Election in the country were manipulated and muzzled by mafia dons and anti social elements who threatened the voters with dire consequences if they do not vote for the candidates picked by the former. “Appavukku Charayam, Ammavukku Sari and namma verpalarkku vote” was the catchword of the political masters, Seshan used to tell.

It meant, alcohol for the family head, sari for the women and vote for the candidate picked up by the local ruffian. But with Seshan assuming office in the Nirvachan Sadan things underwent a drastic change.

Both the DMK and the AIADMK shivered from head to toe at the mention of his name. But don’t be under the

impression that it was as CEC he earned the reputation. That started long back, in 1960s when he worked as the district collector of Madurai which saw unprecedented riots as part of anti Hindi agitation. “My officers were beaten up by rioters in a village. Many government officials were set ablaze and were killed . I went to the village with a police force who cordoned off the area. I had a stick with me and ordered all the villagers to line up outside their houses. I told them if they do not reveal the names of the rioters responsible for the gruesome incident, I would beat them to pulp. The woman began to sing and the men spilled the beans,” Seshan had told in an interview.

He led various departments in the Government of Tamil Nadu during his tenure in the State. When drivers of the State Transport Corporation submitted a memorandum to him listing their grievances in driving the dilapidated buses, Seshan himself took to the wheels of the buses to get a first- hand experience of the difficul-

ties faced by the employees and asked the government to replace the buses which was done in hours!

Delivering a lecture in Kochi in 1993 about the economic liberalization initiated by the then Narasimha Rao government, Seshan said there was nothing innovative in the opening up of the Indian economy. “This was what C.Rajagopalachari had told them in 1950 itself. But it fell in deaf ears as Rajaji (pet name of Rajagopalachari) had dark Salem skin. Since it has come from a fair skinned person, it has been accepted now.

Let’s see whether they would be able to break the logjam and save the Indian economy,” Seshan had said.

President’s rule imposed in Maharashtra; Congress, NCP say no decision yet on Sena proposal

President’s rule was imposed in Maharashtra on Tuesday evening after Governor Bhagat Singh Koshyari in a report to the Centre stated that formation of a stable government was impossible in the current situation despite all his efforts, drawing flak from nonBJP parties.

The development came as the political impasse lingered on for the 19th day after the assembly election results were declared, with the Congress and the NCP saying that they have not yet taken any decision on Shiv Sena’s proposal of forming a government, which they received only on Monday, and will hold further discussions.

At a joint press conference in Mumbai with Congress leaders deputed by Sonia Gandhi to hold talks with him, NCP president Sharad Pawar said the two parties will discuss and evolve a consensus on what should be the policies and programmes if the Shiv Sena was to be supported.

Congress leader Ahmed Patel insisted no final decision can be taken without formulation of a common minimum programme by the three parties. He also condemned the imposition of President’s rule and said the Congress was not given an opportunity to form government.

Earlier in the day, the Union Cabinet chaired by Prime Minister Narendra Modi considered the report of the Governor to the President that was submitted at noon.

The Cabinet recommended that the President issue a Proclamation under Article 356(1) of the Constitution imposing President’s rule in Maharashtra

and keep the state legislative assembly under suspended animation.

“President Ram Nath Kovind has signed the proclamation,” an official said In his report, the governor said that a situation has arisen in the state “in which it is impossible to constitute and/or form a stable Government in the state”, officials said The governor noted that he made attempts to explore the possibility of formation of government by having appropriate communications with all political parties which could have formed the government in alliance with other political parties, but they have not succeeded.

“He is satisfied that the government cannot be carried on in accordance with the Constitution, (and therefore) has today submitted a report as contemplated by provision of Article 356 of the Constitution,” said a tweet from the governor’s office.

After the BJP declined to form the government and the Shiv Sena failed to get letters of support from the NCP and the Congress, Koshyari had on Monday night asked the Sharad Pawar-led NCP to express its “ability and willingness” to stake claim to form government in the state by 8.30 pm on Tuesday.

However, the Governor, is his report, noted that the NCP on Tuesday morning conveyed to him that the party needed three more days to gather requisite support.

The governor felt that as already 15 days had passed, he was not in a position to give more time, the officials said.

President’s Rule can be re-

voked before the six-month period if a situation emerges for formation of a stable government, the officials said.

In the assembly polls held last month, the BJP won 105 seats, followed by the Shiv Sena (56), the NCP (54) and the Congress (48) in the 288-member House. Despite their alliance getting a majority, the BJP and the Shiv Sen parted ways following disagreement over powersharing with the Sena insisting on the chief minister’s post.

An angry Shiv Sena, which was trying to cobble together a non-BJP government with support from the NCP and the Congress, moved the Supreme Court challenging the governor’s decision on Monday to not grant it the three days to submit the letter of support for government formation in the state, but failed to get an urgent hearing.

“The Supreme Court has asked us to mention the writ petition at 10.30 am on Wednesday before the court,” Advocate Sunil Fernandes, who filed the petition on behalf of the Shiv Sena, told PTI. He said a second petition challenging the imposition of President’s rule in the state is being readied. “The decision on when to file it (fresh petition) will be taken tomorrow,” he said.

In its petition, the party termed the governor’s decision “unconstitutional, unreasonable, discriminatory, capricious and mala fide”.

The Congress was scathing too with its chief spokesperson Randeep Surjewala hitting out at the governor and the BJPled Centre saying they had not only played a “cruel joke” on

democracy, but had also trampled upon constitutional practices with their actions.

He also questioned the Maharashtra governor for the “arbitrary” allotment of time to the NCP, Shiv Sena and the BJP to prove support for government formation.

“The governor and rulers in Delhi have done a grave injustice to the afflicted farmers and the common people of Maharashtra,” he said “This is unashamedly dishonest & politically motivated,” Surjewala said on the governor’s report.

The Shiv Sena had suffered a setback in its efforts to form a non-BJP government in Maharashtra on Monday with the Congress at the last moment announcing its decision to hold more talks with ally NCP on supporting the Uddhav Thackeray-led party.

Congress’ Kapil Sibal, who will represent the Shiv Sena in the apex court, told reporters that the Maharashtra governor is working on the directions of the BJP-led central government and alleged that President’s rule has been imposed to facilitate horse-trading.

“That is the whole purpose of the exercise. Allow President’s rule, give sufficient time to yourself and then use money power, get others legislators on board. This is misuse of authority and highly immoral,” he said.

After the Congress-NCP meeting on Tuesday evening, Uddhav Thackeray said the three parties will work out a formula for formation of a government.

He said the Sena had contacted the Congress and the NCP for first time on November 11 and his party also needs a clarity on the Common Minimum Programme (CMP) just like them.

Asked whether he has officially broken the alliance with the BJP, Thackeray said, “If it is broken, it is by them and not me. They lied and tried to prove me a liar.”

He reiterated that sharing the CM’s post was decided before the assembly polls, but the BJP did not honour this commitment.

“It is not true Hindutva when you are in favour of Ram temple, but break promise,” Thackeray said.

Taking a jibe at the governor, he said, “We had asked for 48 hrs but the Governor gave us six months (to form government)”.

Congress chief Sonia Gandhi had earlier spoken to Sharad Pawar on the phone and had authorised Ahmed Patel, Mallikarjun Kharge and K C Venugopal to hold discussions with the NCP chief on the issue of forming the state government.

Gandhi also held talks with the party’s core team members A K Antony and Venugopal at her residence.

Patel is also learnt to have spoken to Pawar over working out modalities with the NCP on government formation.

In the midst of the ongoing political drama, Thackeray and Pawar separately met Sena leader Sanjay Raut at Mumbai’s Lilavati Hospital where the latter underwent an angioplasty procedure.

Raut had led the Sena’s charge for equal share in power with the BJP after the Assembly poll results in Maharashtra.

But that did not work and the alliance came undone.

The ailing leader quoted poet Harivansh Rai Bachchan to reaffirm his party’s resolve to succeed and not give up.

The president has, meanwhile, accepted the resignation of Shiv Sena MP Arvind Sawant from the Union council of ministers.

Sawant had on Monday announced his resignation from the Union cabinet, saying it would not be proper to continue as a union minister when a new government is being formed in Maharashtra.

The Shiv Sena on Tuesday moved the Supreme Court challenging the Maharashtra governor’s decision of not granting it three days to submit the letter of support for government formation in the state but failed to get an urgent hearing in the matter.

The petition is likely to come up before the apex court on Wednesday morning.

The lawyer representing the Shiv Sena told PTI that the apex court registry has informed that it is “not possible to constitute a bench today”.

“The Supreme Court has asked us to mention the writ petition that we filed at 10.30 AM on Wednesday before the court,” Advocate Sunil Fernandes, who filed the petition on behalf of the Shiv Sena, told PTI. He said the fresh/second petition challenging the imposition of President’s rule in the state is being readied.

“The decision on when to file it (fresh petition) will be taken tomorrow,” he said.

The Shiv Sena has sought a direction from the apex court to quash the Governor’s decision, taken on Monday, of not giving it the opportunity to prove majority on the floor of the House.
