Know your product return rights Consumers who find that they no longer like a product that they’ve bought, must depend on the goodwill of the store owner/manager in their quest for a cash refund, as there is no legal protection for consumers with ’buyer’s remorse’ under the Consumer Protection Act (2004). “Consumers do not have a legal right to a cash refund for items they purchase and return, merely because they change their mind, or decide after the fact that the color is wrong, or they made a mistake as to size, etc.,” the Consumer Affairs Commission (CAC) said. However, many retailers will let consumers return said goods for an exchange or for store credit as a gesture of goodwill, provided the approach is made promptly and there is a valid receipt. But consumers do have legal rights to a cash refund if goods purchased are found to be defective. Under Section 24 of the CPA, goods may be returned by a purchaser if s/he: “subsequently discovers that those goods are

defective or different in a material particular from those declared or described. The onus is on the consumer, however, to satisfy certain conditions in order to demand a full cash refund, as stipulated under subsection 3 of section 24 of the Act, including that the goods must be returned in the condition in which they were purchased; or: “with minimal damage resulting from reasonable exposure in the normal course of the consumer’s use of the goods prior to discovery of the material difference between goods received and the goods that the consumer requested.” If there is a dispute as to the condition of the goods, the Consumer Affairs Commission (CAC) is mandated to act as an intermediary. While the duties of the CAC include advocating and mediating on behalf of consumers, under the CPA, it has the legal authority to take matters to court as it seeks resolutions that are acceptable to all parties. Any party that remains dissatisfied with the decision can make further appeal to the courts.
