Professor David Landau’s co-authored article, Law of Democratic Disqualification revieW (forthcoming 2022, with Tom Ginsburg & Aziz Huq), is the first scholarly piece to systematically analyze the complex positive and normative questions raised by disqualification of politicians from seeking office. It offers a positive account of the function that disqualification serves in constitutional ordering, and a normative account of the role that it should play. Drawing on domestic and comparative evidence, it then develops the blueprint of an disqualification‘optimal’regime.

Copyright and Attention 143 (2020), argues that reducing copyright protection may worsen the costs of attention scarcity on consumers of creative expression. Linford argues that preserving copyright protections— especially the derivative right—may have unexpected benefits for consumers, including keeping attention costs in check. Thus, lawmakers and judges should exercise caution before sacrificing the attentionassisting aspects of copyright protection based solely on the intuition that creators could survive with weaker incentives.

In Crowdsourcing Crime Control, 99 texas (2020), Professor Wayne Logan describes the use of crowdsourcing techniques in criminal investigations, of late undertaken by police working alongside amateur web and forensic genetic sleuths, armchair detectives, and others seeking to identify and apprehend criminal suspects. The article discusses how current doctrine is ill-equipped to address this development and provides a framework for its regulation, in the hope of ensuring that the wisdom of the crowd does not become the tyranny of the crowd.

Professor Erin Ryan’s article, and the Takingsification of Environmental Law University of P 2023), takes on the critical but undertheorized question of how to balance private and public interests in critical natural resource commons, including air, water, public lands, energy, and biodiversity resources, all of which are prone to forms of diminution by private exploitation. It identifies several built-in legal biases that favor the protection of private rights in public natural resources in ways that could significantly impact the future of environmental law.

Professor Justin Sevier’s article, 56 U.c. davis exploration of the controversial qualified immunity doctrine from an institutional design perspective. The article presents data from three original psychology experiments suggesting that policymakers ignore the procedural features of the qualified immunity doctrine to the detriment of the doctrine’s popular legitimacy. It further explores recommendations for enhancing the popular legitimacy of the qualified immunity doctrine by maximizing the relational signals that it sends to the public.
