1. PREZZI - I prezzi del listino si intendono al pubblico IVA esclusa.
CICIRIELLO SRL si riserva la facoltà di variare il listino qualora lo ritenesse necessario senza alcun preavviso; sono fatti salvi i soli ordini di merce pervenuti e già confermati dal venditore.
2. ORDINI - Gli ordini sono acquisiti sempre e comunque salvo approvazione del venditore. I tempi di consegna concordati non sono da ritenersi essenziali per l’esecuzione dell’ordine e pertanto non vincolanti.
3. PAGAMENTI - I pagamenti dovranno essere effettuati in base alle indicazioni contenute nella conferma d’ordine.
CICIRIELLO SRL si riserva la facoltà di sospendere la consegna della merce in ipotesi di inadempimento, anche parziale, del compratore.
4. SPEDIZIONI - Eventuali ritardi per causa non imputabile alla venditrice non possono dar luogo a responsabilità o diritto ad alcun indennizzo. L’acquirente prende atto che taluni beni vengono importati dall’estero e risentono dei maggiori tempi di approvvigionamento.
5. CONSEGNE - All’atto della consegna l’acquirente deve controllare il bene ricevuto e rilasciare una dichiarazione che attesti l’avvenuta regolare ricezione e che egli non ha riscontrato evidenti anomalie sui beni oggetto di consegna. In ogni caso, eventuali reclami per aspetti in difformità non rilevati al momento della consegna dovranno pervenire comunque, a pena di decadenza, nel termine essenziale di 10 giorni lavorativi.
6. RECLAMI - Eventuali reclami dovranno pervenire entro 10 giorni dalla data del ricevimento merce; decorso tale termine CICIRIELLO SRL non accetterà più alcun reclamo. La merce potrà esser resa solo dopo autorizzazione da parte di CICIRIELLO SRL. La merce verrà sostituita a seguito di autorizzazione dell’Ufficio Reclami della CICIRIELLO SRL entro trenta giorni lavorativi dal rilascio dell’autorizzazione stessa. Nel rispetto del termine che precede non potranno essere richiesti risarcimenti o rimborsi di alcun genere. Nel caso in cui la merce si presenti difettosa o danneggiata per fatto non imputabile alla CICIRIELLO SRL (es. perché resa al di fuori del suo imballo originario o priva di imballo), le spese di trasporto e di riparazione verranno addebitate al compratore. Nessun reclamo potrà essere fatto se non avrà il regolare pagamento delle fatture.
7. RESI - Non verrà accettata merce in sostituzione se non preventivamente autorizzata da CICIRIELLO SRL tramite apposito modulo di reso. La merce dovrà pervenire in CICIRIELLO SRL, accompagnata da modulo di reso, entro e non oltre 30 giorni dall’autorizzazione e, ove non dovesse pervenire nel termine indicato o priva del modulo, CICIRIELLO SRL riterrà perfezionata la vendita e procederà con la richiesta del pagamento (anche il mancato pagamento di merce non resa nel termine giustificherà la sospensione delle forniture da parte di CICIRIELLO SRL). Nel caso la merce dovesse pervenire danneggiata e priva del suo imballo (o con imballo non integro), CICIRIELLO SRL addebiterà al compratore le spese di trasporto e di eventuali riparazioni.
8. VARIAZIONE CARATTERISTICHE PRODOTTI - CICIRIELLO SRL si riserva il diritto di apportare senza preavviso modifiche dimensionali e/o qualitative per migliorare le caratteristiche dei propri prodotti. I dati tecnici sono indicativi e la ditta declina ogni responsabilità per eventuali errori o inesattezze contenute nel catalogo. Inoltre si riserva il diritto di apportare, in qualunque momento e senza preavviso, tutte le modifiche necessarie a migliorare la qualità degli articoli illustrati nel catalogo.
General sale conditions
1. PRICES - The prices of the price list are intended to the public excluding VAT. CICIRIELLO SRL reserves the right to change the price list if deemed necessary without notice; only for goods already orders and confirmed by the seller are reserved.
2. ORDERS - Orders are always and in any case acquired subject to the seller’s approval. The agreed delivery times are not to be considered essential for the execution of the order and therefore not binding.
3. PAYMENTS - Payments must be made according to the indications contained in the order confirmation. CICIRIELLO SRL reserves the right to suspend the delivery of the goods in the event of non-fulfillment, even partial, of the buyer.
4. SHIPMENTS - Any delays for reasons not attributable to the seller cannot give rise to liability or the right to any compensation. The buyer acknowledges that some goods are imported from abroad and are affected by longer supply times.
5. DELIVERY - Upon delivery, the buyer must check the goods and, when received, issue a declaration certifying that they have been properly received and that he has not found evidence of anomalies on the goods being delivered. In any case, any complaints for non-compliant aspects not presented at the time of delivery must in any case be received, under penalty of forfeiture, within the essential term of 10 working days.
6. COMPLAINTS - Any complaints received within 10 days from the date of receipt of the goods; after this term, CICIRIELLO SRL will no longer accept any complaint. The goods can be returned only after the authorization by CICIRIELLO SRL.
The goods will be replaced following the authorization of the CICIRIELLO SRL Complaints Office within thirty working days from the issue of the authorization. In compliance with the above term, no compensation or reimbursement of any kind may be requested. In the event that the goods are defective or damaged due to a fact not attributable to CICIRIELLO SRL (eg because they were returned outside their original packaging or without packaging), the transport and repair costs will be charged to the buyer.
No claim can be made if he does not have the regular payment of the invoices.
7. RETURNS - Replacement goods will not be accepted unless previously authorized by CICIRIELLO SRL through the appropriate return form. The goods must arrive in CICIRIELLO SRL, accompanied by the return form, no later than 30 days from the authorization and, if it does not arrive within the indicated term or without the form, CICIRIELLO SRL will consider the sale completed and will proceed with the request for payment. (even failure to pay for goods not returned within the deadline will justify the suspension of supplies by CICIRIELLO SRL). If the goods arrive damaged and without their packaging (or with packaging that is not intact), CICIRIELLO SRL will charge the buyer the transport costs and any repairs.
8. VARIATION OF PRODUCT FEATURES - CICIRIELLO SRL reserves the right to make dimensional and/or qualitative changes without prior notice to improve the characteristics of its products. The technical data are indicative and the company declines all responsibility for any errors or inaccuracies contained in the catalog. It also reserves the right to make, at any time and without notice, all the changes necessary to improve the quality of the items illustrated in this catalog.
