ANewOrleans-basedmusician, Wickisamembershipandindustry relationsrepresentativewithThe RecordingAcademyandworkedwith Phippsandhiswife,AngeliquePhipps, toadvocateforthebill.National representativesofTheRecording Academy,theWarnerMusicGroup, theAmericanCivilLibertiesUnion (ACLU)andotherorganizationsalso pushedforthechanges.

“Itsoundsreallysimple,anditis simple:We’rejusttryingtoprotect thecreator’srighttocreateart,” Wicksays.

TheRAPActamendsthestate’s CodeofEvidencetoincludecreativeorartisticexpressionasnot admissibleinacriminaltrialtoprove thecharacterofaperson.There areexceptions,though:Artistic

expressioncanbeusedtoestablish proofofmotive,intentandknowledgewhenit’sdirectlyrelatedtothe crimethedefendantisaccused ofcommitting

ThefinalactsignedbyEdwardsalso isnotasstrongastheoriginalHouse Bill475,whichincludedlanguage prohibitingtheuseofanyartistic expressionunlesstheprosecution couldprovebeforeajudgethatit wasrelevanttothespecificcrimeat handbyclearingseveralcriteria.The newchangesalsoputtheburdenon theaccusedtoprovide“reasonable noticetotheprosecutioninadvance oftrialassertingthattheevidenceis creativeorartisticexpression.”

Onlytimewilltellifandhowthe changeswillprotectartistsincourt, butPhipps,Wickandotheradvocates feelit’sanimportantstepforward.

“Forme,thenextstepistogetthis passedonthefederallevel,”Phipps says.“Iwanttomakesurethisart can’tbeusedtojudgeyourcharacter. Iwantthesameprotectionsand thesamebenefitofthedoubtthat artistsinotherindustriesget.”

Thedeathrowapplicants areseekingcommutations—reductionsoftheir sentencesfromdeathtolifeinprison withoutbenefitofparole—notrelease fromprison,Edwardswroteinaletter topardonboardmembersonAug.9.

“Absentafindingbythecourtof actualinnocence,noneoftheseindividualswillbereleasedfromprison, ever,iftheseapplicationsaregranted,” headded.

CitinghisCatholicfaithandthe “imperfectnatureofthecriminal justicesystem,”Edwardsnotedinhis letterthat“actualinnocence…has beenprovenfartoooftenafterimpositionofthedeathpenalty.”

AdayafterEdwards’letter,the PardonBoard—whichconsistsoffive members,allappointedbyEdwards —scheduledhearingsfor20ofthe56 deathrowinmates.Thatdecisiondrew praiseaswellascondemnation.

CatholicArchbishopGregory Aymondissuedastatementinsupport, adding,“Wecontinuetoprayforthe victimsandtheirfamiliesandfortheir healingandforanendtoviolencein ourcommunities.”

CeceliaKappel,executivedirector oftheCapitalAppealsProject,aNew Orleans-basedgroupthathelped organizethemassappealbydeath rowinmatesinJune,said,“Weare confidentthat,giventhemanyproblemsinherentinLouisiana’sbroken deathpenaltysystem,theboardwill recommendclemencyformanyof thesecases.”

TheLouisianaIceWorksopened onTchoupitoulasStreetin1868.At thetime,theonlyiceinthecitywas importedfromthenortheast,and duringaswelteringsummer,notmuch ofthefrozenproductmadeitswayto NewOrleanscustomers.

AccordingtoreportsinTheDaily Picayune,theLouisianaIceWorks plantdrewwaterfromtheMississippi River,filteredandpurifieditusing salt,ammoniaandheat.Thethreehourprocessproducedsome600 poundsoficeinasinglebatch.

Theicewassoldforlessthantwo centsapound,endingthecity’s dependenceonnaturaliceshipped primarilyfromthenortheast.Local demandsoaredalongwiththecompany’snationalreputation.

TheAugustmeetingwasnoexception.Strolling uptothemicrophoneinhissignatureflip-flops,he deliveredcharacteristicallylong-windedremarks. Butlessexpectedly,however,hoursintotheotherwisemundanemeeting,Burnsideappearedto haveamorepersonalbreakthroughatthepodium.

AddressingCouncilMemberEugeneGreen, whoinapreviousmeetingaskedBurnsidetobe morepositive,hebegan,“Idon’tliketellingpeople positivethings,becauseIwasraisedasachildwith aparentwhosaid,‘Michael,you’rereallysmart, comma,BUT’—andthenproceededtotellmethis orthat,thatI’dgottenwrong.Forinstance,thatI havenocommonsense.

“OneofthethingsCouncilMemberGreenis teachingme,isthatotherpeoplearenotme,and theyreceivecomplimentsdifferentlythanIdo,and it’sbeneficialtothepoliticalprocesstoacknowledgegoodwhenitoccurs.Sohoweverunpleasant thatmaybe—Iwanttosaythankyou,”hesaid.

“Ihopesomeofthemchangetheirbehaviorand seethingsthroughmyeyeballsandbecomeaware thatI’mnotjustthereformyegoorbecauseI’m bored,”hesays.“Thereisalwaysgoingtobethe leastofus,there’salwaysgoingtobethepoor.A societycanbejudgedbythewayittreatspeople whoareatthebottom.”

“Therelationshipwehavewithhim ispersonal,”Giarrussosays.

Thecouncilevenissuedanofficial cityproclamationontheoccasion, recognizinghimasa“staunch communityadvocate”who“hasled theCityanditsstakeholderstoimplementseveralpositiveimprovements, including…removingabandoned tires,cuttingovergrownlots,demolishingblightedproperties,removing abandonedpayphonekiosks” andmore.
