In the month of November, GCA will celebrate its 63rd Anniversary it’s also the month we recognize our Excellence in Construction Award winners and name our Contractor of the Year for 2022. This is GCA’s premier awards event of the year and we are looking forward to seeing some excellent projects. The overall winning project will be sent to compete on the national stage during the Associated Builders and Contractors National Excellence in Construction Awards in the 2023 ABC National Convention in Kissimmee Florida. Lastly, we celebrate National Apprenticeship Week (NAW) from November 14 – 20, 2022. NAW is a nationwide celebration where industry, labor, equity, workforce, education, and government leaders host events to highlight the successes and value of Registered Apprenticeship for re-building our economy, advancing racial and gender equity, and supporting underserved communities. NAW is an opportunity to highlight how Registered Apprenticeship, a proven and industry-driven training model, provides a critical talent pipeline that can help to address some of our nation’s pressing workforce challenges such as rebuilding our country’s infrastructure, addressing critical supply chain demands, supporting a clean energy workforce, modernizing our cybersecurity response, and responding to care economy issues.

In October, GCA celebrates Careers in Construction Month with a proclamation signing by Governor Lou Leon Guerrero in the presence of our GCA members during our September 21st General Membership Luncheon meeting at the Hilton Marianas Ballroom. GCA now joins our affiliate Associated Builders and Contractors (ABC) Chapters in proclaiming the month of October as Careers in Construction month. We start our Careers in Construction Month with our Annual GCA Family Day Picnic to kick off our celebration. Later in the month, GCA will host Construction Warriors, a career exploratory event for middle and high school students where participants have the opportunity to talk to people in the construction industry and also get a firsthand experience in operating the tools and equipment of the construction trades. This event will be held at the GCA Trades Academy Facility in Tiyan. We are expecting over two hundred participants during the 2-day event.

We are heading into our busier months this time of year. We are excited for our upcoming 2022 GCA Construction Industry Trade Fair and Expo and our Meet the Generals event on September 29th and 30th at the Father Duenas Memorial High School Phoenix Center. Our last event was held in 2018 and we have not had this event since then. So, you can imagine how excited we are to hold another event like this after four years. The Construction Industry Trade Fair and Expo allows our members to display their products and services, not only to those in the industry, but also to consumers who are looking for home builders and new product lines being offered in the residential housing market. The GCA Construction Industry Fair and Expo is a FREE event and open to industry and the general public.

The Meet the Generals event, which runs parallel to the fair and expo, allows smaller contractors, material and equipment suppliers, and other ancillary service providers to meet face-to-face with various MACC contractors in a “speed dating” format to show their company’s capabilities and plan for future meetings. This event provides networking opportunities for the smaller subcontractors to meet face-to-face with the larger MACC contactors who are also seeking opportunities for small business utilization goals on their large projects. It’s a solution where everyone benefits for all parties involved.

SAME Guam Post President, Chuck Hazzard III, PMP, attended the 2022 Post Leaders Workshop (PLW) held in Ft. Lauderdale, FL from August 7 9, 2022. Held each year, the PLW brings together leaders of SAME Posts from across the globe to share best practices, discuss areas of need, and learn how to get volunteers engaged and provide value to members at the local level. At our August General Membership Meeting, Chuck shared his notes with the Guam Post. SAME National has put together a Post Leaders Reference Guide that is a great resource for any current or prospective SAME member.

The SAME Guam Post is organizing the 2022 Guam Industry Forum which will be a three day event, scheduled from November 14 16, 2022, at the Dusit Thani Guam Resort. Hundreds of government and industry representatives are projected to attend the forum.

the Contractor (referred to as the Principal ). The Principal is to perform the work as contractually outlined in the underlying contract, plans, specifications and general conditions which all detail what the Principal is expected to do and within what time frame.

Bid Bonds: Bid bonds are most frequently mandated on public/gov’t projects. If/when required, the bid bond will be provided to the owner (government) by the Prime Contractor as part of the contractor’s bid submission. The bid bond guarantees that the bid was placed in good faith and that the contractor, if awarded the contract, will enter in to the contract and provide the required Performance and/or Payment bonds. The bid bond is usually a set percentage of the total bid amount (usually 5% to 20% of the bid). In the event that the contractor fails to enter in to the contract or fails to provide the requirement Performance/Payment bonds, the owner has the right to claim to the surety for an amount up to the full penalty of the bid bond (ie. the full 5-20%). The amount of the claim depends on how much additional costs the owner incurs if the second-low contractor is to be selected in lieu of the low bidder.

Surety is a three party arrangement where one party (the contractor, referred to as the Principal ) has a contractual obligation to a second party (the owner, referred to as the obligee); with a third party (the surety) being a guarantor of the first party, both jointly obligated to the owner/obligee.

In due course they will be able to close their bond file (when appropriate) without much involvement. However, if the contractor/principal should fail to perform on the job, or fail to pay certain vendors, then the surety would become much more involved with the Obligee (and Contractor/Principal) in finding, and possibly funding, a remedy to the situation.

While the Surety remains as surety, the subcontractor in this case would be the Principal of a subcontractor bond, and the Prime Contractor – as beneficiary of the bond – would become the Obligee. I wanted to note the differences when the bonded contractor (Principal) is a subcontractor as opposed to the Prime. If you are reading this from the prospective of a bonded sub, you’ll want to note the subtle differences in identity of the three parties as you read further below… Now back to our regularly scheduled program…]

Let’s begin with describing the basic bond arrangement and the parties involved…

the Obligee: The obligee is the party for whom the contractor is performing the work. The obligee, usually the project owner, has little expected of them with respect to the bond obligations. They, of course, must adhere to the contract terms and (perhaps most importantly) pay the Principal (contractor) as contractually agreed. Otherwise, there is little required of the Obligee.

Performance bonds: The performance bond protects the owner (Obligee) from financial loss due to the contractor’s failure to perform in accordance with the contract, plans and specifications. If, on a bonded project, a Principal fails to perform accordingly, the owner has recourse to file a claim with the surety. The surety must then investigate and, if appropriate, step in and remedy the situation. They can do so by: 1) facilitating a bailout plan with the original contractor-Principal (if agreeable to the owner), or 2) the surety can find an acceptable replacement contractor at the surety’s expense, or 3) the surety can negotiate a financial settlement with the Obligee/owner.

There are basically three primary types of bonds pertaining to contract surety. These are: Bid bonds, Performance Bonds and Payment Bonds

If all goes well, the surety will have little to do (and little communication with the owner/obligee).
