City Manager’s Message By: Jon McMillen, La Quinta City Manager Happy July to our Gem of the Desert! July also marks my one-year anniversary as your City Manager. It has been an extraordinary year! I can honestly say that I never expected my first year as City Manager to be what it has been. I embraced the challenge and the commitment to La Quinta, but to be in the midst of a pandemic is unprecedented. However, I am so proud of this community and want to thank you for your continued efforts in helping to contain the spread, making needed adjustments in your daily lives, getting tested and in supporting each other through it.

Developed and supported Al Fresco outdoor dining program for local businesses providing more flexibility to utilize outdoor spaces for dining. Completed phase 1 and 2 of the Village Complete Streets Project. Completed Highway 111 Corridor Area Plan.

It has been disappointing that we were not able to hold many of our annual Spring events, but we will look forward to safely resuming our community festivities when gatherings are allowed. Until then, thank you for the opportunity to serve as your City Manager. I follow in the footsteps of many great leaders here in La Quinta and I will continue to do my best to ensure that our community continues to be the Gem of the Desert.

This year has continued to be a productive one for the City. We have completed many projects that have brought value to our residents and visitors alike. Even during a pandemic, City Staff continued to complete projects for the good of the City and its residents. These include: • • •

Ensured continuity of essential City services during the COVID-19 pandemic. Established a $1.5 million Small Business Emergency Economic Relief Program for local businesses. Supported those affected by the pandemic by establishing a food distribution partnership, childcare at the La Quinta Museum, and manufacturing face shields at Creation Station for local hospitals. Launched a comprehensive regional police service delivery study between the cities of La Quinta, Indian Wells and Palm Desert. Initiated the first Fire Service Delivery Study for the City to explore best practices and find efficiencies. Evaluated and updated Development Impact Fees. Replanted the medians on Eisenhower Street. Completed the new Traffic Operations Center. Completed Eisenhower Drive drainage improvements, Dune Palms Road Widening, Cove public restroom and trailhead improvements, Highway 111 auto dealership signage, electric vehicle charging stations on Highway 111, and a Highway Safety Improvement Program to install fiber optic cable citywide.

Financial Gems Social and Private Golf Club Tax Update: Unrelated Business Income Taxes Just Got Complicated Submitted by: Robert Hendrix, Osborne Rincon CPAs With the majority of golf clubs being re-opened in the past couple of weeks, it seems apropos that the IRS would be updating the regulations on how taxes will be computed on the private social and golf clubs. In general, private clubs are considered exempt from income taxes except for income derived from unrelated activities including greens fees, meals, equipment rentals or purchases and facility rentals by non-members. With costs increasing and Boards not wanting to raise dues – and now with a pandemic to boot – clubs are trying to find ways of increasing revenues. Encouraging non-members to use the facilities seems to be a tempting way to fill that void. Before the latest update, club controllers had to maintain three separate profit and loss statements for its member, non-member and investment revenue. With the aggregate income from all of the non-member activities being pooled together with expenses, this creates an amount that clubs would pay tax on. The changes that have been proposed will create a nightmare for controllers and will have clubs taking a second look on the value of bringing in non-member revenue.

Gross-to-Gross Method Abolished: Clubs have traditionally been able to use the gross-to-gross method to allocate expenses to an activity. Example: If food and beverage reported a loss in its total operations, it was deemed reasonable to take the same loss percentage to the non-member revenue. This may no longer be deemed a reasonable method to use.

These changes will most likely generate cause for activities that were previously not being taxed to ones that may have high tax consequences. This change has not been finalized, but could go into effect this year. Since the IRS has been wanting to make these changes for a while, it doesn’t appear that they will be going away. Separate Accounting for Each Activity: No longer will clubs have just three profit and loss statements. It is proposed that clubs will now have to create a profit and loss for each separate activity. That means that a club would take greens fees as a separate business from food and beverage, tennis activities, pickleball, facility rentals, investments, etc. The losses from one of these activities will not be able to offset income from any other activity.
