FROM THE ARTISTIC DIRECTOR FOR THOUSANDS OF YEARS, THE THEATER HAS been a place for entertainment, for inspiration, for catharsis. A space for questioning and for examining the most difficult issues in our society through a specific dramatic lens. At a time when the epidemic of sexual assault is more a part of our national conversation than ever, Anna Ziegler’s world premiere play Actually is a deeply and delicately nuanced look at a college campus rape scenario that compels us to lean forward and engage. While the canon of existing plays certainly reflects our current universal human truths, this new play uniquely responds to the most urgent questions of today’s world. This story — of the desire to fit in, of the startling ways communication can crumble, of the turmoil of being young and drowning in a culture of mixed messages — could not be more immediate, especially given our proximity to a college campus. We are thrilled to welcome Anna and director Tyne Rafaeli to the Geffen family. Tyne has brought together a team of designers who have artfully created an intimate, fluid space for this back-and-forth to take shape. With great empathy, cast members Samantha Ressler and Jerry MacKinnon bring their young characters to life. On a personal note, I thank you for making my last seventeen years as Artistic Director such an unmitigated joy. This theater, the Audrey, was only a dream — a parking lot, in fact — when my tenure at the Geffen began. With its creation came new plays, an expanded artistic vision and an entirely new audience — you. Your willingness to engage in and experience new and often unconventional work has allowed me to encourage artists to bring their boldest ideas to fruition. My privilege has been to watch these plays grow from the kernel of an idea to spectacularly staged productions. What a rich, wild and rewarding ride it has been. Thank you. Enjoy the show! HOW TITLE IX AND THE “DEAR COLLEAGUE LETTER” SHAPE POLICY REGARDING CAMPUS SEXUAL ASSAULT BY AMY LEVINSON

THE QUESTIONS AT THE CENTER OF ANNA ZIEGLER’S BEAUTIFUL AND COMPLICATED PLAY Actually revolve in part around how we categorize and assign names to ambiguous or troubling circumstances in an effort to understand them. In this case, the category is sexual assault and for this, there are strict guidelines in place for universities to handle each individual situation with an overall statute. Actually explores where the complexities and failures of humans come into play in these proceedings. But what are the actual rules? What are the legal statutes in place to protect students? It begins with what is known as Title IX. Title IX of the Education Amendments of 1972 states that “no person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.” While the original amendment suffered from vagueness, subsequent Supreme Court decisions in conjunction with the U.S. Department of Education have expanded the scope of this to include the prohibition of sexual harassment of students, including acts of sexual violence. Failure to comply with the enforcement of this statute puts an institution at risk of losing federal funding. P4  PERFORMANCES  MAGAZINE

In 2011, to further specify the responsibilities of institutions to handle these matters with the upmost diligence, the Department of Education published guidance materials. These guidelines, known as the “Dear Colleague Letter,” addressed in detail how to handle cases of campus sexual violence. Somewhere between an inquiry and an in-house trial, campus proceedings seek to address these very individual cases with some sort of methodology. These procedures are the framework in which Actually takes place, and include: • Disseminating a notice of nondiscrimination • Designating at least one employee to coordinate an institution’s efforts to comply with and carry out its responsibilities under Title IX • Adopting and publishing a clear procedure for providing a prompt and equitable resolution of discrimination complaints It is important to note that each institution is responsible for designing its own procedures for examining these cases. While the “Dear Colleague Letter” gives parameters, the scrutiny to which these cases are subjected can vary greatly from place to place. Additional provisions required by Title IX: • Institutions must have a Title IX coordinator who has an adequate legal understanding of sexual harassment and sexual violence. School law enforcement must also have training in these areas.


THE LETTER AND THE LAW • All institutions are required to adopt and publish grievance procedures that may include mediation, counseling and protection from dealing directly with the accused. • Adequate, impartial investigation of complaints including the opportunity for both parties to present witnesses and other evidence. There is a large focus on the procedures being equitable between the complainants and accused. • The school will conduct a timely investigation of the complaint and notify both parties of the outcome. A typical case should be resolved within 60 days of the initial complaint being filed. In addition to these legal proceedings, the letter includes provisions for education and prevention of sexual harassment and violence. Complainants are entitled to safety measures that might include campus escorts and the removal of the accused from the complainant’s classes. While this is a very broad overview of the detailed 14 page letter prepared by the U.S. Department of Education, it makes clear one extremely troubling truth. The very fact that there is a nationally recognized procedure for campus rape cases demonstrates how startlingly widespread this problem has become. Some troubling statistics: • One in five women and one in sixteen men are sexually assaulted while in college. • Freshmen and sophomores are at greater risk for victimization than juniors and seniors. • More than 90% of sexual assault victims on college campuses do not report the assault. • 63.3% of men at one university who self-reported acts qualifying as rape or attempted rape admitted to committing repeat rapes. So while there is a formal proceeding when a victim comes forward, clearly the system in place is doing very little to make victims comfortable enough to do so. Proving victimization in a culture that can be judgmental of victims is an uphill, humiliating and ongoing battle. And the lasting effects on both parties are profound. Further, there has been backlash in regards to the implementation of the Title IX practices with questions about fairness to the defendants in these cases. Some critics of the system refer to an overcorrection that infringes on the rights of the accused. “Sexual assault on campus is a serious problem. But efforts to protect women from a putative epidemic of violence have led to misguided policies that infringe on the civil rights of men. Under the new system, there will be no hearing for the accused, and thus no opportunity to question witnesses and mount a defense. Harvard University, the professors wrote, is ‘jettisoning balance and fairness in the rush to appease

certain federal administrative officials.’”1 The system is flawed for both the victim and the accused. And legal recourse means that the problem has been addressed too late. The “Dear Colleague Letter” does lay out procedures for prevention and education but even still, the very definition of rape continues to be reductive. It is synonymous with violence and it has been shown that oftentimes non-consent comes in the form of capitulation based on fear, embarrassment, anxiety, or even drunkenness. Actually is a study of these nuances. It not only forces us to look at the issue of rape through the eyes of both parties, but the variations on what rape means and how we as both audience and jury bring preconceived notions into this already fraught conversation. What is encouraging, though, is how much sexual violence both on campus and off has become part of the national conversation. A victim at Stanford University, known only as Emily Doe, wrote an open letter (Victim’s Impact Statement)2 when her attacker, Brock Turner, was being sentenced. This incredibly detailed and gut-wrenching explanation of the crime was brutal not only because of the violence of the rape itself, but also the aftermath of how she was treated when she pursued a case against her attacker. After her letter went viral, former Vice President Joe Biden responded with his own letter.3 He praised Emily Doe for her bravery, saying “you are a warrior — with a solid steel spine,” and demanding that as a nation we do better to protect women by raising men who do not perpetuate this pandemic. What Emily Doe’s letter ignited, Biden sought to continue by pushing the conversation into the light. He impresses upon us that we have failed these victims and we must do better. He and others launched the It’s On Us campaign built on the idea that we are responsible for certain action to combat sexual violence — that it’s on all of us: • To recognize that non-consensual sex is sexual assault. • To identify situations in which sexual assault may occur. • To intervene where consent has not or cannot be given. • To create an environment in which sexual assault is unacceptable and survivors are supported.4 While these university inquiries are far from perfect, the inclusion of sexual harassment and assault in Title IX is a step in the right direction. And a play such as Actually recognizes the need to examine each case with great care until such time that sexual violence is no longer an everpresent threat. 1

ANNA ZIEGLER (Playwright) Anna Ziegler’s play Photograph 51, produced on the West End starring Nicole Kidman and directed by Michael Grandage, won London’s 2016 WhatsOnStage award for Best New Play. It has been produced around the country and the world, most recently in Hamburg, Rome and Stockholm. Her play Boy, which premiered Off-Broadway in a Keen Company/Ensemble Studio Theatre co-production, was nominated for the 2016 Outer Critics Circle John Gassner Award and will be produced at TimeLine Theatre in Chicago next season. The Last Match premiered at The Old Globe and was nominated for the 2016 San Diego Theatre Critics Circle Outstanding New Play award; it will be produced at Roundabout Theatre Company this fall. Following the Geffen Playhouse production, Actually will be produced at the Williamstown Theatre Festival and Manhattan Theatre Club. The Wanderers, commissioned by The Old Globe, will premiere there in 2018. Ziegler is writing a television pilot for AMC/ Sundance and a screenplay for Scott Free Productions. Oberon Books has published a collection of her work entitled Anna Ziegler: Plays One. Her other plays are published by Dramatists Play Service. She

holds a B.A. from Yale and an M.F.A. from NYU’s Tisch School of the Arts. TYNE RAFAELI (Director) Tyne Rafaeli was born in London and trained at the Guildhall School of Music & Drama and Columbia University. She has directed classics, new plays and musicals in London and the U.S. Her work has been seen at Classic Stage Company, the Atlantic Theater Company, Williamstown Theatre Festival, Two River Theater, New York Stage & Film, The Playwrights Realm, PlayMaker’s Rep, Goodspeed, Julliard, Great Lakes Theater, American Players Theatre, Idaho Shakespeare Festival, the Eugene O’Neill Theater Center Playwrights Conference and PlayPenn, among others. Before joining the Geffen she was the Casting Director for Steppenwolf Theatre Company in Chicago where her favorites include Frank Galati’s adaptation of The Grapes of Wrath (also La Jolla Playhouse, National Theater in London and Broadway, where it received the Tony Award for Best Play), the original production of Steve Martin’s Picasso at the Lapin Agile (and subsequent productions including Westwood Playhouse and Briar Street Theater in Chicago), Austin Pendleton’s Orson’s Shadow and Charles L. Mee’s Time to Burn. Broadway

transfers include One Flew Over the Cuckoo’s Nest (Tony Award for Best Revival) and The Song of Jacob Zulu. She teaches auditioning at Steppenwolf West and is a member of the Casting Society of America and the Ovation Rules Committee. WILLIAMSTOWN THEATRE FESTIVAL For over six decades, Williamstown Theatre Festival, recipient of the Tony Award for Outstanding Regional Theatre, has brought emerging and professional theatre artists together to create a thrilling festival of premiere work alongside fresh, new productions of the western canon. RANDALL ARNEY (Artistic Director) Randall Arney has been a theater professional for over 30 years and has served as Artistic Director of the Geffen Playhouse since 1999. In addition to his artistic programming and oversight at the Geffen, Arney has helmed many productions for the theater, most recently

New York design credits include the Public Theater, New York Theatre Workshop, Signature Theatre, Second Stage Theatre, Performance Space 122 and Kitchen Theatre Company. He is the lighting/video designer for ChameckiLerner Dance Company (Costumes by God, Visible Content, Hidden Forms, I Mutantes Seras, Por Favor and Não Me Deixe), which has performed in the United States and Brazil. Awards have included the L.A. Drama Critics Circle Angstrom Award for Career Achievement in Lighting Design, multiple Bay Area Theatre Critics Circle Awards, a “Drammy” for best lighting, as well as a Lucille Lortel nomination for The Good Negro at the Public Theater. Mr. Chu is on the lighting design faculty at California Institute of the Arts.

Arney is an ensemble member and former Artistic Director of Chicago’s Steppenwolf Theatre where his directing credits include: Slowgirl, The Seafarer, The Beauty Queen of Leenane, Death and the Maiden, Curse of the Starving Class, Killers and The Geography of Luck, among others. Arney also directed Steppenwolf’s world premiere of Steve Martin’s Picasso at the Lapin Agile, as well as the subsequent national and international acclaimed productions. Mr. Arney’s acting credits with Steppenwolf include Born Yesterday, Ghost in the Machine, The Homecoming, Frank’s Wild Years, You Can’t Take it with You, Fool for Love, True West, Balm in Gilead and Coyote Ugly. As the Artistic Director for Steppenwolf from 1987 to 1995, he oversaw the creation of a new stateof-the-art theater which is Steppenwolf’s current home. Broadway transfers under his leadership include The Rise and Fall of Little Voice, The Song of Jacob Zulu (six Tony Award nominations) and The Grapes of Wrath (1990 Tony Award, Best Play). Mr. Arney has an M.F.A. degree in Acting from Illinois State University and has taught master classes and workshops at UCLA, Steppenwolf, around the U.S. and in Tokyo.

GIL CATES, JR. (Executive Director) As Executive Director, Gil Cates, Jr. leads the Geffen Playhouse in its mission to inform, entertain and inspire diverse audiences with live theater of the highest caliber — both within and beyond the nonprofit theater’s walls. He has proudly served on the Geffen Playhouse Board since 2012. Gil’s theater credits include the award-winning Names (Matrix Theatre Company) starring Dixie Carter and Greg Mullavey, The Night I Knocked Out Joe Frazer and Lost 90 Pounds (Gardner Stage Theater), Three Sisters and David Mamet’s A Life in the Theatre (both at Syracuse Stage). Gil’s film credits include The Surface (starring Sean Astin and Geffen Playhouse alumnus Chris Mulkey), Jobs (starring Ashton Kutcher, Josh Gad, Dermot Mulroney, as well as Geffen Playhouse alumni Matthew Modine and Ron Eldard) and the 2011 feature film Lucky (starring Colin Hanks, Ari Graynor, AnnMargret and Golden Globe winner Jeffrey Tambor). In addition, Gil produced and directed the critically acclaimed

Life After Tomorrow, featuring Sarah Jessica Parker, which won best documentary at the Phoenix Film Festival and later premiered on Showtime. His other films include Deal (starring Burt Reynolds, Bret Harrison and Charles Durning), The Mesmerist (starring Geffen Playhouse alumnus Neil Patrick Harris), and the critically acclaimed independent film Order of Chaos. Gil’s television directorial debut was an episode of the NBC comedy Joey, starring Emmy winner Matt LeBlanc. He studied at the National Theatre Institute in Waterford, Connecticut, and holds a B.F.A. in Drama from Syracuse University.

REGINA MILLER (Chief Development Officer) Regina has advised nonprofit institutions, foundations and corporations on strategy, analysis and fundraising. She has consulted for the Clinton Foundation, National Center for Missing and Exploited Children, Eastern Congo Initiative, Charlize Theron’s Africa Outreach Project and Kershaw’s Challenge, among others. Prior to the Geffen, Regina worked for the Simon

Wiesenthal Center/Museum of Tolerance, where she produced an innovative human rights exhibition that traveled to 14 international destinations around Europe, Asia and the U.S. She also served as the Director of Partnerships for Big Brothers Big Sisters of Greater Los Angeles and the Inland Empire, where she led strategic planning and development while executing policies that advanced the organization’s visibility and growth. Additionally, Regina has a strong passion for teaching. After graduating from University of North Carolina School of the Arts, she taught in preschools and kindergartens in New York. From the age of 13, Regina worked as a professional dancer on Broadway as well as with a number of prominent modern dance ensembles. Fusing two of her interests, she created a highly successful program that incorporated dance therapy and creative movement into an early childhood curriculum as well as writing and producing a television show based on this concept. In addition to being a published author and photographer with Tallfellow Press and Prometheus Books, Regina has taught and lectured at numerous schools in New York, Los Angeles and abroad. Regina is a proud co-founder of the Artemis Agency, a philanthropic agency that actively helps clients change the world!

Geffen Playhouse is affiliated with the University of California at Los Angeles, specifically the UCLA School of Theater, Film and Television. Geffen Playhouse values its role as an important educational resource by providing students with master classes, workshops and internships. Students are also able to work and learn from distinguished visiting Geffen artists such as Alan Ayckbourn, Jon Robin Baitz, Annette Bening, Ed Harris, David Ives, Neil LaBute, David Mamet, Donald Margulies, Terrence McNally, John Rando and Kathleen Turner in areas of directing, playwriting, acting, design, dramaturgy, management and production. Geffen Playhouse also draws upon the distinguished experts in the university to enhance the theater’s programs and research.
