Boîte d’origine. Histoire : The Benrus Watch Co. a été fondé en 1921 à New York par les frères Benjamin, Ralph et Oscar Lazrus, des immigrants Roumains. Histoire : Solvil et Titus est une légende dans l’histoire de l’horlogerie. Paul, le fondateur de l’entreprise, fils de la fameuse dynastie des Ditisheim, nait dans le petit cercle des familles industrielles qui dirigent l’horlogerie suisse à l’époque. Il étudie à l’école de l’horlogerie à Chaux-de-Fonds, le berceau historique de l’industrie de l’horlogerie, et reçoit son diplôme à l’âge de 13 ans. Ravissante montre Bovet Favre Leuba, triple calendrier phases lunaires, boîtier en acier inoxydable, Datora avec le très rare mouvement calibre Valjoux 89, joli cadran noir avec chiffres arabes blancs. Histoire : Fleurier, ville natale de Bovet C’est Daniel-Jean-Jaques-Henri Vaucher , un apprenti de Daniel Jeanrichard en 1730. A l’époque la région était surtout connue pour le travail du métal, un débouché naturel du fait des dépôts ferreux découverts aux alentours au XVe siècle. L’horlogerie s’est développé à Fleurie et dans la région à la fin du XVIIIe siècle mais la production était vendu à crédit sur le marché international, le marchandage et les guerres napoléoniennes ont fini par déstabiliser l’économie horlogère de la région. Arrivé au milieu du XIXe siècle, Fleurie ne produisait presque exclusivement que des montres à destination de la Chine, aussi ce sont les montres Bovet qui ont offert une renommée de centre de l’horlogerie à la ville. Bovet n’était ni la première ni la dernière entreprise à s’intéresser au marché chinois. Il y avait aussi entre autres Wiliam Ilbury, Jacques Ullmann, et Vacheron Constantin. Edouard Bovet a découvert le potentiel du marché chinois lorsqu’il était étudiant chez William Ilbury à Londres, il a d’ailleurs emprunté certaines de ses idées. A partir de 1820 Vacheron Constantin dominait le marché impérial au nord de la Chine, tandis que Bovet tenait celui du sud, beaucoup plus peuplé. Si l’industrie de l’horlogerie datait de bien avant, en effet il avait été introduit par quelques horlogers jésuites au XVe siècle, à l’orée du XIXe les montres produites en Chine étaient de si mauvaise qualité que l’arrivée des produits Européens fut rapidement très appréciée.

Histoire : « Il n’y a rien que la Grande Bretagne possède », écrivait l’empereur Quinlong au roi George III, « dont l’Empire Céleste pourrait avoir besoin. » Rien, sauf une chose: la montre. C’était le seul objet auquel l’élite chinoise accordait quel qu’intérêt. Quinlong avait luimême une collection remarquable. Quand la Grande Bretagne utilisait des vaisseaux militaires et l’opium pour essayer de pénétrer le marché chinois, ce fut un homme d’affaires suisse qui trouva la clef. Histoire : Le fabricant de montres Normandie tient son nom du paquebot Normandie. Le nom Normandie et l’ancre représenté sur le cadran le confirme. Le paquebot SS Normandie a été construit à Saint Nazaire, France, pour la «Compagnie Générale Transatlantique». Le navire, mis en service en 1935, était le paquebot de transport de passager le plus grand et le plus rapide de l’époque, et reste le navire à turbopropulseur à vapeur le plus rapide qui ait été construit. Son design innovant et ses intérieurs somptueux le classe parmi les plus beaux. The reports will include the artistic and scientific information known to the Auction House at the date of the sale and the latter will not accept any responsibility for errors or omissions. The descriptions to be found in the catalogue are drawn up by the Auction House and where applicable by the expert who assists the former, subject to notices and corrections given when the lot is presented and included in the bill of sale. Sizes, weights and estimates are given for information purposes only. The coIours of the works included in the catalogue may vary due to printing techniques. The lack of information on the condition of the goods in the catalogue will by no means imply that the lot is in a perfect state of preservation or free from restoration, wear, cracks, relining or other imperfection. The Auction House Cornette de Saint Cyr will deal with auction sales by telephone and absentee bids free of charge. In all cases, the Auction House Cornette de Saint Cyr cannot be held responsible for a problem with the telephone link along with an error or omission in the execution of the absentee bids received. ln the event of two identical absentee bids, preference will be given to the earliest absentee bid. Fifteen days of free storage is offered. Thereafter, the storage will be invoiced at 36 euros inclusive of tax per month and per lot (or 9 euros inclusive of tax per week and per lot). If the article is collected after the beginning of the week payment for a full week will be requested. Furniture and in general terms any bulky articles are stored at our partner’s warehouse. Storage costs are to be paid by the purchaser and will be invoiced directly by our partners to the purchaser with the tariffs in force as following: free of charge the first two weeks of storage ; from the 15th day, a fee of 22,50 € per two week period (the first two weeks after the auction will also be in-

voiced from the 15th day, as well as the following two weeks). In addition to these storage fees, a handling charge of 45 € is to be included (not-invoiced the first two weeks). Export Tax refund The VAT will be refunded to the buyers who are non-European Union residents upon presentation to our accountant of the export declaration (SAD) of the good(s) purchased duly endorsed by the competent customs authority, within 3 months after the sale. The export declaration must mention the auction house Cornette de Saint Cyr as the consignor and the buyer as the consignee of the good(s). The export of the works of art considered as “cultural goods” must be authorized by the Ministry for the Arts (see article L 111-2 of the Patrimony Code). The export to a country within the European Union requires a certificate of export issued by the Ministry of the Arts with a delay up to 4 months. This certificate could be asked by the Auction House on behalf of the buyer after the sale. The export to a country outside the European Union requires a certificate of export as well as an export licence and a customs declaration. In this case, the buyer has to pass through a transit company in order to ask for these export authorizations. The Ministry of the Arts issues or refuses the certificate of export within a maximum delay of 4 months and the licence export need two further weeks to be obtained. The documents required must be presented to the customs officers. The law punishes to penalties the person who exports or tries to export a cultural good without the authorizations required (see article L 114-1 of the Patrimony Code). The works of art are considered as cultural goods according to their age (generally from 50 years) and their value (price with taxes included) which varies by categories (€ 150 000 or more for paintings, € 15 000 or more for prints… ). These thresholds are set by the decree n° 93-124 of the 29th January 1993 and by the European Regulation of the 18th December 2008 (n° 116/2009). The Auction House is not responsible for the delay or the refusal of the export certificate from the Ministry for the Arts. L’absence de mention d'état au catalogue n'implique nullement que le lot soit en parfait état de conservation ou exempt de restauration, usures, craquelures, rentoilage ou autre imperfection. Les biens sont vendus dans l'état où ils se trouvent au moment de la vente. Aucune réclamation ne sera admise une fois l'adjudication prononcée, l'exposition préalable ayant permis l'examen de l'objet. En cas de retrait d'un objet avant la vente par un déposant et après la parution du catalogue ou, en cas de modification du prix de réserve rendant impossible la mise en vente immédiate de l'objet, le vendeur sera tenu de verser à la Maison de Ventes Cornette de Saint Cyr à titre de dédommagement les honoraires acheteur et vendeur calculés sur la base de l'estimation médiane indiquée au catalogue. La remise de l'objet retiré de la vente sera suspendue au règlement desdits honoraires. En l'absence de règlement, l'objet sera à nouveau présenté à la vente selon les termes de la réquisition de vente initiale. Enchères Les enchères suivent l'ordre des numéros du catalogue. Les enchérisseurs sont invités à se faire connaître auprès de la Maison de Ventes Cornette de Saint Cyr avant la vente afin de permettre l'enregistrement de leurs données personnelles. Le mode usuel pour enchérir consiste à être présent dans la salle. Toutefois, tout enchérisseur qui souhaite faire un ordre d'achat par écrit ou enchérir par téléphone peut utiliser le formulaire prévu à cet effet en fin du catalogue de vente ou sur le site www.cornette.auction.fr. Ce formulaire doit parvenir à la Maison de Ventes Cornette de Saint Cyr accompagné d'un relevé d'identité bancaire ou des coordonnées bancaires au

moins deux jours avant la vente. La Maison de Ventes Cornette de Saint Cyr se charge gracieusement des enchères par téléphone ainsi que des ordres d'achat. Dans tous les cas, la Maison de Ventes Cornette de Saint Cyr ne pourra être tenue pour responsable d'un problème de liaison téléphonique ainsi que d'une erreur ou d'une omission dans l'exécution des ordres reçus. Dans l'hypothèse de deux ordres d'achat identiques, c'est l'ordre le plus ancien qui aura la préférence. En cas d'enchères dans la salle pour un montant équivalent à un ordre d'achat, l'enchérisseur présent aura la priorité. Le plus offrant et dernier enchérisseur sera l'adjudicataire. En cas de double enchère reconnue effective par le commissaire-priseur, le lot sera remis en vente, toutes les personnes présentes pouvant concourir à la deuxième mise en adjudication. Paiement La vente est faite au comptant et conduite en euros. Le paiement doit être effectué immédiatement après la vente. Dans l'hypothèse où l'adjudicataire n'a pas fait connaître ses données personnelles avant la vente, il devra justifier de son identité et de ses références bancaires. Les acquéreurs paieront en sus de l'adjudication, par lot et par tranche, les frais et taxes suivants : - De 1 à 150 000 € : 25% HT (30 % TTC sauf pour les livres 26.37 % TTC) - De 150 001 € à 1 200 000 € : 20% HT (24 % TTC sauf pour les livres 21,10 % TTC) Au-delà de 1 200 001 € : 12% HT (14,40 % TTC sauf pour les livres 12,66 % TTC) Pour les lots en provenance d'un pays tiers à l'Union Européenne, il conviendra d'ajouter la TVA à l'import soit : Pour les lots dont les numéros sont précédés du signe : * une TVA supplémentaire de 5,5 % du prix d'adjudication. Pour les lots dont les numéros sont précédés du signe : ** une TVA supplémentaire de 20 % du prix d'adjudication. L’adjudicataire pourra s'acquitter du paiement par les moyens suivants: - en espèces dans la limite de la législation en vigueur. - par virement bancaire. - par chèque avec présentation obligatoire d'une pièce d'identité. Les chèques tirés sur une banque étrangère ne sont autorisés qu'après l'accord préalable de la Maison de Ventes Cornette de Saint Cyr. Il est conseillé aux acheteurs de fournir une lettre accréditive de leur banque pour une valeur avoisinant leur intention d'achat. - par carte bancaire : sauf American Express. Défaut de paiement A défaut de paiement du montant de l'adjudication et des frais, une mise en demeure sera adressée à l'acquéreur par lettre recommandée avec avis de réception. A défaut de paiement de la somme due à l'expiration du délai d'un mois après cette mise en demeure, il sera perçu sur l'acquéreur des intérêts de 1% du prix d’adjudication par mois de retard ainsi des frais de recouvrement avec un minimum de 40 euros. Tout mois de retard entamé génère l’application des pénalités. L’application de cette clause ne fait pas obstacle à l'allocation de dommages et intérêts et aux dépens de la procédure qui serait nécessaire, et ne préjuge pas de

l'éventuelle mise en oeuvre de la procédure de réitération des enchères régie par l'article L 321- 14 du Code de Commerce. Dans le cadre de la réitération des enchères, la Maison de Ventes est en droit de réclamer à l'adjudicataire défaillant le paiement de la différence entre le prix d'adjudication initial et le prix d'adjudication sur réitération des enchères, s'il est inférieur, ainsi que les coûts générés par les nouvelles enchères. La Maison de Ventes Cornette de Saint Cyr se réserve la possibilité de procéder à toute compensation avec les sommes dues à l'adjudicataire défaillant. De même, la Maison de Ventes Cornette de Saint Cyr se réserve d'exclure de ses ventes futures, tout adjudicataire qui n'aura pas respecté les présentes conditions de vente. La Maison de Ventes Cornette de Saint Cyr est adhérente au Registre central de prévention des impayés des Commissaires-priseurs auprès duquel les incidents de paiement sont susceptibles d’inscription. Les droits d’accès, de rectification et d’opposition pour motif légitime sont à exercer par le débiteur concerné auprès du SYMEV 15 rue Freycinet 75016 Paris. Retrait des achats Aucun lot ne sera remis aux acquéreurs avant acquittement de l'intégralité des sommes dues. En cas de paiement par chèque non certifié ou par virement, la délivrance des objets pourra être différée jusqu'à l'encaissement. Dès l'adjudication, les objets sont placés sous l'entière responsabilité de l'acquéreur. Pour l'enlèvement des lots qui n'ont pas été retirés le jour de la vente, il est conseillé de contacter préalablement la Maison de Ventes Cornette de Saint Cyr au 01 47 27 11 24. Les petits tableaux et objets d'art peuvent être retirés sur rendez-vous au 6 avenue Hoche 75 008 Paris, du lundi au vendredi de 9 heures à 13 heures et de 14 heures à 18 heures (17 heures le vendredi). Après un délai de quinze jours de stockage gracieux, ce dernier sera facturé 36 euros TTC par mois et par lot, soit 9 euros TTC par semaine et par lot. Toute semaine commencée est réputée due. Le mobilier, et de manière générale les pièces volumineuses, sont conservés dans les entrepôts de nos prestataires. Les frais de stockage sont à la charge de l'acheteur et lui seront facturés directement par les prestataires selon les tarifs en vigueur soit : gratuité des deux premières semaines de stockage; à compter du 15e jour, une facturation de 22,50 € par période de 14 jours, (y compris les deux premières semaines qui seront facturées à partir du 15e jour, en addition de la seconde période de 14 jours entamée). A ces frais de stockage s’ajoutent des frais de mise à quai de 45 € (non facturés les deux premières semaines. A partir du jour 15, les frais incompressibles de stockage sont donc de 90 € par lot.) Le magasinage des objets n'engage pas la responsabilité de la Maison de Ventes. Le transport des lots est effectué aux frais et sous

l'entière responsabilité de l'adjudicataire. Exportation Détaxe La TVA facturée sera remboursée à l’acheteur qui justifie de sa qualité de résident hors de l’Union Européenne sur présentation auprès de notre service comptable dans un délai maximum de 3 mois suivant la vente de la déclaration d’exportation (DAU) du bien acquis dûment visée par le service des Douanes. Le document d’exportation devra mentionner la société CORNETTE DE SAINT CYR comme expéditeur et l’acheteur comme destinataire du bien. L’exportation des œuvres d’art considérées comme des biens culturels est soumise à autorisation de la part du ministère de la Culture (cf. article L 111-2 du Code du Patrimoine). L’exportation dans un pays de l’Union Européenne est subordonnée à l’obtention d’un certificat d’exportation d’un bien culturel délivré par le service compétent du ministère de la Culture dans un délai maximum de 4 mois à compter de sa demande. Ce certificat pourra être demandé par la Maison de Ventes pour le compte de l’acheteur après la vente. L’exportation dans un pays tiers de l’Union Européenne est subordonnée outre à l’obtention d’un certificat d’exportation, à la délivrance d’une licence d’exportation et à une déclaration en douanes. Dans ce cas, l’acheteur devra s’assurer les services d’un transitaire afin de solliciter les autorisations requises. Le ministère délivre ou refuse le certificat dans un délai maximum de quatre mois à compter de la demande. La licence d’exportation est délivrée dans un délai de deux semaines suivant l’obtention du certificat d’exportation. Les documents requis devront être présentés à la réquisition des agents de douanes. Il convient de préciser que la loi punit de sanctions pénales quiconque exporte ou tente d’exporter un bien culturel sans avoir obtenu les autorisations requises (cf. article L 114-1 du Code du Patrimoine). Les œuvres d’art sont considérées comme des biens culturels en fonction de critères d’âge (généralement au moins 50 ans) et de valeur (prix TTC) qui varie selon leurs catégories (150 000 euros ou plus pour les peintures, 15 000 euros ou plus pour les estampes…). Ces seuils sont fixés par le décret n° 93-124 du 29 janvier 1993 et par le règlement CE n°116/2009 du 18 décembre 2008. La Maison de ventes ne peut être tenue pour responsable des délais ou des éventuels refus de délivrance d’un certificat d’exportation par le ministère de la Culture. Compétence législative et juridictionnelle Les présentes conditions de vente sont régies par le droit français. Toute contestation relative à leur existence, leur validité et leur exécution sera tranchée par le tribunal compétent du ressort de Paris.
