Note Plaster finishes - If you have areas of your bathroom that you wish to paint rather than tile, then you can apply a plaster finish onto your Lux Elements panel. Please note however, that the Lux Elements panel is water resistant, so plaster may take longer to dry than when applied to a traditional plaster board. Tile weight - One of the great features of Lux Elements is its strong adherence to tiles using approved cement based adhesives. This makes Lux Elements an ideal product to use with heavy tiles such as natural stone. Dependant on the size of the tiles, Lux Elements is suitable for tiles up to 50kg per m². The price list in our brochure dated November 2009 supersedes all previous publications with goods being invoiced at prices ruling on date of despatch. Prices are subject to alteration without notice and include VAT.

All Lux Elements products by Simpsons carry a 5 year guarantee, which covers all manufacturing defaults. This guarantee does not cover damage during fitting or misuse.

• The guarantee is only available to original purchasers who have proof of purchase. Re-stocking Charge

Delivery Orders in excess of £50.00 net invoice will not be subject to carriage charge. All Orders below £50.00 will be subject to a fixed charge of £5.00 + VAT. Any claims of non-delivery, shortage or damaged goods must be reported in writing to the company within two working days from the date of delivery. Such claims will not be accepted for deliveries to a third party address.

Returned Goods

• If the product has been installed, Simpsons must be given the opportunity to inspect the product in the installed condition. • If the product is defective in materials or manufacture the original purchaser must contact our Technical Department within 30 days of the fault occurring. If the fault is not resolved the goods should be returned to Simpsons and at our discretion we will refund the purchase price, repair and return the goods to you or send new goods or parts to you as a replacement, this shall constitute our sole obligation under this guarantee.

Goods may only be returned for credit after receiving written agreement from the company. Cancelled orders will be subject to a fixed charged of 25%. Damaged goods will not be accepted.

• Due to a continuous development program, If in our opinion the product has failed under the terms of the guarantee and a replacement is offered but identical goods are no longer available, Simpsons will replace it with our nearest equivalent product.

Retention of Title

• This guarantee covers normal domestic use; it does not cover faults caused by wilful damage, neglect, misuse, inappropriate cleaning, accidental damage and other events outside Simpsons control.

Ownership of goods shall remain in the company until full payment has been received for all goods comprised in this contract. If any goods are re-sold before payment is made the Company’s right of ownership shall be transferred to the proceeds of sale or to the claim for such proceeds.

Payment Payment is to be made by the end of the month following the date of Invoice. Failure to pay may result in the Company declining to accept orders until such time that your account is brought up to date.

A re-stocking charge of 25% will be levied on all returned goods and a further charge will be levied on all returns that need re-packing. Special orders are non-returnable.

CERTIFICATION Lux Elements products are certified for the development, manufacture and sale of hard foam support elements for modern construction. ISO 9001:2000 Their product are protected by patent no. 31 04 955 The tub adhesives and grout are classified for use both in residential and commercial use.

• The guarantee does not cover any product that has been altered or modified in any way without the prior written consent of Simpsons. • If a claim is made under this guarantee, and the defect is not due to faulty materials or manufacture, Simpsons reserve the right to charge the customer at the current hourly rate in respect of any service engineer time. • The guarantee is only valid for products purchased, installed and used for private domestic purposes in the United Kingdom.

Liability

• The guarantee does not cover ex-display units.

All quotations are given and goods sold subject to the conditions that the seller’s liability is limited to goods proved to have been defective in material or workmanship when goods have not been used for the purpose for which they were intended, not fitted correctly, not maintained to the seller’s recommended standards or have been abused or misused.

• The benefit of this guarantee cannot be transferred to a third party. • The guarantee is in addition to and does not affect your statutory rights.
