The California Transportation Commission has announced the allocated $745 million in new funding to 118 transportation projects across California that will provide congestion relief for motorists and bolster the state’s economy.

The allocations include nearly $82 million from Proposition 1B, a transportation bond approved by voters in 2006. In total, nearly $14 billion in Proposition 1B funds have been distributed statewide, according to a CTC news release. The remaining $663 million in allocations came from assorted transportation accounts. In Northern California, the allocations include: Alameda County: $1,174,000 for a Caltrans project to remove and replace old metal median barriers and concrete slab with new concrete median barriers and concrete slabs. The completed project will reduce needed repairs, crews’ exposure to traffic and provide additional shoulder width. Contra Costa County: $5,868,000 for a Caltrans and Metropolitan Transportation Commission (MTC) project to widen eastbound State Route(SR) 4 in Antioch from Hillcrest Avenue to SR160. The project will widen approximately two miles of SR4 from four to six lanes. Also,
$18,910,000 for a Caltrans and MTC project to construct auxiliary lanes in both directions of I-680 between Sycamore Valley Road in Danville and Crow Canyon Road in San Ramon. The completed project will include two miles of auxiliary lanes and shoulders with retaining walls and soundwalls. And, $18,459,000 for a Caltrans project to rehabilitate bridge decks near Richmond at Scofield Avenue and another location at Western Drive. The project will rehabilitate three bridges by replacing bridge decks to maintain structure integrity Tuolumne County: $2,885,000 – near Buck Meadows at Big Oak Sidehill Viaduct on State Route 120, replace deck and seals, and upgrade railing on bridge. San Joaquin County: $41,779,000 – rehabilitate roadway on Interstate 5, from Charter Way to Country Club Boulevard. This includes reconstruction of the existing eight freeway lanes, widening inside shoulders, reconstructing outside shoulders and auxiliary lanes in order to improve safety and ride quality. City of Ripon: $400,000 – Main Street Phase 2 Enhancements. This includes landscaping, installing new decorative architectural features and streetscape on Main Street, from Acacia Avenue to Industrial Avenue. City of Jackson: $455,000 – construct building and ADA accessibility improvements for the Kennedy Tailing Wheels Park Building. Housing Sales Bounce Higher, Good Sign For Construction Industry The recovery of the U.S. housing market is looking steadier and more
sustainable, a trend that will likely add to economic growth in 2012 for the first time in seven years. In a national survey this month, home builders expressed their highest confidence level in years. Goldman Sachs called new home companies an attractive investment. And in May, sales of new homes reached a national two-year high. Purchases, construction and prices are gradually but consistently increasing. Sales of previously occupied homes rose 2.3 percent in July from June to a seasonally adjusted annual rate of 4.47 million, the National Association of Realtors reported last week. Over the past 12 months, sales have jumped more than 10 percent. New-home sales have been strengthening, too. Toll Brothers, a builder of high-end homes, said that it’s enjoying its most sustained demand in more than five years. Construction industry experts say demand for new homes in the Sacramento region is picking up because of historically low mortgage rates and a scant supply of existing homes for sale. Buyers are turning back to new homes, and builders are cautiously increasing output to meet the demand. That’s a big change for an industry that has been a major drag on the economy since the housing bubble burst more than five years ago. Michelle Meyer, an economist at Bank of America Merrill Lynch, forecasts that home construction will add 0.2 percentage points to growth this year. That would make 2012 the first full calendar year in which housing has added to growth since 2005. Continued on next page

News Briefs Hiring picked up in July, which could support more home sales in the coming months. Job growth helps consumers feel more secure about their finances and typically encourages more of them to buy a house. Employers added 163,000 jobs last month, the most since February. 200 Construction Jobs Expected After Agreement Reached On Energy Project Tulare Planning Commissioners have reached an agreement which will allow the construction of a plant to convert cow manure into energy. The company expects to truck in about 500 tons of feedstock a day, consisting of manure, food processing waste like fat, oils and grease as well as food waste. The project, which hopes to open in early 2014, is the first of 6 greenhouse co-digester projects a Newport Beach based company hopes to build in California. The plant will be located on about 14 acres of leased city land southwest of the Tulare waste water treatment plant and is expected to create about 200 construction related jobs, then 30 to 50 ongoing jobs. Another Development Planned For Palo Alto Just months after Palo Alto approved construction of a new fourstory building in a prime downtown location, another major commercial development is preparing to make its way through the city’s permitting process before going up within a few blocks of the University Avenue Caltrain station. Charles “Chop” Keenan, a prominent developer whose other downtown
projects include buildings that house Miyake Restaurant, Wells Fargo Bank and the former Varsity Theatre on University Avenue, is looking to build a four-story building on Hamilton Avenue, near High Street. The 26,774-square-foot project at 135 Hamilton Ave. would stand just three blocks away from the Lytton Gateway development, a four-story project that the City Council approved in May despite widespread concern from residential neighbors about how the building would affect parking on their streets. Much like Lytton Gateway, Keenan’s proposed development would consist largely of office space. Its bottom three stories would all be dedicated to commercial use, while the top story would include two apartments, according to the application. The building would also include a one-story underground parking garage with 23 spots and “rotating parking lifts” that would allow cars to be stacked. Manteca Fire Station To Go Out To Bid This Month Requests for proposals to finish the design and construct the new $3.579 million fire station going on the north side of Lathrop Road just west of Union Road will go out this month. Fire Chief Kirk Waters told the City Council last week the goal is to start construction in early 2013 and have the fire station up and running in 2014. The proposed station on the north side of Lathrop Road west of Union Road is part of the 1,406-home Del Webb at Woodbridge neighborhood. The design for the station incorporates single-family home elements on the sides that will face future homes and commercial -style elements for the sides facing future retail development. Construction
materials will employ cement plaster and stone veneer for the exterior walls of the 7,173-square-foot structure. The elevations will also include aluminum windows and a tile roof. A 7-foot masonry fence will be located along the northern and southern sides of the property while a sevenfoot decorative metal fence will go along the east side. That is so firefighters exiting the station can see pedestrians on a walking trail that will run along the east side of the site. The city is currently negotiating the sale of the old Carpenter’s Hall at Union Road and Louise Avenue they bought a few years back for possible conversion to a fire station. With the proceeds from that sale plus what fire facility fees have been collected from growth there would be a $1.3 million shortfall of the $3.579 million needed to build the station. That money would come from a $1.3 million loan from the Public Safety Endowment.

A Contractor’s Guide To CCIPs Discover the risks and benefits of Contractor Controlled Insurance Programs Editor’s Note: This is the second of a two-part series on controlled insurance programs. The first article focused on Owner Controlled Insurance Programs (OCIPs). A Contractor Controlled Insurance Program (CCIP) can deliver the same benefits as an Owner Controlled Insurance Program (OCIP) for a general contractor able to manage additional risks from subcontracted operations. CCIPs can also potentially increase a firm’s competitiveness and profitability, but they do come with risks.
How Contractor Controlled Insurance Programs Work A CCIP may be implemented to cover a single project, or it can cover all eligible projects enrolled into the program on a continuous or “rolling” basis. Under a CCIP, the general contractor usually purchases general liability, excess liability and workers’ compensation insurance for his or her company and enrolled subcontractors. The program responds to claims that arise out of operations at the covered project
site during the construction period and liability from completed operations through a specified period—ideally the applicable state statute of repose. Subcontractors enrolled in CCIPs remove insurance costs from their contracts, and the general contractor applies the avoided costs to the purchase of the CCIP. By implementing a CCIP and controlling claims costs through rigorous loss control and claims management procedures, a general contractor can save up to 40 percent on insurance costs compared to conventional insurance costs.
Common Traits of a Good CCIP Candidate • A highly-developed safety culture that permeates throughout the company • Experience in managing claims under a high-deductible program • A robust subcontractor prequalification process • Well-established subcontractor relationships in the areas they operate • A significant percentage of their revenue from established customers to meet the CCIP minimum premium requirements • Expected projects with values between $30 million to $40 million or more are widely considered necessary for a successful outcome. Risks of CCIPs Implementing a CCIP presents many potential benefits for general contractors, but CCIPs involve risks as well. Most programs include a deductible of $250,000, $500,000 or even higher per claim depending on the jurisdiction. Total deductible losses will typically be capped based on a fixed percentage of payrolls, but a general contractor most likely would not be able to charge the maximum loss cost to his or her projects and remain competi-
tive. Failing to control losses could result in significant financial loss. Also, failing to place a sufficient volume of projects through rolling CCIPs can be a risk. Underwriters will charge a fixed minimum premium between 50 percent and 90 percent of the total premium estimated at the CCIP’s inception—they do this to protect the capital backing their obligation to pay claims. General contractors who do not run the minimum volume through their program

will still be required to pay the minimum premium. Contractors must have realistic expectations and healthy backlogs to successfully implement rolling CCIPs. Working with Subcontractors Historically, many controlled insurance program (CIP) sponsors have measured the financial success of their programs by comparing the cost of the CIP to the cost of subcontractors’ insurance costs. Many have veered away from this ap-
proach because it focuses on construction savings for insurance rather than total project costs, including materials, labor and insurance. To illustrate this point, consider competing bids from Subcontractor A, whose insurance cost is $50,000 and bid price for material and labor is $1 million, and Subcontractor B, whose insurance cost is $30,000, but the bid price for materials and labor is only $800,000. Awarding the work to Subcontractor A may achieve greater savings ($50,000 versus $30,000), but the cost of the work (materials and labor) would be $200,000 greater than Subcontractor B. Subcontractor A’s bid may represent greater savings, but Subcontractor B’s quote represents a lower total cost and greater value to the project. To shift the focus to project costs, CCIP sponsors instruct subcontractors to bid net of all insurance costs, which allows bids to be evaluated based on the cost of materials and labor alone. Some argue that this practice levels the competitive playing field for unsafe subcontractors who have higher insurance costs. But a robust subcontractor prequalification process that includes a subcontractor’s Occupational Safety and Health Administration (OSHA) total recordable incident rate (TRIR) and workers’ compensation Experience Modification Rating (EMR) can mitigate this exposure. To achieve full cooperation from subcontractors, follow these best practices: • Fully disclose CCIP loss control and administrative requirements at the time of bid. • Share the sufficient program coverage, limits and duration among all subcontractors. • Avoid the temptation to inflate subcontractor insurance costs to demonstrate savings—remove only the insurance costs that subcontractors would have charged the project in absence of a CCIP.
• Allow subcontractors to participate in the claims adjustment process. Working with Owners Many general contractors who use CCIPs establish their contract price net of their insurance costs and subcontractors’ insurance costs, and they charge for the CCIP at a fixed percentage of that cost. This approach provides a simple way to charge the CCIP to a given project. If the owner wants to understand the percentage and compare it to the OCIP cost, the supporting detail may be provided. Contractors do not have to advertise the CCIP if it satisfies contractual insurance requirements, but many choose to promote the program and their safety culture as an added value to the project and all stakeholders. For owners inexperienced in managing construction risks, a CCIP may seem less risky and a simpler alternative compared to an OCIP. However, an owner who has a well-established OCIP may view a CCIP as a less attractive alternative. Some general contractors promote to owners that running a CCIP adds value to the owner by lessening the owner’s administrative burden and the owner’s financial risk. CCIPs are not appropriate for every construction business owner, but a general contractor with a well-developed safety culture, a healthy backlog of business and an appetite for risk may benefit from a CCIP. 2012 ELECTIONS CALIFORNIA The primary held on June 5 was the first time the Top Two Candidates Open Primary Act was in effect. All candidates for each seat competed in one blanket primary. The two candidates who received the most votes advanced to the general election to be held on November 6. As a result, two members of the same party can potentially run against one another. This occurred in 18 Assembly races and 2 Senate races. The Assembly is composed of 80 members. Each member is elected to two-year terms. Current members of the Assembly are limited to three two-year terms. With the passage of Proposition 28 on June 5, 2012, future term limits will be set at 12 total years of legislative service. All 80 seats will be up for election. 45 incumbents will be seeking reelection ; this includes 29 Democrats and 16 Republicans. There are four (4) Democrats running unopposed in the general election. Capitol Connection Q&A Resource For Contractors By Shauna Krause and David Kalb Capitol Services, Inc. We begin with a ‘suspense’ story offered by a contractor who is becoming ‘unqualified’. You need a license to work, but can you participate in bids without one? We ‘demolish’ a misconception for a contractor who learns that ‘breaking up’ is hard to do… Q: I’m an out-of-state contractor and we currently have a license in CA for our corporation but haven’t been getting much work lately. Our qualifying individual has informed us that he is disassociating from the license and we have 90 days to replace him. Can we just go without a Qualifier since we aren’t really using the license at the present time? A: You do in fact have 90 days to replace your Qualifier once he/she disassociates from your license. After the 90 days your license will become suspended. If you don’t intend on using the license, we recommend that instead of letting it go suspended, you file to inactivate it. In this way you don’t need to have a qualifying individual, bond, or Worker’s Compensation insurance.

Q: I am hoping you may be able to provide some information in regard to one of our Builder’s Exchange members. Their contractor’s license is listed under one name (that is not incorporated) and they are conducting business under another name. Ultimately, they would like their membership to be reflected under this name, however, our policy is to

list members by the name that appears on the CSLB records. Do you have any recommendations on what they need to do with the License Board? Any insight you can provide is greatly appreciated.
A: I am assuming this subcontractor is bidding to a licensed general contractor? While local governments may have some latitude regarding when a license is required, for the most part, the general and all subs should be licensed at the time of bid. There are several exceptions in Code Section 7028.15, plus if the project includes federal funds, a proper license would be required at the time the contract is awarded. Our suggestion; get the license sooner, rather than later!
A: It appears this contractor is a Sole Proprietor. My recommendation is to file an Application to Change Business Name with the CSLB. This is a onepage form and the Board does not require any fee. On the other hand, if he wants to continue operating under BOTH business names at the same time, he’ll need to apply for a second contractor’s license. He should not conduct business under two different names using once license number. Thanks for the question.
Q: I am currently at a project site and we’re having a sub-contractor (who does not have a contractor’s license) come out and crush some concrete. Does he need a license to perform this work and place it in a pile?
Q: For a public works project, does a sub-contractor need a license at the time of bid? The paperwork states that a license is needed at the time the work is to be performed, but doesn’t specify whether you need a license to bid the project.
A: I’m guessing this is not the answer you want to hear, but yes, a contractor’s license is required to break concrete. The appropriate classification to perform this type of work would either be the “C-8” (concrete) or “C61”/”D-06” Concrete Related Services.

Respirator A respirator is an important piece of personal protective equipment that may be worn for many different reasons. It is used when an employee must work in an atmosphere that does not have adequate oxygen. It may be required to protect yourself from other respiratory hazards such as dust, airborne contaminants, noxious fumes, etc. Many of the chemicals that we use require the use of a respirator. Product labels and material safety data sheets (MSDS) tell us how to use chemicals safely and how to protect ourselves from any hazardous properties they have. Prior to use, one must determine which type of respirator should be worn. If you have any doubt ask your supervisor. All employees must be trained so that they know how to put on a respirator properly, the method of testing the face piece to assure the face seal is correct, the capabilities and limitations of the respirator, and the care of respirator protective equipment. Respirators function by filtering or purifying contaminated air, or by supplying air from an outside source. You will

frequently see a cartridge-type respirator in use, especially in many painting operations. This kind of respirator is designed for short term exposure. It is approved for low concentrations of contaminants. You must remember that this type does not generate oxygen. Should you have need for one or have any question about one ask your supervise It is important that chemical cartridges and filters be replaced as necessary to provide complete protection. OSHA requires that employees who must use respiratory protective equipment approved for use in atmospheres immediately dangerous to life, shall be thoroughly trained in the use of the equipment. Employees required to use other types of respiratory protective equipment shall be instructed in the use and limitations of such equipment. Respirators and related equipment shall be inspected regularly, maintained in good condition, and cleaned and disinfected before being reissued. If the equipment is damaged in any way, don’t use it.
