News Briefs Roseville To Build Bridge Roseville has launched a design competition for two new pedestrian and bike bridges over Dry Creek between downtown and Royer Park. The new bridges, along with a Town Square now under construction in front of City Hall, will create a more walkable and lively downtown, officials say. There are two design finalists. Both include an elegant crossing near City Hall. City officials are inviting residents to vote on which design they prefer. You can vote online until Dec. 6. Click here for more information. Sacramento Light Rail Gets Expansion Grant Sacramento Light Rail transit officials were ionformed last week that the federal government will grant them $135 million to launch full construction of a light-rail line from Meadowview to Cosumnes River College. RT officials say they will begin laying track in April, and have the four-mile line running by the end of 2015. Amazon To Build In Tracy Amazon.com has announced that it will build a distribution center in Tracy. City Manager Rod Butler and Mayor Luis Molina said they knew the online retail giant was looking for a third California site. Amazon recently opened a distribution center in the Southern California city of San Bernardino, and a 1 million-square-foot center is under construction in Patterson. The Amazon fulfillment center in Tracy is expected to employ 1,000 people. It’s planned on 70 acres in the city’s northeast industrial area. Amazon won’t say how many people will be employed at the Patterson center when it opens in the spring, putting
the number only in the hundreds. In information provided to Gov. Jerry Brown’s office of business and economic development, the online retailer estimated 350 jobs at its Patterson site, although officials noted that Amazon often expands distribution centers once it opens them. Tracy Mayor Brent Ives said that the Patterson center will focus on bulk distribution, while the one in Tracy will use advanced robotics and offer better-paying jobs. $5.4 Million Lakeport Housing Project Saved The Lakeport City Council has voted to support a proposed affordable senior housing complex during a special meeting last week. “When redevelopment went away, I figured we’d lose the whole project,” Mayor Stacey Mattina said. “So when they were still interested in finishing it, I thought it was such an excellent thing for us.” Construction costs are estimated at almost $5.4 million. LEED Platinum status is a requirement of federal funding the project received. The approved agreement required Lakeport Pacific Associates to report to the council monthly about its efforts to hire locally and provide contact information for the person whom prospective subcontractors should contact about work available on the project. Cost Of MTC Building Work Goes Up To $218 Million The cost of the Metropolitan Transportation Commission’s plan to transform the old tank factory and postal facility at 390 Main St. into a suitable place for regional agencies
to cohabit has increased, according to Steve Heminger, the commission’s executive director. The estimated cost now stands at $218 million, which is $38 million higher than the original estimate from July 2011 but $51 million more than the most recent estimate, adopted in November 2011. (The projected cost fell after the agency bought the building at a lower price.) The massive 1942 building, which the MTC bought last year for $93 million, will be gutted and rehabbed to house the commission, the Bay Area Air Quality Management District and, most likely, the Association of Bay Area Governments. Last week, Heminger told the Bay Area Headquarters Authority, a group of commissioners overseeing the creation of the new regional government headquarters, that the main reasons for the cost increase include: • A $10 million increase in the estimate for seismic retrofitting. • The inclusion in the budget of the $15 million cost of buying and installing technology, fixtures and furnishings for the government agencies inhabiting the building. Those costs aren’t usually included in construction budgets, and weren’t previously, Heminger said. But they were added in an effort to look at the full cost of the project. • An $11 million increase in the cost of improvements for the five floors of the building to be inhabited by government agencies.

Fresno Park Bids Rejected The Fresno City Council has rejected all four bids for building the $7.2 million park because they came in far higher than expected, ranging from $8.3 million to $9.25 million. It was estimated that bids would be around $6.4 million. City officials now will work with Broussard and Associates Inc., which did design and engineering services, to see whether some of the proposal can be eliminated or scaled back enough to get the park under its budget. The challenge for the city will be keeping elements that make the park “universally accessible.” The park proposal has a “number of features” that are expensive but are what make it universally accessible. More Expansion Planned For Apple Apple is planting its flag in Santa Clara in a big way as the technology giant continues its shopping spree for new offices, agreeing to occupy a site where Apple could locate 1,200 or more workers. Cupertino-based Apple has struck a deal with developer Peery Arrillaga for a custom-tailored two-building campus that is under construction on the north side of Stevens Creek Boulevard in Santa Clara a short distance from the Cupertino city limits. Apple declined to discuss the development and leasing deal. However, multiple sources with direct knowledge of the transaction told this newspaper that Apple has leased nearly 296,000 square feet from Peery Arrillaga in a deal that included demolition of existing buildings.

Housing Market Continues Strong Recovery

U.S. builders started construction last month on the most homes and apartments since July 2008, more evidence that the housing recovery is gaining momentum. Housing starts are 87 percent above the annual rate of 478,000 in April 2009, the recession low. The Commerce Department said last week that builders broke ground on homes in October at a seasonally adjusted annual rate of 894,000. That’s a 3.6 percent gain from September. Single-family home construction dipped 0.2 percent to an annual rate of 594,000, down from a four-year high in the previous month. Apartment construction, which is more volatile from month to month, rose 10 percent to an annual rate of 285,000. Applications for building permits, a sign of future construction, fell 2.7 percent to 866,000, after jumping 12 percent in September to a fouryear high. Still, permit applications to build single-family homes rose to their highest level since July 2008.
Bids for the Western Parkway project in Yuba City are expected to be opened in January after City Council approval of plans for the $2 million project to ease traffic congestion at the George Washington Boulevard intersection. The work includes extending Western Parkway from Libby Lane to Highway 20. Development in northwestern Yuba City between Township and Royo Ranchero roads initiated the project. Council members in June 2011 approved the environmental review for the project after taking out a traffic barrier on Royo Ranchero Road. Development in West Sacramento Site work has started on an apartment complex near Raley Field that will feature, among other amenities, a place to wash your dog and repair your bike.
“The overwhelming trend here is a housing market that has clearly shifted into recovery mode,” Robert Kavcic, an economist at BMO Capital Markets, said in a note to clients.

during the UC Regents’ regularly scheduled meeting at UC San Francisco’s Mission Bay campus. The plan calls for a $788.5 million that would allow 39 major capital projects throughout the UC system to move forward, if approved by the state Legislature. Among those projects is UC Merced’s proposed $49 million classroom and academic office building. It would increase oncampus classroom space by 50 percent. Construction for the approximately 77,000 square foot, four-story building could begin shortly after funding is authorized and it’s expected to be completed in 2015. Ongoing construction projects at UC Merced include the Science and Engineering Building 2, expected to be completed in 2014; the Student Services Building, expected to be completed in 2013, and the fourth phase of on-campus housing, expected to be completed in 2013.

It’s important to evaluate your professional exposure, the insurability of such exposure and any potential contractual problems of risk transfer or A&E contractual limitation of liability. Additionally, you should weigh these elements against project profitability and the impact on a design loss resulting in a project delay or, worse yet, a rectification of the work.

To date, nearly half a dozen insurers have entered the professional protective marketplace, expanding coverage options while creating a competitive environment with affordable premiums. Most owners understand professional liability, but contractors professional liability is far more comprehensive, as it includes

Thus, all owners need to determine whether the limit is sufficient for their size and the complexity of their projects. It is for this reason that contractors protective professional indemnity was developed as an additional risk transfer solution. A Holistic Approach Contractors protective coverage should be contemplated as part of a holistic approach to a construction owner’s risk profile. Contractors protective pollution indemnity provides protection to the construction owner for designer errors in excess of the A&E’s professional policy and for instances in which the designer’s policy limits have been exhausted by other claims. This protection extends to the construction company for all design team errors.
The protective portion of the policy can also offer “difference in conditions” (DIC) coverage that extends to the constructor if the underlying professional liability policy is deficient. A few examples of areas covered by DIC include mold, means and methods, construction management and contractual liability exclusions that may exist in the underlying design professional’s practice program. One of the newer extensions of coverage is “mitigation of loss,” or “rectification,” coverage. This is an excellent extension to protect the project budget and mitigate delay due to design error discovered during the course of construction. It affords first-party coverage to the constructor to mitigate and rectify a design defect or error. However, the limit is often sub-limited within the policy and subject to a selfinsured retention as well as coinsurance. Mitigation of loss is typically contem

for their size and the complexity of their projects. It is for this reason that contractors protective professional indemnity was developed as an additional risk transfer solution. A Holistic Approach Contractors protective coverage should be contemplated as part of a holistic approach to a construction owner’s risk profile. Contractors protective pollution indemnity provides protection to the construction owner for designer errors in excess of the A&E’s professional policy and for instances in which the designer’s policy limits have been exhausted by other claims. This protection extends to the construction company for all design team errors. The protective portion of the policy can also offer “difference in conditions” (DIC) coverage that extends to the constructor if the underlying professional liability policy is deficient. A few examples of areas covered by DIC include mold, means and methods, construction management and contractual liability exclusions that may exist in the underlying design professional’s practice program. One of the newer extensions of coverage is “mitigation of loss,” or “rectification,” coverage. This is an excellent extension to protect the project budget and mitigate delay due to design error discovered during the course of construction. It affords first-party coverage to the constructor to mitigate and rectify a design defect or error. However, the limit is often sub-limited within the policy and subject to a selfinsured retention as well as coinsurance. Mitigation of loss is typically contem-
plated by larger construction firms that feel comfortable retaining a portion of self-insured risk. This coverage does not exceed the design professional’s policy; rather, it is taken into account on a firststage basis for the mitigation extension. Additionally, the policies offered are indemnity-based; the insured pays first and
upon proof of loss is reimbursed by the insurance company. Through the use of BIM, the design-onthe-go approach to construction has expedited scheduling and reduced project costs. These fast-track project delivery methods demand increased interaction
between the owner, the design team and the general contractor. The result: more professional liability exposures. That’s why it’s more important than ever to consider strategies to manage professional and pollution risk.

Another contractor ‘assumes’ responsibility for his answer and we alert all contractors to a phone scam to beware of right now… Q: The assets of our company were sold and your firm assisted us with obtaining new licenses in CA, NV, and AZ. Can we cancel the bonds that we have on file for the old company, or are we required to keep them active for a period of time? A: Once the licenses are cancelled, you should contact your insurance company and request that the Bonds be cancelled as well. We’re not aware of any requirement for them to remain on file. This being said, in CA for instance, consumers can make a claim against the Bond for up to two years after cancellation. Q: My insurance company did not renew my Contractor’s Bond and now my license is suspended. I contacted them and they are going to write a new Bond. This means my license will show a suspension for these past weeks and this makes me nervous. Do you know if they can backdate the Bond so there is no break? A: I can tell you that the CSLB will accept a “backdated” Bond if it is received within 90 days of the expiration date. They will retroactively lift

Q: We currently have a Joint Venture (JV) license made up of three entities and we would like to remove one. I assume that when we remove that entity we will also need to amend the name of the JV to remove that company’s business name. Is this possible and how is it done? A: Joint Ventures are treated the same as Partnerships, which means when you remove an entity (partner) from the license the license is cancelled. So, in order to do business as the Joint Venture with just the two remaining entities, you would need to apply for a new license. Also, you are correct that when you apply for the new license you will need to amend the business name. As you may already know, an acceptable Joint Venture business name must include the full business name of each entity listed, part of each entity’s business name, or a completely fictitious name. Both California and Nevada Issue an “Industry Alert”

According to Mr. Sands, the caller leads the licensee or applicant to believe he or she works for the Contractors Board and needs to pay money over the phone to get continuing education credit, renew a license or to schedule a licensing exam.” There is NO law requiring continuing education in CA or NV. Further, CSLB and Nevada License Board staff will never ask for credit card information over the phone, nor do they have the authority to process any payment by phone. The CSLB has begun putting warnings in place on letters sent to applicants and with their renewal notifications. Both agencies have also prominently placed warnings on their web sites. Beware. Housekeeping A clean job is a safe job’ is an old saying that has been around for many years. You may or may not agree completely with the saying, but if you have ever worked at a construction project that was cluttered with scrap material, you do know that good housekeeping plays a big part in maintaining a safe worksite. OSHA Regulation 29 CFR 1926.25 Housekeeping requires that ‘During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs in and around buildings or other structures. Combustible scrap and debris shall be removed at regular intervals during the course of construction. Safe means shall be provided to facilitate such removal. Containers shall be provided for the collection and separation of waste, trash, oily and used rags, and other refuse. Containers used for garbage and other oily, flammable, or hazardous wastes, such as caustics, acids, harmful dusts, etc. shall be equipped with

covers. Garbage and other waste shall be disposed of at frequent and regular intervals. Housekeeping starts at the beginning of the shift and needs to continue throughout the entire workday. Don’t let scrap materials build up; dispose of them daily. Another common housekeeping problem arises with the use of welding leads, air compressor hoses, and extension cords. If placed improperly they become tripping hazards. Keep walkways free for passage. When stripping forms remember to pull the nails out or bend them over. A protruding nail can cause a nasty puncture wound. Scrap cardboard and packing materials left lying around provide excellent fuel for fires. Pop cans, lunch bags and food scraps or wrappers will attract rodents. Avoid potential fire and health hazards by disposing of these items properly. Housekeeping is a never ending process. Do your part by keeping your work area and adjacent walkways and stairs clean and orderly.
No doubt about it - if everyone does their share, good housekeeping will make Your Job a Safer Job!

Each work sequence shall be completed tested and accepted by the University prior to starting the next sequence.
