News Briefs City of Pacifica Gets Grant For Construction The City of Pacifica Department of Public Works received an advisory last week from the National Fish and Wildlife Foundation that grant funds in the amount of $250,000 has been allocated from the Cosco Busan Oil Spill Settlement — Recreational Use Program to the City of Pacifica to support the Pacifica Pier Restoration Project. The Pacifica Pier Restoration Project will repair the concrete deck covers and replace the missing sections of deck railing and wood coping at the Pacifica Municipal Pier. This project will also replace the corroded and missing pier deck lighting and electrical wiring. The City will be combining this grant with a previous grant received from the Wildlife Conservation Board in the amount of $249,000, bringing the total project budget to $499,000. Solano Transportation Authority To Acquire 2.69 Acres For Project

The eminent domain process has begun for properties next to the Solano Transportation Authority’s construction project for the westbound Interstate 80 to westbound Highway 12 improvements. STA plans to acquire 2.69 acres as well as a Pacific Gas and Electric pipeline. The fully funded $110.4 million project aimed at improving operations and safety, and providing additional capacity, according to STA staff, will, among other things, improve connections of westbound I-80 to Interstate 680 and Highway 12. Additionally, the project also includes constructing or improving

The Palo Alto company, which helps homeowners with large renovation projects, said it would begin running advertising for architects and contractors. Since 2010, total U.S. spending on renovations has eclipsed spending on new single-family home construction almost every month as opposed to the pre-2007 years, when the building boom churned out new homes, according to the National Association of Home Builders. Alfred Lin, a partner at Sequoia Capital, who backed Houzz early on, said the home improvement market is now worth as much $300 billion. Gifford Construction of Redding as contractor for its $5.5 million, 30,000-square-foot science and nursing building. Construction is expected to begin this summer, with classrooms on the campus in northeast Redding opening in fall 2014. Simpson University President Larry McKinney said the two-story building is a key to expanding the nursing program — an important connection to higher education in Redding.

Deal Clears Way For Youth Center Project Eighteen months of negotiations have resulted in a deal to build a multimillion-dollar Mid-County youth center, but it could be nearly two years before local children crash the doors. The agreement between the Boys & Girls Club, Live Oak School District and the county calls for a new $5 million building on the grounds of Shoreline Middle School. The project includes a computer

and video editing room, dance and karate rooms, a music room and more. Parts of the building are expected to be available to rent to community groups as well, and the school district expects to reveal more details during a spring community meeting. The county is funding the project with $5 million in former redevelopment funds. The Boys & Girls Club has approved the agreement, with the Live Oak School Board giving its consent last week. Free Paint Giveaway The Yolo County Planning & Public Works Division of Integrated Waste Management is host to a reuse program which makes paint and other reusable products available to the public, free of charge. The program is an extension of the Household Hazardous Waste Drop Off Program, open to the public every Friday and Saturday, 7:30 a.m. to 3:30 p.m. at the Yolo County Central Landfill, 44090 County Road 28H between Woodland and Davis. During February, the reuse program will provide additional free paint on Fridays. “Our entire Household Hazardous Waste Program has been a hit. At the moment though, our reuse program shelves run-eth over with paint,” said John Bencomo, director of Planning & Public Works. “Typically we offer 10 gallons of paint per household, but in February, we are expanding that offer to 25 gallons of paint free of charge. of paint per household on Fridays in February for spring cleaning projects such as painting an old shed or refreshing a rental. A variety of paint is available in numerous colors and types. The reuse program is part of the Household Hazardous Waste Drop Off Program which accepts such items: As batteries; fluorescent bulbs or tubes; used motor oil and filters; cleaning supplies; lighter fluid; antifreeze; aerosols; garden pesticides and herbicides; latex or oil based paints. These programs are sponsored by the Yolo County Department of Planning & Public Works Division of Integrated Waste Management. For more information on the reuse program and proper disposal of household hazardous waste, call 666 8856 or visit: www. yolocounty.org Builders Need More Skilled Workers The January jobs report showed that construction added 28,000 jobs for the month, about 18 percent of the the jobs created overall. It’s the fourth straight month of strong construction job gains as home building has rebounded. Low mortgage rates, rising home prices and low inventories of new homes for sale are expected to continue to boost the housing recovery through 2013. “The construction job recovery has clearly arrived,” said Jed Kolko, chief economist at Trulia, a real estate data analysis firm. But builders say hiring has been crimped because they and their subcontractors are unable to find the skilled construction workers. “The bodies are just not there,” said Johnny Yates, vice president of Rampart Construction in the Dallas-Fort Worth area. Labor Depart-

ment numbers confirm the suge in job hiring, with 25,000 more construction jobs added in the final three months of 2012 than initially estimated. Rampart, which specializes in the booming multi-family home sector, added about 25 workers in 2012. The company now employs 85 people, which is about what it had at the height of the housing boom and more than triple what staffing fell to in 2010. But Yates doesn’t think he’ll be able to expand much further, because he can’t find qualified people. When the bottom fell out of the construction industry after the housing bubble burst, Yates said many skilled workers left the field to find other jobs. “People had to find other work to survive,” he said. Some of the laborers during the housing boom were immigrants who went back to their home countries and haven’t returned, he said. His subcontractors, such as those that install sheet rock, have also had a difficult time filling their staffs and are working with smaller crews, which means projects take longer to complete. Yates said Rampart will probably have to turn down some jobs this year because he doesn’t think he can find the staff he needs. “If the work force was out there and available, there definitely would be more hiring,” he said. That statement supports a 2011 survey by the National Association of Home Builders found only 11 percent of its members were worried about the supply of labor. In January, it rose to 51 percent. NAHB chief economist David Crowe expects that home starts will rise from 535,000 last year to 650,000 this year to 844,000 in 2014.

Pat Newport, a housing economist at IHS Global Insight, forecasts that builders will start work on 970,000 homes in 2013, a 24 percent increase from last year. He expects hiring will grow, as well. Caltrans Plans To Spend $12.4 Billion On Work In 2013 2013 will see a record number of California highway construction projects valued at $12.4 billion, as Caltrans takes on record year for construction. In the Sacramento region, drivers can expect work to continue on some of the areas busiest highways. On a section of Interstate 80 known as “across the top,” Caltrans is spending $133 million adding carpool lanes and auxiliary lanes from West El Camino Boulevard to Watt Avenue. One of the biggest projects won’t start until later this summer, but will have a major impact on motorists. Caltrans plans to close most of the lanes of Highway 50 in an area known as the “Crosstown Freeway” for a 30-day period while they resurface the road. The deck on that bridge needs to be rehabilitated. Also starting this summer, Crews will begin building a carpool lane from Laguna Boulevard to Interstate 5. How one company’s holistic approa Safety has always been an important topic in our industry. However, with the onset of larger-scale jobs, increasingly stringent requirements from insurance agencies and tighter schedules, many contractors have had to revisit their long-standing safety practices. Taking a fresh look at safety can pay huge dividends by keeping all team members healthy and, in turn, by improving productivity. In some ways, we are victims of our own success. Our widespread focus on safety has resulted in many firms having long-standing programs, both in the field and in the office. Most companies today do a thorough job of keeping up with daily tasks such as reviewing jobsite emergency evacuation plans, conducting safety audits, updating accident investigation documentation and holding weekly safety meetings. However, there is danger in not revisiting even the most solid of programs. One of the most common safety mistakes employees make in the area of complacency is succumbing to denial that something bad could happen to them. John Jakimowicz, safety director at Madison Concrete Construction, notes the importance of addressing such a mind-set. “Whether you are a young employee starting out or you have been on the jobsite for years, you are not invincible,” he says. Jakimowicz adds that safety “has to start at the top and be communicated throughout the organization.” In the last few years, Madison has wit-

nessed the insurance industry pushing for increasingly stringent safety programs. In response, Madison has developed a program that not only uses safe equipment but trains on such equipment as well. Further, the superintendent and foreman are responsible for conducting daily inspections, and workers are required to inspect their equipment before use. Training Starts in the Office Safety should be emphasized throughout all facets of the organization. Companies can begin by adopting or developing a comprehensive safety policy and in-house production of employee safety orientation programs. In addition, upper management should meet at jobsites on a weekly basis to review site safety. A specified safety committee should be established, too. Meeting on a monthly basis, the committee should take responsibility to review and discuss recent injuries from all jobs to make recommendations accordingly. Finally, the field management team, along with project managers and estimators, should meet several times a year for additional education. Madison hosts such meetings and incorporates guest speakers to discuss safety trends. As Madison’s president, Jim Dolente Jr., puts it, “We don’t see safety as a goal, but as a way of conducting business and protecting our greatest resource—our employees.” Moving to the Field Hands-on training is important. panies should establish routines that reinforce safe practices, and in the field, weekly talks should be scheduled to review safety issues. According to Jakimowicz, it is important for these talks to focus specifically on a topic related to what is happening on the job at that time. For example, to prepare for the summer’s excessive heat, you can cover heat stress and heat-related injuries to prevent dehydration or similar accidents.

The Role of Equipment In addition to having well-trained employees, it is important to use protective equipment that will help keep all crews safe. One key to success when choosing the right equipment is to have a good relationship with your supplier, as they can provide guidance. Daily inspection of equipment is crucial. These inspections may seem tedious, but failure to conduct them can lead to serious injuries. Another aspect of equipment safety involves the proper operation of all tools, such

as making sure all electrical currents are grounded. Not only is the safety of your workers important, but the safety of nearby residents and pedestrians should be taken into consideration as well. Using safety equipment such as sidewalk canopies for projects alongside walkways or major intersections, construction companies can ensure that everyone stays protected. Likewise, project deliveries involving large trucks require a trained flagger to ensure that pedestrians and drivers are cautious and aware of what is going on.

As Jakimowicz says,

Preparing And Maintaining Records OSHA Style The Occupational Safety and Health (OSH) Act of 1970 requires certain employers to prepare and maintain records of work related injuries and illnesses. In fulfillment of this requirement, OSHA developed a series of specific record keeping forms: OSHA’s Form 300, 300A, and 301. The OSHA 300 series forms are written in plain language and are intended to simplify work-related injury and illness record keeping and enhance company safety and health programs. The resulting data collected by these forms will be used to track and compile statistics on work-related injuries, illnesses, and deaths so that employers

and Cal/OSHA can develop a picture of the extent and severity of work-related incidents. They will also help Cal/OSHA identify the scope of employer-assistance needs. Log of Work-Related Injuries and Illnesses During each year, OSHA’s Form 300, the “Log of Work-Related Injuries and Illnesses”, must be used to classify work-related injuries and illnesses and to note the extend and severity of each case. When an incident occurs, employers must use the Log to record

specific details about what happened. On this form, employers must record information about every work-related death and about every work-related injury or illness that involves loss of consciousness, restricted work activity or job transfer, days away from work, or medical treatment beyond first aid. They must also report significant workrelated injuries and illnesses diagnosed by a physician or licensed health-care professional. Employers must also record work-related injuries and illnesses that meet any of the specific recording criteria listed in 29 CFR Part 1904.8 through 1904.12.

Injury and Illness Incident Report

OSHA’s Form 301, the “Injury and illness Incident Report”, is one of the first forms employers must fill out when a recordable work-related injury or illness occurs. This form, or its equivalent, must be filled in within 7 calendar days after receiving information that a recordable workrelated injury or illness has occurred. The form must be kept on file for 5 years following the year to which it pertains.

Summary of Work-Related Injuries and Illnesses

Employees, former employees, and their representatives have the right to review the OSHA Form 300 in its entirety. They also have limited access to the OSHA Form 301 or its equivalent. (See 29 CFR Part 1904.35, in OSHA’s recordkeeping rule, for further details on the access

At the end of the year, all establishments covered in 29 CFR Part 1904 must complete OSHA’s Form 300A, the “Summary of Work-Related Injuries and Illnesses”, even if no workrelated injuries or illnesses occurred during the year. After careful review of the “Log of Work-Related Injuries and Illnesses” to verify that entries are complete and accurate, the total number of incidents in each category listed on OSHA’s Form 300 must be transferred to the Form 300A. California law requires employers to post the “Summary” page from February 1 to April 30 of the year following the year covered by the “Summary”. It must be displayed in a conspicuous

location where notices to employees are customarily posted. A copy of the “Summary” must also be made available to employees who move from worksite to worksite and employees who do not report to any fixed establishment on a regular basis. At the end of the three-month period, the “Summary” should be taken down and kept on file for a period of five years following the year to which it pertains. For copies of OSHA’s Form 300, 300A, and 301 or further information clarifying mandatory recordkeeping, including which employers are exempt or no longer exempt, visit Cal/OSHA’s Web site, or the federal OSHA Web site. For employers without Internet access or for questions not addressed on these Web sites, call your local Cal/ OSHA consultation office.

Our approach was to educate the consumers to use licensed contractors that have the proper insurance and good referrals. Some of

the handouts were; “Top Ten Tips”, “How to Hire a Contractor”, “Home Improvement Contracts”, information about mechanics liens, Owner – Builders Risks and more…. We were extremely well received by the consumers. Many thanked us for being there and providing the information that they have not seen anywhere else. Many asked for referrals from our membership directory and we even had a few contractors interested in becoming a member. It was a great service and provided us an opportunity to educate the consumers, market our association as being the resource for information and referrals as well as expanding our membership exposure into Sacramento Area. You may not always know where your customer comes from, but I know that many of you will benefit from our efforts at all the Home Shows.

The Auburn Home Show is next – May 17th, 18th and 19th. We will have a booth there and would like to coordinate with other attending members to have a PCCA Area. A California contractor has a ‘scary’ offer that unlike those made by the ‘Godfather’ he can refuse. We often assist attorneys and industry execs with research and explanation of how contractor’s regulations work. This time the lesson is one everyone can benefit from learning, before it costs you dearly… Q: I have been approached by an out-of-state company wanting to use my CA contractor license number. What they proposed is the following: they want me to add their company name as a ‘doing business as’ or dba on my license. They then want to use my license to contract work. I would be performing the work, and they offered to pay me an hourly wage plus an extra monthly fee for the use of my license number. The company has other employees that will be on site besides me, and the company has Worker’s Comp and a business license. But can this be done or does this sound as bad as it looks? I know I can set up as a Responsible Managing Employee (RME) or Responsible Managing Officer (RMO) and do this but I have never heard of this dba approach before. So is this legal but scary or just plain illegal? A: Thank you for contacting us. You are correct in thinking that the method they proposed is not the correct way to go about the process. Q: I am an attorney and I regularly read your column. I have a client whose workers compensation policy is currently expired and therefore their contractor’s license is suspended. I’m trying to stress to them the urgency of this and I remember reading one time in your column awhile back about contractors who are not properly licensed not being able to collect money for the entire project, even if their license is only suspended for part of the project. A: In certain circumstances the CSLB will consider granting a waiver of particular trade exams if they are closely related to the current classification on your license, however the “C-16” Fire Protection is not a classification that the CSLB considers closely related to General Building. Job Trailers Job trailers, tool trailers and office trailers are common to most construction sites. Most likely you take them for granted but be aware that they can be hazardous if installed incorrectly or are poorly maintained. One of the biggest problems with a trailer on site is providing a safe means of access. How do you get in and out of it? Is it safe for all employees? Many times a stack of cinder blocks or a wooden pallet turned on its side is used as a makeshift entry. This will cause accidents. Every effort should be made to have a set of steps built to provide safe and easy access. In most areas of the country trailers are required to be tied down to prevent being overturned during storms or high wind conditions. Local authorities should be checked for requirements. Each trailer should have a fire extinguisher mounted and available for quick use. This applies to all trailers on site. All telephones should have emergency phone numbers posted. Electrical panels should be marked, and if portable hand tools are-to be plugged in outside, receptacles must be protected by a GFCI or a current Assured Equipment Grounding Conductor Program.

Tool trailers are used to store tools and construction materials. THINK before you place items in them. Keep heavy objects low along the walls. Keep the center walkway free from tripping hazards. Place sharp pointed objects down and away to prevent injury. Smoking should not be allowed inside a tool trailer that stores flammables. Watch for pinch points and sharp edges. If at all possible, hand tools, shovels, chokers, extension cords and the like should be hung out of the way. Good housekeeping in the tool trailer saves time and prevents injuries. Many trailers have fans to keep them cool in the warmer months. Be sure the fan blade, belt and pulley are properly guarded to prevent injuries to fingers. Trailers are what you make of them. If storage in them is well planned, they are maintained, and safe access is provided they will make your job easier and more efficient. CONSTRUCTION WORK IS DANGEROUS. SAFE WORK HABITS ARE YOUR FIRST LINE OF DEFENSE.

Any person or entity not satisfied with the outcome of the prequalification must file a writ challenging the outcome within 10 calendar days from the date of the University’s written notice regarding prequalification determination. Any assertion that the outcome of the prequalification process was improper will not be a ground for a bid protest. However, the University reserves the right to accept late submissions and to request, receive, and evaluate supplemental information after the above time and date at its sole determination. The dates, times, and location set for receiving and opening of bids will be set forth in an Advertisement for Bids. The University reserves the right to reject any or all responses to Prequalification Questionnaires and to waive non-material irregularities in any response received. Every effort will be made to ensure that all persons have equal access to contracts and other business opportunities with the University within the limits imposed by law or University policy. Each Bidder may be required to show evidence of its equal opportunity policy. The successful Bidder and its subcontractors will be required to follow the nondiscrimination requirements set forth in the Bidding Documents and to pay prevailing wage at the location of the work.
