News Briefs SMART Awarded $12.5 Million A key regional transportation committee has approved $12.5 million for Sonoma-Marin Area Rail Transit to rebuild the line as far north as Airport Boulevard and possibly add a new station there. The funds were approved by the Metropolitan Transportation Commission’s programming and allocations committee. On Jan. 23, the committee’s action will go to the full MTC board, which usually follows those recommendations. “The upgraded track increases our operations for north Santa Rosa and gets the trains back and forth to the operations and maintenance facility in a timely manner,” said SMART Director Debora Fudge, a Windsor councilwoman. “It also gets us closer to the workers at the airport and halfway to Windsor.” The MTC committee allocated $750,000 to design the project and $11.7 million for construction of the track and station. The money comes from Bay Area toll bridge revenue.

allocating $1.3 million in funding to improve Highway 1 just north of Santa Cruz. A 10-mile stretch of Highway 1 will get safety makeovers at 31 crash-prone areas. The stretch begins at Waddell Creek Bridge and ends at Laguna Road. Construction will include improving guardrails, crash cushions, and storm drainage to reduce the number and severity of traffic collisions. CalTrans spokesman Jim Shivers said construction is scheduled to begin in mid-March 2013 and will likely be completed by the end of September 2013. 474-Unit Rental Housing Project Gets Approval The Milpitas City Council has voted to approve a conditional use permit for a 474-unit, multi-story rental project near Great Mall. The approval paves the way for Newport Beach-based Lyon Communities to build the development, to be called 450 Montague,

SMART is now rebuilding track, building stations and buying rail cars, at a cost of about $360 million, to start service between Guerneville Road in Santa Rosa and downtown San Rafael in late 2015 or early 2016. The additional funds will allow SMART to rebuild the line from Guerneville Road to Airport Boulevard, where SMART is planning a $20 million operations and maintenance facility. Highway 1 Roadwork The California Transportation Commission has announced that it is

on 7.98 acres at 450 Montague Expressway. The project will include a six-story, 865-space parking garage; the completion and dedication of a 2.5 acre public park; improvements to the streetscape of existing adjacent roads and the construction of two access streets; completion of a portion of a public trail along Penitencia Creek; and will feature private amenities such as a roof deck recreational space and three courtyards, city reports state. The project also includes conducting a feasibility study for a future $9-million pedestrian bridge over Montague Expressway likely to be funded through developer impact fees. The council said Lyon’s project is consistent with the Transit Area Specific Plan, which proposes more than 7,100 new dwelling units and nearly 1 million square feet of office space centered near the pending Milpitas Bay Area Rapid Transit Station and existing light rail.

Pismo Beach Will Get Seawall The California Coastal Commission has voted to approve a proposed 147-foot, tie-back seawall to prevent a sewer lift station from falling into the sea. The sewer lift station sits about 12 feet from the bluff’s edge. Officials said if the bluffs were to crumble into the ocean during any significant storm, the entire St. Andrews neighborhood would be left without sewer service, and raw sewage would be dumped into the sea below. The partnership between the Army Corps and Pismo Beach reduces the city’s expenses for the seawall’s construction, as the federal agency will pay 35 percent of the project’s total cost. Construction is estimated at $2.7 million, with design and other elements bringing the total cost to $4.1 million. Sonoma Roundabout Work To Bid This Month Tom O’Kane, interim co-director of the Sonoma County Public Works and Transportation Department said, “The bid should go out in February so that we can start construction in late spring – probably June,” The $2.1 million roundabout is designed to accommodate truckturning movements by including rounded, or ‘traversable,” curbs on the edge of the center island and truck apron. Native vegetation would be included in the center island, roadside trees would be retained where feasible, and trees to be removed will be replaced with

The new bike/ pedestrian pathway is separated from the vehicular travel lanes that form the roundabout with 6-inch high curbs. Matsui Pushes For Natomas Levee Work Congresswoman Doris Matsui has re-introduced the Natomas Basin Flood Protection Improvements Act and the Flood Protection Public Safety Act, both key pieces of legislation that would authorize the Natomas Levee Improvement Project (NLIP). “Authorizing the Natomas levee project is crucial to Sacramento’s flood protection effort and is my number one priority in Congress,” said Congresswoman Matsui. “As we saw last year with Hurricane Sandy, flood protection cannot wait and that is why I am reintroducing this important legislation on Day One of the new Congress. The NLIP is critical to protecting thousands of Sacramento residents and billions of dollars of property and infrastructure. Congress cannot drag its feet any longer; lives, homes and businesses remain at risk and we must authorize this crucial project.” The Natomas Basin Flood Protection Improvement Act would authorize full federal participation in the NLIP, which will restore 100year flood protection and ultimately achieve 200-year level flood pro-

This legislation, which was authored in 2009 and in 2011, has in the past been caught in the House Republican earmark ban, an overly broad ban that blocks any legislation that authorizes or funds a specific project. Bank Awards $18.5 Million for Construction Projects Thirty-eight housing projects in the Valley were awarded grants from the Federal Home Loan Bank of San Francisco to provide more than 60 living units to lower-income individuals. The 38 projects were granted a total of $18.5 million in the bank’s 2012 Round B of Affordable Housing Grants to produce or preserve 2,018 living units to low-income individuals and families in eight states. One grant of $360,000 will help develop the Palmer Villas project in the Fresno County community of Huron. The development will consist of 24 affordable rental units for seniors. The Central Valley Coalition for Affordable Housing sponsoring the development will seek LEED (Leadership in Energy and Environmental Design) Silver certification for its drought-resistant trees and vegetation along walking paths and sitting areas, among other sustainable features. In Madera, the Corporation for Better Housing got a $400,000 grant to provide 40 units of affordable housing for families, seniors and the homeless in the Madera Family Apartments. The construction project will use sustainable design and building materials in accordance with standards of Bay Area nonprofit Build It Green.

South Lake Tahoe Project Could Get Back On Track

“Tourism is our city’s No. 1 industry and bringing Moscone into the 21st century will boost our city’s economy,” Mayor Ed Lee said when he announced the master plan for the expansion. The Board of Supervisors gave unanimous support to the project in a preliminary vote in November. Tourism brings more than $8.4 billion a year into the city, with a major piece of that coming from the various conventions and trade shows centered on the SoMa convention center.

Work on a stalled $420 million development near the state line could begin as soon as this spring, according to statements by South Lake Tahoe City Manager Nancy Kerry. As originally designed, the project includes a condominium hotel, conference center, spa, park, shops and restaurants. Bill Owens, the president and CEO of Owens Financial Group, has closed escrow on 20 of the 29 parcels that make up the development and has approached the city about building some of the project, Kerry said. Last weekthe City Council appointed Mayor Tom Davis to join City Councilman Hal Cole on a sub-committee to be involved in discussions surrounding an expected permit application. Moscone Center Expansion Planned San Francisco is moving ahead with plans for a half-billion-dollar expansion of the Moscone Convention Center, with an opening date of 2018. The city would like to begin construction in 2013. Plans call for construction of a multi-story building near Third and Howard streets, retaining the existing Esplanade Ballroom but adding meeting rooms and office space. The city also would widen the underground concourse beneath Howard Street that connects the two original buildings, changing the two separate exhibition

In 2011, more than 650,000 convention-goers visited the city, pouring about $1.8 billion into San Francisco’s economy, according to a study by San Francisco Travel, which represents the city’s tourism industry. Business Boom In Sanger A movie theater, medical clinic and grocery store are just a few examples of nearly a dozen new developments planned for the city of Sanger. Hundreds of homes are also being built. Work is in progress on the first 30 homes in phase one of a 187 unit subdivision near Church and Indianola. According to city records, building permits for residential housing were up 300% in 2012. The demand is so great, City Manager, Brian Haddix, is recruiting for a fulltime building official to replace the part-time building inspector now under contract. In addition to housing, Haddix added, the city has five new office buildings under construction,

including the Lucido Office Complex on the southeast corner of 7th and P Streets. The four building, 52 office complex is the first downtown development to take place in decades. The American Taxpayer Relief Act Of 2012 Signed The American Taxpayer Relief Act of 2012, also known as the “fiscal cliff legislation,” was signed into law by President Barack Obama on January 2, 2013. Despite the name of the law, all workers will pay higher federal taxes this year due to the demise of the so-called “payroll tax holiday.” The good news: The new law cancels income tax increases that would have resulted in added misery. It also makes several provisions permanent, which will result in less uncertainty (see below box).

Several Tax Breaks Made Permanent One of the most confusing and frustrating aspects of the tax code is lawmakers’ practice of making tax breaks available for a year or two -- and then deciding whether or not to extend them. Thankfully, the new law makes several provisions “permanent.” This doesn’t mean that Congress will never discontinue these tax breaks but we now have some certainty that the following will stick around for awhile: 1. Relatively Favorable Gift and Estate Tax Rules - For 2013 and beyond, the new law permanently installs a unified federal estate and gift tax exemption of $5 million -adjusted annually for inflation -- and a 40 percent maximum tax rate (up from last year’s 35 percent rate). For 2012, the exemption amount was $5.12 million after being adjusted for inflation. For 2013, the inflation-adjusted exemption amount is expected to be approximately $5.25 million. The new law also makes permanent the right to leave your unused federal estate and gift tax exemption to your surviving spouse (the so-called “exemption portability” feature). 2. Alternative Minimum Tax Patch - It had become an annual ritual for Congress to “patch” the AMT rules to prevent millions more households from getting hit with this add-on tax. The patch consisted of allowing larger inflation-indexed AMT exemption amounts and allowing various personal tax credits to offset the AMT. Thankfully, the new law makes the patch permanent, starting with 2012. As a result, about 30 million households a year will be kept out of the AMT zone. The new law increases AMT exemption amounts for 2012 to $50,600 for single taxpayers; $78,750 for married joint filers; and $39,375 for married taxpayers filing separately. (For 2013, these amounts are projected to be $51,900, $80,750 and $40,375, respectively.)

3. Marriage Penalty Relief - Getting married can cause a couple’s combined federal income tax bill to be higher than when they were single. The Bush tax cut legislation eased the so-called marriage penalty by tweaking the lowest two tax brackets for married couples and by giving them bigger standard deductions. These fixes were scheduled to disappear after 2012, but the new law makes them permanent. 4. Larger Child Tax Credit - The $1,000 maximum credit for each eligible under-age-17 child was made permanent. Without the new law, the maximum credit would have dropped to only $500 for 2013 and beyond. In addition, provisions that allow the child credit to be refundable for more households were extended through 2017. 5. Favorable Child and Dependent Care Tax Credit Rules - Under the Bush tax cut legislation, most working parents have been able to claim a credit of up to $600 for costs to care for one under-age-13 child, or up to $1,200 for costs to care for two or more under-age-13 kids. Lower-income parents have been able to claim larger credits of up to $1,050 and $2,100, respectively. The new law makes these credit amounts permanent for 2013 and beyond (without the new law, they would have dropped to $480 and $960 for most parents; $720 and $1,440 for lower-income parents). 6. Favorable Student Loan Interest Deduction Rules This write-off, which can be as much as $2,500 (whether you itemize or not) was scheduled to fall under less-favorable rules in 2013 and beyond. There would have been a 60-month limit on deductible interest, and a stricter phaseout provision would have reduced or eliminated the deduction for many middle-income taxpayers. The new law permanently extends the favorable rules that have applied in recent years. 7. Favorable Coverdell Education Savings Account Rules - For 2013 and beyond, the maximum annual contri-


bution to these federal-income-tax-free college savings accounts was scheduled to drop from $2,000 to a paltry $500, and a stricter contribution phase-out rule would have applied. The new law makes permanent the favorable rules that have applied in recent years. 8. Employer Education Assistance Plans - In recent years, employers have been able to provide up to $5,250 in annual federal-income-tax-free educational assistance payments to an eligible employee. Both undergraduate and graduate school costs could be covered and the education did not need to be job-related. Tax Increases for Higher-Income Individuals Rates on Ordinary Income: For most individuals, the federal income tax rates for 2013 will be the same as they were for 2012: 10, 15, 25, 28, 33, and 35 percent. However, the maximum rate for higher-income folks increases to 39.6 percent (up from 35 percent). This change only affects:

Before 2010, higher-income taxpayers had their itemized deductions and personal exemption write-offs “phased out.” This means that they didn’t get the full benefit of the most popular tax breaks. The phase-out rules were deactivated for 2010 through 2012. Regrettably, the new law brings them back on a permanent basis.

The Payroll Tax Holiday Is Over For 2011 and 2012, the Social Security tax withholding rate on an employee’s salary was temporarily reduced from the normal 6.2 to 4.2 percent. If you’re selfemployed, the Social Security tax component of the self-employment tax was reduced from the normal 12.4 to 10.4 percent. Last year, this payroll tax holiday could have saved one person up to $2,202 (up to $4,404 for a married couple with two incomes). Unfortunately for working folks, the new law does not extend the payroll tax cut through 2013. Key Point: For this year, the Social Security tax can hit up to $113,700 of salary at a 6.2 percent rate and up to $113,700 of self-employment income at a 12.4 percent rate.

Phase-Out Rules Are Back

Rates on Long-Term Gains and Dividends: The tax rates on long-term capital gains and dividends will also remain the same as last year for most individuals. However, the maximum rate for higher-income folks increases to 20 percent (up from 15 percent). This change only affects singles with taxable income above $400,000, married joint-filing couples with income above $450,000, heads of households with income above $425,000, and married individuals who file separate returns with income above $225,000. These changes are permanent (until further notice). Important: These higher-income folks can also get whacked by the new 3.8 percent Medicare surtax on investment income, which can result in a maximum 23.8 percent federal tax rate on 2013 long-term gains and dividends. The 3.8 percent Medicare surtax on net investment income and a new 0.9 percent Medicare tax on wages and selfemployment income both affect higher income taxpayers and became effective on January 1, 2013. They were not part of the new fiscal cliff law.

Personal and Dependent Exemption Deductions: Your personal and dependent exemption write-offs can be reduced or even eliminated. Itemized Deductions: You can potentially lose up to 80 percent of your write-offs for mortgage interest, state and local income and property taxes, and charitable contributions if your adjusted gross income (AGI) exceeds the applicable threshold. Specifically, the total amount of your affected itemized deductions is reduced by 3 percent of the amount by which your AGI exceeds the threshold. However, the reduction cannot exceed 80 percent of the total affected deductions you started off with. For both personal/ dependent exemptions and itemized deductions, the AGI thresholds are $250,000 for singles, $300,000 for married jointfiling couples, $275,000 for heads of households, and $150,000 for married individuals filing separately.


Earned Income Tax Credit Legislation enacted in previous years increased the earned income credit for families with three or more qualifying children and allowed married joint-filing couples to earn more without having their credits reduced. These changes, which help lower-income families, were extended through 2017. American Opportunity Higher Education Credit The American Opportunity credit, which can be worth up to $2,500 and can be claimed for up to four years of undergraduate education, was extended through 2017. The full credit is available to single individuals whose modified adjusted gross income (MAGI) is $80,000 or less ($160,000 for married couples filing jointly). Single taxpayers cannot claim the credit if MAGI is more than $90,000 ($180,000 for married filing jointly). Higher Education Tuition Deduction This tuition write-off, which can be $4,000 or $2,000 depending on income, expired at the end of 2011. The new law retroactively restores it for 2012 and extends it through 2013. Note: You cannot claim this deduction and the American Opportunity credit for the same student in the same tax year. Option to Deduct State and Local Sales Taxes In past years, individuals who paid little or no state income taxes were given the option of instead claiming an itemized deduction for state and local sales taxes. The option expired at the end of 2011, but the new law retroactively restores it for 2012 and extends it through 2013. Charitable Donations from IRAs In past years, IRA owners who had

reached age 70 1/2, were allowed to make tax-free charitable donations of up to $100,000 directly out of their IRAs. The donations counted as IRA required minimum distributions. So charitably inclined seniors with more IRA money than they needed could reduce their income taxes by arranging for tax-free IRA donations to take the place of taxable IRA required minimum distributions. This break expired at the end of 2011, but the new law retroactively restores it for 2012 and extends it through 2013. To take advantage of the retroactive deal, you can treat donations made in January of this year as having been made in 2012. You can also donate IRA distributions taken in December of last year to charities and treat them as 2012 IRA donations. You must transfer such amounts to qualified charities by January 31, 2013. Parity for Employer-Provided Parking and Transit Benefits For 2012, employer-provided parking allowances are tax-free up to a monthly limit of $240. For 2013, the monthly limit is $245. Thanks to the new law, you can be given up to these same amounts last year and this year for tax-free transit passes or vanpooling. For example, you could get up to $245 per month this year to pay for the park and ride plus up to another $245 to pay for the train. Without the new law, there would have been only a $125 monthly limit on employer-provided transit passes and vanpooling for 2012 and 2013. Key Point: If your company doesn’t pay for these fringes, it might offer a salary reduction arrangement instead. Say you set aside $245 per month for the train plus another $245 for the park and ride. If you’re in the 25 percent federal income tax bracket this year, you could save up to $1,920 in federal income and employment taxes.

Tax-Free Treatment for Forgiven Principal Residence Mortgage Debt For federal income tax purposes, a forgiven debt generally counts as taxable cancellation of debt (COD) income. However a temporary exception applied to COD income from cancelled mortgage debt that was used to acquire a principal residence. Under the temporary rule, up to $2 million of COD income from principal residence acquisition debt that was cancelled in 20072012 was treated as a tax-free item. The new law extends this break to cover eligible debt cancellations that occur in 2013. Deduction for K-12 Educators’ Expenses The $250 deduction for teachers and other K-12 educators for school-related expenses paid out of their own pockets was retroactively restored for 2012 and extended through 2013. Energy-Efficient Home Improvement Credit In past years, taxpayers could claim a tax credit of up to $500 for certain energy-saving improvements to a principal residence. This break expired at the end of 2011, but the new law retroactively restores it for 2012 and extends it through 2013. Mortgage Insurance Premium Write-off Premiums for qualified mortgage insurance on debt to acquire, construct, or improve a first or second residence can potentially be treated as deductible qualified residence interest. Before the new law, this break was only available for premiums paid through 2011. The new law retroactively restores the break for premiums paid in 2012 and extends it to cover premiums paid in 2013. However, the deduction is only available for premiums for qualifying policies issued after December 31, 2006 and premium amounts allocable to periods before 2014 and it is phased out for higher-income taxpayers. continued on next page

Should You Run Your Business As A Corporation Or LLC? By Scott Burnett, Esq. Whether you are a full-time or part-time business owner, everyone in the field of construction can benefit from forming a corporation or an LLC. There are two reasons why: one has to do with lowering your personal taxes and the other one with growing your busi-ness. First, no matter what type of way you make your living, you are going to make income and pay taxes. If you are a business owner, your goal is to have the money you make taxed at the lowest rate allowed by law. If you are doing your business as a sole proprietor, you are going to pay more taxes than if you operated your business as a corporation or an LLC. Period. Second, you are in business. Part-time or full-time, every business owner wants their business to grow and become more successful. However, if you are a sole proprietor, your business cannot grow to its full financial potential because it is limited by you. Look at the facts: Sole Proprietorship vs. Corporation or LLC TAXES If you are doing business as a sole proprietor, you will make money throughout the New Year and report that income at the end of the year. You will claim all expenses and deductions that you are eligible for, and the remainder will be your taxable net income. All of this income is now subject to self-employment tax. This is because there are only four ways in which income can come to the owner of a sole proprietorship: cash, fringe

benefits, rent, and royalties. Therefore, almost every dollar of income is going to be taxed at the highest possible tax rate. If you operated your business as a corporation or an LLC, even though you would make the same amount of income, the end result would be very different. The tax code provides additional income reduction tools to the owners of corporations and LLC’s. It allows you to take income out of the business in six different ways: wages, fringe benefits, dividends and distributions, loans, rent, and royalties. As a result, you can change the character of the money that comes to you, and reduce your personal taxes! Let’s look at the four most important ways your corporation or LLC can help reduce your personal taxes. 1. Wages Wages consist of the income you take out of your business that pays you for your efforts. Wages are taxed at the same rates as a sole proprietor example. So at first there appears to be no difference between a sole proprietor and our entity. However, the owner of a corporation or LLC can regulate this income. So our owner here can have some of their lifestyle money taxed as wages, but can also take it out in a variety of other ways. For instance, he could take some income out as wages, or he could flow the income into one of the other six categories mentioned above, so it can be taxed at a lower rate (if it is taxed at all). This

is called regulating income. The owner basically has the ability to change the character of money—an option the sole proprietor does not have because he or she has to declare their income as cash subject to self-employment tax. 2. Fringe Benefits Fringe benefits are legislative tax rules that benefit business. They allow businesses to write off non-traditional business expenses, such as health insurance and retirement plans. Corporations and LLC owners can claim and take these fringe benefits for themselves. Handled this way, the cost becomes a business expense. If you are a sole proprietor and you claimed the same fringe benefit, it would almost always be considered taxable income to the owner for the exact same benefit! 3. Dividends and Distributions A dividend or distribution is considered profit. This profit can be given to an owner throughout the year, or at the end of the year. The key with this type of income is the classification. Since it is not classified as wages, it is not subject to employment tax. Therefore, every dollar paid out as dividend saves the owner 15.3 percent—the going U.S. employment tax rate. 4. Loans A corporation or LLC is considered a separate legal person. Even though you are the owner, you can still interact with it like a separate person. Therefore, you can borrow money from your corpora-


tion or LLC. The obvious benefit is that any money you borrow is not considered taxable income. Sole proprietors cannot enjoy this benefit because they are not considered separate from their business. Summary of Tax Benefits The reality of business taxation is that there are just more opportunities to lower your taxes for corporations and LLCs than there are for sole proprietorships. So it’s simply good business to learn the rules and take advantage of them. As a sole proprietor, you will always pay more in personal taxes. Period. Sole Proprietorship vs. Corporation or LLC Business Growth We all want our businesses to grow and become more successful. However, success and growth can be two different things. As we learned above, we can make the exact same amount of money as we made last year, but end up paying less in taxes if our business is structured

differently. Therefore, we could be more successful simply by keeping more of the money we make. But growth is not simply expansion of the business. We can have our business grow independent of our efforts in our trade. Let me explain. Because your corporation or LLC is considered a separate legal person in the eyes of the law, it has the ability to grow independent of you. It can develop and expand its own financial identity. For example, it can establish credit for itself, which is independent of the owner. That means your business has unlimited growth potential. The sole proprietor and their business are one and the same person. Therefore, a sole proprietor cannot create their own independence and grow financially without the owner. Another interesting aspect of this separation concept is that any credit you have, as an individual, is considered a debt. Any credit the business establishes

for itself is an asset. If the business was ever sold, the credit it established would be added to the value of the business. This again is not available to the sole proprietor. This is one more of the many ways you can grow your business without making any more money! Sole Proprietorship vs. Corporation or LLC Summary If you want to make extra money and become more successful, you are better off operating your business as a corporation or LLC. Remember, part-time or fulltime, this is a business. No matter how much time you spend in it, you always want to make sound business decisions. Applying Title 24 Building Energy Efficiency Standards By: Schiller Cassell Architect, CEPE, LEED AP As a PCCA member and architect specializing in building performance, my primary role is helping contractors understand and apply the Title 24 Building Energy Efficiency Standards, in this case to a specific project. A contractor recently asked for help in preparing a bid proposal for a new residence based on drawings from the late 1990s. Drawings were limited to plans, elevations and sections for a 2,300 SF single story with a slab-on-grade foundation. Notes and specifications were minimal with no HVAC information other than a condenser pad for a standard split system. He wanted to know the changes that would be needed to meet the 2008 Standards with the minimum number of HERS tests. Despite three code cycles, we modeled the house based on the original drawings, suggested some design changes

and achieved compliance with only two HERS tests, refrigerant charge and duct leakage. In this case, the major change was a reduction in total glazed area to the maximum allowed without penalty (20% total and 5% west elevation of total conditioned floor area, Package D, Climate Zone 12). For example, we reduced window height from six feet to five feet (3060 to 3050) and an external French door (modeled as a window) from eight feet to seven feet (2680 to 2670). An alternative would be to maintain the original window areas with high performance Low-E, and more expensive, glazing (a U-factor/SHGC from .38/.37 to say .34/.19). In addition to the T-24 Report (CF-1R) meeting his requirements, we provided a summary of results, recommendations, alternatives, and tools that allowed him to modify the design and window schedule consistent with T-24 compliance. This approach allowed the contractor flexibility in resolving the final design

and cost with the owner without the cost and time of referring back to us for a compliance check until the design is finalized. Once we receive the final documents, we can revise the model and issue the final T-24 Report. In the absence of any major design change we expect minimal revision. We will also be able to check compliance for any construction changes, manage rebate applications, and minimize the potential risk of cost and delay of HERS testing. With each code cycle, the complexity of energy efficiency standards will increasingly affect building design, construction cost and project delivery. For example, according to the CEC (CA Energy Commission) the new 2013 Standards due out in 2014 will require 25% less energy for new residential (30% less for new nonresidential). Since the CEC relies primarily on the construction industry to achieve their energy efficiency goals, contractors should select their project teams carefully to minimize the risks of non-compliance throughout the project cycle.

Possibly no two words strike more fear in the hearts of architects, engineers and contractors than “construction defect.” A claim for construction defect can cost astronomical amounts to correct and defend. And then there’s the damage to your reputation and its impact on your future opportunities for work. It’s enough to break a business. Construction Defect Risks New technology, materials and applications have changed the way commercial buildings, homes and condominiums are constructed. Advances are enabling the design and construction of buildings that are more attractive and less costly. Yet, many of these advances have yet to be tested in real application over time, where problems may be uncovered that were never anticipated in the lab. At the same time, new applications require new skills from contractors, who may overlook important requirements for installation or take shortcuts that cause devastating consequences. When problems occur, it’s hard to know the cause without investigation, and everyone on the project is forced to become involved.

Types of Construction Defects

If the court finds against you and you are a subcontractor, the policy will frequently pay for property damage caused by the occurrence.

Generally, courts categorize construction defects in one of four categories: 1. Design deficiencies typically relate to building designs that do not meet code or perform to standard. 2. Material deficiencies occur when use of inferior materials causes significant problems, such as when windows leak or fail to perform even when properly installed. 3. Construction deficiencies are problems created by poor quality workmanship. 4. Subsurface deficiencies usually involve cracked foundations or other structural damage caused when soil is not properly compacted and prepared for adequate drainage. The goal of the court is to determine fault and damages, and require the party responsible for the defect to remedy the situation. Insurance Under the standard commercial general liability (CGL) policy, your insurance company has a duty to defend you for

It does not, however, cover the costs to remedy your work – the faulty workmanship or material that led to the damage. In many cases, the cost to correct the construction defect will be greater than the actual property damages incurred. Keep in mind that if you are a general contractor, the whole project is your work. What You Can Do to Manage Your Risk Many risks you face are not typically covered by insurance. In addition to insurance, you can reduce your risk through: Risk Control The best way to avoid a construction defect claim is through quality construction. Work only with architects, engineers and contractors who have good reputations and a track record of performance. Don’t cut corners. Plan and perform work in the correct sequence and with proper supervision. Be sure to document any and all plan changes. Organized records are critical to your defense.

Capitol Connection Q&A Resource For Contractors By Shauna Krause and David Kalb Capitol Services, Inc. If you are reading this now and are unlicensed, a resolution to become a licensed contractor is a good choice in 2013. While most of us have been working to make (and keep!) New Year’s resolutions, the CSLB has been hard at work implementing new laws and regulations for contractors… First, contractors should be aware that employee-reporting laws have been strengthened by the passage of Assembly Bill 1794. The new law, which took effect January 1, 2013, authorizes the Employment Development Department (EDD) to share new-hire employee information with agencies in the state’s Joint Enforcement Strike Force on the Underground Economy (of which the CSLB is a member) and the State Compensation Insurance Fund. This new practice of information sharing among state offices will ensure that employers are accurately reporting their employee payroll to their insurance carrier for establishing their Worker’s Compensation premium. Contractors are currently required to carry adequate Worker’s Comp insurance for employees or submit an exemption or Certificate of SelfInsurance. However, a CSLB study revealed that nearly half of licensed contractors either claim an exemption based on having no employees or maintain a minimum policy under which no employees are reported to their insurance carrier.

“This landmark legislation benefits consumers, contractors, and employees,” said CSLB Registrar Steve Sands. “When employers properly report and insure employees, consumers are protected by Workers’ Compensation insurance coverage if an accident occurs on their property, businesses pay less in insurance premiums, and employees are eligible for unemployment insurance when they’re properly listed on the payroll.” Next up, Assembly Bill 2237, sponsored by the CSLB, more clearly defines the term “consultant” as it relates to building and construction work. The new law states that anyone who provides or oversees bids for construction, arranges for subcontractor work and schedules, and/ or has oversight for a project is, in fact, acting in the capacity of a contractor and must be state-licensed. In California, a state contractor license is required for any project that is $500 or more in combined labor and material costs. Another CSLB-sponsored bill strengthens enforcement authority over contractors who violate state contracting laws. AB 2554 amends Business and Professions Code sections 7011.4 and 7106.5 to enable the CSLB Enforcement division and its representatives to issue notices to appear in court related to disciplinary actions against a license. AB 2219 indefinitely extends the requirement that all C-39 Roofing contractors obtain workers’ compensation insurance coverage, even if they certify that they have no employees. The bill also extends, indefinitely, the requirement that insurers conduct annual audits, and requires that these audits be conducted in person to verify the accuracy of the reported number of employees. AB 2114 enacts new construction permit requirements for swimming pools, spas, or public wading pools. AB 2339 requires state regulators and those involved in the heat pump and geothermal heating and cooling industries to evaluate policies and develop infrastructure for wider use of these technologies. SB 1576 allows the CSLB to take administrative action if a licensee files a false complaint again another licensee. This is a short list, you can probably think of a lot more because we all, at one time or another, have been guilty of taking shortcuts. Usually it’s because we are attempting to save some time. Occasionally someone comes up with an idea that works, and is a time-saver. That’s great, as long as safety is not sacrificed. Your life and your health are too important to risk by taking stupid chances, and that is exactly what 999 out of 1000 shortcuts are - stupid! Get smart think safety first - always!

5. Horseplay causes a lot of injuries on the job - but many of us continue to play practical jokes. 6. A circular saw can amputate a finger - but we insist on using the saw without a guard! 7. We know the safe way to climb a ladder - but we climb it with one hand full of tools!
