News Briefs Sacramento Streamlines Permit Process

As part of Sacramento Streamline, the City of Sacramento announced a pilot program aimed to further improve the efficiency of the building permit process and help ensure that all work performed is done safely. Dubbed the Accelerated Minor Permit Program, this new service – which will go live mid-February – will allow licensed contractors to purchase permits for specific minor installations and repairs. The cost savings of purchasing permits in bulk could be up to 75 percent. The first available permit would include water heaters for residential and commercial customers, with other work including re-roofs and electrical circuits to follow shortly thereafter.
$2.5 Billion Spent, $2 Billion More Needed
The program will allow licensed contractors to immediately purchase permits, in groups of five, for specific minor installations and repairs, at a reduced cost. As part of the program, City staff will randomly inspect one installation per grouping, to make certain work performed is done correctly. The City hopes the program encourages contractors and residents to obtain a building permit for a variety of minor projects. Other streamlined improvements are on the horizon, including epermit – a convenient tool to obtain building permits online without having to come to the City’s public counter. Inspectors taking the first-ever inventory of flood control systems overseen by the federal government have found hundreds of structures at risk of failing and endangering people and property in 37 states, including in California. Levees deemed in unacceptable condition span the breadth of America. They are in every region, in cities and towns big and small: Washington, D.C., Cleveland and Dallas, Augusta, Ga. and Brookport, Ill., as well as California. After Hurricane Katrina in 2005, California voters approved nearly $5 billion in bonds to shore up the state’s aging flood protection system. With more than half the money spent, officials say they need up to $12 billion more to finish.

In Sacramento, a 42-mile-long levee along the Sacramento and American rivers protects the Natomas area, a flood-prone basin transformed from cropland into a community of 100,000 with an airport, nearly three dozen schools and two interstates. That levee received an unacceptable rating by the U.S. Army Corps of Engineers. But, at this time, only about half the $810 million needed for upgrades has been raised from state and local sources. The city is seeking federal financing of the rest. Were it to fail, “it would be beyond catastrophic,” said Angelique Ashby, the city’s vice mayor. The poor rating led federal emergency officials to impose strict building limits that have prevented homeowners from making repairs and delayed construction of schools and a police station, she said.

“This is going to be a national problem and it just hasn’t dawned on people how big it’s going to be,” said Jeffrey Mount, a levee management specialist and founder of the Center for Watershed Sciences at UC Davis. “We’re in a never-ending cycle of flood and rebuild.” As of Jan. 10, the Corps had published ratings for 1,451, or 58 percent, of the levees. Of those, 326 were unacceptable, 1,004 were minimally acceptable with deficiencies that need correcting, and 121 were acceptable. Local governments and districts are responsible for upgrading unacceptable levees. In Yolo County, most levee maintenance is the responsibility of local reclamation districts, said Panos Kokkas, the county’s director of public works. Reclamation districts are funded and governed by property owners whose lands the levees protect. Kokkas said there are several such districts along the Sacramento River and Cache Creek, and that they are overseen by the state Department of Water Resources’ Central Valley Flood Protection Board. December Surge In Home Building
it is nearly double the recession low reached in April 2009. Construction increased last month for both single-family homes and apartments. And the pace in which builders requested permits to start more homes ticked up to a 4 ½ year high. Applications for new building permits, which are seen as an indicator of builders’ confidence in the market, were little changed from November’s rate. But the annual rate of 903,000 reported in December is up 28.8 percent from last year’s level. This is one more positive sign that the housing market is picking up steam, as record-low mortgage rates have spurred demand for homes. A recovering job market and a tapering off of foreclosures have also given the market a boost. As distressed homes leave the market, that means that there are more buyers interested in purchasing fewer available homes. Home prices, in turn, have continued to rise, posting the biggest percentage gain in more than two years last month. Apartment construction, which is more volatile, surged 23 percent last month. It is now back to pre-recession levels.
U.S. builders started work on homes in December at the fastest pace in 4 ½ years and finished 2012 as their best year for residential construction since the early stages of the housing crisis.

The Commerce Department reported that builders broke ground on houses and apartments last month at a seasonally adjusted annual rate of 954,000. That’s 12.1 percent higher than November’s annual rate. And

jumping events – and American Disability Act requirements necessary for the ongoing Stouffer Field modernization project. The board approved $100,000 to help replace both student computer labs at RHS, with $75,000 of that going immediately and the remaining $25,000 to be used as matching funds for a proposed RHS technology boosters club, according to Trustee Ernie Tyhurst. Stouffer Field will receive $250,000 from Fund 35. Of that, $100,000 will go towards replacing the restrooms at the RHS stadium. Funding not to exceed $50,000 will be used for upgrading classroom locksets district-wide, the D Building roof including asbestos abatement at RHS, and resurfacing of tennis courts. Summer School Construction Projects The Cupertino Union School District is set to begin a major series of construction projects this summer. Last June, voters in the district attendance boundaries passed Measure H, a $220 million school facility and repair bond measure. The bond will be used to modernize classrooms and bathrooms, upgrade earthquake and fire safety systems, replace infrastructure, update science labs and technology systems and build additional classrooms. The twenty elementary school campuses in the district will see the addition of robust wireless Internet networks. Other summer projects include adding exterior lighting to six campuses, roof replacement at another three campuses, painting at another two campuses and the replacement of sewer, water and storm drain underground utilities at 12 sites.
Perhaps the most ambitious projects will be at Lawson and Cupertino middle schools. The two schools were a major focal point when voters were asked to approve the bond. Last year, the district said it was anticipating a surge in enrollment at Hyde, Cupertino and Lawson middle schools. Phase I of the Lawson Middle School project will see the construction of a new 20-classroom, two-story building. Four of those will be science classrooms, six will be for math and science, and 10 will be standard classrooms. There are also plans for a new band building, including two music rooms and an area for storage.
Pier 70 Development Plan Unveiled Forest City has unveiled a proposal for a mixed-use innovation center at Pier 70 that could include as many as 1,000 housing units, 2.2 million square feet of office space, and a diverse collection of spaces to accommodate 275,000 square feet of artisans, retailers, designers, and boutique manufacturers. Forest City estimates that the infrastructure aspect of the work will cost $152 million and the historic restoration part of the project will come in at $90 million.
To make room at Lawson, the neighboring district office on Vista Drive will vacate the premises by the end of April. The district is leasing two office suites in Sunnyvale at 1309 S. Mary Ave. for at least the next five years. The district office’s move will also make way for a new track and field at Lawson. The Lawson project will begin with site preparation between June and early September. Construction of the new buildings will start soon after and run into August 2014. The new track and field will break ground in mid-June 2014 and last until approximately the end of October.
While much of the proposal carries out ideas cultivated at Forest City’s 5M project at Fifth and Mission, the inclusion of housing is surprising because the Port of San Francisco had previously said that residential development at the site would conflict with the noisy ship repair businesses that flourish on the pier. But Forest City has circumvented the conflict by placing the housing as far from the ship operations as possible and has been working closely with BAE Systems, which operates the facility, the largest floating dry dock on the U.S. West Coast.
Phase I of Cupertino Middle School’s project is equally ambitious in scope. It, too, will see the construction of a new 20-classroom, two-story building with the same number of science, math and regular classrooms. The school will also get a new gymnasium in addition to its current one. The locker rooms will be rebuilt, and buildings 100, 200, 300 and 500 will be modernized.
The Forest City concept envisions a new waterfront neighborhood with eight acres of green space that both stretches along the waterfront and juts into the heart of the campus. The parkland would create both access to the Bay as well a town common of sorts — a lively interior urban park that could be compared to Washington Square in San Francisco’s North Beach.
Site improvements and classroom construction follow the same schedule as Lawson’s identical project. The new gym will break ground in late August and take about a year to complete.
Phase one, which would start construction in 2016, would include the reuse of two historic shipyard buildings. The 100,000-square-foot Building 2 would become about 100 units of housing. The 160,000-square-foot
Building 12 would be reimagined as a loft-style creative office building with a ground floor marketplace that spills out into the public plaza. The scale of the central area would draw inspiration from the network of alleys and narrow pathways that characterized Pier 70 during World War II, when it was the busy home to 18,500 workers. San Jose Pushing Development Hard When Chuck Reed took over as San Jose’s Mayor, he wanted to change the city’s construction focus from housing to business. He’s some success. “There are a billion dollars of investment in our development pipeline, which could generate over 3 million square feet of new office and research and development space, more than 800 high-rise and wood frame residential units and more than 600,000 square feet of regional and neighborhood retail space over the next few years,” Reed wrote in a recent memo. Projects on the horizon include the Century Winchester site on Winchester and Olin and Olsen; the former Garden City site, expansion at Valley Fair, South Bay Alviso, Tisch Office, a new office site from the Silverstone Housing project, Symphony Tower Form, a residential high rise at 200 Park Ave., a Courtyard by Marriott with 300 rooms at Santa Clara and Highway 87 and Karina Hotels. Improve Productivity With Crawler Carriers Consider incorporating this machine into your fleet for versatile performance
Mike Crimaldi knows track carriers. He was working with crawler-mounted drills before he had a driver’s license, starting out as a driller’s helper at age 15. As his company’s drilling fleet grew, so did its service and repair capability. Eight years ago he transitioned out of direct drilling services to found Rig Source Inc. in Elburn, Ill. Since then, more and more customers have wanted to put crawlers under a variety of equipment that spanned the construction industry. By now Crimaldi has just about seen it all. Speaking from his 35 years of experience, he sums it up: “If you can mount it to a truck, you can put it on tracks.” Tracks provide a stable, versatile platform that can turn about in place to maneuver equipment precisely where it needs to be, and they do this with significantly less threat of damage to the worksite’s surface. Additionally, tracks allow owners to keep equipment in the field when soil and weather conditions would park truck-mounted equipment, thus improving productivity. Tracking the Industry Though the most common mounts still tend to be flatbeds and dumpers, Crimaldi says, “One customer might have a flatbed to mount on a tracked undercarriage, the next a scissor lift. That’s the exciting thing for us—the new uses we keep seeing for it.” He has seen customers use the unit for mulch blowers, mat carriers, mobile epoxy coating machines, hydro-

seeders, mobile cranes, tracked welding units, personnel carriers, water tank carriers and off-road service vehicles. Crimaldi says the roots of the tracked carrier market can probably be traced to tracked dumpers. Contractors noted how they could be used on soft, wet ground when trucks would either cause too much damage or get stuck. As trucks wore out, owners found they could extend the life and utility of their equipment by remounting it to similar tracked carriers. “They would get maybe another five to ten years of use out of their equipment,” Crimaldi says, “but they were also finding that tracks gave them more flexibility for all ground and weather conditions.”

Tracked carriers were originally designed for off-road use. Using rubber tracks eliminated the need to lay down lumber or matting to protect paved surfaces the rig might have to cross or work from. Advances in rubber track technology have made them highly durable and long lived. “Manufacturers don’t bother much with steel anymore,” Crimaldi says, “since so many customers have gone to rubber.” Choosing a Carrier For customers deciding whether to mount certain equipment or which manufacturer to purchase from, Crimaldi defers to Rig Source’s director of sales, Matt Slater. Are there cases where he’d advise against upgrading to tracked
equipment? Slater couldn’t think of any offhand. Rubber track carriers exert as little as 3 psi of pressure on the surface, and their terrain-traversing capabilities surpass those of trucks and trailers. Though they can’t be driven to and from a worksite, transportation isn’t a problem. Slater explains, “Most contractors already have a trailer to haul their equipment to the site, so they’re set.” One potential limitation is size. Track carriers come in almost any size class imaginable, he says, but the greatest customer demand has been for what Crimaldi describes as “the largest carrier possible without requiring special permitting to transport it.” Trailers with loads 8-feet and 6-inches wide or more require oversize permits. Slater explains that, as far as manufac-
turers are concerned, most North American customers prefer to buy from North American vendors. The issue is not one of nationalism or even of technical superiority, however, and Slater notes that many of the overseas models are well made. Instead, it’s a matter of maintenance. With many foreign models, he says, “The parts are proprietary to that manufacturer.” He explains that the advantage of a wholly North Americanmade carrier is that parts and service can be found locally throughout the U.S. and Canada.

Should You Run Your Business As A Corporation Or LLC? By Scott Burnett, Esq. Whether you are a full-time or part-time business owner, everyone in the field of construction can benefit from forming a corporation or an LLC. There are two reasons why: one has to do with lowering your personal taxes and the other one with growing your busi-ness. First, no matter what type of way you make your living, you are going to make income and pay taxes. If you are a business owner, your goal is to have the money you make taxed at the lowest rate allowed by law. If you are doing your business as a sole proprietor, you are going to pay more taxes than if you operated your business as a corporation or an LLC. Period. Second, you are in business. Part-time or full-time, every business owner wants their business to grow and become more successful. However, if you are a sole proprietor, your business cannot grow to its full financial potential because it is limited by you. Look at the facts: Sole Proprietorship vs. Corporation or LLC TAXES If you are doing business as a sole proprietor, you will make money throughout the New Year and report that income at the end of the year. You will claim all expenses and deductions that you are eligible for, and the remainder will be your taxable net income. All of this income is now subject to self-employment tax. This is because there are only four ways in which income can come to the owner of a sole proprietorship: cash, fringe

benefits, rent, and royalties. Therefore, almost every dollar of income is going to be taxed at the highest possible tax rate. If you operated your business as a corporation or an LLC, even though you would make the same amount of income, the end result would be very different. The tax code provides additional income reduction tools to the owners of corporations and LLC’s. It allows you to take income out of the business in six different ways: wages, fringe benefits, dividends and distributions, loans, rent, and royalties. As a result, you can change the character of the money that comes to you, and reduce your personal taxes! Let’s look at the four most important ways your corporation or LLC can help reduce your personal taxes. 1. Wages Wages consist of the income you take out of your business that pays you for your efforts. Wages are taxed at the same rates as a sole proprietor example. So at first there appears to be no difference between a sole proprietor and our entity. However, the owner of a corporation or LLC can regulate this income. So our owner here can have some of their lifestyle money taxed as wages, but can also take it out in a variety of other ways. For instance, he could take some income out as wages, or he could flow the income into one of the other six categories mentioned above, so it can be taxed at a lower rate (if it is taxed at all). This

is called regulating income. The owner basically has the ability to change the character of money—an option the sole proprietor does not have because he or she has to declare their income as cash subject to self-employment tax. 2. Fringe Benefits Fringe benefits are legislative tax rules that benefit business. They allow businesses to write off non-traditional business expenses, such as health insurance and retirement plans. Corporations and LLC owners can claim and take these fringe benefits for themselves. Handled this way, the cost becomes a business expense. If you are a sole proprietor and you claimed the same fringe benefit, it would almost always be considered taxable income to the owner for the exact same benefit! 3. Dividends and Distributions A dividend or distribution is considered profit. This profit can be given to an owner throughout the year, or at the end of the year. The key with this type of income is the classification. Since it is not classified as wages, it is not subject to employment tax. Therefore, every dollar paid out as dividend saves the owner 15.3 percent—the going U.S. employment tax rate. 4. Loans A corporation or LLC is considered a separate legal person. Even though you are the owner, you can still interact with it like a separate person. Therefore, you can borrow money from your corpora-
tion or LLC. The obvious benefit is that any money you borrow is not considered taxable income. Sole proprietors cannot enjoy this benefit because they are not considered separate from their business. Summary of Tax Benefits The reality of business taxation is that there are just more opportunities to lower your taxes for corporations and LLCs than there are for sole proprietorships. So it’s simply good business to learn the rules and take advantage of them. As a sole proprietor, you will always pay more in personal taxes. Period. Sole Proprietorship vs. Corporation or LLC Business Growth We all want our businesses to grow and become more successful. However, success and growth can be two different things. As we learned above, we can make the exact same amount of money as we made last year, but end up paying less in taxes if our business is structured
differently. Therefore, we could be more successful simply by keeping more of the money we make. But growth is not simply expansion of the business. We can have our business grow independent of our efforts in our trade. Let me explain. Because your corporation or LLC is considered a separate legal person in the eyes of the law, it has the ability to grow independent of you. It can develop and expand its own financial identity. For example, it can establish credit for itself, which is independent of the owner. That means your business has unlimited growth potential. The sole proprietor and their business are one and the same person. Therefore, a sole proprietor cannot create their own independence and grow financially without the owner. Another interesting aspect of this separation concept is that any credit you have, as an individual, is considered a debt. Any credit the business establishes
for itself is an asset. If the business was ever sold, the credit it established would be added to the value of the business. This again is not available to the sole proprietor. This is one more of the many ways you can grow your business without making any more money! Sole Proprietorship vs. Corporation or LLC Summary If you want to make extra money and become more successful, you are better off operating your business as a corporation or LLC. Remember, part-time or fulltime, this is a business. No matter how much time you spend in it, you always want to make sound business decisions. Applying Title 24 Building Energy Efficiency Standards By: Schiller Cassell Architect, CEPE, LEED AP As a PCCA member and architect specializing in building performance, my primary role is helping contractors understand and apply the Title 24 Building Energy Efficiency Standards, in this case to a specific project. A contractor recently asked for help in preparing a bid proposal for a new residence based on drawings from the late 1990s. Drawings were limited to plans, elevations and sections for a 2,300 SF single story with a slab-on-grade foundation. Notes and specifications were minimal with no HVAC information other than a condenser pad for a standard split system. He wanted to know the changes that would be needed to meet the 2008 Standards with the minimum number of HERS tests. Despite three code cycles, we modeled the house based on the original drawings, suggested some design changes
and achieved compliance with only two HERS tests, refrigerant charge and duct leakage. In this case, the major change was a reduction in total glazed area to the maximum allowed without penalty (20% total and 5% west elevation of total conditioned floor area, Package D, Climate Zone 12). For example, we reduced window height from six feet to five feet (3060 to 3050) and an external French door (modeled as a window) from eight feet to seven feet (2680 to 2670). An alternative would be to maintain the original window areas with high performance Low-E, and more expensive, glazing (a U-factor/SHGC from .38/.37 to say .34/.19). In addition to the T-24 Report (CF-1R) meeting his requirements, we provided a summary of results, recommendations, alternatives, and tools that allowed him to modify the design and window schedule consistent with T-24 compliance. This approach allowed the contractor flexibility in resolving the final design
and cost with the owner without the cost and time of referring back to us for a compliance check until the design is finalized. Once we receive the final documents, we can revise the model and issue the final T-24 Report. In the absence of any major design change we expect minimal revision. We will also be able to check compliance for any construction changes, manage rebate applications, and minimize the potential risk of cost and delay of HERS testing. With each code cycle, the complexity of energy efficiency standards will increasingly affect building design, construction cost and project delivery. For example, according to the CEC (CA Energy Commission) the new 2013 Standards due out in 2014 will require 25% less energy for new residential (30% less for new nonresidential). Since the CEC relies primarily on the construction industry to achieve their energy efficiency goals, contractors should select their project teams carefully to minimize the risks of non-compliance throughout the project cycle.

Possibly no two words strike more fear in the hearts of architects, engineers and contractors than “construction defect.” A claim for construction defect can cost astronomical amounts to correct and defend. And then there’s the damage to your reputation and its impact on your future opportunities for work. It’s enough to break a business. Construction Defect Risks New technology, materials and applications have changed the way commercial buildings, homes and condominiums are constructed. Advances are enabling the design and construction of buildings that are more attractive and less costly. Yet, many of these advances have yet to be tested in real application over time, where problems may be uncovered that were never anticipated in the lab. At the same time, new applications require new skills from contractors, who may overlook important requirements for installation or take shortcuts that cause devastating consequences. When problems occur, it’s hard to know the cause without investigation, and everyone on the project is forced to become involved.

Types of Construction Defects
If the court finds against you and you are a subcontractor, the policy will frequently pay for property damage caused by the occurrence.
Generally, courts categorize construction defects in one of four categories: 1. Design deficiencies typically relate to building designs that do not meet code or perform to standard. 2. Material deficiencies occur when use of inferior materials causes significant problems, such as when windows leak or fail to perform even when properly installed. 3. Construction deficiencies are problems created by poor quality workmanship. 4. Subsurface deficiencies usually involve cracked foundations or other structural damage caused when soil is not properly compacted and prepared for adequate drainage. The goal of the court is to determine fault and damages, and require the party responsible for the defect to remedy the situation. Insurance Under the standard commercial general liability (CGL) policy, your insurance company has a duty to defend you for

It does not, however, cover the costs to remedy your work – the faulty workmanship or material that led to the damage. In many cases, the cost to correct the construction defect will be greater than the actual property damages incurred. Keep in mind that if you are a general contractor, the whole project is your work. What You Can Do to Manage Your Risk Many risks you face are not typically covered by insurance. In addition to insurance, you can reduce your risk through: Risk Control The best way to avoid a construction defect claim is through quality construction. Work only with architects, engineers and contractors who have good reputations and a track record of performance. Don’t cut corners. Plan and perform work in the correct sequence and with proper supervision. Be sure to document any and all plan changes. Organized records are critical to your defense.

A few of my customers have asked me to install solar heating for their residential pools that I have serviced, but I have been told by other contractors that I specifically need either a “B” (General Building) or a “C-46” (Solar) license to do these installations. Is that correct? A: Nice to hear from you again! Since solar contracting is an ever-expanding part of construction these days, there is a lot of talk and also a lot of confusion over the proper license that a contractor needs in order to perform this work. A “C-53” Swimming Pool contractor is authorized to include the installation of solar heating in swimming pools projects, so you will not need to obtain any additional classifications. There are also several other classifications that allow contractors to perform solar installation/repair jobs: “A” (General Engineering); “B” (General Building); “C-4” (Boiler) contractors are authorized to

perform solar heating specifically associated with boilers, hot-water heating and steam fitting; “C-10” Electrical contractors can perform solar projects that involve electrical energy; “C-36” Plumbing contractors can perform solar to heat water or fluids; and of course “C-46” Solar Contractors can perform all types of solar installations. It turns out he does not have a “C-9” license. Where is the line drawn between a lathe and plaster contractor and a drywall contractor? Can a “C-35” contractor take on regular drywall services? Laser Safety The type of laser which has found the greatest use in the construction industry has been the helium-neon (He-Ne) gas laser. Its beam has been used to project a reference line for construction equipment in such operations as dredging, tunneling, pipe laying, fine grading, ceiling tile grid installation, marine construction, etc. A few hazard controls to observe when using lasers: 1. Personnel who work with laser units should be aware of the potential eye hazards and importance of limiting unnecessary exposure. 2. A warning sign should be attached to the laser equipment in a conspicuous location indicating the potential eye hazards associated with the laser and warning against looking into the primary beam. 3. The binoculars of aiming telescopes should not be used to view the direct beam unless the beam intensities are greatly below safe levels. 4. The use of corner cube retro-reflectors should be avoided at close ranges if the reflected beam is to be observed.
5. During the alignment and set up procedures, care should be taken to avoid aiming the laser into potentially occupied areas. 6. Stable mounts for the laser are important so that it can be readily controlled. 7. Lasers should never be left unattended during operation. Beam shutter or caps should be utilized, or the laser turned off when laser transmission is not actually required. Despite the potential hazards, the laser beam can be used safely if the proper procedures and all necessary precautions are followed. No employees other than highly trained persons should be permitted to work in an area where they could come in direct contact with the laser beam. The guidelines here should be applied only to the small He-Ne lasers and are not by any means complete. Always check the manufacturer’s instructions, precautions, and guidelines for each particular unit. When in doubt, ask your supervisor.
