News Briefs Work To Resume On Natoma Valley Subdivision Construction will resume soon on a long-delayed Folsom subdivision, the latest sign of rebirth in the region’s home building business. The Natoma Valley site, at the corner of Blue Ravine Road and East Natoma Street, was abandoned years ago by Dunmore Capital and has since become an eyesore at an otherwise vibrant intersection. But the 79-lot parcel in northeast Folsom was recently acquired by national home builder D.R. Horton, for $6.4 million, from Sacramento investor Ethan Conrad, who was a lender on the project and foreclosed on it in 2008. Horton now is about to start site work on the partially finished lots and put up its first models there “in the next few months,” said Jim Radler, a broker with Land Advisors Organization who represented Conrad in the sale. SMART Sets To Bid Out Work Sonoma-Marin Area Rail Transit plans to award up to $80 million in new contracts this spring, primarily to finish the southern end, from the Marin Civic Center to downtown San Rafael, but also to complete work in Sonoma County. So far, about 15 miles of track have been completed in Sonoma County, along with the repair or replacement of 25 road crossings and six bridges, work that was part of a $105 million package of contracts now nearing completion. The system has a number of major projects still ahead of it, including the replacement of the aging bridge over the Petaluma River. Rather than rehab the existing bridge, which is more than 90 years old, SMART chose to buy an existing bridge across Galveston Bay in Texas, which was being
replaced at the orders of the Coast Guard. The bridge was cut into pieces and shipped by rail to Napa last summer, where it is being stored. It probably will be reassembled there and floated by barge to the bridge site, though SMART has yet to pick a contractor for the work, so some details remain uncertain. More Major Construction Planned For San Jose Santana Row, already a shopping, dining and entertainment destination, could also become the home for some big tech companies under an ambitious plan by the developers of the San Jose complex to construct three big office buildings. Together, the planned Santana Row office buildings would total about 700,000 square feet -- enough square footage to accommodate 2,800 to 3,500 workers. Federal Realty, the principal owner of Santana Row, wants to develop the buildings on underutilized sites at the retail, restaurant, residential and cinema complex. The new offices would be built along the south edge of Santana Row, in the vicinity of the existing CinéArts movie theaters. They would be constructed on surface parking lots and the current site of an apartment complex known as the Dudley Apartments. Federal Realty at some point would bulldoze the apartments to make way for one of the office buildings. The developer also intends to build underground parking garages with more stalls than the surface lots. Fresno Construction Picking Up Steam 2013 is shaping up as the beginning of better times in the construction
industry in the greater Fresno area. Major construction projects have picked up in Fresno and Clovis — including the office, industrial and retail sectors — as market and economic conditions improve. One standout project is the McCormick Barstow law firm building project at El Paso and Fresno streets in Fresno. The three-story structure will span 68,000 square feet. It is scheduled for completion Nov. 1 of this year. Renovation is also putting some construction workers back to work. StarPoint Properties of Beverly Hills, which in 2012 purchased the 151,000-square-foot Guarantee Financial Center on Shaw Avenue in Fresno for $4.5 million, plans to renovate and refurbish the office campus. Renovation plans include upgrading the façade and common areas, new landscaping, repair of elevators and fixing roofs. FedEx Ground will double the size of its Fresno distribution center by 198,000 square feet later this year. An affiliated firm has purchased a 20-acre parcel at the southwest corner of East and North avenues, two blocks from Highway 99. The current warehouse is near Willow and North avenues. The new building is in its design phase. Two Free Building Trades Training Programs Offered Two free training programs will be offered this spring to help Stanislaus County residents learn skills needed to get jobs in construction trades and at Amazon’s new distribution center. building trades will be provided in Modesto for people considering careers as plumbers, electricians and sheet metal workers. The training will be offered by trade unions and will include 120 hours of instruction during three weeks in May. Worker safety, cardiopulmonary resuscitation and first aid, blueprint reading, math skills, tools and materials, and interviewing skills will be taught. The training is designed to help people pass the exams needed to get jobs in trade union apprenticeship programs. To qualify, applicants must be at least 18, be high school graduates, have valid California driver’s licenses and reliable transportation, be legal U.S. residents, take a WorkKeys exam and pass a drug screening. About 20 people will be accepted into the pre-apprenticeship program. Those interested in applying must

Caltrans Allocates $113.9 Million For Various Projects
• Elk Grove: $5 million to widen Grant Line Road between Survey Road to Waterman Road and other improvements.
From “bridge aesthetic improvement” along Highway 99 to widening the heavily traveled highway in Merced County, Central Valley highway projects have been allocated $113.9 million by the California Transportation Commission. The total is about 30 percent of a total of $333 million approved for a total of 91 projects to improve the state’s transportation system.
• Merced County: $52 million – Atwater-Merced Expressway Phase 1A. The project will widen State Route 99 near Atwater to six lanes near Buhach Road and construct a new interchange.
Statewide, the allocations include $233 million from Proposition 1B, a transportation bond approved by voters in 2006. In total, nearly $15 billion in Proposition 1B funds have been distributed statewide.
• San Joaquin County: $32.6 million – Bouldin Island Rehabilitation Project. The project will replace 8.6 miles of existing roadway on State Route 12 from the Potato Slough Bridge to the Mokelumne River Bridge. It will also widen the shoulders and install a concrete median barrier.

• Madera County: $1.4 million for improvements to Avenue 9.

The Mount Sutro housing development project received unanimous approval last week. It will feature 34 units in 12 two-unit and 10 one-unit buildings. The project will also create a new road to access the development, 68 parking spaces and a wa-
ter-catching system to prevent the hillside from getting saturated and potentially creating landslides, according to development plans. The project will be located off the north end of Crestmont Drive. Yuba City Receives $625,000 For Bike Lanes The California Transportation Commission approved $625,000 for Yuba City on Tuesday to improve bicycle lanes along Butte House and Pease roads. Funds will be used to expand road shoulder widths to accommodate bikeways along Butte House Road, between Madison and Tharp roads; and on Pease Road, between Stabler Lane and Live Oak Boulevard. The commission said the projects will close gaps in bicycle/pedestrian routes, connect bicyclists and pedestrians to activity centers, increase the number of bicycle and walking trips, and improve safety/security for bicyclists and pedestrians Porterville Development Receives Council Approval Plans for an upscale housing and commercial development known as Henderson Village are moving forward. The Porterville City Council has voted in favor of the development at its regular meeting last week, allowing Malibu-based Pacific Rim Companies to move forward with a 23-acre subdivision west of the southwest corner of Henderson Avenue and Newcomb Street. The plans call for the construction of a 168-unit apartment complex on roughly 11 acres, a two-story 18,000-squarefoot office building, just under five acres of retail space that includes a 4,200-square-foot financial pad, two 3,200-square-foot fast-food pads for drive-thru restaurants, two retail buildings adding up to 39,400 square feet,
and a 518-unit self storage facility. The development will have a Spanish mission style theme. The complex includes 21 eight-unit apartment buildings, two community rooms, and an office building. It also boasts three open space areas at roughly 17,000 square feet each. One of the spaces includes a community pool with arbor. There is also a covered barbecue and picnic area near the largest open space area that provides residents a place to cook and eat outdoors. Each unit provides a 50-square-foot personal outdoor patio or balcony space. Planning Commission To Review Facebook’s West Campus Plans Facebook’s plan to build a second campus on the west side of Bayfront Expressway moves to the Menlo Park Planning Commission today. The social network company has asked the city to rezone its 22-acre West Campus site because the building height there is now limited to 35 feet. The 433,555-square-foot office and rooftop park that Facebook wants to build above a surface-level parking lot would reach a height of 73 feet, according to city documents. The building has been designed by celebrated architect Frank Gehry. The commission also will consider approving an official statement that the development’s benefits would outweigh its negative environmental impacts. According to a city memo, one significant and unavoidable impact could be additional traffic at the intersections of Marsh and Middlefield roads and University Avenue and Donohoe Street. Construction noise is another potential impact. In addition, the commission is to consider allowing removal of 175
heritage trees and approving Facebook’s agreement to provide either $4.5 million in fees to the city for affordable housing or put up 15 affordable housing units elsewhere, or a combination of both. In January, the city council approved a development agreement for the West Campus project that calls for Facebook to pay Menlo Park $1.5 million over 10 years and $100,000 for local improvements, and to restrict the number of vehicles entering and leaving the new campus. Agreement Reached To Build SF Hospitals New hospitals will grace both Cathedral Hill and the Mission district after a lengthy and contentious development squabble between city leaders and California Pacific Medical Center officials ended in a tentative compromise. San Francisco Mayor Ed Lee, California Pacific Medical Center and several members of the San Francisco Board of Supervisors confirmed new plans last week for CPMC’s huge construction projects at Cathedral Hill and St. Luke’s Hospital. CPMC had initially proposed tearing down the vacant Cathedral Hill Hotel and replacing it with a 555-bed hospital. St. Luke’s Hospital in the Mission district, which primarily serves low-income people, would have been reduced in size and could have been shut down. The compromise reached includes downsizing the $2 billion, 555-bed Cathedral Hill medical campus to just 274, and expanding a new St. Luke’s structure from 80 to 120 beds. Sutter Health affiliate will build a new hospital with up to 304 beds at Cathedral Hill at Geary Boulevard and Van Ness Avenue while spending $2 billion to replace the aging, seismically unsafe St. Luke’s campus on Cesar Chavez Street with a 120-bed general acute care hospital.

Breaking down the financial impact of providin As we head into 2013 and the third year of the Patient Protection and Affordable Care Act (PPACA), construction business owners need to be aware of the additional fees that will be assessed on insurers and employers that provide self-insured plans. These fees will increase the cost of providing a group health plan for your employees. Fees to Fund Research on PatientCentered Outcomes PPACA created the Patient-Centered Outcomes Research Institute (PCORI), which is charged with funding research that will provide patients, their caregivers and clinicians with the evidence-based information needed to make betterinformed health care decisions. PCORI is to be funded in part by a fee, commonly referred to as “comparative effectiveness fee” or “PCORI fee,” assessed on health insurers and sponsors of self-insured group health plans. The PCORI fee will first be assessed with respect to plan or policy years ending after September 30, 2012. The fee is equal to $1 multiplied by the average number of covered lives (employees and dependents) for the first plan or policy year ending on or after October 1, 2012. The fee will be equal to $2 multiplied by the average number of covered lives for policy or plan years ending after September 30, 2013.

If a group health plan is insured, the health insurer is responsible for calculating and paying the fee. If the company sponsors a self-insured plan, the company is responsible for paying the fee. Transitional Reinsurance Fee The transitional reinsurance program established by the PPACA will require health insurance issuers, as well as certain plan administrators on behalf of self-insured group health plans, to make contributions to a transitional reinsurance program for a three-year period beginning January 1, 2014. The transitional reinsurance program is intended to reduce the uncertainty of insurance risk and to stabilize premiums in the individual market during the first three years of operation of the state health insurance exchanges, 2014 through 2016, by making payments toward high-cost cases as a result of adverse selection. For purposes of employer-sponsored plans, this appears to mean that a plan’s total reinsurance contribution is based on the number of enrollees covered under the plan. In other words, the fee does not apply solely to the employee participant, but it also applies to all dependents covered under the plan. Health and Human Services (HHS) has yet to confirm the amount of the per capita fee that will apply for each reinsurance contribution enrollee.

However, it appears that some insurers have estimated the fee could range from $61 to $105 per reinsurance contribution enrollee. To the extent that this is the case, this fee will result in a significantly greater fee liability to the plan than the PCORI fee. The final regulations make clear that the reinsurance contributions are to be collected on a quarterly basis beginning on January 15, 2014. Penalties will apply to a health insurance issuer or a group health plan that does not remit the required transitional reinsurance contributions to the state or HHS, as appropriate. In general, the maximum monetary penalty that may be imposed appears to be $100 per day per affected individual. Pay or Play Penalties In 2014, large employers with 50 or more full-time equivalent employees could be subject to two potential penalties: the No Coverage Penalty and the Unaffordable Coverage Penalty. The No Insurance Penalty subjects certain employers to a $2,000 per full-time employee penalty, excluding the first 30 full-time employees, under specific conditions. The Unaffordable Coverage Penalty applies if an employer offers its full-time employees the opportunity to enroll in coverage under an employer plan that either is unaffordable (relative to an employee’s W-2 income) or does not provide minimum value. This

ng a group health care plan for your employees penalty is $3,000 for every full-time employee who receives a subsidy for coverage in a state exchange. The factors that affect the onset or avoidance of additional costs under the pay-or-play provisions of the ACA are the following: • Number of full-time employees currently waiving health insurance: The individual mandate requires everyone to be enrolled in some basic level of health insurance coverage starting January 1, 2014. Therefore, individuals who have foregone coverage in the past have an incentive to obtain health insurance. If employer-sponsored insurance is “affordable” for these individuals, this will increase employee participation levels in the employer’s program in comparison to current participation levels. For example, if an employer is currently paying $6,000 for single coverage and there are 50 employees who have waived coverage in the past but choose to take the employer-sponsored insurance in 2014, the additional cost to the employer will be $300,000. • Employer contributions to health insurance premiums: Employers who pay all or a significant portion of the premium costs for their employees are less likely to have full-time employees qualifying for exchange subsidies, since the premiums will be affordable (less
than 9.5 percent of their W-2 wages). This reduces or eliminates the likelihood that the employer will be assessed penalties under the ACA if the company maintains insurance coverage. Note that construction companies benefit from deductibility of their contributions to employee premiums. There is a break point at which it is more financially advantageous for a construction company to pay insurance premiums than to pay the penalties. Premium payments, unlike ACA penalties, are deductible on a company’s tax return. Employers who contribute more than $3,000 annually toward employee premium costs will save money for every employee who goes to the exchange and receives subsidies. • Overall premium costs and affordability: Construction companies with employees earning less than 400 percent of the federal poverty level will be disadvantaged in 2014 if they offer high-premium plans to their employees, because the plan will not be affordable unless the construction company covers all or most of the cost. If the available plans are unaffordable for employees in this income range, they will be eligible for exchange subsidies, and the employer will be assessed corresponding penalties. If a company’s wages for each of
its full-time employees exceeds 400 percent of the federal poverty level, it will pay no penalties but may see more employees enroll in employersponsored insurance. • Employers who drop health insurance coverage: In most cases, it will cost less for a construction company to drop health insurance coverage and pay the $2000 penalty for each full-time employee after the first 30. However, full-time employees whose wages exceed 400 percent federal poverty level will be disadvantaged in this situation; they will not be eligible for exchange subsidies and will have to pay 100 percent of the premium costs in the exchange. The construction business owner should consider the additional compensation necessary to attract and retain management employees in this scenario. For example, if the employer is currently paying $6,000 toward the cost of insurance premiums for 20 employees in this category, the additional compensation cost to the employer could be $120,000 plus payroll and other taxes. Many provisions in the PPACA impact the cost to provide health care coverage for employees. Construction business owners should be aware of these additional fees and penalties and work with their benefit consultants to determine the financial impact of health care on the company.

First, a quick answer for a guy in a real hurry… Q: I never imagined I’d do more than follow your column when I could, but I do have an issue. I am trying to sell my business and plan to remain as the Responsible Managing Officer (RMO). The buyer is under the impression that I must own 20% of the stock to make the RMO position legitimate. I am maintaining that a separate bond would suffice without stock ownership. I would be grateful if you would respond to this issue since escrow is to close in two days and this just became an issue today.

A: You are correct! There is no requirement that you own any percentage of the corporation. If the new owner posts a $12,500 Bond of Qualified Individual, you would not need to own any stock. The bond is required for all RMO’s that own less than 10%. Good luck with the sale.
A: Yes, there is a license for that. The specific type of license can be a little tricky as that work can fall under several different classifications depending on exactly what you’re doing. It can be covered under a “C-39” (Roofing), “C-33” (Painting), “C-29” (Masonry), or “C-54” (Tile). Each of these classifications has a trade exam. There is also the “D-65” which is “weatherization and energy conservation” that includes weather stripping, caulking, water heater pipe wrap, etc. The “D-65” does not have a trade exam.
Contractor Alert: March 2013 – The CSLB reminds contractors that they must call 811 before beginning a project that will disturb the ground surface – whether by digging, drilling, boring, etc. You must contact either the Northern or Southern California regional notification center at least two working days (but not more than 14 calendar days) before beginning your excavation project. According to the bulletin, “the regional notification center call is free by dialing 811. If you fail to register, your excavation will be considered unauthorized digging and you may be subject to a fine of up to $50,000, held responsible for any repair costs, and potentially lose your contractor license.”

Backs Have you ever given much thought to your back? It’s there when you need it, but only if you don’t abuse it. The back is made up of four major parts. The spine, nerves, muscles, and the spinal cord. There are thirtythree bones in the spine and thirty-one pairs of nerves branching out from the spinal cord. All of them must work together. If they don’t, you could end up with anything from a strain to a ruptured disk, fractured vertebrae, and/or a debilitating disease like arthritis. To help prevent a back injury you should exercise, practice good posture, eat the right foods, and watch your weight. Check with your doctor for muscle strengthening exercises for the back. Other things you can do to prevent back injuries include using work-saving devices -- hand trucks, forklifts, wheelbarrows, and dollies can assist you. When

you have an object to lift that is too heavy or bulky get help! Ask a co-worker for their assistance. Remember, two backs are stronger than one.’ Now, what can you do when you have to do some lifting? Check out the object to be lifted. Think about how you are going to grasp the load and make sure there is a clear path of travel so you won’t stumble. Before you lift, stand close to the object, bend down at the knees and straddle it, get a good grip, and lift with your legs while keeping your back straight. The secret is to let your legs do the work. It doesn’t have to be a heavy load -- even a small, very light object lifted incorrectly can trigger a back injury. Back injuries can be painful, disabling, paralyzing, and sometimes even fatal. Protect your back by following the guidelines above. You’re here today -- we want you BACK tomorrow.

The Internet Accounts For 4.7% of the U.S. Economy
Survey Says: 77% of Americans would be willing to give up chocolate for an entire year, rather than go without the Internet. Only 21% though would give up sex, and an even smaller 7% would go without a shower.
According to a recent survey conducted by CNN Money, the Internet contributes more to the American economy than the entire federal government, according to a new study by the Boston Consulting Group. The Internet accounted for $684 billion, or 4.7% of all U.S. economic activity in 2010, Boston Consulting Group found. By way of comparison, the federal government, contributed $625 billion, or 4.3%, to the nation’s output. If it was considered its own separate industry, the Internet would also be larger than America’s education, construction or agricultural sectors.
In the retail sphere alone, e-commerce accounted for 5% of U.S. sales in 2010. “All businesses are increasingly digital and need to think about how to take advantage of these opportunities,” said Dominic Field, a BCG partner and co-author of the report. Boston Consulting Group predicts the Internet will grow about 10% a year through 2016 in the Group of 20 nations.
