News Briefs San Francisco Wins National Planning Grants Two public-housing sites in San Francisco will start the design process to build new mixed-use developments after receiving grants from the federal government. Mayor Ed Lee, city officials and community leaders joined the U.S. Department of Housing and Urban Development on Friday to announce that San Francisco was awarded two $300,000 Choice Neighborhoods Planning Grants. With the money, Bridge Housing Corp. and Sunnydale Development Co. will be able to develop new plans for mixed-use housing at sites in Potrero Hill and Sunnydale. Once the plans are complete, the projects will be eligible for more funds from HUD through the Choice Neighborhoods implementation grants — such as the $30 million The City was awarded last year for the Alice Griffith Public Housing Development. In Potrero Hill, the plan is to convert the Potrero Terrace and Potrero Annex sites into a community that has 1,600 units of public, workforce and market-rate housing, according to Amy Tharpe, director of policy and planning for the Mayor’s Office of Housing. The site currently has 606 public housing units that date back to 1941, according to HopeSF. In Sunnydale, the 785 units of public housing will be converted to include 1,000 affordable rental units and 700 affordable and market-rate for-sale units, planning documents show. Preliminary plans also call for new park space and revitalized street corridors.
October to its strongest level since June 2006 as more serious buyers expressed interest in buying new single-family homes. The one-point gain in the National Assn. of Home Builders/Wells Fargo Housing Market Index doesn’t seem like much. But the increase was the sixth straight monthly upswing for the measure, bringing it to a level of 41. Still, any number less than 50 shows that more builders consider sales conditions to be poor. Measures of sentiment toward current sales conditions and prospects over the next six months both stayed at less-than-optimistic levels. Confidence levels improved in three regions and stayed the same in the Northeast, but remain depressed. A component in the National Assn. of Home Builders index showed that, according to builders’ reports, prospective buyer traffic soared five points to 35 — that gauge’s highest level since April 2006. Builders last month started construction on single-family houses and apartments at the fastest rate in more than four years, the Commerce Department said Wednesday. And they laid plans to build homes at an even faster pace in coming months—a signal of their confidence that the housing rebound will last.

The pace of construction has grown steadily in the past year, and analysts expect it to keep rising. The increase has been fueled by recordlow mortgage rates, more stable home prices and a shortage of previously occupied homes for sale.

Proposals Sought For Block 9 in San Francisco Developers are lining up to take on block 9, the Transbay District parcel in San Francisco that is slated for 580 units of market-rate and affordable housing. Proposals are due December 12. The Successor Agency to the San Francisco Redevelopment Agency recently held a workshop where prospective developers could ask questions about the project. Builders in attendance included Meg Spriggs of AvalonBay, Steve O’Connell of Grosvenor, Glen Ceridono of BRE Properties, Don Lusty and Julia Bennett of Related California, Drew Sullins of Jackson Pacific, and Eric Tao of Avant Housing. The nonprofit developers attending the block 9 meeting include MidPen, Bridge Housing, Chinatown CDC, and TNDC. Transbay block 9 is a 31,000-squarefoot site on Folsom Street between First and Essex streets. The project will include a 400-foot tower and a shorter podium building. At least 20 percent of the units must be affordable to families earning less than 50 percent of the area median income, currently $51,500 for a family of four. The request for proposals comes about 10 months after Golub & Co. and Mercy Housing were selected to develop two other parcels, Transbay District blocks 6 and 7. Diede Construction Wins Fire Station Contract
Apartment Complex Work In San Jose To Begin Soon
The Manteca City Council has approved a $3.2 million design build agreement with Diede Construction for a 7,173-square-foot fire station designed by LDA Partners of Stockton. The city is currently negotiating the sale of the old Carpenter’s Hall at Union Road and Louise Avenue they bought a few years back for possible conversion to a fire station. With the proceeds from that sale plus what fire facility fees have been collected from growth there would be a $1.3 million shortfall of the $3.579 million needed to build the station.
A mixed-use apartment project in San Jose’s midtown should start construction within weeks now that the developer has closed on a $42 million construction loan. The four- to five-story building will wrap around a five-story parking garage and feature 36 studios, 96 one-bedrooms and 86 two-bedrooms.

The architecture mirrors that off the Del Webb community. The fire station planned for the northeast corner of the future intersection of Madison Grove at Lathrop Road just west of Raley’s will employ cement plaster and stone veneer for the exterior walls and use warm earth tones. The elevations will also include aluminum windows and a tile roof. It is part of a two-pronged plan the Manteca City Council implemented in June to bolster public safety by tapping an $8 million endowment fund set up using developer fees. The fund paid for the restoration of a four officer gang unit in July. It also is fronting $1.3 million in the form of a no-interest loan to help cover the construction costs plus $165,000 a year to help cover additional staffing along with utilities and upkeep. That funding - along with the shifting of manpower from the 100-foot aerial platform engines that is one of two

Sacramento City Unified School District Asks Voters For $414 Million For Construction The Sacramento City Unified School District is asking voters to approve two school bonds totaling $414 million to address a host of construction projects as well as health and safety issues. Those costs would be in addition to bonds previously approved by voters in 1999 and 2002. Property owners in the school district are currently paying $83 per $100,000. Money from those bonds has been allocated or spent, district Superintendent Jonathan Raymond said.
“Giving our kids the best education we can means providing them with the equipment, technology and learning environments essential to acquiring the skills they need,” Raymond said. The primary bond up for a vote is Measure Q for $346 million in construction, rehabilitation or replacing school facilities, primarily at district high schools. Projects include modernizing classrooms, science labs and computers; fixing leaky roofs and gutters; and replacing heating and air conditioning units. Measure R for $68 million is focused on student health and safety at all grade schools by fixing old playgrounds and athletic fields, improving physical education facilities and upgrading kitchen facilities. School bond money cannot be used for operating expenses, including administrator, teacher or janitor salaries. Raymond said Sacramento City Unified schools, on average, are 50 years old and badly in need of renovation. School district officials said they will benefit from low interest rates and competitive bidding, which are bringing down construction costs. Sacramento City trustee Patrick Kennedy said the district will also be aggressive about looking for matching grants for money spent. “We can turn this $400 million into a lot more,” Kennedy said. “We have a history of doing that.” Talk to us! Contractors State License Board Cracks Down On Unlicensed Activity During California Blitz Nearly 100 people face the possibility of criminal charges after being caught in simultaneous statewide undercover sting operations this week conducted by the Contractors State License Board (CSLB). Among those arrested during CSLB’s fall California Blitz were several repeat offenders, including one who was caught in a CSLB sting just two weeks ago. Investigators from CSLB’s Statewide Investigative Fraud Team (SWIFT) conducted stings on October 17 and 18, 2012, in Alameda, Los Angeles (2 locations), Monterey, Placer, San Diego, San Luis Obispo, and Sonoma counties. SWIFT investigators posed as homeowners seeking bids for home improvements such as painting, flooring, landscaping, fence repair, tree trimming, gutter installation, and water heater replacement. A total of 92 individuals were arrested and now may face misdemeanor charges for contracting without a license (Business and Professions Code section 7028). The penalty for a conviction is up to six months in jail and/or a fine of up to $5,000. At least two are repeat offenders and now face a mandatory 90-day jail sentence if convicted a second time. Seventy-seven of the individuals also may be charged with illegal advertising (Business and Professions Code section 7027.1). State law requires contractors to place their license number in all print,

broadcast, and online advertisements. Those without a license can advertise to perform jobs valued at less than $500, but the ad must state that they are not a licensed contractor. The penalty is a fine of $700 to $1,000. Twelve others may be charged with requesting an excessive down payment (Business and Professions Code section 7159.5). In California a down payment cannot exceed 10 percent of the contract total or $1,000, whichever is less. This misdemeanor charge carries a maximum penalty of six months in jail and/or up to a $5,000 fine. Fourteen of the phony contractors also were issued Stop Orders (Business and Professions Code section 7127). CSLB investigators can halt job site activity when any person with or without a contractor license does not have workers’ compensation insurance coverage for employees. One licensee also was given a Stop Order. Failure to comply with a Stop Order can result in misdemeanor charges and penalties, including 60 days in jail and/or up to $10,000 in fines. The totals may increase as some suspects are expected to provide their bids via email or fax. STING HIGHLIGHTS Andy Karl Kelly is all too familiar with what it’s like to get stung by CSLB. Kelly was arrested at a sting in Yolo County two weeks ago (News Release). Even though

his CSLB license (#931776) expired in April 2011, he has continued to work, regularly placing multiple ads on craigslist.org. Those ads continued to be posted after Kelly’s recent arrest, so CSLB investigators invited him to the Roseville sting. Kelly and his business partner, Anthony Lester Arriola, showed up. Even though they did not give a bid, both were taken into custody for fraudulent use of an invalid license number (Business and Professions Code section 7027.3) in some of the craigslist ads. That violation can be charged as a felony, which carries a possible penalty of up to one year in jail and a fine of up to $10,000. A suspect caught in the Union City sting is connected to one of CSLB’s Most Wanted. Investigators contacted Samuela Lavulavu and invited him to give a bid for concrete work. Lavulavu sent someone else to give the bid. That man gave the undercover investigator a CSLB-issued pocket license for a different company. He left the sting house midway through the bid process, saying there was an emergency. Vaionita Foketi arrived a short time later, stated he was from Lavulavu Concrete, and gave the CSLB investigator a bid. Foketi was arrested for contracting without a license. Investigators now will try to determine if the legitimately licensed contractor will face administrative action, for either not carrying workers’ compensation insurance, or for aiding and abetting unlicensed activity.
A few of those caught were formerly licensed contractors. Gary Gene Gayer had a contractor license from 1988 through 1990. It is unknown how many of the last 22 years he has worked without a license. But, during this week’s sting in Arroyo Grande, he gave a CSLB undercover investigator a bid for concrete work. The next day, he posted an ad on craigslist.org that included a greeting to the investigator.

CSLB investigators at the Redondo Beach sting were assisted by the federal Immigration and Customs Enforcement (ICE) Fugitive Unit. Agents helped when suspects could not be identified or were in the United States illegally. ICE was responsible for identifying the suspects and determining if they had prior criminal history or previously had been deported. Eleven suspects were booked by ICE during the two-day operation.
• Look for the contractor’s state license number. California law requires it to be in all forms of advertising.
Also in Redondo Beach, CSLB investigators noticed a house next door to the sting property was being painted. During a break, an investigator asked the man doing the work for a business card and determined that he was the business owner and might be unlicensed. He invited the man, Jacinto BorjasAyon, to the house to give a bid. Borjas-Ayon bid and was arrested. He also was booked by ICE and his vehicle was towed because he did not have a driver license.
• Don’t be misled by unlicensed contractors who give you a business or “handyman” license number.
“CSLB and its partners in law enforcement are serious about enforcing our state’s consumer protection laws,” says CSLB Registrar Steve Sands. “Unlicensed, illegal activity that puts homeowners at risk and puts those who follow state laws at a competitive disadvantage will not be tolerated.” “The Alameda County District Attorney’s Office remains dedicated to protecting citizens from unlicensed contractors,” says District Attorney Nancy E. O’Malley. “This
CSLB urges consumers to follow these tips before hiring anyone to work in or around their home or business:
• If the contractor doesn’t have a state license, the ad must state that fact. • In California, unlicensed people can’t take jobs valued at $500 or more (combined labor and materials).
• Before you call anyone for a bid, check the license number on CSLB’s website at www.cslb.ca.gov or www.CheckTheLicenseFirst.com to make sure the license is in good standing, and that the contractor has workers’ compensation insurance coverage for employees.
• Contractors are required to have their plastic pocket license or Home Improvement Salesperson registration card with them. Ask to see it when getting your bid. • Ask to see a photo ID to verify the person’s identity. • Get at least three bids, check references and previous work, and get a detailed written contract. • Don’t pay more than 10 percent or $1,000, whichever is less, as a down payment. • Don’t pay in cash, and don’t let payments get ahead of the work. The California Contractors State License Board operates under the umbrella of the Department of Consumer Affairs. Capitol Connection Q&A Resource For Contractors By Shauna Krause and David Kalb Capitol Services, Inc. When something sounds too good to be true you know the likely results. We ‘strip the cover off’ rules on who can and can’t do electrical work with- or without- the proper license. A ‘swift’ review of an unlicensed contractor’s recent bid for work… Q: I found Capitol Services on the Internet. You look to be experienced in licensing matters. I was asked to become a RME on a new license. The person wants to use my Sole Owner license and pay me a fee each month. He said I did not even need to be involved in the company. I’m not using the license at this time, but can you tell me if this is legal? I thought I was supposed to work a certain amount of time each week? A: There are several significant problems with the above ‘proposal’. First, to become a Responsible Managing Employee (RME) you should be involved in the day-to-day operations of your “employer”. Second, as an employee, you should be working at least 32 hours a week (or 80% of the time the company is operating). Third, “loaning” your contractor’s license to someone can get you into trouble with the CSLB. Also, keep in mind that you’ll be required to inactivate your Sole Owner license in order to act as the Qualifier on this new license. Q: I am writing about Section 7057. Can a supervising contractor for a new house do JUST electrical work without doing any other work? Is he required to have a special license for getting electrical work done by his employee or an unlicensed sub contractor?

A: I suspect you’re asking if a “B” contractor can just do electrical (“C10”) work on a residential construction project. The answer is NO, since he/she must perform two or more unrelated trades (not including framing) or hold the specialty classification. You can however, take on the project and use a licensed “C-10”sub to do the electrical work. Under no circumstances should you use an unlicensed subcontractor.

Q: I have a quick question that hopefully you could answer. If someone has been acting in the capacity of a General contractor, overseeing subcontractors and laborers in various specialties, but has not had a license, could that “illegal” experience be used to qualify towards applying for a legitimate license?
The CSLB SWIFT Unit recently conducted a sting operation in the Central Valley. Two of the suspects did not provide bids at the sting location, but said they would e-mail/fax their bid to the investigator (who was posing as a home owner) within a few days. After measuring the kitchen and both bathrooms, “Mr. Smith” left. True to his word, the investigator received a bid and then asked “Mr. Smith” to come to her place of employment to review it. The unlicensed individual “contractor” arrived without ever noticing that he was at the CSLB office. He confirmed the estimate and was immediately issued a Notice To Appear (NTA) for illegal advertising and contracting without a license.
A: Yes, the CSLB will accept selfemployed (illegal) experience as long as it can be certified by someone who has worked with this individual. Backs Have you ever given much thought to your back? It’s there when you need it, but only if you don’t abuse it. The back is made up of four major parts. The spine, nerves, muscles, and the spinal cord. There are thirtythree bones in the spine and thirty-one pairs of nerves branching out from the spinal cord. All of them must work together. If they don’t, you could end up with anything from a strain to a ruptured disk, fractured vertebrae, and/or a debilitating disease like arthritis. To help prevent a back injury you should exercise, practice good posture, eat the right foods, and watch your weight. Check with your doctor for muscle strengthening exercises for the back. Other things you can do to prevent back injuries include using work-saving devices -- hand trucks, forklifts, wheelbarrows, and dollies can assist you. When you have an object to lift that is too heavy or bulky get
help! Ask a co-worker for their assistance. Remember, two backs are stronger than one.’ Now, what can you do when you have to do some lifting? Check out the object to be lifted. Think about how you are going to grasp the load and make sure there is a clear path of travel so you won’t stumble. Before you lift, stand close to the object, bend down at the knees and straddle it, get a good grip, and lift with your legs while keeping your back straight. The secret is to let your legs do the work. It doesn’t have to be a heavy load -- even a small, very light object lifted incorrectly can trigger a back injury. Back injuries can be painful, disabling, paralyzing, and sometimes even fatal. Protect your back by following the guidelines above. You’re here today -- we want you BACK tomorrow.
