MCOY: A process and criteria that define excellence
T
here are good reasons why the Michigan Contractor of the Year (MCOY) Awards has become such a popular event—and perhaps the biggest reason is that the awards aren’t just about celebrating those contractors who have discovered the “winning formula.” Rather, they’re about improving the overall construction industry where the rest of us live and work. When the annual MCOY Awards were developed six years ago, the emphasis was on how to improve working relationships between subcontractors and contractors. The underlying intent is to support those who are doing a great job—reinforcing what they are doing while making it desirable for others to follow suit. The awards, by design, are not a “popularity contest.” Instead, they give the American Subcontractors Association of Michigan (ASAM) members an opportunity to nominate and recognize general contractors and construction managers who exhibit best practices, professionalism and collaboration with Michigan’s subcontracting community. More significantly, the process educates our general contractor friends about how subcontractors and suppliers view the partnerships that are formed through construction projects. Contractors are nominated based on the experiences a subcontractor has with the general contractors they work with. The goal of the MCOY Awards is to build trusting relationships; the end result is a community of top-notch contractors and
subcontractors working well together— with owners getting everything they pay for and more. ASAM set out to make a difference through action and self-responsibility; the popularity of the MCOY event is evidence that members of the construction industry have the same desire to play at a high level. ASAM members evaluated nominees for performance in specific categories that are essential to the contractor-subcontractor relationship. Each member company scored nominees in a confidential, defined process encompassing the following criteria: Bid Ethics and Practice, Safety, Jobsite Supervision, Communication, Schedule Coordination, Project Relations, Lien Process, Administrative Procedures, Payment Terms, and Quality Workmanship. Bid Ethics and Practice: Does not make a practice of post-award price reductions from other contractors involved in the project. Notifies subcontractors of major discrepancies or obvious deviations related to scope of work. Ensures consistency as it relates to scope of work, plans and specifications. Safety: Leads the way in creating a safe jobsite by ensuring each site is clean, neat, organized, and professional. Provides written standards as it relates to jobsite safety and holds all of those involved on a project accountable to follow these standards. Jobsite Supervision: Projects are run well with minimal scheduling delays. Takes the lead in setting the tone for a
positive jobsite where challenges are dealt with in a professional timely manner, individuals are treated with respect and dignity, and all are working together to produce a quality project.

Communication: Questions and concerns are dealt with in a timely matter so as to keep the project moving forward. Communicates candidly, openly, and professionally the successes and challenges to all involved in the project.
Payment Terms: Recognizes the importance of cash flow to the contractors on the job, and consistently pays in accordance to the terms agreed upon in the contract.
Schedule Coordination: Accepts and incorporates input regarding overall project schedule and informs all affected parties in advance of potential challenges with the schedule. Understands the flow of the project, appropriately sequences the work, and holds all involved appropriately accountable to meet the overall job schedule. Project Relations: Approaches the project in the spirit of teamwork and handles all team members’ concerns and input in a cooperative, reasonable manner. Sets the tone for all to work together for the good of the project. Manages owners’ expectations and works to ensure that all contractors involved maintain a positive reputation. Lien Process: Respects the lien rights of other contractors involved in projects, provides the appropriate notices as a matter of practice, and does not take offense when this process is followed. Administrative Procedures: Processes and replies to requests for information, change orders, submittals, and other
Quality Workmanship: Maintains standards for quality of work that meet or exceed the industry standards. Engages all contractors in the exploration of best practices and innovative solutions as it relates to the construction process.

s fall descends upon us, our calendars fill up quickly, and we’ve got choices to make. We have fall sporting events with our children. We want to catch the ‘big game’ with our favorite sports team on Sunday afternoon. In the construction world, we have important choices too. Each fall, we begin the push to complete major projects before the Michigan winter sets in. Like any great sports team, construction managers (CM) and general contractors (GC) face choices for their project teams. If they draft the right team at the right time, they can deliver a win to the customer – winning on both schedule and budget. But, without the right players, the entire project is at risk of a loss. A great CM/GC will scan the roster carefully and review past performance to draft the right team for the project at hand. The American Subcontractor Association of Michigan (ASAM) members work with the contractors in Michigan to be the preferred contractors and subcontractors on every jobsite. The process begins at project inception, much like the football draft. Member companies partner with key suppliers across the state to make sure they meet the commitments made with their contractor customers. Before a project even begins the contractors, subcontractors and suppliers hand pick their team to get the job done right. Like any professional sport, the right training ensures top performance. ASAM provides education initiatives, best business practice reviews and construction advancement forums for member companies to hone their skills and knowledge. ASAM Endowment Scholarship
T
his year marks the third annual ASAM Scholarship. Founded in late 2012 ASAM joined Ferris State University and USI Insurance Services to create the ASAM Endowment and Scholarship fund. This endeavor is one of the many tactics that the ASAM Education Committee was established to support. The Education Committee provides students a direct connection to subcontractors and suppliers in the region. Motivated by a mutual desire to equip students with the knowledge of the contracting trades needed to produce effective and quality workforce in Michigan, Ferris State University College of Engineering Technology has formed a close bond with ASAM and the Education Committee.
This year’s scholarship recipient is Layna Beer, majoring in Construction Management at Ferris State University (FSU). Scheduled to graduate in December 2015, Ms. Beer graduated from Petoskey High School in 2011 and started her higher education at North Central Michigan College. She transferred to FSU in Fall 2012, completing an AAS degree in Architectural Technology with honors (Magna Cum Laude) in May 2014. Ms. Beer is the Vice President of Sigma Lambda Chi, the FSU international awardwinning chapter of the honor society for Construction Management. She is a member of the Associated Construction Students and the National Society of Collegiate Scholars. A member of FSU’s Women
in Technology, she has served as the group’s VicePresident. Ms. Beer continues to be a role model for her fellow students. After completing internships on projects for Clark Construction at Central Michigan University and FSU, last summer she interned with CRG Companies—a design-build firm in South Carolina. She is participating as a member of the design-build team in the Associated Schools of Construction Region 3 student competitions for her second year this October. The ASAM board and education committee looks forward to seeing what opportunities lie ahead for Layna as she completes her degree and starts her career in the industry.

ASAM’s Participation in the Construction Workforce Development Alliance
B
uilding the next generation of the construction industry workforce is a top priority, both in West Michigan and across the country. To address this important issue in our regional community, the ASAM formed an alliance in early 2014 with two other prominent construction industry associations – the Associated Builders and Contractors of West Michigan (ABCWM) and the Home Builders Association of Grand Rapids (HBAGGR). These three associations comprise the Construction Workforce Development Alliance (CWDA). The mission of the CWDA is to improve the image of the industry as a whole and to promote opportunities to the future members of our workforce. The results of this industry alliance are remarkable. First, CWDA instituted the Construction Core Certification program at Grand Rapids Community College (GRCC). The Construction Core Certification program is designed to give the participants 100 hours of Core Construction training in areas such as Construction Math, Basic Construction Drawing, Rigging, Rough Terrain Fork Lift, Lead Awareness, First Aid/CPR, 10-Hour OSHA Certification, Competent Person Scaffolding, Asbestos Awareness and Communication and Teamwork. Successful completion of the program guarantees the participants interviews with three companies. The 100-hour program is compressed into a three-week period and all the participants receive certifications and interviews. The pilot program kicked off in January of 2014, and the first group of graduates received their certificates in May of the same year. In May 2014, CWDA instituted
the Jump Start Scholarship program, giving applicants the chance to receive fully paid scholarships towards the program. We granted 17 fully paid scholarships to cover the cost of our Construction Core Certification with the help of MIWorks! of Allegan and Kent Counties, who covered half of the cost of tuition. In June 2015, a class of 18 students went through the Core Program and graduated. They are now a part of the growing construction workforce in West Michigan. Once students graduate the Core Curriculum they can chose to narrow their focus with additional modules for structural steel, concrete, and carpentry. As more modules are needed for other trades they will be added to the curriculum. In April 2015 the inaugural CareerQuest was held at DeVos Place, and it highlighted careers in Construction, IT, Advance Manufacturing, and Healthcare. Over 6,000 students from across West Michigan attended the event. The construction industry was well represented. Nearly every trade had their own booth staffed by companies who joined together to represent the best that is their industry. Students had the opportunity to try welding, laying various flooring, smashing unbreakable glass and ascending safety stairs to get a bird’s eye view of the entire convention center from the concrete shoring display. Many of the adult chaperones complimented construction industry participants on how well-designed the construction quadrant was and how engaging the booths were. The event was so successful that the next one will be held on May 10,
2016 at DeVos Place. Make plans now to be a part of this event and show the workforce of tomorrow the great career opportunities that construction offers! All of the great things CWDA does require resources. The generous donations of ASAM members’ time has been instrumental in getting the CWDA off the ground. The other essential resource is money to fund the programs. A fund raising committee has been drawn together from members of all three associations, and the first inaugural CWDA Rally was held May 7, 2015 at the GRCC MTEC building. It featured an auto racing theme including race cars on site. Various trades competed in construction-themed competitions such as putting on PPE, installing fasteners, recycling construction materials and building a race car out of PVC piping. The winner of the traveling trophy this year was Architectural Metals,

The outreach component will consist of programs such as the Jumpstart program through GRCC and CareerQuest. Fundraising efforts will include the Rally as well as other events. American Subcontractors Association to Celebrate 50 Years of Accomplishments
T
he American Subcontractors Association will celebrate its 50th anniversary during its annual convention, SUBExcel 2016, March 3-5, 2016, in Miami, Fla. “As we prepare to reflect on our Association’s many accomplishments over the past 50 years, we recognize that none of these triumphs would have been possible without the strong leadership, membership, and valued collaboration with our fellow industry associations,” said 2015-16 ASA President Letitia “Tish” Haley Barker, president of Haley-Greer, Inc., Dallas, Texas, one of the largest curtain wall contractors in the United States. “These individuals and organizations form the foundation upon which our Association stands, and we will continue to rely on them to represent and carry out our ideals, mission, and values over the next 50 years and beyond.” Since 1966, ASA has served as the united voice for construction subcontractors and helped improve the business environment through professional education offerings during SUBExcel workshops and online webinars, influencing numerous court decisions, protecting subcontractors’ legal rights in construction documents, and effecting state and federal public policy changes on such issues as prompt payment, contingent payment, retainage, mechanic’s liens and surety bonding, risk allocation, and many others. Legislative Advocacy “Subcontractors across the country are scoring new victories every legislative session,” said Phil Nevlud, chair of the ASA Task Force on Government Advocacy.
“And success breeds success. When subcontractors in one state are able to help pass a law that protects subs’ rights, it makes it easier to promote similar legislation in another state.” Nevlud, drywall sales manager for Marek Brothers Systems, Inc., Houston, Texas, has experienced first-hand how subcontractors can make a difference in the state legislative arena. He was there when ASA of Texas, working in coalition with the Texas Construction Association, pushed through subcontractor legislation. “It’s critical that subs get involved at the local level,” Nevlud noted. “Some of the changes subcontractors need to bring fairness to the industry aren’t going to come from the federal level. ASA Chief Advocacy Officer E. Colette Nelson added, “ASA focuses its advocacy resources to subcontractor-specific issues that no other organization is likely to work on.” Some examples of ASA initiatives include eliminating pay-if-paid clauses, eliminating retainage, reforming mechanic’s liens and surety bond laws, and limiting inappropriate risk shifting. “ASA provides input where it is important that policymakers hear about the unique challenges of construction subcontractors,” Nelson said. Contract Documents Protecting subcontractors’ legal rights in construction documents and representing their interests in the negotiation of various model documents is another key goal of ASA. The ASA Task Force on Contract Documents, charged with these responsibilities, approaches its task with a serious-
ness and intensity equaled by few others. ASA Task Force on Contract Documents Chair Brian Cubbage, contracts administration counsel for Heico Construction Group, Alexandria, Va., exemplifies the ASA task force’s commitment to assuring that subcontractors get a fair deal in their contract dealings. According to Cubbage, the most important focus of the task force is to “remember what our middle name is — ‘subcontractors,’” and its most important function is to “educate subcontractors on what to look for when a subcontract arrives on their desks,” he said. “If the work the task force does saves one subcontractor from signing a bad subcontract, we’ve done our job.” In the Courts The ASA Task Force on the Subcontractors Legal Defense Fund is responsible for managing ASA’s advocacy efforts before the judicial branch of government. Each year, courts across the country hand down hundreds of decisions interpreting federal and state laws that apply to subcontractors’ businesses. Many decisions impacting subcontractors interpret the contract provisions of subcontract agreements — provisions like pay-if-paid, hold-harmless, duty-to-defend and no-damages-fordelay. Some of these decisions are precedent-setting and carry significance for subcontractors across state lines. ASA’s Subcontractors Legal Defense Fund supports ASA’s critical legal activities in precedent-setting cases to protect the interests of all subcontractors. ASA taps the SLDF to fund amicus curiae, or “friend of the court,” briefs in appellate-level cases that would have a significant impact
on subcontractor rights. No other construction association has an active advocacy effort in the courts. W
hat’s in a name? At first glance the “MCOY” brand offers prestige, recognition, and a boost of energy to the finalists and winners. “It feels like we just won the biggest bid of our lives,” remarked Frank Stanek, O-AK’s President & CEO, during our company’s 2014 acceptance speech. “We’re going to call an executive order to release all of your retainage tomorrow,” he joked. From a macro perspective, though, this award has an even deeper impact. The program is transforming our local construction industry by encouraging General Contracting and Construction Management firms to improve our business operations in ten clearly defined categories: bid ethics and practice, safety, jobsite supervision, communication, schedule coordination, project relations, lien processes, administrative procedures, payment terms, and quality workmanship. This is no small feat. How does the American Subcontractors Association of Michigan do it? Here’s our take. Build a platform: Never before have our companies been evaluated so specifically based on the way we conduct our businesses. The MCOY program puts it all on the table. The voting process is systematic and detailed; representatives from each subcontracting company have the responsibility of rating each finalist firm, on a scale from one to ten, in each of the ten categories. Additionally, in order to rank a company, the voter must have worked with them over the course of the past year. The top rankings are the basis of the resulting platform upon which we all strive to stand. Raise the bar: The platform is elevated each year. To be the best, you must strive for continuous improvement. At the 2012 MCOY award banquet (the year following our first victory) O-A-K was not voted into the top three finalists. So we took a good hard look in the mirror. We identified the operational areas in which we had the greatest room for improvement, we developed specific strategies to address those
areas, and we implemented. Two years later, in 2014, we won again. Our specific categories of focus were bid ethics and practice, and communication. Based on feedback from our subcontractors we were good at communicating when a project was coming out to bid, but afterward we needed to do a better job of communicating the bid results. To address our follow-up procedure, we developed a new page on our website where we directly posted bid results for public projects. We also began to email all bidders, as a matter of consistent policy, to thank them for their efforts and inform them if they were not selected. We believe these small but diligent efforts to raise the bar had a positive impact on our industry and guided our path toward a MCOY victory in 2014. Evoke competitiveness: If the aforementioned strategies are not enough to propel our local construction industry toward greatness, the exclusivity of the award is also a motivating factor. In everyday business General Contractors and Construction Managers constantly compete against one another to be named the lowest bidder, the most experienced candidate, and the most creative presenter. Sometimes we get it right; sometimes we do not. But with each passing week we are given new opportunities. With the MCOY award only one company wins. Only one award banquet is held each year. We all wait on pins and needles for that single announcement, as we sit among our peers, business partners and competitors. And we all want to win. O-A-K is grateful to have received the MCOY title in 2014, and we commend ASAM for the impact they continue to have on our West Michigan construction community.
