MCOY: A process and criteria that define excellence

T

here are good reasons why the Michigan Contractor of the Year (MCOY) Awards have become such a popular event—and perhaps the biggest one is that the awards aren’t just about celebrating contractors who have discovered the “winning formula.” Rather, they’re about improving the overall construction industry where the rest of us live and work. When the annual MCOY Awards were developed five years ago, the emphasis was on improving working relationships between subcontractors and contractors and supporting those who are doing a great job—making it desirable for others to follow suit. The awards are not a “popularity contest.” Instead, they give American Subcontractors Association of Michigan (ASAM) members an opportunity to recognize general contractors and construction managers who exhibit best practices, professionalism and exceptional collaboration with Michigan’s subcontracting community. More significantly, the nomination process demonstrates to general contractors how subcontractors and suppliers value partnerships formed through construction projects. The goal of the MCOY Awards is to build trusting relationships within a community of top-notch contractors and subcontractors working well together—to successfully provide owners with everything they pay for and more. ASAM set out to make a difference in the world through action and self-responsibility; the popularity of the MCOY Awards is evidence that members of the construction industry have the desire to play at a high level.

ASAM members evaluate nominees for high performance in specific categories that are essential to the contractorsubcontractor relationship. Each member company scores nominees in a confidential, defined process that encompasses the following criteria: Bid Ethics and Practice, Safety, Jobsite Supervision, Communication, Schedule Coordination, Project Relations, Lien Process, Administrative Procedures, Payment Terms and Quality Workmanship.

Bid Ethics and Practice: Does not make a practice of post award price reductions from other contractors involved in the project. Notifies subcontractors of major discrepancies or obvious deviations related to scope of work. Ensures consistency in scope of work, plans and specifications.

Project Relations: Approaches the project in the spirit of teamwork and handles all team members’ concerns and input in a cooperative and reasonable manner. Sets the tone for successful collaboration on the project. Manages owners’ expectations and works to ensure that all contractors involved maintain a positive reputation.

Safety: Leads the way in creating a safe jobsite by ensuring each site is clean, organized and professional. Provides written standards on jobsite safety and holds all involved accountable to these standards.

Schedule Coordination: Accepts and incorporates input regarding overall project schedule and informs all involved parties in advance of potential challenges. Understands project flow, appropriately sequences work, and holds all involved accountable to meet the overall job schedule.

Lien Process: Respects the lien rights of other contractors involved on projects, provides appropriate notices as a matter of practice, and does not take offense when the lien process is followed.

Jobsite Supervision: Ensures projects are led with minimal scheduling delays. Takes the lead in setting the tone for a positive jobsite where challenges are dealt with in a professional and timely manner, individuals are treated with respect and dignity, and all work together to produce a quality product.

Administrative Procedures: Processes and replies to requests for information, change orders, submittals and other formal requests timely and in a way that does not require the contractors involved to take unnecessary risk or make assumptions that may later prove to be false.

Communication: Deals with questions and concerns in a timely matter to keep the project mov-

ASAM Legislative Update

T

he ASAM Legislative Committee focuses on reporting and addressing issues at state and local levels to keep our members up to date. We are currently working with the Grand Rapids Area Chamber of Commerce to develop a Public Private Partnership (P3) coalition that will help build support for the regulatory and statutory changes necessary to protect contractors and subcontractors from unnecessary risk. There are currently no Subcontractor

Payment Assurances on Public-Private Partnerships in Michigan, which is why ASAM supports the extension of The Little Miller Act to P3’s. The Committee has also been addressing promptpay on public work. Under Michigan law construction liens are not valid against public projects, and under normal circumstances a bond is not going to come into play for slow payment. The good news for subcontractors and suppliers is that public enti-

ties do pay for work completed per contract; the bad news for the supply chain is that slow-pay is common and they have little leverage against a public entity. Not building the cost of working with slow-pay entities into bidding hurts subcontractors’ profitability and cash-flow, while building the cost of slow-pay into projects costs taxpayers. Having the government operate in a more accountable fashion benefits everyone in the supply chain and more importantly, taxpayers.

ASAM Endowment Scholarship

T

his year marks the second year that the ASAM Endowment Scholarship will be awarded. In 2012 ASAM joined Ferris State University and USI Insurance Services to create the ASAM Endowment and Scholarship Fund, one of many endeavors that the ASAM Education Committee was established to support. The Education Committee connects students directly with subcontractors and suppliers in the region. Motivated by a mutual desire to equip students with contracting trades knowl-

edge needed to produce an effective and quality workforce in Michigan, ASAM and its Education Committee have formed a close bond with Ferris State university’s College of Engineering Technology. This year’s scholarship recipient is Jeff Tarnowski, a Construction Management major at Ferris State University who is scheduled to graduate in 2015. Jeff is also president of FSU’s Associated Construction Students. In this role he helps bring students together to create networks

within the West Michigan construction community and throughout the state. He has also participated in the ACS Competition Design/Build Team for Region 3. The ASAM board and Education Committee look forward to seeing what opportunities lie ahead for Jeff as he completes his degree and starts his career in the industry.

ASAM’s Participation in the Construction Workforce Development Alliance – Driving the Future of the Construction Industry

E

arly in 2014, ASAM formed an alliance with two other prominent construction industry associations to improve the image of the industry as a whole and draw attention to the need for the next generation of construction workers. The Associated Builders and Contractors of West Michigan (ABCWM) and Home Builders Association of Greater Grand Rapids (HBAGGR), along with ASAM, have formed the Construction Workforce Development Alliance (CWDA) and instituted the Construction Core Certification program at Grand Rapids Community College (GRCC). The pilot program kicked off in January and the first group of graduates received certificates in May. In May, the Alliance instigated the Jump Start Scholarship program, giving applicants the chance to receive fully paid schol-

arships towards the program. We offered 12 and ended up providing 17 fully paid scholarships to cover the cost of our Construction Core Certification program with the help of MIWorks! of Allegan and Kent Counties, who covered half of the cost of tuition. This program was designed to give participants 100 hours of Construction Core Certification training, and guaranteed them interviews with three companies upon completion of the program. The 100-hour program was compressed into a threeweek period, and all of the participants received certifications and interviews. The first Jump Start Scholarship program was a huge success and we’re hoping to do it again next spring. In June, the CWDA and Talent 2025 hired the Upjohn Institute to do an evaluation of the West Michigan construction industry employment needs. The survey went

out in July and ran six weeks. As of this article’s publication, data is still being compiled. Our hope is that the information will assist the State of Michigan in realizing construction employment needs and help the CWDA establish Construction Core Certification program classes. The program continues this fall with the addition of three class modules in Structural Steel, Concrete and Carpentry. New class modules will be added as needed. In addition to the work the Core Construction Certification program has undertaken, the CWDA will participate in a Career Quest Day held at DeVos Hall on April 28, 2015. This event will highlight careers and opportunities within the construction industry—including mechanical, IT and health care—to students, teachers and guidance counselors.

ASAM and ASA-PAC Endorse Terri Lynn Land for U.S. Senate

A

dding to an eventful start of the year in the construction industry is an eventful political year. The upcoming mid-term elections may lead to a shift in political control of the United States Senate, significantly impacting national economic policy, and, with it, the construction industry. With much of Michigan’s recent economic resurgence owing to strong policy, the American Subcontractors Association (ASA) is particularly interested in the race for Michigan’s open U.S. Senate seat. While much progress has been made, much remains to be done. Given the importance of this election, the American Subcontractors Association of Michigan (ASAM), along with the ASA’s national Political Action Committee (ASA-PAC), endorsed Terri Lynn Land’s candidacy for the U.S. Senate. Terri announced her campaign for the U.S. Senate in the summer of 2013. She pre-

viously served two terms as Michigan’s 41st Secretary of State (2003-2010) and as Kent County Clerk (1992-2000). Terri’s deep roots in construction and development issues were formed while observing her father, grandfather and husband build and expand properties across West Michigan. As Secretary of State, she put Uniform Commercial Code Filings (UCC) online for same-day searches and moved critical notary service functions from Lansing to four regionally located Secretary of State offices. These initiatives have helped streamline processes critical to the proper functioning and growth of the construction industry. Growing up in her family’s small business also taught Terri the importance of hard work, balanced budgets and customer service. “Now,” she says, “I am ready to take my work ethic and experience as a mother, small businesswoman and public official to

Washington to show them how government should work for the hardworking taxpayers.” Because of her work encouraging expansion in the construction industry and job growth through smart policy, Terri is poised for success in the U.S. Senate. According to Ken Misiewicz, president of ASAM, “Terri has voiced strong support of critical subcontractor issues, among them bid listing for federal construction projects, prompt payment legislation and payment protection for subcontractors on jobs involving public/private partnerships.”
