I’ve used this space over the last several months to remind you about the numerous events and activities the Greater High Desert Chamber of Commerce offers to its members. You and your employees have unique opportunities to network with fellow members (and in some cases, nonmembers) while also learning about legislation that may affect businesses in California and other inherently important topics as you continue to call the High Desert your company’s or agency’s home. One upcoming event is a mix of all of those things – and it happens to be the event that really pulled me into the chamber world. Ignite High Desert is scheduled May 19 at Victor Valley Christian Church in Hesperia. This event is unlike just about anything else in our region. Speakers get five minutes and 20 slides (which advance every 15 seconds) to tell you about something. Anything. I used my five minutes in 2018 to talk about my discoveries as a food reviewer in the Daily Press. In the five years I wrote about local eateries, I found and tasted the best pizza in the High Desert, fish tacos that would rival any hole-in-the-wall space in San Diego, fine Italian dining tucked away in the village of Apple Valley, and a burger with peanut butter and jelly. Other speakers who’ve graced the Ignite stage have talked about hiking to the highest point in each of the 50 states; overcoming but embracing fear; the uplifting yet heartbreaking journey that is in vitro fertilization; and the key to understanding the development of a teenager’s brain. Suffice to say, there is always something to learn and by which to be entertained at Ignite High Desert. I plan to be there and to soak in all that this year’s presenters have to share with us. WHAT TO DO WHEN EMPLOYEE VIDEO RECORDS EMPLOYEE ACCIDENT
An employee used his mobile phone to film a co-worker lying in a pool of blood shortly after a workplace accident. This employee then posted the video on his personal social media account with no comments other than an exclamation point. What are my options?
Posted videos are a “thing” in our current society and have achieved their own adjective — “viral.” This is not surprising, given that most people have hand-held portable computer devices with an amazing capability to film events that can be shared with the world. Videos are posted on social media for many purposes, some laudable, others offensive. The viral nature of the George Floyd video shows the power of the phone and media. The rules surrounding when an employer can video-record employees — notice, privacy zones — are somewhat clear. What if an employee is filming other employees? The details surrounding the filming, such as the purpose, can turn an offensive, intrusive action into a legal and worthy deed. Key Considerations Before an employer acts, it must investigate the circumstances surrounding the video recording. These are the key considerations: Have there been worker complaints about workplace safety or unlawful activity? For example, if there have been such complaints, the filming may have been done to document an unsafe working condition or other illegal workplace conduct, such as sexual harassment. What if the employee in the question had filed a complaint with Cal/OSHA? The filming and the resulting evidence may be legal and protected. Also, if you fire someone for filming illegal working conditions, you may be subject to a retaliation claim. Employers should always discuss the legality of workplace restrictions on workplace recordings with legal counsel before taking any action against an employee who has filmed something at work. Do you have a handbook policy regarding employees filming other employees, with or without their permission? Because video recording has become so common, employers should assume that it is happening in the workplace, possibly without the consent or knowledge of those being filmed. Employee handbooks are the best method to communicate workplace policies, and they should cover the use of video and audio recording devices at work. To the extent that employers can legally restrict workplace activities and behavior, the rules should be communicated in the employee handbook. insight magazine | 6
Does filming an injured co-worker violate the code of conduct? A company’s code of conduct may include rules about assisting an injured employee, calling for help, or otherwise acting to mitigate the harm. Standing and recording the incident may violate one or more of these rules. Does failure of the employer to discipline/terminate the employee create a risk for the employer? Filming an employee under the circumstances in the question and posting a video on social media may invade protected privacy interests. Co-workers who observed the filming may be offended and feel strongly that the employer should dismiss the employee. Make sure that your anti-harassment and anti-discrimination policies clearly state that harassment or disrespectful or unprofessional conduct of any type will not be tolerated. The GHDCC Legislative Committee continues to be active in the Inland Empire Chamber Alliance, the Cal Chamber and we continue to write letters and take positions on legislation that effects our High Desert businesses. As a member of the Inland Empire Chamber Alliance (19+ member chambers) our combined voices have taken positions on legislation that impact, not only the High Desert, but the Inland Empire region. Over the next few months, there are plans for the entire Inland Empire Chamber Alliance to go to Sacramento and have in person meetings with our legislators. The Greater High Desert Chamber of Commerce also hosts monthly Legislative Zoom meetings. Having these meetings via Zoom continues to be successful with an average attendance of 50+ each month. During these meetings, the attendees receive reports from the elected representatives’ offices and special guest speakers. Attendees can listen and ask questions from the representatives’ offices and the guest speakers. In January, we hosted Dakota Higgins, Deputy Chief of Staff for Supervisor Paul Cook, Dillon Lesovsky, Chief of Staff for Assemblyman Thurston Smith and Ross Sevy, Deputy Chief of Staff for Congressman Jay Obernolte who presented on the final re-districting maps that were approved in December. In February, Senator Rosilicie Ochoa Bogh presented and then in March our SB County District Attorney Jason Anderson spoke. Mark your calendars for the 3rd Thursday of each month at 9:00 am…watch for an eblast to register each month. In April, we will have Sheriff Shannon Dicus as a guest speaker. CALCHAMBER IDENTIFIES 2022 JOB KILLER BILLS The California Chamber of Commerce has released two waves of bills to be included on its 2022 job killer list. The list so far totals 15 bills, including two carry-over proposals from 2021. “California companies are the economic engine that drives innovation and job creation in our state and are responsible for the record revenues the state is currently experiencing,” said CalChamber President and CEO Jennifer Barrera. “Yet, the bills on this year’s job killer list reflect a lack of appreciation of the economic realities and regulatory challenges employers—and especially small business employers—face as they continue to emerge from the impacts of this pandemic. A shrinking workforce coupled with California’s oppressive legal climate, penchant for overregulation, and continued push for even higher taxes, will hamper the ability of California companies to remain competitive in the future.
